Carl Schmitt hat sich einer öffentlichen Klärung seiner Haltung in der NS-Zeit verweigert. Allerdings unternahm Schmitt nach 1945 eine Art indirekter Beichte in Form eines Berichts, gerichtet an den prominenten Jesuiten Przywara: Spiegelung des eigenen Selbst in der Rolle eines Kapitäns, auf dessen Schiff das Kommando in Wahrheit längst von den meuternden Sklaven übernommen worden ist (nach Melville, Benito Cereno). Annäherungsversuche an das katholische intellektuelle Milieu blieben ohne Resonanz. Der Briefwechsel mit Rudolf Smend dokumentiert die Hochachtung für Schmitts wissenschaftliche Leistungen bei gleichzeitiger Reserviertheit hinsichtlich der von Schmitt eingenommenen politischen Rolle. Von den eigenen Schülern gedrängt, geht Smend widerwillig schließlich stärker auf Distanz zu Schmitt. Der Sündenbockmythos wurde im Laufe der Zeit immer kompakter. Walter Benjamins Dankbarkeit für Schmitts Anregungen wird in der linken Szene zunächst als peinlich übergangen. Fasziniert von der starken eschatologischen Dimension im Werk Schmitts hat der jüdische Philosoph Jakob Taubes, Exponent einer linken Eschatologie „von unten“, den Kontakt zu Schmitt gesucht. Taubes, der die erheblichen Differenzen mit Schmitt nicht verschleiert, beruft sich ausdrücklich auf die höhere ethische Dignität von Verzeihung und Nachsicht. In diesem Horizont werde es möglich, die Stärken der Theorie Schmitts zu würdigen und ihre dunklen Seiten auszuhalten.

Un comentario habitual en los estudios acerca de la obra de Carl Schmitt es que su concepto de lo político oscila entre la nostalgia por el Estado fuerte de la era westfaliana y la convicción de que la escena política contemporánea ha cambiado irremediablemente al poblarse con nuevos actores, tanto estatales como no estatales. A pesar de esta ambivalencia hay vetas importantes que vale la pena desarrollar pensando con Schmitt y a la vez contra él, sea navegando a través de su teoría de lo político, sin avalar todas las consecuencias que extrae de ellas, o llevando su reflexión en una dirección que no contempló o en la cual no pudo o no quiso ir. En este trabajo discutiré algunas de las tensiones en su reflexión –la naturaleza del nexo entre guerra y política, al estatuto del enemigo y el argumento normativo acerca del orden como bueno en sí mismo– para luego examinar su distinción entre la política y lo político –tal vez su aporte más original y duradero al pensamiento político contemporáneo– y desarrollar el tema de la doble inscripción de lo político.

Ich beginne mit einem Detail. «Manchmal», so Franco Moretti, lässt seine [meine] Sprache «an Carl Schmitt denken»: «Die Ausnahme ist interessanter als der Normalfall.» Moretti weist sofort darauf hin, dass mein Ansatz weltanschaulich meilenweit von Carl Schmitts entfernt ist. Zur Geschichte dieses Diktums gehört, dass Schmitt mit seiner Äußerung über die Ausnahme in einer Politischen Theologie einen Absatz eines nicht namentlich genannten «protestantischen Theologen» kommentiert. Dass es sich bei diesem um Sören Kierkegaard handelt, ist kein Geheimnis. Der zitierte Abschnitt stammt aus Kierkegaards Schrift Die Wiederholung – Schmitt lässt jedoch stillschweigend drei Sätze daraus unter den Tisch fallen.1 Zunächst fasst Kierkegaard die Beziehung zwischen Ausnahme und Regel ontologisch auf – doch dann legt er plötzlich ihr erkenntnistheoretisches Potential offen: «und wenn man das Allgemeine so richtig studieren will, braucht man sich bloß nach einer berechtigten Ausnahme umzusehen; sie zeigt alles viel deutlicher auf als das Allgemeine selbst.»

Der Artikel rekonstruiert die Geschichte von Carl Schmitts Reichsbegriff. Die historische Situation im Frühjahr 1939 hatte Einfluss auf den Weg seines juristischen Werks. Der Reichsbegriff war Thema eines Vortrags, den Schmitt in das Zentrum seiner „Völkerrechtlichen Großraumordnung“ stellte. Diese im April 1939 erschienene Publikation wurde nach Ausbruch des Krieges mehrfach ergänzt. Der Abschnitt zum Reichsbegriff blieb unverändert. Schmitt unterstützte mit seinen Beiträgen zum Völkerrecht den aggressiven Weg der NS-Politik, der zum Ausbruch des Krieges im September 1939 führte. In einem Essay vom Mai 1939 über das Reich und den Untergang der europäischen Kultur zitierte er frühere Veröffentlichungen. Sie hatten ihn zu einem neuen völkerrechtlichen Gedanken geführt. Reiche, nicht Staaten sollten Träger des Völkerrechts sein. An diesem Gedanken hielt Schmitt auch während des Krieges fest. Sein Essay ist ein Selbstportrait des Juristen Schmitt. Seine Gegner erhoben den Vorwurf mangelhafter Weltanschauung. Sie forderten eine „völkische Großraumordnung“. Im Zweiten Weltkrieg schloss sich Schmitt nicht Ereignissen an, die der Ideologie vom „Lebensraum“ Taten folgen ließen. Mit dem Begriff „Ereignisse“ wurden 1941/42 Kriegsverbrechen in den „Ereignismeldungen UdSSR“ benannt. Die Stäbe des „Reichssicherheitshauptamts“ werteten sie aus. Schmitt ließ den Zusammenhang dieser Verbrechen mit dem Typus des totalen Staats unbeachtet. The article reconstructs the history of Carl Schmitt's concept of the Reich. The historical situation in the spring of 1939 had an influence on the path of his legal work. The concept of empire was the subject of a lecture that Schmitt placed at the center of his “Völkerrechtliche Großraumordnung”. This publication, which appeared in April 1939, was supplemented several times after the outbreak of World War II. The section on the concept of empire remained unchanged. Schmitt's contributions to international law supported the aggressive course of Nazi policy before September 1939. In a May 1939 essay on the Reich and the Decline of European Culture, he cited earlier publications. They had led him to a new idea of the causal connection between empires and international law. Schmitt held on to it even during the war. His essay is a self-portrait of the jurist Schmitt. His opponents raised the accusation of a deficient world view (Weltanschauung). They demanded a "völkische Großraumordnung". In the Second World War, Schmitt did not join events (Ereignisse) that gave action to the ideology of Lebensraum. The term "Ereignisse" was used in 1941/42 to name war crimes in the "Ereignismeldungen UdSSR". The staffs of the Reich Security Main Office (Reichssicherheitshauptamt) evaluated them. Schmitt ignored the connection of these crimes with the type of the total state.

Zusammenfassung Der Artikel befasst sich mit dem Wandel von Rauminterpretationen und Europavorstellungen in der deutschen Mediävistik und dem Völkerrecht in den 1940er Jahren am Beispiel des Hansehistorikers Fritz Rörig und Carl Schmitts. Ausgehend von den Diskussionen zwischen Rörig und Schmitt um die Figur des Piraten, die aus ihrer Bekanntschaft aus dem „Kriegseinsatz der Geisteswissenschaften“ entstand, wird nach den Verschränkungen geschichtswissenschaftlicher Konzepte mit zeitpolitischen Fragestellungen gefragt. Unser Beitrag zeigt, dass die als Fragmentierung erfahrene Kriegsniederlage von 1918, der Nationalsozialismus, aber besonders die Kriegserfolge zu Beginn des Zweiten Weltkrieges für Intellektuelle wie Schmitt und Rörig katalytisch wirkten, um sich vom Nationalstaat als konstantem Bezugspunkt zu lösen und historische Phänomene mit Begriffen jenseits des Staats zu fassen. Er argumentiert, dass der Schlüssel zu diesem Wandel im relativen Raumverständnis Schmitts und Rörigs lag, nach dem Räume durch soziale Operationen konstituiert wurden. Während Schmitt mit seiner „völkerrechtlichen Großraumordnung“ überstaatliche Reiche zu Völkerrechtssubjekten aufwertete, gelangte Rörig in enger Korrespondenz zu einer Neubewertung des Verhältnisses von Raum, Reich, Hanse und Europa. An die Stelle einer national verstandenen Hanse, die Teil einer protoglobalisierten Weltwirtschaft gewesen sei, verstand er sie nun als Träger eines europäischen Großraumes. Die Vagheit dieser Konzepte ermöglichte ihre Umschreibung nach 1945. Während die Raum- und Reichskonzepte in den 1990er Jahren erst neu entdeckt wurden, setzten die sich von Rörig zur Legitimation des deutschen Eroberungskrieges vorgebrachten Ansätze, historische Phänomene wie die Hanse nicht mehr in einem nationalen, sondern spezifisch europäischen Rahmen zu fassen, nahtlos durch.

O artigo se propõe a sustentar a atualidade do pensamento schmittiano no que concerne ao conceito de guerra e a sua atual transição para a noção de guerra global. Schmitt previu, com grande clarividência, aquilo que começou a ocorrer nos últimos anos do século XX e que continua se desenvolvendo ainda mais nos dias atuais: uma “guerra global” assimétrica, conduzida pelas grandes potências dotadas de meios de destruição em massa, in primis por parte das potências capitalistas e liberais anglosaxônicas. Ao final, ver-se-á que se trata de uma guerra total, não mais submetida a limitações jurídicas e, portanto, absolutamente destrutiva, mas, todavia, considerada não somente “justa” como também “humanitária”, pois é concebida como uma ação de polícia internacional contra os inimigos da humanidade: contra os novos bárbaros e os novos piratas.

Notre actualité nous interroge sur la compréhension de la guerre et sur le statut de ses relations avec la politique. Ce travail examine cette question et il le fait à partir des réflexions de Michel Foucault sur le sujet. En nous appuyant aux manuscrits inédits du philosophe, conservés dans les archives du « Fonds Foucault » à la Bibliothèque nationale de France, nous montrons que les analyses foucaldiennes sur ce thème, qui n'ont pas toujours reçu la juste attention, jouent en réalité un rôle déterminant dans l’œuvre de l'auteur. À partir de cette première investigation l’on a développé un deuxième parcours de recherche, lié au précédent : les réflexions de Foucault sont mises en relation avec celles de Carl Schmitt – une comparaison entre deux différentes généalogies qui a rarement été établie, sur laquelle la littérature critique reste encore très modeste aujourd'hui. Compte tenu des matériaux non encore publiés, nous montrons que le modèle polémocritique foucaldien se construit sur la base de certaines proximités théoriques importantes autour de la formulation schmittienne de la théorie du politique et se développe comme une critique radicale de celle-ci. Penser Foucault comme critique de Schmitt se révèle non seulement décisif pour comprendre la pensée du philosophe français, mais fondamental aussi pour enquêter l’actualité de ces deux auteurs par rapport à la question de la guerre. C’est finalement ce sujet qui traverse tout au long ce travail
The issue of war, its status and its relationship to politics is one of the most pressing key problems of our time. I analyze this subject starting from the reflections of Michel Foucault. By examining the author’s unpublished manuscripts, located at the ‘Fonds Foucault’ at the Bibliothèque nationale de France, I show that although the analysis of war played a decisive role in Foucault’s thought, this subject has not always received adequate attention in scholarship. Following this first line of investigation, I then propose a second line of inquiry, which consists in putting Foucault’s reflections in relation to those of Carl Schmitt: a comparison between two different genealogies which has rarely been examined and on which the critical literature is still scant today. Considering the unpublished materials, I show that the Foucaultian’s polemocritical model has some relevant theoretical proximity to the Schmittian theory of the political, and in fact develops as a radical critique of it. Rethinking Foucault as a critic of Schmitt proves to be not only important in order to understand the French philosopher’s thought, but also fundamental to explore the relevance of these two authors on the topic of war. This is the research question that runs through the entire work
La nostra attualità ci interroga sulla comprensione della guerra e sullo statuto del suo rapporto con la politica. Questo lavoro si misura con tale questione e lo fa a partire dalle riflessioni di Michel Foucault sull’argomento. Anche grazie al riferimento ai manoscritti inediti del filosofo francese, conservati presso gli archivi del “Fonds Foucault” alla Bibliothèque nationale de France, si dimostra che le analisi foucaultiane sul tema, le quali non sempre hanno ricevuto un’adeguata attenzione, rivestono in realtà un’importanza decisiva innanzitutto all’interno dell’opera dell’autore. A partire da questo primo piano di indagine viene quindi sviluppato un secondo percorso di ricerca, intrecciato rispetto al precedente: le riflessioni di Foucault vengono messe in relazione con le posizioni di Carl Schmitt – un confronto tra due diverse genealogie che è stato raramente praticato e sul quale la letteratura critica è all’oggi ancora esigua. Tenendo conto dei materiali non ancora pubblicati, viene mostrato infatti che il modello polemocritico foucaultiano si costruisce sulla base di alcune rilevanti prossimità teoriche rispetto alla formulazione schmittiana della teoria del politico e si sviluppa come una critica radicale verso questa. Pensare Foucault come critico di Schmitt si rivela non solo importante ai fini della comprensione del pensiero del filosofo francese, ma anche fondamentale per indagare l’attualità dei due autori rispetto alla questione della guerra. È questa infatti la domanda di ricerca che percorre sottotraccia l’intero lavoro

Abstract:
This study will address the life and work of Carl Schmitt, highlighting his legal theory, his relationship with the Nazi regime and the impact of his ideas on the process of Nazification of German law. Schmitt was a controversial thinker of the 20th century, whose legal reflection was intertwined with his political ideas and the historical context of his time. His theory of decisionism established a direct correlation between Law and Sovereignty, questioning formal normativism and liberalism. Despite being criticized for his affiliation with the Nazi party in 1933, his legal work is considered profound and coherent, deserving scientific study independent of ideologies. During the Weimar Republic, Schmitt feared the crisis and fragmentation of the German State and defended exceptional powers for the President of the Reich. The rise of the Nazis to power surprised him, but he tried to realize his constitutional theory of the "Total State", which ended up influencing the Nazification of law. The use of general clauses and vague concepts allowed the interpretation of norms in accordance with the Nazi worldview. Schmitt argued that judges should fill out the content of the clauses in accordance with the Führer's vision, aligning the courts' actions with the interests of the German people. Schmitt's relationship with the Nazi regime was ambiguous, oscillating between moments of support and distrust of Hitler. The work highlights the importance of historical contextualization to understand Schmitt's reflections and the impact of his ideas on the application of law during the Nazi period. The research seeks to offer a critical and independent analysis, aiming to deepen the understanding of the thinker and his legacy, which still resonate in contemporary debates on law and politics.

Unquestionably (or: undoubtedly), every competent speaker has already come to doubt with respect to the question of which form is correct or appropriate and should be used (in the standard language) when faced with two or more almost identical competing variants of words, word forms or sentence and phrase structure (e.g. German "Pizzas/Pizzen/Pizze" 'pizzas', Dutch "de drie mooiste/mooiste drie stranden" 'the three most beautiful/most beautiful three beaches', Swedish "större än jag/mig" 'taller than I/me'). Such linguistic uncertainties or "cases of doubt" (cf. i.a. Klein 2003, 2009, 2018; Müller & Szczepaniak 2017; Schmitt, Szczepaniak & Vieregge 2019; Stark 2019 as well as the useful collections of data of Duden vol. 9, Taaladvies.net, Språkriktighetsboken etc.) systematically occur also in native speakers and they do not necessarily coincide with the difficulties of second language learners. In present-day German, most grammatical uncertainties occur in the domains of inflection (nominal plural formation, genitive singular allomorphy of strong masc./neut. nouns, inflectional variation of weak masc. nouns, strong/weak adjectival inflection and comparison forms, strong/weak verb forms, perfect auxiliary selection) and word-formation (linking elements in compounds, separability of complex verbs). As for syntax, there are often doubts in connection with case choice (pseudo-partitive constructions, prepositional case government) and agreement (especially due to coordination or appositional structures). This contribution aims to present a contrastive approach to morphological and syntactic uncertainties in contemporary Germanic languages (mostly German, Dutch, and Swedish) in order to obtain a broader and more fine-grained typology of grammatical instabilities and their causes. As will be discussed, most doubts of competent speakers - a problem also for general linguistic theory - can be attributed to processes of language change in progress, to language or variety contact, to gaps and rule conflicts in the grammar of every language or to psycholinguistic conditions of language processing. Our main concerns will be the issues of which (kinds of) common or different critical areas there are within Germanic (and, on the other hand, in which areas there are no doubts), which of the established (cross-linguistically valid) explanatory approaches apply to which phenomena and, ultimately, the question whether the new data reveals further lines of explanation for the empirically observable (standard) variation.

In the spring of 2021, the Danish Borderland Association published the book Danskerne findes i mange modeller – portrætter af 15 unge med bindestregsidentitet by Marlene Fenger-Grøndahl. The book consists of fifteen interviews with young so-called cultural ambassadors of the Borderland Association, as well as essays on the history of the Danish-German borderland and the concept of a hyphenated identity that the young respondents refer to. In minority research, the concept of a hyphenated identity is both used and contested. However, the interviews underline that the concept can serve as an important backdrop for the empowerment of young people with minority identities. The aim of the research is to identify the elements of the psycholinguistic image of the leading character in the dark fantasy adventure film Maleficent directed by Robert Stromberg (2014). The task consists of two stages, at the first of which I identify the psychological characteristics of the character to determine to which of the archetypes Maleficent belongs. As the basis, I take the classification of film archetypes by V. Schmidt. At the second stage, I distinguish the speech peculiarities of the character that reflex her psychological image. This paper explores 98 Maleficent’s turns of dialogues in the film. According to V. Schmidt’s classification, Maleficent belongs first to the Matriarch archetype and later in the plot to the Scorned Woman archetype. These archetypes are representations of the powerful goddess of marriage and fertility Hera, being respectively her heroic and villainous embodiments. There are several crucial characteristics revealed by speech elements.
