Abstract:
This chapter argues that two types of process affect the allocation of water between users. The first of these are a set of intentional strategies, which dominate the literature on water allocation. These include institutional allocating mechanisms and the purposeful appropriation of water. The second type of process is unintended and occurs through indirect action or inaction. Through this second type of process, people, sectors, and places nevertheless gain water share. Unintended allocation arises from within the ungoverned spaces and “wicked problems” of land and water transformations in two interrelated ways: (1) via external changes in non-water sectors and (2) via internal changes within the water management sector. This unintended or hidden type of water allocation process is largely overlooked. Yet, it is potentially important because volumes of water moved through unintentional allocation can be large, and it can undermine well-intentioned policy interventions in the water and land management sectors.

This chapter will address several aspects of gender inequality in college athletics, including inequitable allocation of resources and opportunities, inadequate institutional response to allegations of sexual violence against college athletes, and employment discrimination against female coaches and administrators. These challenges exist notwithstanding federal law, Title IX, which prohibits sex discrimination in education. Reasons for the recalcitrance of gender inequality in college sports include limitations of the law to adequately motivate compliance, as well as the patriarchy’s reliance on sport as a means of constructing and sustaining the relationship between masculinity and power. For these reasons, it is important to consider both legal and extra-legal solutions to the problem of gender inequality in sport that involve lawmakers and individual and associated educational institutions, as well as the general public.

Abstract:
The 1984 cost/benefit model for the evolution of carnivorous plants addresses their potential energetic and ecological advantages. It has provided a conceptual framework for research on distribution, variation in trap allocation and mechanisms, association with low rates of photosynthesis and whole-plant growth, and ecology of carnivorous plants relative to noncarnivorous ones. We re-assess this model, its potential extensions, and the validity of its assumptions and predictions. We review what is known about photosynthesis, respiration, relative growth rates, and resource allocation in carnivorous and noncarnivorous plants, and growth, nutrient limitation and stoichiometry, adaptation to different prey, and optimal trap allocation of carnivorous plants. We propose explanations for six ecological and evolutionary paradoxes involving carnivorous plants. Future advances will hinge on better quantification of the cost/benefit model and comparing model predictions with data.

This chapter focuses on the institutional framework for water in India that has the presence of a number of institutions organized horizontally and vertically. The first section of the chapter explains the different models adopted by different states to create drinking water utilities. While water institutions are generally created on a sectoral basis, a recent trend has been to set up independent water regulatory authorities mainly to look after sectoral allocation and regulation of pricing. In this context, the second section reproduces one of the earliest and one of the very few laws to set up an independent water regulatory authority that is actually in force. The third section brings in legal instruments to set up institutions that promote private sector participation in a number of sectors including the water supply sector.

Chapter Two provides a hands-on guide to the coding scheme. The authors measure delegation (the conditional grant of authority by member states to an independent body) and pooling (the joint exercise of authority by member states). They disaggregate by examining 1) the role and composition of institutional actors in an international organization (IO); 2) at distinct stages of decision making (agenda setting, final decision, opt-out, ratification, dispute settlement); 3) across six decision areas (accession, membership suspension, constitutional reform, budgetary allocation, financial compliance, policy making). The authors define the content and specify intervals for each indicator, and discuss how they avoid formalism, triangulate estimates, avoid contagion, and adjudicate ambiguity.

Italy has a unitary rather than a federal state, and thus the constitutional system has evolved toward an increasingly complex and dynamic set of interactions between the national government and the several regions of Italy. The Court’s case law dramatically reflects that shift where disputes regarding the allocation of authority between regional and national states account for a sharply increasing proportion of the Constitutional Court’s work. This chapter presents that body of jurisprudence and thereby offers helpful points of reference and comparison for the many other constitutional systems around the world grappling with the challenges of drawing a healthy balance between local autonomy and national unity.

By presenting the Court’s principal lines of case law regarding the allocation of powers in the Italian constitutional system, this chapter explores the constitutionally regulated relationships among the President, Executive, Parliament, and Judiciary. It reveals that rather than a “separation of powers” in the conventional sense of contemporary constitutional models, the Italian system is best described as instituting a set of reciprocal “relations of powers” with the Constitutional Court as the “judge of powers” that maintains and guarantees these interrelationships of constitutional actors. The chapter explores this role of the Constitutional Court in its relations with both Parliament and the President of the Republic, as well as the Court’s regulation of the relationship between the President and the Executive.

Innovation is crucial for development. A set of institutional capacities and coordinated actions between the public and private sectors are required to drive large mission-oriented innovation policies (MOIPs) to address priority issues and set a direction for the path of development. This work identifies what restrictions exist in institutional and policy capacities that hinder the design and implementation of MOPs in Chile. This work is based on a case study design. The study analyzes the design and implementation of two strategic programs for innovation and development in the solar energy and mining sectors. The study showed that the capacities of the programs analyzed were evident in the construction of a shared vision and the identification of innovation-led solutions for the development of the two sectors, but the lack of leadership from the government hinders the implementation of the programs, particularly because of the lack of coordination between government agencies and ministries for budget allocation and strategy definition.

The chapter explains the relationship between the issue of natural resources management and international human rights law (IHRL), and places it into context with regards to the book. It examines how the management of natural resources is linked to broad issues of economic development, peace, and security, as well as the political, economic, social, and cultural rights of individuals and communities. The introduction also establishes the analytical framework of the book by adopting a rights-based approach to natural resources management and its regulation, and how these activities related to the structural allocation of wealth and power. Overall, it looks at the interaction between IHRL and natural resources based on six main concerns: sovereignty, property, governance, access to sources of livelihood/food production, cultural and natural heritage, and conservation.
