Kata kunci: batak; lingkungan; surat tumbaga holing.ABSTRACTIn recent years there has been a lot of environmental destruction, such as dumping garbage into rivers, lakes, seas, public roads. Indonesia produced up to 65 million tons of waste in 2016. The above series of environmental crimes arise because apart from being less firm, fair and the benefits of existing legal regulation on environmental protection, they are also caused by the lack of empowerment of indigenous peoples' potential in environmental protection as mandated by the 1945 Constitution and Law Number 32 of 2009. The research uses empirical legal research methods with a normative juridical approach and a socio-legal approach. The results of the study indicate that the Batak indigenous people have carried out environmental protection through the Surat Tumbaga Holing which is regulated in Patik, Filosofi Adat Dalihan na Tolu and Marga. The types of sanctions are: Dibondarkon, Sappal Dila, Dipaorot sian Huta, Dipaorot sian Marga, Diapaulak Salipi Natartar. Keywords: batak; environmental; surat tumbaga holing.

Abstract:
Continuing their studies of post-Pinochet memorials in Chile, the authors analyse a recent trend in the interpretation of trauma sites in Santiago which regards the need to resolve the tensions raised by the Pinochet years as more important than dwelling in detail on what was visited upon the victims. We argue that this significant shift from previous interpretations is carried by the younger generation of guides who did not undergo the repression personally. We note these changes with approbation, while noting that the desire not to discuss the worst excesses of the Pinochet regime has led to to a corresponding downplay of the highest points of human experience manifested by the victims themselves. We cite several instances that mark a peak of human experience in Chilean history, and suggest that several might well be used by the site interpreters to further instil a sense of pride among Chilean young people, rather than despair.

Bragg, Don C. "An Improved Tree Height Measurement Technique Tested on Mature Southern Pines." Southern Journal of Applied Forestry 32, no. 1 (February 1, 2008): 38–43. http://dx.doi.org/10.1093/sjaf/32.1.38.

Full text
Abstract:
Abstract Virtually all techniques for tree height determination follow one of two principles: similar triangles or the tangent method. Most people apply the latter approach, which uses the tangents of the angles to the top and bottom and a true horizontal distance to the subject tree. However, few adjust this method for ground slope, tree lean, crown shape, and crown configuration, making errors commonplace. Given documented discrepancies exceeding 30% with current methods, a reevaluation of height measurement is in order. The sine method is an alternative that measures a real point in the crown. Hence, it is not subject to the same assumptions as the similar triangle and tangent approaches. In addition, the sine method is insensitive to distance from tree or observer position and can not overestimate tree height. The advantages of the sine approach are shown with mature southern pines from Arkansas.

Mlauzi, Linje Manyozo. "Reading modern ethnographic photography : a semiotic analysis of Kalahari Bushmen photographs by Paul Weinberg and Sian Dunn." Thesis, 2002. http://hdl.handle.net/10413/4609.

Full text
Abstract:
Indigenous communities, like the Bushmen of the Southern Kalahari, always attract visitors who 'go there' to experience the 'life out there'. Travelling in their 4x4s, these visitors also bring cameras and take pictures of their interactions with subject communities as evidence of 'having been there'. For academics and journalists, these pictures are meant to illustrate their presentations of 'what is actually there'. Both types of photographs are known as ethnographic photography. This study. asks and attempts to answer the question: how do we study ethnographic photography? As much as photographers attempt to portray their subjects realistically, their representations are often contested and criticised as entrenching subjugation, displacement and dehumanisation of indigenous peoples through 'visual metaphors' and other significatory regimes. This discussion reconsiders the concept of imaging others, by offering an analytical semiotic comparison between Paul Weinberg's anchored and published photographic texts of the Bushmen, on the one hand, and Sian Dunn's unpublished, inactive texts of the #tKhomani Bushmen, on the other. The discussion is an attempt to understand documentary photographers, processes of producing of images, the contexts in which they are produced and how the communities that are represented make sense of them. Concerns with the objectivity of representation go beyond the taking and consuming pictures of other cultures. This study is, therefore, grounded in cultural, social and ideological factors that shape the production and consumption ofphotographic representations of and from other cultures.

Abstract:
AbstractThis chapter briefly traces the struggle to restore sanitation workers’ humanity in India since the early twentieth century. Sanitation labor has generally been carried out by people from the Dalit community, a group of castes formerly referred to as “untouchables.” By paying attention to M. K. Gandhi, B. R. Ambedkar, government authorities, and nongovernmental organizations (NGOs), this chapter examines how humanitarian interventions were made via ideological and practical approaches to address the circumstances of sanitation workers and the limitations thereof. Gandhi’s emphasis on the moral aspect of scavenging and Ambedkar’s stress on the structural inequalities in the division of sanitation labor informed the mainstream ideas in preindependence India. However, efforts after independence were committed to abolishing the specific task of manual scavenging as a sine qua non for the emancipation of sanitation workers. These endeavors primarily entailed abolishing scavengers’ customary rights, the technological invention of low-cost flush toilets, and legal actions taken against the government. However, these attempts have led to dismissing the importance of providing “adequate sanitation” to the bulk of the population (Chaplin, The politics of sanitation in India. Orient Blackswan, New Delhi, 2011: 185, 267), enhancing nonscavenging sanitation workers’ conditions, and developing a more mechanized, holistic human waste disposal system. Further, having underlined the unsanitary, inhuman, or moral dimensions of sanitation labor, these interventions did not necessarily consider the complicated context of actual sanitation workers regarding how they perceive the labor on their own terms.

Abstract:
Catullus’ poetry reveals an acute awareness of the constant and almost unfathomable widening of his world in the late Roman Republic. In his work people and goods circulate with ease through geographical space, impervious to boundaries. But the cultural notion that only the ends of the world impose limits on Roman territory takes its toll, especially at the level of the subject. The porous nature of geographical boundaries seems to rub off onto the signifiers by which Catullus constructs himself, Lesbia, his brother, his friends, enemies and acquaintances, as well as the places they move through, as coherent, unified, fixed entities.

Abstract:
The sine qua non of a good society is that people have the freedom to be and to do that of which they are capable. However, people cannot have this freedom when caring for others is pitted against self-interest. Self-interest devolves into a care-lessness that is antithetical to the good society. Caring for others, by contrast, is a necessary condition for this freedom. Caring for others is the sine qua non of the profession of nursing. With the match between the sine qua non of a good society and of nursing, the profession has the power to address political and social barriers people face in having the freedom to be and to do that of which they are capable.

Abstract:
This chapter juxtaposes Ovid’s erotic and his exilic elegy. In Rome people could visit and examine Agrippa’s map; expansion and conquest sit hand in glove with powerful fantasies of imposing order, control, and hierarchy. In his early elegiac works Ovid contemplates feminine self-adornment. Luxury goods from foreign places flow to the capital, and the city’s female inhabitants seek out, then display on their bodies, the commodities of empire. Once the Ovidian women cloak themselves in the trappings of empire, however, they become one with their accoutrements. In the second part of the diptych, exilic Ovid, just like his adorned women before him, suffers in the face of absent fines. At the very margins of empire, in Tomis on the Black Sea, when he finds himself contemplating first-hand the permeable fines at the furthest edge of imperium, stable, fixed boundaries evaporate, and hybridization and melange take over. It becomes increasingly difficult to ascertain where imperium ends and the non-Roman world (not-yet-Roman world) begins. The Greeks, the Getans, the barbarians have already mixed together, and ultimately even the one Roman cannot sustain his Romanness.

THE MANIFESTATION OF STUDENTS ‘TOLERANCE TO UNCERTAINTY AND THEIR SELF-ESTEEM. The research of tolerance to uncertainty and self-esteem as an individual predisposition to report to complex social and professional situations is particularly current and important in the context of the pandemic that revealed several psychological problems. The psycho-emotional well-being of the population is interpreted as the way the person perceives himself, evaluates his life, the way he feels and activates on a personal and social level. This interpretation has changed during the pandemic crisis. Young people mention that in moments of uncertainty their safety is affected, which leads them to make impulsive, anxiety-filled choices. Respectively, self-esteem undergoes changes with the confrontation of situations full of uncertainty. A high level of self-esteem allows people to act effectively, to cope with the difficulties of existence.

Abstract:
Traditional leadership in South Africa pre-existed both the colonial and apartheid systems of governance and was the main known system of governance amongst indigenous people. In any case, as opposed to the current political pattern of discrediting traditional leadership, Africans have their own comprehension of democracy, which is pointedly from the liberal democracy of the West. Traditional leadership was democratic based on its own unique way in what we these days allude to as ‘consensus'. This chapter contends that the institution of traditional leadership is still significant as a trusted institution for governance by most of the people living in rural South Africa. The chapter contends as revered in the Basotho aphorism, mooa khotla ha a tsekisoe maxim, that traditional leadership is a sine qua non in rural areas. The South African post-apartheid government has neglected to conclusively characterize and unambiguously explain the role and significance of traditional leaders in local governance.

Abstract:
A radical shift in the velocity and volume of general mobility was a sine qua non of mass emigration. The pre-existing shape of labour mobilities set the context for the emergence of mass emigration. The beginnings of mass emigration were located in the British Isles in the 1820s, but the scale of the discontinuity requires a measure of the circumstances before the change. Modern mass mobility erupted in the western world in the early nineteenth century, especially in Victorian times. The case of Alexander Somerville in Scotland provides a standard pattern for mobility in the transitional age. English historians have long identified an array of categories of mobility in the pre-modern population, some long-distance, some seasonal, some local and circulatory. A composite picture has emerged which emphasises the essential fluidity of the population before industrialisation, of people in localised motion and perhaps increasingly so.

Abstract:
Chapter 7 posits an important hypothesis for this book: senators could not reach everybody for many reasons, so they were surrounded by a wide spectrum of people, non-senatorial actors who intervened in conversations with several degrees of agency and thus played an important role in the transmission of information and, therefore, in politics. The chapter focuses mainly on two groups: freedmen and elite women; finally, it questions the role of courtesans within this system. Elite women did not intervene in politics exclusively in their own realm; instead, their role in conversations attests to their inclusion within the broader network of conversations and the circulation of information that sustained Roman politics. Trusted liberti also played a relevant role. Even those actors with a lower degree of agency were not mere mouthpieces who parroted words that they had been taught. These actors played a limited role in institutional politics. However, they were a sine quibus non within the sphere of extra-institutional politics.

Abstract:
The present complexity cannot be grasped by endless enumeration of objective factors. Each choice reveals what a person is believed to be; each choice shapes people through the effects that it produces/fails to produce. Individual and personal characteristics thus cannot be controlled only by the law, because the latter is enforced by persons. Research should be moved to a higher level where they could be controlled and implemented through values if their basic human properties could be known that operate also within public administration. No area can be taken as final; no single conviction will always give the right answer in a new or different set of circumstances that requires a different approach and a new conviction based on it. A culture of dialogue should be hence established through whistleblowing and other adjustments, using a central perspective on situations from the highest management combined with a horizontal one to provide information. In both perspectives, public employees are the sine qua non for good administration.

Abstract:
Abstract An example of vascular anastomosis is coronary artery bypass grafting (or CABG), which is the most common open-heart surgery in the United States today. It is used to treat people with coronary heart disease. Although it generally produces good outcomes, it is not without risk of failure. Due to rotation-related fluid stress on the graft at the point of attachment, possibility of clots forming at extraction and perfusion sites is high. The possibility of endothelialization at the suture joints carries a further risk of flow obstruction. Present research proposes a new blood contacting medical device that is attached to both ends of a vascular graft, and aids in flow rotation at the points of blood extraction and perfusion, thereby alleviating the possibility of clotting at those sites. It also shifts the suture lines such that the endothelialization causes minimal flow obstruction compared to current techniques. Simplified 3D models of both the current grafting technique and the proposed device are evaluated with periodic rectified sine pulse acting as a surrogate for human blood pulse. For both perfusion and extraction, better outcomes were observed for vascular anastomosis with the proposed blood contacting medical device.

Abstract:
In this script we’ll describe the everyday, little actions of the citizens that break the rules of the urban areas’ organization. Starting from the Old Town of Palermo, that we used as the example in our analysis, we’ll show how the “conquest”, even just temporary, of streets and squares could achieve a revitalization and a revaluation of quarters. Our focus is on understanding how revitalization/ re-conquest of urban areas has taken place. By altering people preconcieved ideas of areas of the city, this process achived the “domestication” of some areas that, out of their usual context, are inserted in new relations. Our choice to take Palermo as example derives from some typical characteristics of this city: the first one is due to its historical-cultural origins which, in some way, favor the settlement of new comunities; the second is that the way of live among population of different cultures develops in the centre of the city, not in the suburbs. These features make Palermo not unique, but atipical compared to the rest of Europe where immigrants and lower-class people, are generally forced to the external areas of towns. From this point of view we can imagine Palermo’s Old town as a sponge which is able not just to absorb new comunities, but also to attract people from the middle classes. In European cities gentrification processes are started thanks to projects realized by the Public Administrations, On the contrary in Palermo this process generates from actions of the inhabitants themselves. The change of degenerative trend and the increasing value in the Real Estate Market is therefore not caused by a political action, but thanks to the initiative of the lower class.

Abstract:
We are witnesses and participants of Copernican changes in the world which result in major crises/challenges (economic, political, social, climate, demographic, migratory, MORAL) that significantly change “normal” circumstances. The law, as a large regulatory system, must find answers to these challenges. Primarily, these circumstances relate to (i) the pandemic - Corona 19, which requires ensuring economic development with a significant encroachment on human freedoms and rights; (ii) globalization, which fundamentally changes the concept of liberal capitalism as the most efficient system of production of goods and services and democracy as a desirable form of government; (iii) automation, robotics, artificial intelligence, and big data are changing the ways we work, live, communicate, and learn in a Copernican manner. The law should serve to shape the relationship between people in order to realize a life of love and freedom. This is done to the greatest extent through the constitutional engineering of selected institutions. The legal system focuses on institutions that have a raison d'etre in their mission, which is read as “ratio legis”, as a desirable normative and real action in the range of causal and teleological aspect. Crisis situations narrow social cohesion and weaken trust in institutions. It is imperative to seek constitutional engineering that finds a way out in autopoietic institutions in allopoietic environment. We believe that the most current definition of law is that = law is the negation of the negation of morality. It follows that morality is the most important category of social development. Legitimacy, and then legality, relies on morality. In other words, the rules of conduct must be highly correlated with morality - legitimacy - legality. What is legal follows the rules, what is lawful follows the moral substance and ethical permissibility. Therefore, only a fair and intelligent mastery of a highly professional and ethical teleological interpretation of law is a conditio sine qua non for overcoming current anomalies of social development. The juridical code of legal and illegal is a transformation of moral, legitimate and legal into YES, and immoral, illegitimate and illegal into NO. The future of education aims to generate a program for global action and a discussion on learning and knowledge for the future of humanity and the planet in a world of increasing complexity, uncertainty and insecurity.
