Abstract:

Abstract:
At the end of the nineteenth century many Western artists were fascinated and influenced by Oriental and, in particular, by Japanese art. That tendency, called Japonisme, began with the Universal Exposition of London in 1851, where Chinese and Japanese art was introduced with great success. Japonisme spread easily across West, charming it. It extended soon to literature, poetry and theatre. American and European artists found in Oriental art, culture and tradition a suitable means for the renewal of their artistic expression. Why Western art was not suitable to outline its expressions anymore? Why artists felt the need to find their renewal of the forms in Japan’s traditions? This is what my research is about. Through the literary, poetic and theatrical productions of Ernest Fenollosa, Ezra Pound and William Butler Yeats, I intend to draw a critical path paying attention to the cultural, theoretical and textual reasons. They devoted their artistic life to the search for a renewal of the contemporary poetic form by means of the discovery of Oriental and mainly Japanese culture

Abstract:
The recording of the planning, executive and transformative processes of significant rationalist architectures in Forlì aims at providing a useful contribution for a deep knowledge of this heritage with the purpose of its future transmission. Starting from the archive sources and getting to the direct reading of the buildings, the study focuses on the Fascist period and it provides documentary evidence of four architectures in Forlì: the Casa del Balilla, the Santarelli Kindergarten, the Industrial Technical Institute and the Aeronautical College. Nevertheless, the detailed study of built architectures is necessary but not enough to guarantee the safeguard of a unique and unrepeatable heritage: a solid investigation of knowledge doesn’t make sense without a methodological order. Placing itself in the scenario of the restoration of the 20th century heritage, the research develops the topic from a point of view that has been little explored: the relationship between Modernity and Restoration. Indeed, although the thesis draws attention to the issues concerning the materiality and the transformation of significant rationalist architectures in Forlì, it provides a broader overview of the encounter with modernity in order to wonder whether restoration could be an expression of it. The investigation first gets to a reflection that involves the critical-methodological questions of the operation and then deepens the technical-operational aspects of the intervention that are the direct consequence of the orientation of method. It is the solicitations which the ferments of modernity can offer to the present that emerge configuring restoration as an effective expression of it. The aim is to outline a picture of deep knowledge of relevant material proofs in Forlì and to develop a treatise that might be useful, in theoretical and operative terms, to the identification of strategies oriented to the conservation and contemporary use of the 20th century architecture.

Abstract:
The aim of this project is directed to the study of mechanisms and rules of the auxilium in delictum according to the principles and the criminal law institutions of the 16th Century. During the 16th century, a new method finalized to the systematic analysis of the law has been put in place. In the meantime, will start the process of reorganization of the law system that will lead to the formation of the generalia delictorum. By using of expression, jurists of the late jus commune refer to the principles, the rules and the institutions of criminal law. This work will try to reconstruct, from this background and with these coordinates, the issue of the criminal liability coming from auxilium in delictum according to the theories of the 16th Century’s jurists. The 16th Century’s criminal liability features will be the subject of this work’s first part. In this context will be analyzed the issue related to the imputatio facti alieni in delictis. To investigate this matter will be first taken in consideration the objective structure of the crime and, then, the subjective one. To better understand the crime phenomenon, so, will be necessary to analyze the mechanisms which leaded to the co-responsible charge. For these reasons the first chapter will be dedicated to the to the general concept of “guilt”. The purpose of the chapter is to clarify the principles with which the 16th century’s jurists dealt with the issue of the auxilium in delictum. The second chapter will approach the concept of mandatum. Analyzing this legal principle will lead to important reflections on the objective and subjective structure of the auxilium in delictum. The third chapter will tackle the ratihabitio discipline and the fourth the consilium discipline.

SITE, C. DELLE. "LA SACRA ROTA ROMANA E LE SUE DECISIONI IN MATERIA COMMERCIALE NEL XVII SECOLO." Doctoral thesis, Università degli Studi di Milano, 2012. http://hdl.handle.net/2434/168357.

Abstract:
The purpose of the work, divided into three chapters, is to provide a contribution on how the trade has evolved in the seventeenth century, with particular attention to the “decisiones” of the Tribunal of the Sacra Rota Romana. The whole trade was governed by custom and practice that merchants were accustomed to use in their trade but, only in the sixteenth century, with the revolutionary instrument of the press began to circulate the first treaties, including those written by Santerna and by Stracca. The merchant class was not having a good reputation in ecclesiastical circles, and probably also this was the reason because we needed to wait long time before being able to find the first specific works that are only interested in commercial law. In view of such aspect is particularly interesting to investigate how the Roman Courts have dealt with the whole commercial subject that belong at that world of merchants in constant expansion. The first chapter is intended primarily to highlight how the Sacra Rota Romana has had an extensive expertise in trade issues and has helped to consolidate with its judgments those commercial practices which were carried out by economic operators. It will provide the reader with an overview of the institutions of commercial law which were dealt with. First of all the writings of merchants and their probative value with the consequent need for a merchant who wanted to serve their own book in legal proceedings. In this case, the document must be fitted with some elements called “adminicula” that allowed it to purchase a full evidentiary value in their favor. Will be then examined problems related to “corsa” and piracy and how religious factors affected such processes; then the reserch will deal with judgments about the company and in particular the delicate theme of usury compared to economic issues. On this special topic will be analyzed the ways in which could be compensated for loss of earnings and the actual damage. The second chapter analyzes the establishment of marine insurance extremely used in the seventeenth century and as the Sacra Rota Romana has disciplined this contract strictly commercial, With special attention to its classification, and the problems refered at the compensation for the damages ad the risk. The third chapter deals with the establishment of exchange and “litterarum cambii” and intends to focus on how the Roman Court will be compared to this contract in consideration of the obvious implications in terms of usury. Ultimately it aims to provide an insight into how was administered the commercial life in seventeenth-century Rome, paying attention to: 1) jurists invoked within the same “decisiones”: Baldo and Bartolo, through Santerna and Stracca till the contemporary Scaccia and De Luca 2) judgments from other courts and particularly the Genoese one.

Abstract:

The aim of this study is, as the title of the research makes clear, the ownership issue in the territories of Saint Peter, implying with this expression the legal discussion about the notion of property in its two different perspectives: the private property and the collective property. In terms of time, the study runs from the 18th century – period in which the owner issue was discussed across Europe – to the present day. In terms of geographical location, the research focuses on the territories of Saint Peter whose borders coincide approximately with those of central Italy. The work will present, as the sub-title suggests, a constantly evolving itinerary in understanding of the ownership issue. The end point of this itinerary will be the recovery of the community dimension in the relationship with the environment as an alternative to private property.

Abstract:

Abstract:
The study is made from the complete reconstruction of an industrial Italian village (textile industry) in the 19th century: Follina, in Venetia. In the 19th century, the local population rose from 1,200 inhabitants to nearly 1600. Kinship is called to report empirically its role in the transmission of the values and social capitals with regard to the community context. Kinship is observed by its ability to influence interpersonal and intergenerational relationship. Thesis' narrative is divided into two parts. On the one hand an analysis of context, relationships and positions, in an almost microhistorical way, on the other hand more sophisticated analysis using methods of formal Social Network Analysis and methods of Event History Analysis. Analyses focus on demographic events such as marriage, migration, death and birth control (source population registers). Through studies on the godparenthood relation, as an important social relation, it is possible to estimate in an original way the quality of the kinships' practices. The survey goes to the sense to place each actor (families, individuals) in the exact "availability" and the "quality" which he has in the village. While considering other variables such as socio-economic, gender, age, it could be observe what are the priorities given in families, how to define the demographic choices and availability of kin when managing the emergencies and mutual support.

Abstract:
Key Message Ontario long-term care (LTC) home residents have experienced disproportionately high morbidity and mortality, both from COVID-19 and from the conditions associated with the COVID-19 pandemic. There are several measures that could be effective in preventing COVID-19 outbreaks, hospitalizations, and deaths in Ontario’s LTC homes, if implemented. First, temporary staffing could be minimized by improving staff working conditions. Second, homes could be further decrowded by a continued disallowance of three- and four-resident rooms and additional temporary housing for the most crowded homes. Third, the risk of SARS-CoV-2 infection in staff could be minimized by approaches that reduce the risk of transmission in communities with a high burden of COVID-19. Summary Background The Province of Ontario has 626 licensed LTC homes and 77,257 long-stay beds; 58% of homes are privately owned, 24% are non-profit/charitable, 16% are municipal. LTC homes were strongly affected during Ontario’s first and second waves of the COVID-19 pandemic. Questions What do we know about the first and second waves of COVID-19 in Ontario LTC homes? Which risk factors are associated with COVID-19 outbreaks in Ontario LTC homes and the extent and death rates associated with outbreaks? What has been the impact of the COVID-19 pandemic on the general health and wellbeing of LTC residents? How has the existing Ontario evidence on COVID-19 in LTC settings been used to support public health interventions and policy changes in these settings? What are the further measures that could be effective in preventing COVID-19 outbreaks, hospitalizations, and deaths in Ontario’s LTC homes? Findings As of January 14, 2021, a total of 3,211 Ontario LTC home residents have died of COVID-19, totaling 60.7% of all 5,289 COVID-19 deaths in Ontario to date. There have now been more cumulative LTC home outbreaks during the second wave as compared with the first wave. The infection and death rates among LTC residents have been lower during the second wave, as compared with the first wave, and a greater number of LTC outbreaks have involved only staff infections. The growth rate of SARS-CoV-2 infections among LTC residents was slower during the first two months of the second wave in September and October 2020, as compared with the first wave. However, the growth rate after the two-month mark is comparatively faster during the second wave. The majority of second wave infections and deaths in LTC homes have occurred between December 1, 2020, and January 14, 2021 (most recent date of data extraction prior to publication). This highlights the recent intensification of the COVID-19 pandemic in LTC homes that has mirrored the recent increase in community transmission of SARS-CoV-2 across Ontario. Evidence from Ontario demonstrates that the risk factors for SARS-CoV-2 outbreaks and subsequent deaths in LTC are distinct from the risk factors for outbreaks and deaths in the community (Figure 1). The most important risk factors for whether a LTC home will experience an outbreak is the daily incidence of SARS-CoV-2 infections in the communities surrounding the home and the occurrence of staff infections. The most important risk factors for the magnitude of an outbreak and the number of resulting resident deaths are older design, chain ownership, and crowding. Figure 1. Anatomy of Outbreaks and Spread of COVID-19 in LTC Homes and Among Residents Figure from Peter Hamilton, personal communication. Many Ontario LTC home residents have experienced severe and potentially irreversible physical, cognitive, psychological, and functional declines as a result of precautionary public health interventions imposed on homes, such as limiting access to general visitors and essential caregivers, resident absences, and group activities. There has also been an increase in the prescribing of psychoactive drugs to Ontario LTC residents. The accumulating evidence on COVID-19 in Ontario’s LTC homes has been leveraged in several ways to support public health interventions and policy during the pandemic. Ontario evidence showed that SARS-CoV-2 infections among LTC staff was associated with subsequent COVID-19 deaths among LTC residents, which motivated a public order to restrict LTC staff from working in more than one LTC home in the first wave. Emerging Ontario evidence on risk factors for LTC home outbreaks and deaths has been incorporated into provincial pandemic surveillance tools. Public health directives now attempt to limit crowding in LTC homes by restricting occupancy to two residents per room. The LTC visitor policy was also revised to designate a maximum of two essential caregivers who can visit residents without time limits, including when a home is experiencing an outbreak. Several further measures could be effective in preventing COVID-19 outbreaks, hospitalizations, and deaths in Ontario’s LTC homes. First, temporary staffing could be minimized by improving staff working conditions. Second, the risk of SARS-CoV-2 infection in staff could be minimized by measures that reduce the risk of transmission in communities with a high burden of COVID-19. Third, LTC homes could be further decrowded by a continued disallowance of three- and four-resident rooms and additional temporary housing for the most crowded homes. Other important issues include improved prevention and detection of SARS-CoV-2 infection in LTC staff, enhanced infection prevention and control (IPAC) capacity within the LTC homes, a more balanced and nuanced approach to public health measures and IPAC strategies in LTC homes, strategies to promote vaccine acceptance amongst residents and staff, and further improving data collection on LTC homes, residents, staff, visitors and essential caregivers for the duration of the COVID-19 pandemic. Interpretation Comparisons of the first and second waves of the COVID-19 pandemic in the LTC setting reveal improvement in some but not all epidemiological indicators. Despite this, the second wave is now intensifying within LTC homes and without action we will likely experience a substantial additional loss of life before the widespread administration and time-dependent maximal effectiveness of COVID-19 vaccines. The predictors of outbreaks, the spread of infection, and deaths in Ontario’s LTC homes are well documented and have remained unchanged between the first and the second wave. Some of the evidence on COVID-19 in Ontario’s LTC homes has been effectively leveraged to support public health interventions and policies. Several further measures, if implemented, have the potential to prevent additional LTC home COVID-19 outbreaks and deaths.

Abstract:
Administering Pfizer-BioNTech’s COVID-19 vaccine during the early stage of the vaccine rollout (January/February 2021) to as many individuals as possible would prevent more COVID-19 cases in Ontario as compared to reserving half of the initial allotments as second booster doses (Figure 1). On-label use of the vaccine with the administration of two doses is important, as the second dose significantly boosts the immune response and results in a substantial increase in neutralizing antibodies. However, using 100% of the initial allotments immediately to vaccinate as many individuals as possible does not preclude on-label use with two doses, even though the interval between first and second booster dose may become longer than 21 days.

Tennant, David. Business Surveys on the Impact of COVID-19 on Jamaican Firms. Inter-American Development Bank, May 2021. http://dx.doi.org/10.18235/0003251.

Full text
Abstract:
The datasets come from two surveys of Jamaican businesses conducted between May and June 2020. Two sets of self-administered surveys were conducted using Survey Monkey. A very small sample of financial institutions was surveyed to gain perspective on the challenges facing financiers as a result of the pandemic, and their efforts to respond to such challenges. Nine financial institutions completed this survey, and the results were used to complement the information derived from the second and major survey. The second survey targeted non-financial businesses operating in Jamaica. The sample of firms was selected from a list of all registered Jamaican firms, obtained from the Companies Office of Jamaica. A stratified random sample was used based on firm type, region, and sector. Some firms may have also participated in the study through contact made by their respective affiliations, which were approached to endorse the study and encourage their members to engage. A total of 390 firms completed the second survey. A significant degree of representation was achieved across size, type and age of business, sector and location of operation. Good gender representation was also achieved.
