Abstract:
This thesis will deal with the development of the situation of the Roma minority in the Swedish school system in the period between 1954 to 2010, based on two Swedish Government Official Reports of the group's situation in the Swedish schools. The study is done by the report Zigenarfrågan (SOU 1956:43) and with the report Romers rätt (SOU 2010:55). The report Romers rätt was written by the Delegation for Roma issues and gives an updated picture of the situation of Roma in the Swedish school system. The state investigation Zigenarfrågan, is also important as the latter resulted in the Roma children enrolled in Swedish schools. This work will look at the various governmental investigations by the theory used for analysis called ”structural discrimination theory”. Comparison of these two reports by structural discrimination as theory has shown that Zigenarfrågan good vision and belief in the assimilation proposals, did not lead to desired results. Instead of achieving a homogeneous school, it resulted in a discriminatory school that still lives by the principle of homogeneity. Many of the proposals made in the report Romers rätt shows that Swedish school much because of its international bonds, trying to counter the structural discrimination directed against Roma and other minorities. But the work becomes very difficult when the structural discrimination norms are deeply ingrained in society's various institutional bodies.

Abstract:

The aim of this essay is to study the decision making process and implementation of the principle of political participation and influence for Roma minority in Sweden. The results regarding the decision making process is structured through a discourse influenced policy analyses. Problem picture and recommended measures in the political documents representing the decision making process are analysed through theories of minority rights and equality. The implementation is seen through, by the author given minority discourse and the work in the roma council and analysed by the same theories already mentioned.

The results show that regarding the decision process the aim of art.15 in the framework convention is based on the idea of equality while the Swedish documents relates more to an idea of the right to speak for the group. Regarding recommended measures, the framework convention gives several recommendations on specific measures for political participation while the Swedish documents focuses on the general politics of the state. The results of the analyses of the implementation shows that those actors in the discourse, comparing the political participation for romas before and after the implementation of the minority policy creates a positive view of the principle, while those relating the principle to real influence in the political decision gives a more negative view of the implementation. The work in the Roma council shows that the majority of the issues are in information and discussion form and mostly information given by government staff. There has been critical voices from Roma representatives, while an another think time will give more space for Romas to have more influence. The Roma representatives still have a position outside the positions of real power influence in the consultative body.

Abstract:
With a history of racial discrimination, which inevitably led to illegal occupations of private and public land and subsequent violent evictions, South Africans have enjoyed constitutional protection against illegal and forcible evictions since the mid-1990s. Sweden, a country considerably less accustomed to illegal occupations, does not guarantee the same protection against forcible evictions. However, the recent influx of Roma from Romania and Bulgaria to Sweden without the means to support themselves has resulted in an increase of illegal occupations and led to evictions from publicly owned land. This paper examines: (i) how the case of South Africa relates to the situation in Sweden, (ii) the extent of legal protection offered by Sweden relating to the right to housing and (iii), whether when carrying out such evictions, Sweden respects European legislation and precedent. The results show that South African and European courts have interpreted the right to housing as a right to alternative accommodation for illegal occupants. With no constitutional right to housing in Sweden, legislation only guarantees the right to housing for holders of a permanent right of residence. For EEA citizens, such as Romanians or Bulgarians, the right of residence is conditional. In the absence of a legal obligation to consider the situation of illegal occupiers or to provide alternative accommodation, there seems to be a gap in Swedish legislation; leading to a failure on the behalf of the state to adhere to European commitments and to protect those most vulnerable in society.
