Parmi l'ensemble des instruments de paiements par cartes, le porte-monnaie électronique illustre en la matière un mode de paiement nouveau : le prépaiement, faisant entrer le PME dans une nouvelle catégorie de cartes de paiement, celle des cartes prépayées ayant vocation au règlement des petits montants. Cette nouvelle carte de paiement chargé en "monnaie électronique" connait déjà de nombreuses applications dans les pays européens, la France envisageant une application sectorielle fin 96 alors qu'elle a pourtant la paternité du projet. Que faut-il entendre par "porte-monnaie" électronique au milieu des nombreux types de cartes dites "prépayées" ? Quelle sera la nature de la charge ainsi que les implications juridiques et monétaires ? Autant de questions que l'entrée dans l'ère du paiement électronique de petits montants peut susciter
The electronic purse is a pre-paid card as a paiment instrument, similar in appearance to a debit or credit card, with a micrichip that allows a monetary value to be loaded and stored. The value can be disbursed in whole or in parts to others, usually for the provision of goods and services. The development of multi-purpose cards is relively recent. Most schemes are still at the planning or trial stage and there is little public awareness let alone use of such cards. However, narket research conducted for proposed issuers of cards is said to give great encouragment and it is the common view that within the next few years there will be a rapid growth in the use of pre-paid cards. There are numerous commercial advantages in handling electronic value rather than cash and if public confidence can be maintained, there is reason to believe that pre-paid cards will become a popular means of paiment. The novelty of the electronic purse means that generally they have not been specfically provided for in current laws and regulations. Most of the the countries studied have no legislation drawn with the intention that it should apply to pre-paid cards. Difficult questions of interpretation arise when considering whether existing laws apply to the operation of pre-paid cards wich in somecases, give rise to uncertainties and anomalies

Abstract:

Fournir un service de mobilité porte-à-porte pour les voyageurs est un objectif largement partagé. C’est aussi un objectif stratégique pour SNCF. En effet, après plus de trente années de croissance portée par le TGV, l’entreprise a fait face à des difficultés qui l’ont incitée à revoir son modèle économique. Elle vise à s’affirmer comme un véritable opérateur multimodal et à retrouver, grâce à d’autres modes que le train, sa vocation de desserte fine des territoires. Le porte-à-porte consiste à permettre aux individus d’aller d’une origine à une destination sans utiliser leur voiture, donc en utilisant différents moyens de transport mis bout à bout. La question posée est celle de l’existence d’un hypothétique opérateur de mobilité porte-à-porte qui serait l’interlocuteur unique du voyageur et qui lui garantirait la continuité de service tout au long du déplacement. Ce travail étudie, dans une démarche de recherche-intervention, les modèles économiques possibles pour un opérateur de mobilité porte-à-porte : quelle offre, quelle organisation entre les acteurs, quelle répartition des coûts et de la valeur ? La thèse apporte dans un premier temps une analyse approfondie de la notion de porte-à-porte pour les voyageurs. Ensuite elle détaille les enjeux pour les différentes parties prenantes. Les évolutions du contexte réglementaire de la mobilité en France, les enjeux relatifs au développement durable et la modification des équilibres en place sous l’effet de la transition numérique de l’économie sont passés en revue. Au sein de SNCF, différents approches du porte-à-porte existent qui reflètent la complexité de l’entreprise. L’évolution du système d’acteurs dans leur diversité ouvre des perspectives nouvelles. Trois grands types de modèles économiques pour le porte-à-porte sont identifiés : un modèle intégré, un modèle de plate-forme et un modèle distribué. Il en découle des trajectoires possibles de moyen et long termes pour le groupe ferroviaire. Sans être exclusifs les uns des autres, les trois modèles ont chacun leur domaine de pertinence. Affirmer un modèle économique distribué du porte-à-porte semble toutefois être une orientation à privilégier pour que le transport ferroviaire reste pertinent face à la voiture individuelle
The goal of providing passengers with seamless door-to-door mobility has today become a common objective, and a key priority for SNCF, France’s historical national rail group. After more than 30 years of growth thanks to the success of the TGV high-speed train, SNCF faces difficulties that have prompted it to reconsider its business model. The firm has decided to become a genuine multimodal operator with the capacity to provide a comprehensive territorial service through a variety of transport modes. The principal function of door-to-door transport is to enable travellers to go from A to B without using their own cars but a sequence of transport modes. This raises the possibility of the emergence of door-to-door mobility operators that provide a one-stop shop for travellers and offer continuity of service provision over an entire journey. This paper explores possible business models for a door-to-door mobility operator: the nature of the service, organisation between stakeholders and the revenue model. It begins with a detailed analysis of the idea of door-to-door service in the context of passenger transport. It then studies the main challenges for the stakeholders, in particular the evolution of France’s regulatory framework, issues relating to sustainable development and the effects of the digital economy. Different approaches to door-to-door provision exist within SNCF, reflecting the complexity of the company. Growing diversity in the system of actors has opened up new possibilities. Three contrasting business models were identified for door-to-door services: the integrated model, the platform model and the distributed model, all of which offer possible mid-term and long-term strategic directions for SNCF. Without being mutually exclusive, all three models are relevant in their distinct spheres. Nevertheless, the distributed model would seem to offer the greatest potential for rail transport to remain competitive with the private car

Abstract:

In questo testo tratteremo alcuni punti importanti nel campo della computazione quantistica, analizzando in particolare certi aspetti di fondo della realizzazione delle porte logiche quantistiche. Dopo una breve introduzione sulla computazione ed alcune caratteristiche particolari, proprie del mondo quantico, da tenere in considerazione nella realizzazione dei QuBit, l'entità in cui viene immagazzinata l'informazione equivalente al bit classico dei computatori, inizieremo la discussione sulla realizzazione delle porte logiche quantistiche. Tratteremo di come viene descritto un QuBit, dai suoi stati rappresentati tramite operatore di densità, che nel caso di una singola unità si riduce alla cosiddetta sfera di Bloch. Discuteremo di conseguenza sia le porte logiche quantistiche che operano su singolo QuBit che di controllo, specialmente tratteremo l'importanza di poter avere una porta universale equivalente al NAND. Tutto questo per poi argomentare come sia possibile realizzare una implementazione fisica. Delle varie possibilità tratteremo le trappole ioniche, dove vengono usati gli stati interni della struttura iperfine e dei livelli vibrazionali degli ioni per rappresentare il QuBit. Questo specialmente per la capacità dello stato interno, piuttosto che quello vibrazionale, di avere lunghi periodi di coerenza. Argomenteremo su come sia possibile realizzare delle porte logiche quantistiche per questa metodologia, con maggior premura riguardo alla C-NOT (Contolled-NOT). Questo a dimostrare che un implementazione di queste porte è possibile ed effettivamente realizzata sperimentalmente. Concluderemo questa dissertazione con una breve analisi critica della metodologia studiata e una prospettiva su possibili impieghi futuri.

Abstract:

La promesse de porte-fort, enoncee dans l'article 1120 du code civil, est l'engagement du porte-fort envers le stipulant de procurer le consentement du tiers. Le porte-fort conclut un contrat pour le compte d'un tiers sans en avoir prealablement le pouvoir. Il promet soi-meme qu'un tiers s'engagera. La promesse de porte-fort se manifeste dans l'accomplissement des faits et des actes juridiques. Elle n'est soumise a aucune forme determinee. Le juge, en procedant a l'interpretation de ladite promesse, a le pouvoir de restituer a la convention sa veritable qualification juridique sans etre tenu d'adopter la qualification proposee par les parties. La ratification est l'acte par lequel le tiers declare vouloir s'approprier le contrat qui a ete conclu pour son compte par le porte-fort. Celui-ci est donc libere. Il ne garantit que la ratification et non pas l'execution du fait car il n'est pas caution. Le tiers se trouve alors engage directement envers le stipulant. La ratification produit retroactivement ses effets au jour ou a ete faite la promesse de porte-fort. La non ratification engage la responsabilite contractuelle du porte-fort envers le stipulant. La promesse de porte-fort n'est pas consideree comme une promesse pour autrui. Le tiers n'est pas oblige sans son consentement. Elle ne constitue donc pas une derogation au principe de l'effet relatif des conventions prevu par l'article 1165 du code civil. La promesse de porte-fort se distingue des autres institutions voisines a savoir la gestion d'affaires, l'enrichissement sans cause, la representation, le mandat, la stipulation pour autrui, le contrat de transport de marchandises et la convention collective. Elle jouit de caracteristiques propres qui lui assurent une nature juridique appropriee. Elle constitue une institution originale et autonome. Cette originalite et cette autonomie se refletent en droit des societes, en droit des suretes, en droit compare et au lege ferenda
The promise of the "porte-fort" stated by the article 1120 of the civil code, is the engagement towards the stipulant to obtain the consent of the third party. The contractant concludes a contract on behalf of a third without having the power of doing it in the first place. He himself promises that a third will take the engagement. The promise of the "porte-fort" appears in the accomplishement of legal facts and legal transactions. It is not submitted to any special form. While interpreting the promise, the judge has the power to give back to the contract its real judicial qualification without having to follow the qualifications suggested by the parties. The approval is the act whereby the third lets know that the wants to make the contract that had been concluded in this behalf by the contractant. The contractant is therefore freed. He garantees only the approval, but not the execution of the fact, and that is because he is not "caution". The third becames then directly engaged tomards the stipulant. The approval has a retroactive action since the day where the promise of the "porte-fort" has been made. The lack of approval binds the liability out of contract of the contractant towards the stipulant. The promise of the "porte-fort" is not considered a promise for others. The third is not bound if he did not give his consent. The promise of the "porte-fort" is not a derogation to the principle of the relatif effect of contracts stated by the article 1165 of the civil code. The promise of the "porte-fort" is different from other close notions such as business management, "l'enrichissement sans cause", representation, mandat, provision in favour of the third party, shipping contract of goods and collective labour agreement. It has its own characteristics that give it a proper judicial nature. It is a unique and independant notion. This uniqueness and independance are reflected in corporation law, "safety law", comparative law and lege ferenda

Abstract:

Cette étude a pour thème le rôle social et politique de l'art contemporain. Pour appréhender ce sujet, nous avons décidé de nous pencher sur la manière dont Krzysztof Wodiczko conçoit l'art, qu'il définit comme une pratique socio-esthétique agissant au sein de la culture dans le but de la transformer. Ainsi, nous avons porté notre attention sur une de ses prestations esthétiques : "le Porte-parole" (1994). Pour l'artiste, cet Instrument destiné aux immigrés leur permet de prendre la parole dans l'espace public et de s'opposer à leur exclusion. Mais que peut signifier l'utilisation d'un objet esthétique? Comment se manifest-t-elle? A quelles "techniques de désaliénation" K. Wodiczko a-t-il recours? Quelles peuvent-être les conséquences de ce travail sur l'espace démocratique? En retraçant l'histoire de ce projet, nous nous attachons à décrire le mode d'apparition du Porte-parole, nous observons étape par étape (à partir notamment d'entretiens réalisés auprès des "performeurs/immigrés") les conditions de son utilisation et les effets qu'il produit sur ses utilisateurs. L'analyse des composantes et de la structure du signe, l'emploi des notions d'in situ, de performance, de fiction, l'usage de concepts appartenant aux champs de la psychanalyse, de la sociologie, de la linguistique, nous permettent de participer à la réflexion sur le rôle cognitif de l'art
This study takes as its theme the social and political role of contemporary art. In approaching this subject, we have decided to direct our attention to the way in Krzysztof Wodiczko which conceptualises art, which he defines as a social-aesthetic practice operating within the heart of culture with the idea of transforming it. We have thus focussed upon one of this artistic performances : the "Mouthpiece" (1994). For the artist, this Instrument made for immigrants allows them to speak out in the public domain and to opose their exclusion from it. But what could the use of such an aesthetic object signify? How will it present and reveal itself? To which techniques of de-alienation does Krzysztof Wodiczko have access? What could the consequences of this work be in a democratic arena? In retracing the history of the project, we commit ourselves to describing the way in which Mouthpiece presents itself we observe stage by stage (working, in particular, from the interviews that resulted from working closely with "performers/immigrants") the conditions of their use and the effects which they produce on their users. The analysis of the components and structure of the sign, the deployment of notions of the in-situ (site contextuality), performance and fiction, the use of concepts pertaining to the fields of psychoanalysis, sociology, linguistics, enable us to participate in the reflection upon the cognitive role of art

Fils d'un cordonnier de Nevers, chassé à 13 ans du collège en raison de son caractère rebelle, ayant vécu la rude vie de marin durant la guerre d'Amérique, Chaumette adopte rapidement les positions radicales de la démocratie parisienne au printemps 1791, aux cotes des cordeliers, des journalistes des révolutions de Paris. Élu membre de la commune insurrectionnelle par la section du théâtre français, il rompt avec les girondins sur la question de la garde départementale. Élu procureur de la commune de Paris en décembre 1792, il contribue à la victoire du 31 mai 1793 sur les girondins en plaçant la commune au centre du mouvement des sections parisiennes, mobilisées contre les girondins pour l'emprunt force sur les riches. Il prend la tête des manifestants qui le 5 septembre 1793 obtiennent de la convention la création de l'armée révolutionnaire. Il se rallie à l'offensive déchristianisatrice par haine de la Vendée et par pragmatisme révolutionnaire : les palais épiscopaux deviendront temple de l'humanité, accueillant les vieillards et les malades. Ayant voulu disputer le contrôle de l'appareil terroriste parisien au comité de sureté générale, il perd le soutien des cordeliers. Il approuve les décrets de Saint-Just, et celui qui abolit l'esclavage ; il ne s'associe pas à la tentative cordelière d'épuration de la convention. Accusé d'avoir accepté l'or de l'étranger et d'avoir voulu démoraliser la république en imposant l'athéisme, il est guillotiné, en réalité parce que le gouvernement révolutionnaire stabilisé doit nécessairement briser toute velléité d'indépendance politique de la sans-culotterie
Son of a shoemaker from Nevers, France, expelled from secondary school at the age of 13 because of his rebellious nature, having lived the tough life of a merchant marine during of american war for independence, chaumette quickly took up the radical positions of parisian democracy in the spring of 1791, alongside the cordeliers, journalists from revolutions de paris, elected member of the insurrectional commune by the "théâtre français" section, he broke with the "girondins" over the question of the formation of a regional militia based in paris to protect the convention. Elected paris commune "procureur" in december 1792, he played a role in the may 31, 1793 victory over the "girondins" by placing the commune at the centre of the movement of parisian sections, mobilised against the "girondins" in order to ensure the forced borrowing of money from the rich. He was at the head of the september 5, 1793 demonstrators who obtained the creation or a revolutionary army from the convention. He rallied to the dechiristianisation offensive due to his hate of the vendee counter-revolutionary uprising and through revolutionary pragmatism : the epispocal palace then became the temple of humanity, welcoming the old and the sick. When he tried to win control of the parisian terrorist apparatus of the comite de surete generale, he lost the support of the cordeliers. He approved Saint-Just's decrees hand those abolishing slavery ; he refused to be associated with the cordelian attempt to purge the convention. Accused for having accepted gold from abroad and for having attempted to demoralise the republic by imposing atheism, he was guillotined. The real reason for his conviction, in fact was the need for the newly stabilised revolutionary government to do away with any sort of political independence on the part of the "sans-culottes"

Abstract:

Ce mémoire présente un système d'aide à la communication pour personne handicapée (parole et facultés motrices réduites). Sur ordinateur, un moyen de communication alternatif est la saisie de message sur clavier simulé. Ce moyen de communication pose cependant un problème d'excessive lenteur. Dans Sibylle, nous proposons deux aides complémentaires. La première est une prédiction de lettre qui permet de sélectionner rapidement les lettres sur le clavier simulé, en reclassant, après chaque saisie, les lettres sur le clavier simulé. Le classement est établi en fonction des probabilités d'apparition des lettres estimées avec un modèle n-gramme. La deuxième aide est une prédiction de mot dont le rôle est d'économiser les saisies. Pour établir ces prédictions, le modèle de langage proposé intègre des connaissances d'ordre syntaxique (analyse en chunks aux modèles de langage stochastiques). Ces travaux ont donné lieu à une application, Sibylle, utilisée par des IMC au CMRRF de Kerpape.
