Abstract:
This paper examines the use of juries in criminal cases in Canada and the United States. It is part of a larger study of the administration of criminal justice in Niagara County, Ontario and Niagara County, New York. The basic question examined is why persons accused of serious crimes in the United States usually select a jury, whereas persons in similar circumstances in Canada normally select trial by a judge alone. An investigation of this question will enable us to see some significant differences between the administration of criminal justice in the United States and Canada. It will also show how changes in specific procedural rules may affect other practices. There is a complex interplay between procedural rules. The paper concludes by showing that the widespread use of juries in the United States is consistent with the more populist grass-roots approach in American society which tends to distrust government, compared with the traditional respect for authority, including the authority of judges, in Canada.

Abstract:
Purpose Digital evidence is now infused in many (or arguably most) cases of sexual assault, which has refigured investigative tools, policing strategies and sources of cynicism for those working in sex crime units. Although cynicism, both its sources and affects, is widely studied among scholars of work and policing, little is known about how police working in sex crime units experience, mitigate and express cynicism. The purpose of this paper is to fill this gap in understanding and explore the role of cynicism amongst investigators working in sex crime units. Design/methodology/approach To address this research gap, the authors conducted 70 semi-structured in-depth interviews and two focus groups with members of police services organizations across Canada working in sex crime units. Findings Examining sources of cynicism and emotional experiences, the authors reveal that officers in these units normalize and neutralize organizational and intra-organizational sources of cynicism, and cope with the potentially traumatizing and emotionally draining realities of undertaking this form of “dirty work.” The authors show that officer cynicism extends beyond offenders into organizational and operational aspects of their occupations and their lived experiences outside of work, which has implications for literature on police work, cynicism and digital policing. Originality/value The authors contribute to the literature on cyber policing by, first, examining sex crimes unit member’s sources of cynicism in relation to sex crimes and the digital world and, second, by exploring sources of cynicism in police organizations and other branches in the criminal justice system. The authors examine how such cynicism seeps into relationships outside of the occupation. The authors’ contribution is in showing that cynicism related to police dirty work is experienced in relation to “front” and “back” regions (Dick, 2005) but also in multiple organizational and social spheres. The authors contribute to the extant literature on dirty work insofar as it addresses the underexplored dirty work associated with policing cyber environments and the morally tainted elements of such policing tasks.

Abstract:
<p>The aim of this paper was to describe the phenomenon of woman’s crime in Canada from the perspective of statistical data analysis. For this reason, the statements regarding the frequency of the studied phenomenon in three research periods were presented: 1975–1981, 1984–1994 and 1999–2009. The Canadian woman perpetrators were found to have established categories of crimes (property crimes, violent crimes), the frequency of which has changed during the periods under investigation. In the context of the studies carried out, in particular, the phenomenon of the increase in the frequency of woman’s offences committed using violence, remains a matter of concern. This fact indicates an increase in the pathologization of their behaviours. Moreover, in the last research period (1999–2009) there were also new trends in the criminal activity of women – road traffic offences and offences involving drugs and narcotic drugs, however, their level was not high.</p>

Abstract:
Despite the importance of studying sexual assaults perpetrated by women, the field knows very little about female sexual offenders’ (FSOs) use of violence or physical injury resulting from these assaults. This study draws more than 20 years of National Incident-Based Reporting System (NIBRS) data reported to police (1992-2014) to identify factors that distinguish between female perpetrated incidents of sexual assault that result in severe, minor, or no physical victim injuries above and beyond the sexual assault itself. Using a multinomial logistic regression model (MNLM), 15,928 incidents of FSO-perpetrated sexual assault were analyzed from the NIBRS. The results showed that the extent of victim injuries sustained during the sexual assault incidents was associated with a number of factors, including the presence of a female victim, the age of victim, a greater number of offenders, and the presence of weapons. In particular, incidents that resulted in major victim injuries were significantly associated with alcohol and drug use by the perpetrator. In general, incidents with young children were at increased risk of a sexual assault resulting in a major or minor victim injury. Although further investigation is needed to continue to better understand female sexual offending behaviors, these findings suggest that certain incident characteristics increase the likelihood of the assault to involve the use of violence by an FSO against her victims.

The article considers foreign experience in the investigation of financial crimes on the example of such countries as the United States, Poland, Spain, Canada, France. The influence of financial crimes on the functioning and development of the state has been studied, and the peculiarities of counteracting and combating money laundering in these countries have been determined. The activity of the State Financial Monitoring Service on detection and processing of information of risky financial transactions and its cooperation with foreign divisions of financial investigations is described. The most popular countries in which there are entities with a suspicious reputation for financial transactions are identified. It is also determined that the legalization of criminal proceeds is a financial crime that encroaches on the established procedure for conducting financial transactions, and hence on the national interests of the state.

Time and again, cases come to light in which companies in unstable regions have participated in crimes, including human rights violations. However, the economic power over these companies is regularly geographically distant, anchored in the stable regions of the world, e.g. in a corporate headquarters located in Europe, the USA, Canada or Australia, where the economic profit ultimately accrues. Starting from this imbalance, the present essay examines the question of the criminal (co-)responsibility of these power holders using the example of the German legal system. It becomes apparent that the concept of criminal law, which is still based almost exclusively on individual responsibility, leads to deficits in the investigation of the most serious economically driven crimes. Despite this need for reform, however, even de lege lata a top management based in Germany can be held (jointly) liable for distant crimes under the concept of "principal’s criminal liability" (“Geschäftsherrenhaftung”).”

Abstract:
This study aims to analyze and describe the crime of child abuse by parents in terms of child protection aspects. Current developments bring about the evils that society suffers from: violent crimes and maltreatment. One of the most common are crimes involving child victims. Such cases are known as child abuse. Two main problems arise from this declaration. That is, the regulation of criminal sanctions for criminal acts committed by parents and legal protection of children who are abused within the meaning of the Child Protection Act. This investigation uses a normative legal investigation type with a legal and conceptual approach. This research is included in normative research, which is sourced from primary legal materials. Data were collected by using literature and document study methods. The results show that. The imposition of criminal sanctions on criminal acts committed by parents if they meet the elements of Article 76C is child protection against abuse of political activities, involvement in armed conflict, involvement in social unrest, and involvement in cases. Abstract:
In an effort to establish a clearer understanding of the sentencing of sexual assault offenders, this study analyzes data generated from a content analysis of sexual assault cases, using feminist theory as a backdrop for the analysis. The sample consists of ninety-seven sexual assault cases from across Canada for the period of August 15, 1992 through August 15, 1993. Using a statistical analysis, the data were analyzed for evidence of whether certain factors aggravated or mitigated sentence length. The findings indicate that factors not affecting sentence length include breach of trust, sex of the judge, sex of the complainant, plea and show of remorse. Factors that work to mitigate sentence length include the youth or old age of an offender. Finally, variables that, when present, aggravate an offender's sentence length are prior offences, force, sexual intercourse and psychiatric considerations. These findings indicate that while there has been some response to feminist concerns regarding criminal justice processing of sexual assault, some of the myths that have been traditionally associated with its victims and offenders are still influencing the judiciary.

This study records an attempt to apply feminist epistemology to the conduct and communication of social science research, specifically of the Badgley Report. When I began, I wanted to understand why and how mainstream social science research persists in evading feminist analysis of the problem of child sexual abuse, despite agreement on incidence and perpetrators. I also wanted to find ways of producing knowledge that did not either evade nor postpone voicing the truths of women's and children's experiences of child sexual abuse. I have learned that commitment to a feminist framework requires critical consciousness of all aspects of the processes by which knowledge is constructed, including the relationship and interaction between the writer and reader of research. Thus, what I have attempted to do in this thesis is to communicate feminist research processes through both the form and the content of my report.

Twenty women linked with the sex trade in Edmonton, Canada went missing or were murdered between 2001 and 2008. In this study, I use Foucauldian and feminist theories, via discourse analysis, to examine the ways that Edmonton’s newspapers (re)present these murders. My findings show that the newspapers’ discourse deviantises these women, thereby minimising the tragedy of their disappearances and deaths. This deviantisation is deployed in three ways; by framing sex trade workers as criminally, medically, and morally deviant. Criminal deviance places sex trade workers firmly on the ‘wrong’ side of the law, making them undeserving of police protection; medical deviance implies that only women who are mentally ill in some way would take part in the sex trade, and, simultaneously, hyperbolises the role of sex workers in the spread of venereal diseases. Finally, discourses of moral deviance place sex workers on the ‘wrong’ side of morality and femininity. iv

Abstract:
Although some research has focused on feminist practice in general, the external and internal dynamics of feminist practice still remains theoretically and empirically under-researched. This study addresses this void in feminist research and places a special focus on the relationship of feminist organisations with the state and within the broader context of the women's movement. This thesis explores the constitution and maintenance of feminist practices in one specific context in South Korea and Australia. Drawing on empirical and historical data derived from the case studies, two questions are explored in this study: What constitutes feminist practices in a feminist organisation? How can feminist practices be sustained?. Two feminist-run Sexual Assault Centres (SACs), one in Korea, one in Australia are studied and analysed, involving 32, in-depth interviews with activists of the two centres, non-participant and participant observation, and document analysis. First, this thesis provides a detailed account of feminist practice and organisational dynamics among feminist organisations, the feminist movement and the state. This thesis confirms that the practices of feminist organisations are seen as dynamic processes constituted by the context in which they are situated, the role of feminist activists and the nature and strength of the broader women's movement. This study, in particular, demonstrates that the relationship of the organisation with the state is a strong determinant in constructing feminist practices. Second, this thesis examines organisational practices at different phases such as the establishment, development and crisis phases. As both centres were experiencing crises, the study illuminates that the crisis in each centre has provided an opportunity for re-examination and reflection on their practices in shifting internal and external contexts. This study also suggests that continuous reflexive attention is necessary to maintain feminist practices. Moreover, the study demonstrates that the role of the activists in constructing and maintaining feminist practices is critical, in particular, in small organisations such as the ASAC and KSAC. This research, the first major study on feminist practices in Korea and Australia, makes a significant contribution to the study of feminist organisations, the state and, in general, feminist theory.

Abstract:
This study tested an underlying assumption of professionals who interview young children with anatomically correct dolls: children who have been sexually abused react differently to interviews with the dolls than children who have not been sexually abused. The behavior of a group of children who were referred to a mental health clinic in the southwestern United States because of suspected sexual abuse was compared to the behavior of a group of children referred to the same clinic for other reasons while the children were interviewed by clinicians using anatomically correct dolls. The study examined four categories of behavior which consisted of indicators of child sexual abuse from the literature. The four categories were: (1) sexual behavior; (2) anger/aggression; (3) anxiety/regression; and (4) avoidant behavior. Clinicians at the mental health clinic identified potential subjects for the study from the outpatient population. Parents were given written and verbal descriptions of the study and asked to contact the researcher if they were interested in allowing their child to participate. The voluntary nature of participation in the study was stressed. Eleven children who were referred because of suspected sexual abuse and eleven children referred for other reasons were successfully recruited. Groups were matched as closely as possible as to sex, age, racial/ethnic group and developmental level. Two dependent measures were employed: the Behavioral Checklist and the Likelihood of Victimization Scale. Both instruments were designed for the research study. The Behavioral Checklist was completed by two observers who watched each interview from behind a one-way mirror. The Likelihood of Victimization Scale was completed by the clinicians who interviewed the children. Observers as well as interviewers were blind to the referral status of the children. Statistically significant differences were obtained for two of the four categories of the Behavioral Checklist. The same two categories correlated significantly with the Likelihood of Victimization Scale. The results provided support for the assumption tested.

Abstract:
Approximately one in four women experience sexual violence in college. Public institutions of higher education identify professionals specifically responsible for Title IX compliance, campus grievance processes, and survivor advocacy. Success in these roles depends upon a variety of institutional, legal, and procedural factors, and the ability to balance compliance, accountability, transparency, confidentiality, and care for students in pursuit of institutional justice. However, the literature has failed to acknowledge the complexities and individual cost of serving in these contentious roles. Moreover, facets of organizational culture can hinder grievance professionals' efficacy in fulfilling their duties, facilitating consistent and fair resolutions, and ensuring just outcomes. This exploratory, qualitative study sought to fill the literature gap and add insight into the experiences and perspectives of student conduct, Title IX, and advocacy professionals at multiple public institutions by seeking to understand individual actions, values, and responses in light of organizational structures, institutional policies, leadership, grievance models, and power dynamics. Data indicated that professionals involved in campus grievance endure severe emotional strain in their efforts to facilitate justice, especially if their own values and principles are misaligned with those of institutional leaders, policies, grievance processes, or outcomes. Moreover, the findings suggest that such misalignment diminishes professional efficacy, which increases stress, fatigue, and leads to burnout, thereby decreasing the likelihood of realizing justice. Recommendations include revisions to graduate education, reimagined compelled disclosure policies, the need for employee support programs, and a call for further accountability of institutional leaders. Finally, an alternative paradigm is explicated for moral and justice-centered resolutions of campus sexual assault.
