Full textThe exaltation of the dichotomous aspect of time, divided between work and leisure time, has led to obscure reproductive, domestic, educational and assistance work, but also to ignore the work of school and professional training; just as it has deprived of legal relevance the times forcibly linked to work, such as those of the journey from home to the workplace or the time dedicated to work, in addition to the scheduled time, in creative and responsible work. In this dynamic, paid time has represented a masculine time par excellence to which women have had to adapt if they wanted to take part in it on an equal footing. This approach, both in the organization of work and in the rules that regulate its functioning, is still strongly present in our system today. Starting from these considerations, the thesis aims instead to take an approach that puts the subject at the center, enhancing the concept of time of the person, in a perspective that is not linked only to productive needs, but that gives value to the human person and his relationships as such. Dwelling first on the search for a legal anchorage within the Constitution at the time of the person, the emphasis was subsequently placed on the most recent developments in Europe with respect to the chosen theme, in particular on the failure of attempts to rewrite the directive on working hours, on the additional role played by the Court of Justice in the reinterpretation of existing legislation and on the emphasis attributed by European governance to issues relating to family care and assistance. The topic was then framed with respect to the internal perspective of the national system. The reference legislation on working hours was analyzed to underline the approach mainly aimed at defending temporal flexibility in the interest of the employer, who has a strong power to decide and vary the location of the service. It was therefore reasoned on the need, also in the perspective of support and enhancement of the initiatives applicable collectively, of a legislative intervention, aimed at attributing subjective rights in favor of workers over the temporal organization, which prevail over the interest economic activity of the company, if they detect particular needs of the person linked to fundamental rights and values that find constitutional legal recognition. Finally, the main legal solutions pursued so far, and still widely practicable, for the creation of new balances between the efficient management of the organization of the company and greater self-control by the single worker and the single worker were described and analyzed in a problematic key.

Full textTraining for the development of new skills, in the construction industry as well as in many of the sectors of which Italy's productive fabric is composed, is at the center of a wide-ranging debate involving multiple aspects: from the construction of a professionalism responsive to market demands, to the need to adapt the workforce to the technological, demographic and social changes to be encountered in the coming years. The research is aimed at analyzing the evolving role of the social partners in the construction industry in regulating training and labor market aspects in order to understand how representative actors will face the future changes. The research intends to delve into issues related to education and training systems, trying to read the changes through the analysis of an industrial relations system characterized by the presence of well-structured bilateral bodies and a particularly developed social dialogue - not only at the national level - on these issues. An attempt will therefore be made to interpret collective bargaining as a participatory tool for the construction of job profiles through bilateral logics created by the industrial relations system itself. Through the analysis of current market governance tools and the apprenticeship in its training function, the research will describe the current composition of the system to devote, subsequently, ample space to national and European projects. In fact, the action of the social partners in the context of training processes is now joined by the role played by European projects, which seems to be able to redesign a professional figure and identify skills even at the European level.

Full textThe subject of this doctoral dissertation is contract catering, intended as product group. It is anyway not confirmed the existence of so-called product group, completely independent, which could be considered autonomous compared to other product groups universally recognized, as the traditional catering or, in general, retail and catering businesses, product group where contract catering was included – at least according collective labour agreements - until recent times. In the first chapter of the dissertation it is chosen the historiographical method to better understand the autonomous path of contract catering compared with similar sectors, with the main purpose not just limited to affirm the existence of the category, but also to describe a sectorial development which has experienced moments characterized by several peculiarities, certainly worthy to be analysed in detail. Subjects of the second chapter are the structure of collective labour agreements of the sector, which in these years are under a complete renovation. The analysis begins with the evolution and the description of the evolution of the collective bargaining inside the sphere of Tourism collective labour agreement; since the beginning of the seventies the contract catering is identified as an under-sector, with high level of autonomy, of retail and catering businesses, which is also included in the framework of the Tourism category. It is therefore necessary to examine on one side the entire collective labour agreement of the category, as it developed until today, and on another side the specific provisions included in the collective agreement related to contract catering, where existing. It is indeed necessary to analyse the Tourism Collective Labour Agreement, signed on the 20th of February 2010, the last one applicable for contract catering, to understand the peculiarity of every contractual institute included into the Collective Agreement and to evaluate the capability to comply with the sectorial necessities; particularly interesting for the dissertation the analysis of the following contractual institutes: field of application, validity, duration, second level collective bargaining, Tourism bilateral bodies, part-time contracts, working time, flexibility, wages, illness compensation and specific regulation of contract catering sector. At the end of such analysis it is described the 2012 withdrawal of Angem (Italian Association representing Contract Catering companies) from the FIPE (Italian Federation representing retail and catering businesses), which was the employers’ Association where Angem was associated since its institution in 1973, and the cancellation by Angem – later withdrawn – of the Tourism Collective Labour Agreement, and the claim of signing a new specific Collective Labour Agreement, which will be probably finalized in 2017. Determinants of the new order of the representation of contract catering companies are the main subject of the third chapter. They could be divided into three categories: historical and institutional, juridical, economical. The analysis of these determinants emerge to be fundamental to comprehend if, beyond a specific historical path and specific type of companies different from retail and catering businesses, there is a real need which is encouraging sectorial companies to search for a typical autonomous representation. At the end of the dissertation it is included a specific literature review, which disclose the relevant literature related to the arguments presented and different positions assumed.

Full textThe work analyses the outsourcing processes on the point of view of industrial relations, with the purpose to verify the effectiveness of the collective bargaining provisions to “manage” these processes. The dissertation moves from the assumption that the second-level agreements should be implemented, considering the applicability to all employees and the greater proximity to the interests concerned. The major part of the analysis revolves around the service contracts and the heterogeneous related provisions of the national collective labour agreements (such as the ban on outsourcing, the information to trade unions, the entitlement to certain treatments or to hold down the employment relationship), which should be developed by company or territorial level agreements. Then the dissertation focuses on the transfer of business, highlighting the role of the second-level bargaining, which could be able to find a compromise between competitiveness and social protection, as well as to control the compliance of the transactions. The work also considers the staff leasing contract, hoping for a system of collective representation and negotiation which includes the temporary workers. Finally, with reference to the so called “working project consulting agreements”, the author observes that the trade unions should give to the consultants a major collective protection.
