Full textOur goal in this study is to analyze the economic foundations of the rice self sufficiency objective (which ranks high in the agenda of the government) and assess the attainability of such goal after the devaluation of the CFA franc. Two main themes are evoked here. The first one focusses on the array of policies implemented before the devaluation. The causes of poor results obtained (growth in the importations of rice), seem to stem from inconsistencies between declared objectives and policies implemented. Chapter one has shown that food security rather than self-sufficiency was guiding force of reforms. This result is confirmed when we analyze in the chapter 2, the evolution of the rice market. The analysis of rice market evolution shows the reforms undertaken as well. In the second part, we analyze the effectiveness and usefulness if policies implemented after devaluation. For that purpose, indicators of performance of rice production have been calculated using Policy Analysis Matrix (PMA). This indicators, computed for the pre-devaluation as well as post-devaluation period have shown some increasing competitiveness of the local production units. We finally estimate the supply response behavior of peasants using a dynamic supply model with an Error Correction Mechanism (ECM). This econometric analysis shows that supply of rice is positively correlated with relative price (of rice, cotton and maize), negatively with price of inputs (especially labor) and credit. Full textThe soil is the upper layer of the earth’s crust, the plan surface that stretches from one horizon to the other. It is the crop lands, the scattering sand, the ground we trample on, the link between men and their territory: garden, region, state. The soils, those fragile and multifunctional ecosystems, provide many ecological services and guarantee the environmental quality. The law contains several conceptions of the notion of soils quality. But, far from constituting a protection status, this integration ignores, a priori, their environmental qualities. However, the soils are a finite resource and their non-sustainable use leads to their degradation, often irreversible, and to their growing scarcity. Progressively, the law added elements of soils multifonctionality, integrating sustainable practices. This utilitarian approach of soil quality proves to be selective and remains focused on the preservation of a small part of all the ecological services: the ones that men directly need, like food production and ignores the indirect ones like carbon storage. Nevertheless, this approach is complemented by the raising of an objectivist conception of quality, which reveals the propensity of the law to take into account the intrinsic value of soils

Full textNowadays, food products security reveals an increased desire for caution. Case law and rules concerning liability for defective products aim to improve consumers' legal security. According to its legislative history, the purpose of law n°98-389 of May 19th 1998 is to establish a liability called "objective" that is distinguished from the classic common law liability based on fault. Manufacturers and sellers are therefore expected to put on the market a product that provides “the safety that a person is entitled to expect”. This consumer protection rule also includes an obligation to furnish information and advice. But is this new safety obligation equally applicable to all products, including food, according to the classification provided in article 1386-3 of the civil Code? Also, any producer of a defective movable must compensate for any damage caused to the physical well-being or property of individuals. Legal scholars seem commonly to admit that these so-called "objective" measures based on a presumption of prejudice for "risk creation" make the compensation of victims easier to obtain. However, doesn't the victim's compensation inevitably depend on a causal link between the manufacturer's fault and the victim's damage? Is the proof of causation subsumed in the notion of "compensable damage"?

Full textUne remise en cause de cette approche est manifeste depuis le déclenchement de la crise de la " Vache folle " en mars 1996. Crise de prime abord conjoncturelle, elle a eu de nombreuses implications notamment quant au mode d'appréhension de tout le secteur alimentaire, dont elle invite à revisiter le statut juridique.
Largement réorganisé, celui-ci tend à devenir le cadre d'une action cohérente grâce à la consécration de la notion de chaîne alimentaire et au développement d'instruments adaptés à la gestion des risques. De plus, la poursuite de l'objectif de sécurité alimentaire oriente désormais toute l'action communautaire fondée sur les principes de précaution et de prévention. Ces nouvelles orientations devront être pleinement articulées avec les exigences des accords multilatéraux conclus dans le cadre de l'OMC et, par ailleurs, elles confortent, peu à peu, les droits à la protection de la santé et à l'information reconnus aux consommateurs. Faudrait-il au-delà leur reconnaître un droit fondamental à la sécurité ?

Full textRural areas of West Africa have seen notable transformations these last two decades, mainly due to high population growth, development policies in favor of export crops and introduction of new cropping practices. The results of these developments are a pressure on forestry resources, an evolution of farming systems, a depletion of soils and a saturation of cultivated areas. The number of conflicts for resources access increases, reviving buried ethnical tensions, and the question of food security is raised. In that context, early warning systems have been developed in order to foresee and curb food insecurity by the mean of hazard analyses.The present work deals with agrarian changes and their mechanisms, in the context of early warning systems development. New methodological approaches are explored, based on modeling and remote sensing in order to create a retrospective and prospective analysis of agrarian dynamics of the Tuy province, located in West Burkina Faso.We first focus on the issue of cross-scaling in agro-ecosystems dynamics models, by building a multi-scalar model of past developments. The model uses interaction graphs to simulate processes occurring from the plot scale to the regional scale (crop production, crop rotation and crop area expansion). We show that modelling across scales is achievable without resorting to methods of aggregation or disaggregation, usually applied for this type of study.The model is then used to analyze two aspects of agrarian dynamics of Tuy province. The first one deals with clearances dynamics in the context of Malthus vs Boserup debate, concerning the impacts of demographic growth on natural resources. Prospective scenarios are simulated and their consequences on natural vegetation surfaces are assessed: these scenarios simulate emigrations of a part of the population towards other areas, the implementation of protected areas, a demographic regulation and an ecological intensification of farming systems.The second aspect concerns decisional processes of farmers in order to constitute their crops rotations. The study consists in understanding the important variations of cultivated species, observed during the studied period, by analyzing the simulated weight evolution of different determining factors involved in the decisional processes.Finally, we show that anthropic processes footprints are explicitly detectable in remote sensing images, by using multi-scalar simulations of the model developed. Then, we create an assimilation of satellite data in the model in order to re-calibrate it and reinforce its abilities to reproduce past dynamics. This last part opens important perspectives concerning the joint use of remote sensing data and agro-ecosystems dynamics
