Abstract:
The article forms an actual scientific idea about the impact of ensuring the labor rights of judges in Ukraine on the level of their social security. It is determined that the level of social security of judges depends on the quality of ensuring their labor rights, because such rights exist for sustainable human development, that is, there is a satisfaction of the needs for social benefits that are produced in the field of labor. Rights exist to prevent the occurrence of situations in which an employee experiences humiliation of his human dignity, restriction of his freedom, as well as other human rights. The rights are regulated by general and special rules, considering the social risks common to all employees and special for judges. Such regulation is carried out to reduce the negative impact on judges. This regulation is subject to the principle of legality. Labor rights are ensured and protected at the expense of the State Budget of Ukraine. They are guaranteed by the State at the national level and by international governmental organizations at the international level. The labor rights of judges can be protected both in the general order, considering certain exceptions, and with the help of special forms of protection that are provided only for judges. The level of implementation and protection of the labor rights of judges determines the level of civilization of society. It is proved that the peculiarities of the labor rights of judges and their impact on the social security of judges require the state to create favorable conditions for their provision. In cases where the State ignores such a duty and the employment rights of a judge are not sufficiently ensured, the State concerned cannot be considered social, legal, and democratic. The lack of guarantees for the implementation of the labor rights of judges, which is currently happening in Ukraine, negatively affects the independence of the courts and the proper administration of justice in the country.

Abstract:
This scientific article deals with social guarantees for judges at work. Social support for retired judges forms an integral part of social security and is one of the labor guarantees of the rights for judges. The article tackles the question of financial security of judges, which is one of the guarantees of the independence of judges. The subject of the study is the special status of retired judges, which guarantees proper administration of justice, and permits to impose high requirements to judges and allows keeping confidence in their competence and independence. The article also considers the issue of a lifetime allowance for judges after their retirement. The author notes that the most important guarantee for retired judges is their pension coverage. This guarantee is expressed, in particular, in the fact that judges have the priority right to choose the type of pension coverage.

Abstract:
From the viewpoint of the way of acquisition and termination of the judicial service, judges in Serbia passed a long road from ordinary civil servants that were acquiring and losing their position solely based on the will of the minister of justice, to independent judges with guaranteed tenure appointed on recommendation from the highest courts and dismissed by decision of the highest courts in the country. The path, however, was not straight-line, neither in terms of normative solutions nor in terms of political and social temptations. The Law on Judges from 1881 which regulated the Judiciary of the Principality of Serbia on the principles of judicial consistency, competence and financial security, introduced for the first time the method of electability (co-optation) of judges by judicial collegiums in the Serbian judiciary. At the same time, this Law completely disempowered Minister of Justice of the right to decide on the termination of the judge's office and handed it over to the highest court in the country - the Cassation court. The significance of the formal guarantees of judicial independence, which has been ensured since 1881 by specific procedure of acquisition and termination of judicial office, became questionable due to both "pestilent" touch between judges and politics, but also for substantial number of judges who took judicial independence as judicial irresponsibility.

Abstract:
The Convention of ILO № 102 is the basic source of international-law rules in the area of social security. This convention concerns the standards of judicial review in matters regarding social security. It declares that whenever a claim is settled by a special tribunal established to deal with social security questions and on which the protected persons are represented, no right of appeal should be required. It means that matters regarding social security should be settled by tribunals that are organizationally, personally and procedurally separated from those dealing with other cases. In Poland, most of the matters regarding social security are settled by common courts, by their special departments, in a special procedure. Nevertheless, relevant departments can also deal with cases concerning labor law and they do not consist of persons who are not judges and represent protected persons. It means that the Polish regulations concerning the judicial review in matters regarding social security do not fulfill the standard established by the Convention № 102.

Abstract:
This Article examines a controversial national security measure: the use of the armed forces within domestic borders. Military policing blurs the boundaries between crime and war, and tends to entail greater use of force against individuals. It has received relatively little academic attention but deserves to be better understood. No democratic state has relied on military policing for longer than India. And within India, no region has been subject to military policing for as long as the northeastern state of Manipur. I analyze how military policing in Manipur has fostered abuse by the armed forces, which in turn has prompted litigation and judicial innovation. Based on my analysis, I critique dominant theories about the state’s exceptional security powers. I advance two main claims. First, exceptional powers rarely remain exceptional; they eventually become the norm. Once deployed, these powers persist, and the license they provide seeps into broader habits of governance. Second, once normalized, exceptional powers become more vulnerable to judicial intervention. Judges become unwilling to accept the government’s argument that these powers are always and only used to fight pressing threats. These powers eventually become a routine subject of judicial review. Even once judicial review becomes routine, however, judges tend to be more willing to help victims of abuse than to punish abusers.

Are administrative adjudicators subject to external influence and pressures? We present the results from a nationwide survey of agency adjudicators, focusing on immigration judges (IJs) and administrative law judges (ALJs) in the Social Security Administration (SSA). ALJs follow decisional procedures spelled out in the Administrative Procedure Act (APA) and are given substantial legal protections from agency pressures. IJs do not follow APA procedures, nor do they receive its protections. We find IJs give significantly greater deference to the positions of the public, their agency, Congress, and the president, and report more favorable attitudes toward interest groups in adjudications.

Abstract:
The article traces historical development, doctrine, and impact of constitutional review in Ukraine related to matters of social justice. It is shown that international review of Ukraine’s reports on observance of human rights obligations indicated a low level of compliance during the absence of independent constitutional review by the judiciary. After the establishment of the constitutional review, the compliance was improved against all doubts, whether socio-economic rights are justiciable in the Ukrainian context, and whether the judges are empowered enough to reshape authoritarian policies. Constitutional Court of Ukraine developed a doctrine of social justice based on the values of the rule of law, liberty, and equality, founding a pragmatic balance between the imperatives of individual freedom and economic security. In legal reasoning, judges implemented ideas of the human-centered state and personal autonomy in civil society, close to liberal democratic views, expressed by framers of the Constitution of Ukraine.

Дисертацію присвячено дослідженню правового механізму захисту трудових та соціальних прав суддів в Україні. У роботі розкривається поняття та зміст трудових і соціальних прав суддів, а також сутність, соціально-правове значення та структура правового механізму захисту цих прав суддів. У рамках розкриття змісту досліджуваного правового механізму особлива увага приділяється нормативній основі цього механізму, системі суб’єктів захисту прав суддів, а також формам (враховуючи способи і засоби) і методам захисту правового механізму захисту трудових та соціальних прав суддів. Узагальнено основні актуальні проблеми захисту трудових і соціальних прав суддів в Україні, а також сформульовано конкретні пропозиції й рекомендації щодо удосконалення правового регулювання захисту трудових і соціальних прав суддів, зокрема: ратифікація Конвенції Міжнародної організації праці № 151 1978 року та прийняття Закону України «Про захист права на організацію державних службовців», що передбачатиме внесення змін до законодавства про поширення на суддів права на створення профспілки, вступу до неї та виходу з неї; внесення змін до Закону України «Про судоустрій і статус суддів» у частині окреслення переліку трудових і соціальних прав суддів, особливостей, форм і суб’єктів захисту цих прав. В диссертации впервые комплексно раскрыта сущность правового механизма защиты трудовых и социальных прав судей в Украине, а также проблематика его функционирования, в результате чего сформулированы конкретные предложения по его оптимизации, которые предложено учесть в рамках предстоящей судебно-правовой реформы. Обосновывается, что правовой механизм защиты трудовых и социальных прав судей в Украине представляет собой нормативно определённый, основанный на идее социального государства целостный юридический конструкт, охватывающий правовые средства и способы, посредством которых прямо или косвенно реализовывается защитная функция государства относительно защиты трудовых и социальных прав судей. В соответствующем контексте указывается, что данный механизм имеет особое социально-правовое значение, формируя условия надлежащего обеспечения социальной безопасности судей и в обществе в целом, а также способствуя развитию государства в качестве правового и демократического, делая возможной реализацию евроинтеграционных стремлений Украины. Доказывается, что исследуемый правовой механизм своей структурой охватывает: нормы национального законодательства и международно-правовых актов по защите трудовых и социальных прав человека в целом и судей в частности; общеправовые и специальные правовые принципы защиты прав судей; субъектов защиты трудовых и социальных прав судей, условно разделённых на соответствующих субъектов международного и национального уровня; формы и методы защиты трудовых и социальных прав судей. При этом обращается внимание на то, что структуру системы субъектов защиты трудовых и социальных прав судей можно условно разделить на такие две группы: субъекты международно-правового уровня защиты (международный судебный орган, международные неправительственные организации, осуществляющие защиту трудовых и социальных прав судей); субъекты национального правового уровня защиты (административные суды, органы судейского самоуправления, органы судейского управления, ассоциации судей). На основе критического анализа правозащитного потенциала соответствующих субъектов защиты трудовых и социальных прав судей, особенностей форм (способов и средств) защиты утверждается, что наиболее эффективным образом судья может защитить права в судебном порядке, который непосредственно зависит от уровня обеспечения государством достойного труда и социальной безопасности судей. Обосновывается позиция, в соответствии с которой на сегодняшний день основными проблемами защиты трудовых и социальных прав судей являются следующие: общее снижение уровня социальной безопасности в государстве; десоциализация сферы труда профессиональных публичных служащих в целом и судей в частности; недостаточное качество правового регулирования функционирования правового механизма защиты трудовых и социальных прав судей; недостаточная эффективность защитного влияния субъектов защиты трудовых и социальных прав судей; частое осуществление в Украине судебно-правовых реформ, не учитывающих потребностей комплексной оптимизации защиты трудовых и социальных прав судей. Для решения вышеизложенных проблем предложено: создать и утвердить концепцию по совершенствованию правового механизма защиты трудовых и социальных прав судей, которая должна быть учтена при проведении очередной судебно-правовой реформы в Украине; привести национальное законодательство в соответствие с международно-правовыми актами, касающимися защиты трудовых и социальных прав работников, в частности госслужащих; принять Закон Украины «О внесении изменений в Закон Украины «О судоустройстве и статусе судей» относительно защиты трудовых и социальных прав судей»; устранить институциональные барьеры, препятствующие эффективной защите трудовых и социальных прав судей в Украине; усилить правозащитные возможности отдельных субъектов защиты трудовых и социальных прав судей, а именно Совета судей Украины и ассоциаций судей. The dissertation is devoted to the research of the legal mechanism of protection of labor and social rights of judges in Ukraine. The paper reveals the concept and content of labor and social rights of judges, as well as the essence, socio-legal significance and structure of the legal mechanism for the protection of these rights of judges. As part of the disclosure of the content of the studied legal mechanism, special attention is paid to the normative basis of this mechanism, the system of subjects of protection of judges' rights, as well as forms (including methods) and methods of protection of legal mechanism of labor and social rights of judges. The main current issues of protection of labor and social rights of judges in Ukraine are summarized, as well as specific proposals and recommendations for improving the legal regulation of protection of labor and social rights of judges, in particular: ratification of the ILO Convention 1978 151 and development and adoption of the draft Law " On protection of the right to organize civil servants ”, which will provide for amendments to the legislation on extending to judges the right to form, join and leave a trade union; amendments to the Law of Ukraine "On the Judiciary and the Status of Judges" in terms of outlining the list of labor and social rights of judges, features, forms and subjects of protection of these rights.

Дисертацію присвячено визначенню та вирішенню проблемних аспектів правового регулювання праці суддів у межах поглибленої євроінтеграції України. Надано комплексну соціально-правову характеристику праці суддів, а саме розкрито соціальне значення праці суддів, визначено критерії та ознаки якісної роботи суддів, що засвідчують її належний соціальний вплив. Встановлено актуальні перешкоди ефективній роботі суддів в Україні, а також стан виконання державою євроінтеграційних завдань відносно поліпшення функціонування судів та суддів. Окреслено комплекс теоретичних і практичних проблем, які перешкоджають забезпеченню трудових прав суддів в Україні, впровадженню в систему правосуддя стандартів гідної праці на всіх етапах існування трудових правовідносин із цією категорією працівників: під час виникнення трудових відносин із кандидатами на посаду судді, у процесі перебігу та припинення трудових відносин із суддями. На підставі аналізу судової практики щодо захисту трудових прав суддів в Україні на кожному з означених етапів встановлено реальні проблеми, з якими стикаються судді на практиці під час реалізації свого права на працю, а також визначено роль судового захисту прав суддів у нашій державі. Виявлено особливості правового регулювання виникнення, перебігу та припинення трудових правовідносин за участю суддів в окремих державахчленах ЄС. Враховуючи проаналізований зарубіжний досвід, сформульовано конкретні пропозиції щодо вдосконалення національного законодавства у досліджуваній сфері. The dissertation is devoted to the search and solution of problematic aspects of legal regulation of judges' work within the framework of deep European integration of Ukraine. The study provides complex socio-legal characteristics of the work of judges. It defines the social significance of the work of judges, determinates the criteria and signs of quality work of judges, which confirm its proper social impact. A complex of theoretical and practical problems that hinder the provision of labor rights of judges in Ukraine and interfere the implementation of decent work standards in the justice system is described. The analysis of problems is made at all stages of the existence of labor legal relations with this category of workers: in the beginning of labor relations with candidates for the position of a judge, in the process and termination of employment with judges. Based on the analysis of judicial practice on the protection of labor rights of judges in Ukraine at each of these stages identified real problems faced by judges in practice during the realization of their right to work. The role of judicial protection of the rights of judges in state is also defined. Peculiarities of legal regulation of the emergence, course, and termination of employmentwith judges in some EU member states areinvestigated. Considering the analyzed foreign experience, specific proposals for improving national legislation in the study area are formulated.

My motivation to write this thesis is based on the controversy surrounding the Social Security system that has recently infiltrated the media. Through my research, I have discovered the debate concerning Social Security is not a recent development but has existed since the 1930’s. Many sources are warning citizens to no longer count on Social Security as they most likely will not receive benefits until a extremely old age if they receive benefits at all. Current retirees are fearful of either a decrease in benefits or not receiving the money they contributed to the system through the years of employment at all. Proposals and options for overhauling the system have moved to center stage in politicians’ agendas and numbers of solutions have surfaced. Unfortunately, this debate is creating a huge divide between party lines in Congress. Some argue for more government control while others advocate privatization. The goal for this thesis is to perform a cost/benefit analysis of the two ideologies and determine which is more practical and realistic for both the government and the people.

COORDENAÇÃO DE APERFEIÇOAMENTO DO PESSOAL DE ENSINO SUPERIOR
Nos últimos anos no Brasil algumas modificações paramétricas foram implementadas na Previdência Social para tentar diminuir o crescente déficit entre os pagamentos de benefícios e o recebimento de contribuições. Nesse trabalho, Previdência Social é estudada sob um ponto de vista diferente: ao invés de uma análise focada apenas nos déficits atuais, utiliza-se a reserva de benefícios concedidos como uma forma de medir o impacto futuro das atuais regras de concessão de aposentadorias e pensões. Dependendo dos parâmetros utilizados, o valor da reserva supera o PIB real de 2005. O resultado também mostra que decisões sobre o aumento real do salário mínimo têm impacto bastante significativo nos gastos com benefício da Previdência Social.
In the last few years the Brazilian Government had implemented some parametrical changes to the Social Security System so to try to diminish the growing deficit in between its benefits and contribution. In this work, the Social Security is studied under a different point of view: instead of looking at nowadays deficits, the necessary reserve to benefits already under payment will be calculated, so as to measure the future impact on the political decisions which are made today. Depending on the assumed parameters, the value of this reserve can be bigger than the GDP in 2005. This result shows also how the real value increase of the minimum wage impacts significantly this reserve.

The Spanish public pension system is currently based on the pay as you go (PA YOO) principle. This thesis examines the current structure of this public system and its financial viability in the face of expected demographic changes. First, demographic and macroeconomic models were created extending out to 2050 and, based on them, the finances of the system were estimated assuming that the current regulations would remain largely unchanged. The simulations indicate that the system will show small surpluses for the next years followed by an alarming deterioration beyond 2020, mainly driven by demographic factors such as increasing life expectancy and the reduction in fertility rate observed in the last two decades. The baseline demographic and macroeconomic scenario results in a projected deficit of about 7% of GDP by 2045. This outlook includes a reduction of unemployment and an increase in labor force participation within reasonable limits. It is also shown that high immigration, fertility and productivity growth, again, within reasonable limits, while improving the financial outlook, do not resolve the issue. Without significant reforms, the system will be faced with a reduction in benefits and/or an increase in the payroll-tax by the second quarter of this century. The model is further used to test the effectiveness of potential reforms. We conclude that a permanent solution could be supported on three pillars: 1. The creation of a Pension Fund with the surpluses of the PAYOO system and a creative investment policy such as that recommended by Modigliani et al. 2. The contribution of the prospective surpluses from the unemployment system (INEM) to the fund during a transitory period. 3. Reforms in the pension calculating procedures that will foster participation in the labor force and eliminate some of the distortions introduced by the current system. These reforms would maintain financial viability without having to raise the payroll-tax. Furthermore, the tax could be reduced gradually beyond 2045. Additionally, this reform would combine advantages from funded pension systems, such as deepening of the capital stock and consolidation of the financial markets, with those of PAYOO schemes, such as their redistributive aspects and "defined benefit" character.

Abstract:
Several applications require random sampling to be protected against a biased behavior. When conflicting parties have different interests in its result, the system must guarantee that collusion among any number of entities cannot influence the resulting computation. Such is the case of legal systems, in which jurors and judges must be randomly picked to ensure impartiality in judicial cases. However, when informational systems are used to generate randomness, it should also provide auditability of its mechanisms to promote confidence in its fairness. This article presents a tool of one such mechanism that combines the randomness provided by hash functions with active social engagement. Each stakeholder in a legal proceeding contribute with his/her own share to the drawing, so that fairness is achieved if at least one entity is honest. Any interested party can audit a drawing using only public information, and misconduct of any party can be traced back to the culprit as soon as the result is computed. Our open-source implementation provides security by design, not depending on the secrecy of its component to attain all the required security properties.
