Full textOften invoked in actions for damages before the Court of Justice of the European Union to overcome obstacles to the engagement of the European Union's extra-contractual liability, nofault liability is a vague concept whose definition, nature and very existence are contested. However, the study of this concept, based on the case law of the Court of Justice of the European Union, reveals an original Praetorian construction based on the influence of national laws on public liability. Liability without fault has acquired, with the judgments of the Court of Justice and the Court of First Instance, a consistency which makes it appear to be a legal category comprising several liability regimes in which proof of wrongful activity by the institutions of the European Union or its agents is not necessary to engage in non-contractual liability. However, no-fault liability is hardly an effective legal remedy available to individuals because of the judge's reluctance to expressly recognize it as a principle of extra-contractual liability and because of the rigorous interpretation of the conditions of its validity

Full textScientific progress is accompanied by increasing risks. Patients are exposed to medical errors and must take action against medical professionals in order to obtain reparation for the harm suffered. In principle, the patrician is held by a best effort undertaking. However, the legislator, pursuing jurisprudence, has allowed for two exceptions to sujective responsability. Firstly, doctors and health establishments are fully lagally responsible when harm is due to a fault with a medical product. Secondly, the health establishments are fully legally responsible for harm resulting from hospital-acquired infections

Full textCause of liability has been one of the most discussed questions since the principle of administrative irresponsibility was given up. Sometimes seen as a general principle of explanation, sometimes as a legal rule, cause of liability is an element of justification. In order to clarify the discourse on liability, cause of liability has to be distinguished from principles which justify the legal rule of liability. For doctrine and jurisprudence, the risk theory and the principle of public expenses equality are the two causes of liability. This presentation has to be renewed because of the creation by the Conseil d’Etat of cases of liability in which the proof of a fault is not compulsory but which do not relate to classical cases. A new presentation with two categories based on the notion of obligation should be preferred. When the event giving rise to the damage ignores a pre-existing obligation it is a true system of responsibility but when the event giving rise to the damage doesn’t ignores such an obligation it is a mechanism of guarantee and not a system of responsibility. “Liability without fault” is a negative category with no unity and no specific causes. Fault is only a condition of liability: liability with fault and liability without fault are not different in nature

Full textResponsibility without blame plays a very noticeable role in the french courts of administration. Owing to the particularities of its construction and the fact that it occupies a considerably greater space than in civil law, responsability without blame in administrative law is all the more significant because of the wide diversity of fields in which it is applied. It seems to have more empirical than logical origins, or at least, this is what one can deduce, from the great variety of instances where one can observe it. But a study in greater depth of the area of responsability without blame leads one to note the methodical reasoning, the precision, the scrupulous undertakings of the judge. The area is significantly more homogenous than it seems. The highlighting of the various elements pointing to this cohesion allows us to better understand the capacity of this responsibility to develop itself

Full textThe question of the state’s responsibility towards international engagements is subject to jurisprudential evolutions. In 2011, the Counsel of the State dedicated the responsibility without fault due to the international customs. These dedications provoked a debate about the founded assimilation between the responsibility of the acts of laws and the responsibility due to the international conventions. Concerning this, one must turn to the past: the system of responsibility based on the occurrences of international conventions inaugurated with the stop of the company of radio electric energy. In 1966, the Counsel of the State overtook the problem of the theory of government act and constituted a system of responsibility based on the principle of equality before the public charges. The rule of reparation is not destined to repair the damages directly resulting from the convention, but those caused by its application. It only concerns the abnormal and particular damages. This state of responsibility was accepted under the close terms of the system of responsibility on the acts of laws.Today and with the jurisprudential evolution, a disassociation operates between the responsibility of actions on international engagements and the responsibility of the acts of law. It seems possible to sanction independence from the system of responsibility of actions of international engagements and that of law

Full textCommitted in disregard of the precautionary principle, the fault of precaution has not been enshrined in legal terms and has not been the subject of any in-depth study in public law. It is therefore a question of defining the characteristics of the precautionary fault, to identify the variants and invariants, taking into account the precautionary principle which, constituent of a standard, of a norm with constitutional, legislative, customary value, at the origin of multiple obligations, has different legal sources, written and unwritten, as the law of liability of public authorities, mainly case law. The characteristics and reception of the precautionary fault reveal that it comes from the sovereign will to protect the environment or health. What determines the meaning and scope of the fault of precaution in the light of its consequences, its legal and moral implications as questions inherent to the attributability of harm. Like the separation of powers, the existing legal risk tainted with scientific uncertainty as to its reality and scope, is a central notion of the law of liability which leads to rhetorical uses of the precautionary principle. This thesis provides a critical analysis of liability law for fault of precaution, based on the current state of scientific and doctrinal knowledge

Full textPublic liability evolves and a lot of systems of compensation cannot be filed in the usual classification of this field. To remedy this problem, the thesis suggests creating a new legal category: liability without act. This one contains systems of public liability within which the victim is exempt from proving an act imputable to the person responsible. Twenty very different systems are presently filed there. Their analysis makes understanding of historical evolution of liability without act possible. The creation of liability without act produces three types of consequences which must be considered. First, it plays a particular part in compensation for victims. Second, it affects present categories of public liability which are fault-based liability and liability without fault. Finally, it is the beginning of a reconstruction of the structure of public liability. In fact, this field can be presented thanks to the distinction fact-based liability / liability without act

Full textThe aim is to analyze the junction of general principles of law at European level. this study is limited to the general principles of the right to these two legal cultures, to the principles accepted by the jurisprudence and imposing itself on the administration and its relations with individuals. it will thus be necessary to answer several questions, including: do general principles of law really tend to converge? Is it necessary to detect a uniformity of law under the influence of the general principles of European rights or does it make it possible to emphasize that certain principles are "universal"? if not, why do certain principles remain specific to certain legal systems? should we not see in European rights the possibility of enriched by the general principles of rights of extranational origin? but also to share the general principles of French law? /
Pouillaude, Hugo-Bernard. "Le lien de causalité dans le droit de la responsabilité administrative." Thesis, Paris 2, 2011. http://www.theses.fr/2011PA020054/document.
Full textCausal relationship is a central term in the law of administrative responsibility. Between fault and prejudice, the examination of causal relationship is an essential element of justice and constitutes an unavoidable intellectual requirement. It allows the judge to give an order which is both rational and just to facts. Reputed to be impenetrable, suspected of arbitrariness, driven into alleged decline by the development of the logic of insurance, causal relationship has never formed the object of a full-fledged study in public law. The analysis of the notion of causal relationship allows us to correct the image above. It first reveals that we have to distinguish the metaphysical problem of causality from the pragmatic question of causal explanation. The nature of the problem posed by these two questions is different. The question that is put to the judge is modest : give a rational explanation to facts without looking for the truth. It secondly allows to observe that the causal relationship, if it does not come close to being an objective observation of facts, does not bear the imprint of a specific subjectivity with regard to other indeterminate notions in law. The study of the practice of causal relationship bears witness to this. The administrative judge has an ordered approach of the causal relationship founded on a balance between attachment to the materiality of facts and the finality of causal explanation. In the identification of a cause, in the prioritization of multiple causes or in fixing damages, administrative jurisprudence is characterized by this freedom, which is in conformity with the Blanco ruling, in the determination of a jurisprudential policy that causal relationship sometimes renders possible, but which it only follows most often

Full textNuclear energy always caused the polemic. Whereas some consider that a “sure” nuclear energy could contribute to ensure at the same time a better safety of the energy supplies and a reduction of the greenhouses gas emissions, others reproach its several types of risks, particularly, the nuclear accidents, the nuclear waste control, the non-proliferation and the terrorist attacks or even armed against civil nuclear installations. Actually, return of the experience of the most catastrophic nuclear accidents in history (Three Mile Island (the United States) in 1979, Tchernobyl (former USSR) in 1986 and FukushimaDaiichi (Japan) in 2011), showed that serious nuclear accidents can have a variety of potentially far-reaching effects (very often transboundary) for people, property and the environment. The Fukushima accident confirmed once again the need to improve the existing rules of international nuclear energy law to put in place a global nuclear liability regime that addresses all of the states that may be affected by a nuclear accident. Today’s challenge is, therefore, to guarantee an efficient, fair and harmonized repair of the different types of damage resulting from an accident occurring in a nuclear installation

Full textIn this thesis three themes related to wireless sensor networks (WSNs) are covered. The first one concerns the power loss in a node signal due to voltage droop in the battery of the node. In the first part of the thesis a method is proposed to compensate for the apparent increase in the calculated distance between the related nodes due to decrease in the energy of the signal sending node battery. A function is proposed whose arguments are the apparently observed RSS and the current voltage of the emitter node battery. The return of the function is the corrected RSS that corresponds to the actual distance amongst the connected nodes. Hence increasing the efficiency of the RSS based localization methods in WSNs. In the second part of the thesis a position estimation method for localization of nodes in a WSN is proposed. In the proposed localization algorithm anchor nodes are used as landmark points. The localization method proposed here does not require any constraint on the placement of the anchors; rather any three randomly chosen nodes can serve as anchors. A heuristic approach is used to find the relative topology with the help of distance matrix. The purpose of the distance matrix is to indicate whether or not a pair of nodes has a connection between them and in case of connectivity it gives the estimated distance between the nodes. By using the information of connectivity between the nodes and their respective distances the topology of the nodes is calculated. This method is heuristic because it uses the point solution from the intersection of two circles instead of conventional triangulation method, where a system of three quadratic equations in two variables is used whereby the computational complexity of the position estimation method is increased. When two connected nodes have another node in common, then by using the information of distances between these interconnected nodes, two possible positions are calculated for the third node. The presence or absence of a connection between the third node and a fourth node helps in finding the accurate possibility out of the two. This process is iterated till all the nodes have been relatively placed. Once the relative topology has been calculated, we need to find the exact symmetry, orientation, and position of this topology in the plane. It is at this moment the knowledge of three nodes positions comes into action. From the relative topology we know the temporary coordinates of the nodes. By having a comparison of certain characteristics between the temporary coordinates and the exact coordinates; first the symmetry of relative topology is obtained that would correspond to the original topology. In other words it tells whether or not the relative topology is a mirror image of the original topology. Some geometrical operators are used to correct the topology position and orientation. Thus, all the nodes in the WSN are localized using exactly three anchors. The last part of the thesis focuses on the detection of faults in a WSN. There is always a possibility that a sensor of a node is not giving accurate measurements all of the time. Therefore, it is necessary to find if a node has developed a faulty sensor. With the precise information about the sensor health, one can determine the extent of reliance on its sensor measurement. To equip a node with multiple sensors is not an economical solution. Thus the sensor measurements of a node are modeled with the help of the fuzzy inference system (FIS). For each node, both recurrent and non-recurrent systems are used to model its sensor measurement. An FIS for a particular node is trained with input variables as the actual sensor measurements of the neighbor nodes and with output variable as the real sensor measurements of that node. The difference between the FIS approximated value and the actual measurement of the sensor is used as an indication for whether or not to declare a node as faulty

Full textProducts liability is the name of a field of law concerning the liability of persons who are engaged in the business of selling or otherwise distributing products who sell or distribute a defective product for harm to persons or property caused by the defect. They are strictly liable. Their liability is a kind of liability which goes beyond the traditional distinction between the contractual and tortious liability. The United-States of America and European Union have the most developed products liability laws in the world. In the United-States the American Law Institute memorialized precedential rule of strict products liability in tort in §402A of the Second Restatement of Torts, and officially promulgated it in 1965. In 1992, the American Law Institute began working on a new Restatement (Third) of Torts on the specific topic of products liability law, approving the new Restatement in 1997 and publishing it in 1998 as The Restatement (Third) of Torts: Products Liability. In Europe, Council Directive of 25 July 1985 on the approximation of the laws, regulations and administrative provisions of the Member States concerning liability for defective products (85/374/EEC) constitutes specific law of products liability of European Union member states. This directive has been transposed in French law by 19 May 1998 act and formed articles 1386-1 to 1386-18 of civil code. Fault is the only legal basis of Iranian products liability law. For solving conflicts of laws and jurisdictions which arise from international trade of products and determining the applicable law and competent jurisdiction we can implement international conventions and regulations which have been elaborated on this subject as well as traditional rules of conflicts of laws and jurisdictions of the countries

Full textThe French Law about installations (Classified Installation for Environment protection CIEP) is generally understood as a compromise between the protection of economical and environmental interests. This dissertation analyses the terms of this social contract, and, in this aim, we study the different CIEP litigations facing judicial (civil and criminal) and administrative Courts. Then, it is put into evidence the structural difficulties to achieve this goal. This is mainly due to the missing of an effective representation of the Environment in front of these Courts in spite of unquestionable progresses in Law and Constitution. This work makes proposals for the rewriting the CIEP Law by a more comprehensive integration of the fundamental roots of the sustainable development, particularly the precaution principle and the participation of the concerned people. This involves extending strict liability to the precaution

Rouillé, Louis. "Disagreeing about fiction." Thesis, Paris Sciences et Lettres (ComUE), 2019. http://www.theses.fr/2019PSLEE064.
Full textIn this dissertation, I contribute to contemporary debates in analytic philosophy about truth, interpretation and reference in fiction. I defend a version of "functionalism" (originating in Kendall Walton's work) which says that the key concept for analyzing fictions is pretence or make-believe. In the first part, I argue against the modal account of truth in fiction and then introduce "pretence semantics". The modal account says that fictional statements are similar to counterfactual statements, which can be given truth-conditions using possible-world semantics. But the fictional well exceeds the possible, and also the impossible (of hypothetical impossible-world semantics). Moreover, the modal account is incompatible with a causal theories of semantic information which can be argued for independently. As for pretence semantics: it is a formal apparatus delivering fictionality-conditions (instead of truth-conditions) which derive from real features of the props used in games of make-believe and some "principles of generation". In the second part, I fine-tune pretence semantics on a case study. It is a literary debate about what is true in Kafka's story "the Metamorphosis". Nabokov once argued against critics who say that Gregor Samsa has turned into a monstrous cockroach. Cockroaches do not get stuck on their backs; Gregor is stuck on his back in the opening scene of the story. So, Nabokov argues, he cannot be a cockroach; he must be a big beetle. In order to analyze this "great beetle debate", I use the notion of "faultless disagreement" which comes from epistemology. I thus investigate the indeterminacy of fictional events which, I argue, is neither linguistic nor ontological but pragmatic in nature. In the third part, I defend anti-realism about fictional names which says that fictional characters do not exist and that fictional names do not refer. Anti-realism is the same doctrine as functionalism applied to reference. Though intuitive, the view has to meet a powerful counterargument based on "metafictional uses" of names. For instance, one can say truly: "Emma Woodhouse is a fictional character". Given compositionality, it follows that the name "Emma Woodhouse" refers in such contexts. This argument leads to a form of realism: fictional names refer to some kind of "abstract artefact". I show that the best realist theories are inadequate. Then I provide an analysis of the linguistic data introducing a notion of perspective. It enables me to circumscribe the problematic metafictional statements for the anti-realist. Ironically, anti-realists mainly struggle with negative existentials, although these put into words the central tenet of anti-realism, namely that fictional characters do not exist. Pretence semantics (which yields fictionality-conditions) is helpless for giving truth-conditions to them. To account for them, I use a version of positive free logic which combines with pretence semantics. Anti-realism is thus both intuitive and tenable

Full textWhile the radical distinction between criminal law and civil liability is classically taught, a thorough survey of positive law reveals a general and profound trend towards a confusion of these two disciplines. Faced with this paradox, the jurist wonders : how to articulate the civil and criminal laws of responsibility ? To answer this question, the thesis suggests abandoning the traditional approach of the subject, which consists in treating it as a mere category of classification of the different branches, civil and criminal, of responsibility/liability. Legal responsibility is presented as an autonomous and general institution organizing the response from the system to abnormal disturbance of social equilibrium. Civil liability law and criminal law are, as far as they are concerned, henceforth conceived as the mere technical applications of this institution in positive law.On the basis of this new approach and through the prism of the study of liability conditions in private law, the thesis proposes a technical and rational organization of criminal law and civil liability that may provide the guiding principles of a real general theory of legal responsibility. As a general institution, it gives not only a concept of responsibility, requiring degradation of a legally protected interest, abnormality and legal causation, and establishing the convergence of criminal law and civil law, but also a system of responsibility, determining the divergences of them and steering the first towards the protection of general interest and the second towards the protection of victims

Full textIn this thesis, the model-free control was applied and adapted to delayed systems whose delay is either known or unknown. This method of control does not require the specific knowledge of a model of the system, it finds all its effectiveness in the apprehension of the unknown delays. Different adaptations of the classical approach, based on the minimization of frequency and temporal criteria, have been proposed in the context of a known, bounded or unknown delay. They allowed us to extend the range of systems considered and to improve the intrinsic performance of the model-free control. The delayed systems, which are the main target of this thesis, were able to benefit from these improvements. The problem of the fault-diagnosis of delayed systems was then addressed. A new method of model-free diagnosis has been proposed, based on model-free control principles. Our proposal only uses the temporal evolution of the system's input and output signals. Due to the generation of residual signals, the detection and localization of actuator/system faults were permitted under certain assumptions. Finally, we have studied the fault-tolerance properties of model-free control and its efficacy has been proven. Compared with more conventional methods, such as the PI Controller for example, a notable difference is to be mentioned. Indeed, unlike a PI controller, the model-free control is robust not only to low-frequency input disturbance signals, but it also allows for the rejection of other signal types by estimating summary parameters. Throughout this report, the effectiveness of the proposed approaches was illustrated in terms of control or diagnosis by multiple academic examples

Full textThe development in Micro Electro-Mechanic Systems (MEMS) combined with the emergence of new information and communication technologies allowed the integration of the data sensing, processing and transmission in a single tiny device which is the wireless sensor. Consequently, the networks formed by these sensors offer a lot advantages compared with the traditional networks, in particular in terms of the deployment simplicity and cost. This led to the development of a wide range of Wireless Sensor Networks' applications in the domains of health, environment, industry, infrastructures, spatial activities, or even military activities and in many other domains. However, new challenges appear from the particular characteristics of these networks. In fact, many applications of this type of networks are critical and require that the correct functioning of the network is maintained as long as possible. However, the environments in which these networks are deployed return the mission of network maintenance very complicated or even impossible; hence, the necessity of integrating mechanisms of self-correction which aim to overcome the appeared problems without a human intervention. In this context, we focused our study on the techniques and mechanisms implemented to improve the property of fault tolerance in the wireless sensor networks. First, we proposed centralized and distributed approaches for the connectivity restoration and the channel reallocation in a multi-channel communication context after the failure of a critical node. After the formulation of the problem as a multi-objective optimization problem, we proposed some algorithms based on the heuristics of graphs coloring and Steiner tree, very known in the graph theory to solve this type of problems. In a second part in this thesis, we studied a particular application case, precision agriculture, and we proposed a distributed solution for the failure recovery in wireless sensor networks

Full textA networked control system (NCS) is a control system in which the control loop is closed over a real-time network. NCSs are used in many industrial applications, and also in applications such as remote control, unmanned aerial vehicles or surgical teleoperation, ... The major advantages of NCS are a flexible architecture and a reduction of installation and maintenance costs, the main disadvantage of NCS is the network effects, such as time-delays, that influence the performance and stability of the control loop. These systems are also vulnerable to cyber attacks. This thesis makes some contributions regarding the detection of cyber-physical attacks as well as the development of a controller which capable of dealing with the other the bad effects of the network like time-delays.To achieve this goal, the proposed approach is to adapt model-free controller and to improve its use in NCS. The main idea is based on mutual benefit between Smith predictor and the basic model-free controller. Then, the intelligent structure of model-free control is applied along with Generalized Predictive Controller (GPC) to achieve the Intelligent Generalized Predictive Controller (IGPC) as an enhancement for the standard GPC. The IGPC is designed along with two different methods for cyber-attack detection. Moreover, a new security mechanism based on the deception for the cyber-physical attacks in NCS is proposed, this mechanism can allow to stop the cyber-attacks by providing the last line of defense when the attacker has an access to the remote plant. Finally, two detectors for controller hijacking attack are introduced. The objective is to be able to detect an attack such as the Stuxnet case where the controller has been reprogrammed and hijacked. The advantage of these proposed detectors is that there is not necessary to have a priori mathematical model of the controller

Full textDirect Drive Wind Turbines (DDWTs) are equipped with Permanent Magnet Syn- chronous Generators (PMSGs). Their three most common failures are demagnetization, ec- centricity (static, dynamic and mixed) and inter-turn short circuit. Machine Current Signa- ture Analysis is often used to look for generator problems, as these impairments introduce additional harmonics into the generated currents. The Fast Fourier Transform (FFT) is utilized to compute the spectrum of the currents. However, the FFT calculates the whole spectrum, while the number of possible faults and the number of introduced harmonics is low. The Goertzel algorithm, implemented as a filter (the Goertzel filter), is presented as a more efficient alternative to the FFT. The spectrum of the currents changes with the wind speed, and thus the detection is made more difficult. The Extended Kalman Filter (EKF) is proposed as a solution. The spectrum of the residuals, computed between the estimated and the generated current, is constant, regardless of the wind speed. However, the effect of the faults is visible in the spectrum. When using the EKF, one challenge is to find out the covariance matrix of the process noise. A new method was developed in this regard, which does not use any of the matrices of the filter. DDWTs are either placed in remote areas or in cities. For the monitoring of a DDWT, tens or hundreds of kilometers of cables are necessary. Wireless Sensor Networks (WSNs) are suited to be used in the communication infrastructure of DDWTs. WSNs have lower initial and maintenance costs, and they are quickly installed. Moreover, they can complement wired networks. Different wireless technologies are com- pared - both wide area ones, as well as short range technologies which support high data rates

Full textThe main focus of this thesis is on multilevel graphical modeling of behavior and organization of a set of component systems in a System of Systems concept. In the present work, we model the wireless communication link among component systems, with all its major effects, using a graphical modeling tool for describing flow of power in multi-physics domain called Bond Graph. This model permits identifying mathematically, the quality of signal received at information sink based on model parameter values. We conduct an experiment on cooperative behavior of two humanoids in a system of systems concept and demonstrate how we are able to experimentally measure the parameter values defined in our model.Next we justify how we are able to evaluate quantitatively, the fault tolerance level of a wireless communication link and introduce the need for redundant links in system of systems. Then we propose a methodology for coupling Hyper Graph, used for modeling the organization of component systems, and Bond Graph in multilevel graphical modeling of system of systems. Finally, we discuss another system of systems with two cooperating component systems, a Unmanned Aerial Vehicle (UAV) and an intelligent autonomous vehicle (robuTAINer), in which the UAV will supply navigation information to the intelligent autonomous vehicle to be able to safely maneuver in a confined space. We develop algorithms for robuTAINer detection and navigation from UAV. Then we practically test our algorithms and analyze the obtained results

Full textModern distributed services are expected to be highly available, as our societies have been growing increasingly dependent on them. The common way to achieve high availability is through the replication of data in multiple service replicas. In this way, the service remains operational in case of failures as clients can be relayed to other working replicas. In distributed systems, the classic technique to implement such fault-tolerant services is called State-Machine Replication (SMR), where a service is defined as a deterministic state-machine and each replica keeps a local copy of the machine. To guarantee that the service remains consistent, replicas coordinate with each other and agree on the order of transitions to be applied to their copies of the state-machine. The replication performed by modern Internet services spans across several geographical locations (geo-replication). This allows for increased availability and low latency, since clients can communicate with the closest geo-graphical replica. Due to their reliance on a leader replica, classical SMR protocols offer limited scalability and availability under this setting. To solve this problem, recent protocols follow instead a leaderless approach, in which each replica is able to make progress using a quorum of its peers. These new leaderless protocols are complex and each one presents an ad-hoc approach to leaderlessness. The first contribution of this thesis is a framework that captures the essence of Leaderless State-Machine Replication (Leaderless SMR) and the formalization of some of its limits. Due to the increasingly sensitive nature of replicated services, leveraging simple benign failures is no longer enough. Recent research is headed towards developing protocols that support arbitrary behavior of some replicas (Byzantine failures) and that also thrive in a geo-replicated environment. An example of this new type of sensitive replicated services that has been the focus of a lot of research are blockchains. Blockchains are powered by Byzantine replication protocols adapted to work over hundreds or even thousands of replicas. When the membership control over such replicas is open, that is, anyone can run a replica, we say the blockchain is permissionless. In the converse case, when the membership is controlled by a set of known entities like companies, we say the blockchain is permissioned. When such Byzantine protocols follow the classic leader-driven approach they suffer from scalability and availability issues, similarly to their non-byzantine counterparts. In the second part of this thesis, we adapt our framework to support Byzantine failures and present the first framework for Byzantine Leaderless SMR. Furthermore, we show that when properly instantiated it allows to sidestep the scalability problems in leader-driven Byzantine SMR protocols for permissioned blockchains

That is why, in this thesis, we are interested in aspects related to : routing, fault tolerance and interference management in WMSNs.Given the very low number of routing protocols, that have approached the experimental phase and still less those who approached it during data transmission in real time, we developed in this context, a geographic routing protocol baptised GNMF (Geographic Non-interfering Multipath Fault-tolerant),First, we improved node's selection mode used by the greedy-forwarding, to deal with local minimum problem, where a multi-criteria objective function (distance, energy and reception power) related to next-hop choice has been defined. Then, we introduced an optimization phase of built paths to eliminate loops and an adaptive approach to manage simultaneous traffic transmissions. After that, we oriented towards fault tolerance, to ensure transmitted data reliability and network connectivity. To this end, we modeled the number of lost packets during package delivery and proposed two mechanisms. The curative is used when sudden failures occurs and the preventive to anticipate batteries depletion. Both are combined with a dynamic failover strategy during alternative paths construction. Finally, we presented an interference model and a third mechanism that limits interactions between adjacent links. In addition, we also defined a path loss model in a multipairs environment (source, sink) and computed the error probability coefficient based on a distance function that separates the data flows. A new metric has been added in the objective function, related to noise sum of the active nodes that interferes on forwarding set nodes of the current node.Obtained results show the effectiveness of the proposed approaches that have been studied and validated both by simulation and on an experimental testbed

Bouillon, Anne. "Gilles Deleuze et Antonin Artaud : L'impossibilité de penser." Thesis, Poitiers, 2013. http://www.theses.fr/2013POIT5005.
Full textIn the thought of Deleuze, the poetry of Antonin Artaud seems like the line of convergence par excellence from which all the Deleuzian proliferation of concepts are developed. Indeed, Artaud is the person who shatters the image of thought – or what we usually mean by " thinking " in philosophy – rejecting its innateness and universality, in other words, the cogitatio natura universalis. Because, for both Artaud and Deleuze, thought is most often confronted by its real problem – its powerlessness or its impossibility. So the first part of the thesis deals with understanding the dismissal of the image of thought in Deleuze's Difference and Repetition, from Artaud's notion of " génital inné " [innate sexuality] in the Correspondence with Jacques Rivière. If the image of thought says nothing about the process of thinking, of what logic are we capable ? Through the discovery of the paradoxical logic deployed in the paradoxes in Deleuze's Logic of Sense, it is a matter of thinking about the connection between Artaud and Nietzsche. The main thrust of this section is a critique of the judgement made by Artaud. Lastly, thrown into the paradoxes of life, the third part considers the great non thought of philosophy, that is the body : indeed, of what body are we capable ? The challenge, the impossibility of thinking about the question of the body - comparing Spinoza's Ethics and Artaud's body without organs - is to reconnect thought with life, in accordance with the intention of Neitzsche's Gai saber [The Gay Science] and that Artaud did not cease to revise from his earliest writings. The impossibility of thought implies not only a separation from life, but also the unthinkable that is the body: indeed, does this mean talk of our own body as we experience it ? To what extent does the creation of a rhizome of concepts in A Thousand Plateaux by Deleuze and Guattari explore Artaud's body without organs, the body experienced that still remains mysterious for thought ? Artaud hoped that he would be loved not for his work, but for his life, testifying to a great health against a sick world: the prospect of the impossibility of thinking is then thought wounded and profound, taking on a life of its own in all its opacity

Full textAn efficient predictive maintenance is based on the reliability of the monitoring data. In some cases, themonitoring activity cannot be ensured with individual or wired sensors. Wireless sensor networks (WSN) arethen an alternative. Considering the wireless communication, data loss becomes highly probable. Therefore,we study certain aspects of WSN reliability. We propose a distributed algorithm for network resiliency and datasurvival while optimizing energy consumption. This fault tolerant algorithm reduces the risks of data loss andensures the continuity of data transfer. We also simulated different network topologies in order to evaluate theirimpact on data completeness at the sink level. Thereafter, we propose an approach to evaluate the system’sstate of health using the random forests algorithm. In an offline phase, the random forest algorithm selects theparameters holding more information about the system’s health state. These parameters are used to constructthe decision trees that make the forest. By injecting the random aspect in the training set, the algorithm (thetrees) will have different starting points. In an online phase, the algorithm evaluates the current health stateusing the sensor data. Each tree will provide a decision, and the final class is the result of the majority voteof all trees. When sensors start to break down, the data describing a health indicator becomes incompleteor unavailable. Considering that the trees have different starting points, the absence of some data will notnecessarily result in the interruption of the prediction process

Full textWe study in this thesis optimization problems with application in optical networks. The problems we consider are related to fault-tolerance and efficient resource allocation and the results we obtain are mainly related to the computational complexity of these problems. The first part of this thesis is devoted to finding paths and disjoint paths. Finding a path is crucial in all types of networks in order to set up connections and finding disjoint paths is a common approach used to provide some degree of protection against failures in networks. We study these problems under different settings. We first focus on finding paths and node or link-disjoint paths in networks with asymmetric nodes, which are nodes with restrictions on their internal connectivity. Afterwards, we consider networks with star Shared Risk Link Groups (SRLGs) which are groups of links that might fail simultaneously due to a localized event. In these networks, we investigate the problem of finding SRLG-disjoint paths. The second part of this thesis focuses on the problem of Routing and Spectrum Assignment (RSA) in Elastic Optical Networks (EONs). EONs are proposed as the new generation of optical networks and they aim at an efficient and flexible use of the optical resources. RSA is the key problem in EONs and it deals with allocating resources to requests under multiple constraints. We first study the static version of RSA in tree networks. Afterwards, we examine a dynamic version of RSA in which a non-disruptive spectrum defragmentation technique is used. Finally, we present in the appendix another problem that has been studied during this thesis
Shehaj, Marinela. "Robust dimensioning of wireless optical networks with multiple partial link failures." Thesis, Compiègne, 2020. http://www.theses.fr/2020COMP2540.
Full textThis thesis summaries the work we have done in optimization of wireless optical networks. More specifically, the main goal of this work is to propose appropriate network dimensioning algorithms for managing the demand and ensuring traffic satisfaction in a network under partial link failures (i.e. when some links and/or nodes are operational with reduced capacity) caused mostly by weather conditions. The primary criterion in deciding the efficiency of the proposed algorithms for the network is the dimensioning cost of the network while keeping the traffic satisfaction at high reasonable levels. The main application area we have in mind are the networks that apply Free Space Optics (FSO) - a well established broadband wireless optical transmission technology where the communication links are provided by means of a laser beam sent from the transmitter to the receiver placed in the line of sight. FSO networks exhibit several important advantages but the biggest disadvantage is vulnerability of the FSO links to weather conditions, causing substantial loss of the transmission power over optical channel. This makes the problem of network dimensioning important, and, as a matter of fact, di cult. Therefore, a proper approach to FSO network dimensioning should take such losses into account so that the level of carried traffic is satisfactory under all observed weather conditions. In this thesis, we firstly describe such an approach. In the first part of the thesis, we introduce a relevant dimensioning problem and present a robust optimization algorithm for such enhanced dimensioning. To construct our approach we start with building a reference failure set which uses a set of weather data records for a given time period against which the network must be protected. Next, a mathematical model formulation of the robust network dimensioning problem uses the above failure set. Yet, such obtained reference set will most likely contain an excessive number of states and at the same time will not contain all the states that will appear in the reality. Hence, we propose to approximate the reference failure set with a special kind of virtual failure set called K-set parameterized by an integer value K, where K is less than or equal to the number of all links in the network. For a given K, the K-set contains all states corresponding to all combinations of K, or less, simultaneously affected links. Sometimes, there are situations where the weather is extremely bad and what we propose is to build a hybrid network model composed of FSO and fiber links. The second part of this thesis is devoted to the improvement of the so-called uncertainty sets (or uncertainty polytopes). In the first part we have introduced the idea of link Ksets. Now we extend this by considering simultaneous degradations of K nodes (meaning degradation of all adjacent links). Finally, inspired by the hitting set problem a new idea was to find a large number of subsets of two or three affected links and to use all possible combinations (composed of 2 or at most 3 of this subsets) to build a new virtual failure set that covers as much as possible the reference failure set that we got from the study of real weather data records. Next, this new failure set will serve as input for our cut-generation xxi algorithm so that we can dimension the network at a minimum cost and for a satisfactory demand realization. A substantial part of the work is devoted to present numerical study for different network instances that illustrates the effectiveness of the proposed approach. A dedicated space is given to the construction of a realistic network instance called Paris Metropolitan Area Network (PMAN)

Full textHighly prevailing phenomenon worldwide, healthcare associated infections pose a significant threat to public health. They are considered to be an inevitable reality of the healthcare system that affects a large number of persons with diverse injuries. They result from a complex interplay of factors and represent a major burden for both victims and society, physically, mentally and financially. Although healthcare associated infections seem to be an important concern for health authorities in Quebec, compensation of victims remains problematic. At the moment, victims have to go through the traditional system of civil liability and face numerous obstacles. Classic rules are proved to be difficult to apply in a context where the source of the infection is often unknown and the factors that contributed to its development multiple. Confronted to this problem and to the dissatisfaction felt, some foreign jurisdictions have recognized the unsuitability of traditional rules and have introduced a no-fault compensation system in the hope of improving victims’ fate. Quebec chose to opt for the same solution in various fields, such as automobile accidents and immunization. This thesis proposes a comprehensive study of the need to adopt a no-fault compensation scheme benefiting victims of healthcare associated infections. The objective of this project is to outline the characteristics that would ensure the efficiency and viability of the no-fault scheme.
