Abstract:
Free speech and academic freedom are vitally important values. According to growing media reports, however, they are under attack and they are under attack in the exact place where they ought to be most protected: in our institutions of higher learning. This chapter explores two phenomena alleged to silence people on academic campuses: politically correct culture and microaggressions. These sorts of silencing involve a person deciding against speaking and deciding this because of the speaker’s beliefs about how the audience would respond to her speaking. As this chapter will show, not all cases of choosing to remain silent are on a par; the issues are complex but each sort of these two sorts of academic silencing is a real possibility.

This authoritative annotated document collection surveys and explains efforts to censor, intimidate, suppress—and reform and improve—news organizations and journalism in America, from the newspapers of colonial times to the social media that saturates the present day. This primary source collection will help readers to understand how the press has been vilified (usually by powerful political or corporate interests) over the course of American history, with a special focus on current events and how these efforts to censor or influence news coverage often flout First Amendment protections concerning freedom of the press. Selected documents highlight efforts to intimidate, silence, condemn, marginalize, and otherwise undercut the credibility and influence of American journalism from the colonial era through the Trump presidency. Most of the featured documents focus on efforts borne out of self-interested attempts to shape or conceal news for political or economic gain or personal fame, but coverage also includes instances in which press actions, attitudes, or priorities deserved censure. All told, the collection will be a valuable resource for understanding the importance of a free press to American life (and the constitutional basis for preserving such), the motivations (both selfish and altruistic) of critics of American journalism from the earliest days of the Republic to today, and the impact of all of the above on American society.

Abstract:
Every developing child goes through a series of stages associated with childhood and adolescence. This is the focus of chapter 3. To some extent development is an invariant progression shaped by cognitive and biological growth, and the capacities and limits that exist at any stage of individual growth. At the same time, the progression reflects the unique experience of each individual over their life course, particularly with nonlegal and legal authority figures. Beyond that, every child grows up during a particular period in history that has particular events such as the war in Vietnam or the 9/11 terror attacks, which create a unique social climate and produce common concerns and outlooks among the members of a particular age cohort. These common elements have been widely discussed in popular writing that has sought to distinguish among the silent generation, baby boomers, generation X, millennials, and generation Z.

Abstract:
This Prologue describes three stories concerning Korematsu. The first is told in late 2015 by U.S. judges. It reaches back to the Supreme Court’s 1944 ruling in Korematsu validating the World War II Japanese American removal and incarceration. And it discerns insights, maybe lessons, for America about fundamental freedoms sacrificed in the name of perceived exigency. The second story starts with Justice Jackson’s loaded weapon warning about expanding Korematsu’s principle to new purposes. In 2014, then-Supreme Court justice Antonin Scalia responded to a question about a possible U.S. mass exclusion or roundup of Muslims with a disturbing prophesy. The third story concerns Scalia’s it-could-happen-again prophesy and how the laws fall silent. That story is an amalgam of calls for mass Muslim exclusion and detention by government officials and Republican presidential candidates after the 2015 Paris and San Bernardino attacks—calls that partially coalesced in President Trump’s controversial 2017 exclusion-and-detention executive orders.
