Torges, Gwendolyn B. "The right to be left alone v. the crime against nature: An analysis of Bowers v. Hardwick." Diss., The University of Arizona, 2005. http://hdl.handle.net/10150/298801.

Full text
Abstract:
This qualitative case study analyzed the United States Supreme Court's opinion in Bowers v. Hardwick, 478 U.S. 186 (1986), and the historical and legal background leading up to the case. Often characterized as a decision representing an emotional rejection of homosexuality rather than a reasoned application of constitutional privacy precedent, this inquiry sought to identify and document the determinants of the outcome in Bowers, in which a slim majority of the Court ruled that the constitutional right of privacy did not prohibit states from regulating homosexual sodomy. The study demonstrated that although homophobia certainly played a part in the Bowers decision, that the opinion was not necessarily inconsistent with previous privacy decisions such as Griswold v. Connecticut , 381 U.S. 479 (1965), and Roe v. Wade, 410 U.S. 113 (1973). The author concluded that the dominant insight gleaned from Bowers is that there is no such thing as a constitutionally protected right of privacy, at least not in the way that privacy is conventionally understood. The Bowers opinion illuminates that the Court's privacy jurisprudence has been more about the privileging of certain relationships (such as that between husband and wife or doctor and patient) than it has been about personal privacy. Such relationships serve an important limiting principle. The author concluded that the outcome in Bowers was not the insufficiency of the claim of a right to privacy, but the insufficiency of any limiting principle. The research documented and analyzed history of the two bodies of law most relevant to the Bowers opinion: state law which criminalized sodomy; and constitutional protection of individual privacy.

Dahlblom, Kjerstin. "Home alone : sibling caretakers in León, Nicaragua." Doctoral thesis, Umeå universitet, Epidemiologi och folkhälsovetenskap, 2008. http://urn.kb.se/resolve?urn=urn:nbn:se:umu:diva-1877.

Abstract:
Sibling caretaking, although common across time and cultures, has not been well researched from the carer’s point of view. In Nicaragua, ranked as one of the poorest countries in the Americas, sibling caretaking is common. The country’s historical background and its state of chronic poverty, widespread unemployment, loose family structures, and migration and mobility makes of the old practise of shared management child care a necessity. Households headed by sing¬le mothers constitute a particular Nica¬raguan charact¬eristic. Many children are expected to help in their own families and care for their siblings and other children living in their households. In its broadest sense sibling caretaking is a public health concern, and we conducted this study to widen the understanding of the phenomenon as it is represented in a setting undergoing a rapid social transition. The main objectives were to identify, describe and analyse the life situation of sibling caretakers in poor areas in León, Nicaragua, with focus on how they perceived it themselves. A combined qualitative and quantitative methodological design was used, mainly applying an ethnographic approach. A further ambition was to explore involvement of children in a participatory research process in accordance with the ‘Convention on the Rights of the Child’. The overall emotion expressed among the caretakers was pride, even if their situation often was characterized by stress and coping problems. They perceived their work as important for their families and they appreciated to fend for their siblings. Household work and nurturing of siblings were shaping the future lives of the caretakers and constituted part of their socialization. Even if many of these children achieve essential life skills as caretakers, they are at risk of falling behind as they grow older. Their long-term personal development is likely to be hampered by the obligations they have as caretakers. The carers' awareness of missing out on education was the most problematic issue for them. From a societal point of view, caretaking has negative consequences. The individual child is marginalised with limited access to basic education, contributing to overall low educational levels in Nicaragua. While the structuring conditions leading to sibling caretaking may be difficult to change, awareness of how these can affect children might make way for improvements in terms of access to school education and support from the society. The knowledge gained from this study should be further utilised to plan for interventions that take children’s perspectives into consideration.

Abstract:

I investigated percent coverage, plant height, species richness, and woody stem density in plant communities in ten study plots during spring and fall (2010–2012) within 3 different treatments (continual mowings, one fall mowing, and one fall mowing with native wildflower seeds) on Highway 25 right-of-way in Oktibbeha and Winston counties, Mississippi. I recorded 277 plant species including native and non-native forbs, legumes, grasses, rushes/sedges, and woody plants. Non-native agronomic grasses exhibited greatest coverage greater than 90 percent occurring in all treatments. Percent coverage of plants less than 0.46m height category exceeded 100 while, greater than 0.46m plant height categories averaged 55 percent. Woody stem density ranged from 7,772 year 1 to 10,025 stems/hectare year 2. I detected no significant differences in plant height or woody stems among treatments. One mowing per year retained agronomic plant cover for erosion control and annual cost savings up to 75 percent for roadside maintenance.

Solminihac, Arnaud de. "La vie privée : les racines d'un concept juridique protéiforme." Electronic Thesis or Diss., Université Paris-Panthéon-Assas, 2022. http://www.theses.fr/2022ASSA0019.

Full text
Abstract:
"Privacy" or "private life" is regarded as a general notion of the french law. This words appears for the first time France during the French Constitution to protect individual reputations. Under this report, private protection is an extension of the concept of defamation as it was understood under ancien law. According to old law conception, infamous revelations must be repressed even if they are true. This approach presupposes that personal information has no place in the public space. In the same way the rule of secrecy is institutionalized in order to protect specific relationships: the secret of confession, secret of letters, confidential medical information, etc. This thesis intends to link the concrete protections of the private sphere to Western history in general

Abstract:
My thesis project, Better Alone focuses on single person households from a perspective of loneliness. The objective has been to find an architectural solution to decrease experienced loneliness. In this project I intend to address the issue and design a way of living that can relieve the experience of involuntary loneliness. I have used two main strategies: the first is to provide space for social interaction in connection to the home and to create reasons to enter and linger in these spaces. The second main strategy is to blur or stretch the border that separates the home into privacy through visibility. The project's site is  in southern Stockholm, in between the neighborhoods Hammarbyhöjden and Hammarby sjöstad, a fairly central location. The site's most prominent characteristic is the fact that it is a steep slope. At the bottom of the slope runs Hammarbyvägen, which is a fairly busy road. Together these two aspects create a barrier between the neighborhoods of Hammarby sjöstad and Hammarbyhöjden, these are challenges that I have addressed in the project.

Abstract:
Cosplay, the costumed performance of characters sourced from Japanese popular culture, has become an international phenomenon. Today there are Cosplay events held on every permanently inhabited continent, but there has been limited academic research into Cosplay practice and culture on the national level (Brainbridge and Norris 2009, Brainbridge and Norris 2013, Galbraith 2012, King 2013, Langsford 2014, Sagardia 2017) and no prior international comparative studies between Australia and the United States. This volume focuses on a comparative statistical and ethnographic analysis of Cosplayers in the United States of America and Australia between 2014 and 2015 with an interdisciplinary scope. Each chapter addresses a different aspect of Cosplay practice including history, sites of practice, generational hierarchy and cultural capital, psychological motivations, and gendered performance which aim to further complicate understanding of international Cosplay cultures and to establish a new framework for an interdisciplinary approach to performative groups.

My thesis is a sustained argument that the practical reason is not a suitable master concept in ethics, let alone the only ethical notion we need. In Chapter One, I defend the idea that desires have irreducible and pervasive normative significance. More particularly, I defend reasons internalism - the claim that desires are a necessary condition on practical reasons - by developing a new version of this thesis. In this version, desires serve to veto practical reasons, which are in turn grounded in objective values. I argue that this compatibilist picture provides an account of self-interested reasons which is intuitively superior to its purely objectivist rivals. In Chapter Two, I argue that evaluative notions are distinct from prescriptive notions, which reasons talk is meant to encode. According to my account, it is partly constitutive of wickedness (an evaluative notion) that the wicked person lacks moral reasons - understood as the basis for potentially apt prescriptions - to mend his ways. For some people, I suggest, are deaf to moral instructions in something close to a literal sense. I argue on this basis that the distinction between evaluative and prescriptive 'oughts,' and the attendant possibility of iterating them, vindicates internalism about moral reasons too. A solution to Chisholm's paradox is a welcome fringe benefit. In Chapter Three, I begin to develop an alternative to prevailing reasons-based conceptions of ethics, by focusing on social relationships, such as friendship. I argue that agents can behave decently by being guided by implicitly normative concepts like friendship, which contain codes of conduct like "Friends help each other out," and "You don't snitch on your friends." Such 'do's and don'ts' and the corresponding concepts enable agents to behave well instinctively, even when they believe they have no reason to do so. I argue further that recognizing who someone is - i.e., the social relationship in which they stand to you - can be action-guiding and even mandating. I argue that this kind of social awareness is a viable alternative to positing intuitive responsiveness to reasons, and defend the idea that it underwrites a form of practical necessity worthy of the name.

Abstract:
The purpose of the research was to add to the body of knowledge concerning pipe organ literature by locating and describing compositions for pedals alone. The search was made with indexes, abstracts, organ literature bibliographies, Union Catalogues, on-line computer services, correspondence with publishers, and an examination of the general performance literature, method books and etude books. The study included works for organ solo which are primarily for pedals alone. A work with a few manual chords was not excluded, but a work which consistently uses the manuals, even in the most subsidiary role, was not included. The study was concerned with compositions which are intended for public performance. Exercises were omitted.FindingsThe efforts of thirty-three composers have produced thirty-nine compositions or collections of for pedals alone. One of the works makes exclusive use of clusters, three use dodecaphonic techniques, and four are from the Romantic Era. The remainder are compositions divided between twentieth-century moderate styles and twentieth-century conservative styles.Seventeen of the works require a pedal board with thirty-two pedals, eighteen of the works require at least thirty pedals, and three may be played on an instrument with twenty-five pedals. One work which does not use traditional notation could presumedly be played on any instrument.Thirteen works, one of which is in Langlais' collection of etudes, employ pre-existing tunes which are treated to variations or other compositional techniques. The other works use a variety of formal designs including fugue, fantasy, sonatina, rondo, dance forms, passacaglia, free form, and other designs.Alkan has the earliest complete work for pedals alone which is readily available.

Full text
Abstract:
Corporate Social Responsibility (CSR) is a topic of rising importance in the current human rights discussion. As multinational supply chains have a growing impact on people’ lives, both in more developed and developing countries the question of how to regulate the behaviour of the companies that engage in these supply chains becomes increasingly important. States have tried to do this through both national and international law, by introducing hard law regulations as well as voluntary frameworks, so called soft law initiatives. The general legal framework of international law will first be introduced and subsequently focus will lie on the United Nations Principles on Business and Human Rights (The UN Guiding Principles) concerning the social responsibility of companies. In this thesis, the second of these sections is explored through an investigation into what responsibilities financial institutions, institutions that provides financial services for its clients or members, can be considered to have according to the legal framework associated with the corporate responsibility of human rights. The position of financial institutions is unique in a supply chain due to their distance to the production and hence to the country wherein the most fundamental human rights risks are present. Meanwhile, these financial institutions are also key to the trade operating throughout the supply chain. The thesis will identify the human rights issues along a supply chain and investigate the subsequent responsibilities that are tied to the financial institutions. The primary objective of the thesis is to clarify how to apply the international framework to the financial institutions and provide an answer to the question of what the human rights responsibilities of financial institutions are along a supply chain and to answer the question: what are the human rights responsibilities of financial institutions along a supply chain?

Åström, Aneq Meriam. "Arrhythmogenic right ventricular cardiomyopathy : Is it right?" Doctoral thesis, Linköpings universitet, Klinisk fysiologi, 2011. http://urn.kb.se/resolve?urn=urn:nbn:se:liu:diva-70403.

Full text
Abstract:
Arrhythmogenic right ventricular cardiomyopathy (ARVC) is an inherited heart disease, where sudden cardiac death in young seemingly healthy persons may be the first symptom. There is a need for more sensitive and accurate diagnostic methods to detect signs of disease, at an early stage and in relatives of affected individuals. The aim of this thesis is the evaluation of new non-invasive modalities in assessment of right ventricular (RV) volume and function with focus on patients with ARVC. Clinical and non-invasive follow-up of fifteen patients with ARVC during a mean period of 8 years permitted the evaluation of disease progression. RV volume analysis by magnetic resonance imaging relies on short axis (SA) views. A new axially rotated modality acquisition was tested and its feasibility in assessment of RV volume was evaluated. This acquisition seems to be able to improve the assessment of RV volume and function by reducing the uncertainty in defining the basal slice of the RV. A third study concentrated on analysis of RV regional and general function by echocardiography, using tissue Doppler imaging as well as two dimensional (2D) longitudinal strain based on speckle tracking in patients with ARVC, their first degree relatives and in healthy subjects. 2D strain showed a good feasibility in analysis of the RV function in relatives and controls but less in ARVC patients probably due to the progressive myocardial cell death with fibro-fatty replacement of the RV wall. In order to detect and follow up echocardiographic changes an index was developed combining dimensional and functional parameters for the left and for the right ventricle. Advances in the molecular genetics of ARVC have provided new insights into the understanding of the disease. Hitherto, 9 candidate genes have been identified. A new mutation in the plakophilin 2 gene was detected in a three generation family. The clinical phenotype related to this mutation was investigated. The studies have evaluated and developed methods for studying the right ventricle with special emphasis on ARVC. With the ultimate goal of preventing sudden death in ARVC, a combination of genetic testing and improved diagnostic methods may create an improved algorithm for risk stratification and selection to prophylactic treatment.

Vollmer, Joseph Gerard. "Evaluation of plant growth regulators for managing fescue turf along highway rights-of-way." Diss., Virginia Polytechnic Institute and State University, 1989. http://hdl.handle.net/10919/54803.

Full text
Abstract:
Plant growth regulators (PGR's) including metsulfuron plus mefluidide at 10 plus 140 g ha⁻¹, chlorsulfuron plus mefluidide at 20 plus 140 g ha⁻¹, imazethapyr plus imazapyr at 67.5 plus 2.5, 96.4 plus 3.6, and 115.7 plus 4.3 g ha⁻¹, ACP 2100 at 60, 120, and 180 g ha⁻¹, and DPX L5300 plus mefluidide at 10 plus 140, 20 plus 140, and 70 plus 140 g ha⁻¹ were applied to ‘KY 31’ tall fescue (Festuca arundinacea Schreb.). All rates of imazethapyr plus imazapyr, ACP 2100, and chlorsulfuron plus mefluidide afforded a significantly higher turf quality than metsulfuron plus mefluidide. ACP 2100 at 120 and 180 g ha⁻¹, imazethapyr plus imazapyr, DPX L5300 plus mefluidide at 70 plus 140 g ha⁻¹, and metsulfuron plus mefluidide gave the most consistent seedhead suppression. When treating seven month old tall fescue, DPX L5300 plus mefluidide did not adequately suppress seedhead elongation. Metsulfuron plus mefluidide, regardless of timing, caused excessive injury. All rates of imazethapyr plus imazapyr and the upper rates of ACP 2100 afforded the best turf quality followed by chlorsulfuron plus mefluidide in 1988 to ‘Rebel’ and both years to ‘KY 31’. Red fescue (Festuca rubra L.) quality was best with chlorsulfuron plus mefluidide and the high rate of DPX L5300 plus mefluidide. All other treatments resulted in a poorer quality turf. For all field studies on all turf types, in general, multiple applications were not practical and often caused excessive injury regardless of timing. Root studies conducted in the greenhouse revealed that with one application, imazethapyr plus imazapyr, ACP 2100, and DPX L5300 plus mefluidide provided root dry weights ranging from 0.5 to 0.7 g, which was greater than metsulfuron plus mefluidide, chlorsulfuron plus mefluidide, and the mowed check which afforded root dry weights of 0.1, 0.3, and 0.2, respectively. With two applications ACP 2100 and DPX L5300 plus mefluidide afforded 350, 1100, 200 and 200% greater root volume than metsulfuron plus mefluidide and chlorsulfuron plus mefluidide and 200, 630, 600 and 600% greater root dry weights. Three applications are not recommended. In laboratory studies using ‘KY 31’ tall fescue, mefluidide enhanced the uptake of ¹⁴C-DPX L5300 after 48 hours by as much as 11% and the translocation of ¹⁴C by 8.4% to the young leaves, 9.3% to the old leaves and 6.1% to the culm. Radioactive material concentrated in the tips of leaves. No significant accumulation of ¹⁴C occurred in the crown or roots.

Martínez, Díaz Maria del Mar. "Stand-alone hybrid renewable energy systems (HRES)." Doctoral thesis, Universitat Politècnica de Catalunya, 2017. http://hdl.handle.net/10803/457978.

Full text
Abstract:
End of Energy Poverty and achieving Sustainable Energy for all by 2030 is a universal challenge. 1.3 billion people without energy access and 2.8 billion people using unsustainable solid fuel for cooking and heating are global challenges for human and societal sustainable development. Nearly $1 trillion of investment is expected in the Sustainable Energy for All (SE4ALL) scenario to achieve universal energy access in 2030. Around 60% of investments will be in isolated off-grid and mini-grid systems with the relevant goal of duplicating the renewable energy sources in the energy mix. Access to innovation trends in renewable energy off-grid would benefit future installations. This work brings to light the recent years research contributions in Hybrid Renewable Energy Systems (HRES) and related aspects that would benefit these required investments in isolated off-grid and mini-grid systems. An overview on the thematic focus of research in Hybrid Renewable Energy Systems (HRES) in the last decade, period 2005 - 2015, is provided. This review covers multiple key aspects of HRES as the main focus of the research (technical, economical, environmental, financial, etc.); the design of the system (type of load, energy sources, storage, availability of meteorology data, etc.); different optimization criteria and objective function; software and modelling tools; and the type of application and country among others. A methodology for searching, identifying and categorizing the innovations related to HRES is proposed. Applying this methodology during this PhD work results in a primary database with a categorized bibliography including nearly 400 entries. Currently system design is mainly technical driven with economic feasibility analysis regarding the energy cost. As for environmental aspects, the beneficial impacts of renewable energy are hardly introduced as an economical value that is so far the most important decision-making criteria. Regarding decision-making tools, the most currently used optimization algorithms and software tools for the design of HRES is HOMER and a case study for understanding is proposed. Following the analysis of most popular and relevant criteria, an easy to use guideline is proposed encouraging decision-making for more sustainable energy access. There are untapped research opportunities for HRES in multi-disciplinary thematic areas. The analysis of innovations regarding the system design for Hybrid Renewable Energy Systems (HRES) have identified potential for research community aligned with the trends to integrate the value chain and foster innovative business models and sustainable energy markets. After the analysis of those different focus that goes from technical and economical, to environmental, regulatory or policy aspects, an integrated value chain for HRES systems is defined. Knowledge, methodologies & tools are provided in this PhD work for more stand-alone hybrid systems creating value for more of the stakeholders involved. After reviewing the latest innovations in HRES per thematic focus, an integrated value chain for those systems has been proposed and multidisciplinary research opportunities have been identified. Identifying the need to include the environmental aspects in early stages of the decision-making has lead to propose an easy to use guideline integrating most relevant criteria for the design of stand-alone renewable power systems. Finally, the research opportunities identified and the untapped potential of transferring latest innovations have result in the creation of the website ElectrifyMe (www.electrifyme.org) to enable valuable international networking contacts among researchers and encouraging multi-disciplinary research. "Knowledge, methodologies & tools" are powerful contributions by research community and innovators to foster more sustainable energy for all.
Koegel, Mary. "Never Alone: A "Look" At Imaginal Companions." TopSCHOLAR®, 2007. http://digitalcommons.wku.edu/theses/429.

Full text
Abstract:
American culture tends to consider imaginary friends (or imaginal companions, as I refer to them) as a folk belief belonging in the realm of childhood. If an adult believes in imaginal companions, they are potentially subject to the social stigma of psychological labeling. The mass media reflects this perception of reality and influences social interactions regarding experiences and beliefs in imaginal companions. Fear of this social stigma limits folk group size, which potentially creates an issue with informant group size. I gathered my informants from a group of friends, whom I interviewed over a one-year period. Although there is a danger of overgeneralizing when dealing with a small informant group, I reached many useful conclusions pertaining to the belief in imaginal companions as a "hidden tradition" expressed through narratives in small groups. Social relationships clearly exist between imaginal companions and believers of imaginal companions. The formation of a dyadic folk group begins with the initial appearance of the imaginal companion and communication with the believer. The believer perceives their imaginal companion or companions by manipulating the influence of the culture and society around them. However, there are other folk groups to consider in relation to this phenomenon as well. Through storytelling in safe environments, folk groups of varying sizes emerge, ranging from other dyads to slightly larger groups. Although a believer may create these groups through cautious social interaction, they may also be born into a safe environment such as a family of believers. These groups tend to revolve around storytelling. Investigations of these social interactions, as expressed in narrative form, suggest American cultural influences on personal perceptions of reality.

Parker, George. "Actor Alone: Solo Performance in New Zealand." Thesis, University of Canterbury. Theatre and Film Studies, 2008. http://hdl.handle.net/10092/1035.

Full text
Abstract:
This thesis explores solo performance in New Zealand. That solo performance has been widely used in New Zealand's relatively brief theatre history is usually ascribed to the economy, manoeuvrability and adaptability of the form - common reasons for the popularity of solo performance elsewhere as well. But this thesis considers solo performance as a kind of theatre that has been suited to New Zealand in a distinctive way. In particular, I argue that solo performance has emerged on the margins of mainstream theatre in New Zealand as a means of actively engaging with a sense of isolation that typifies the post-colonial New Zealand experience. The ability of the solo performance to move between remote rural settlements and urban centres has connected these New Zealand communities in a way that is unusual for theatre in New Zealand. Furthermore, a solo performer speaking directly to an audience about the experience of living in New Zealand allows for an intimate interaction with a traditionally stoic and laconic masculine society. In this thesis, I make a case for three solo performances where it is possible to see, in the representation of a search for what it means to be a New Zealander, a theatrical contribution to nation-building: The End of the Golden Weather (1959), Coaltown Blues (1984) and Michael James Manaia (1991). However, in a subsequent chapter, I look at solo performances in New Zealand that might better be understood within global movements such as feminism and multiculturalism. I argue that this shift has depleted the power that the form once held to comment upon New Zealand identity and to assist in the search for national identity. I conclude the thesis by considering how ongoing theatre practice may be informed by the experience of solo performance in New Zealand.

Lashomb, Donald A. "Working through tradition alone : Joyce's mythic return." Thesis, University of York, 2008. http://etheses.whiterose.ac.uk/11079/.

Full text
Abstract:
Though much has been written on Joyce and mythology, this thesis explains the necessary link between myth-oriented literature and Joyce's appropriation of materials from external sources. The study focuses primarily on Finnegans Wake but devotes significant attention to Ulysses as well. Though Joyce was an individualistic twentieth-century writer, his last book integrates with older traditions of collective authorship, and in particular we find many recurrences of elements from Irish mythology and folklore. The strange words ofFinnegans Wake often prove alterations of other authors' sentences. Much as each bard of an oral tradition would overhear and then reuse the stories, motifs, and even wordings of other bards in the production of his/her 'own' songs, Joyce seems to have regarded any and all texts he read as potential precursors to portions ofFinnegans Wake, which he likened to 'pure music'. Chapter 1 investigates Joyce's reappropriation of pre-existent elements, situates his work in relation to various myth-oriented literatures, and parallels aspects of his authorship with the roles ofthe Irishfili and druids. Chapter 2 explores how the returns of myth in Finnegans Wake depend upon felicitous states of knowledge-deficiency. Joyce's readers must use their imaginations to make sense of the difficult text much in the way that Vico's ignorant 'first people' created gods to explain their world. Chapter 3 discusses Joyce's affinity with James Clarence Mangan regarding Irish tradition, and also differentiates Joyce's work from the project of the Irish Literary Revival. Chapter 4 examines the dichotomy between orality and writing in Finnegans Wake. The fox of Irish fables becomes an allegory for the poet who mediates between oral culture and tradition-binding literature. Lastly, Chapter 5 discusses themes of plagiarism and piracy in Finnegans Wake, noting that the appropriation of readymade materials is often considered criminal in the present age.

Channon, Harriet Alice. "For Trumpet Alone: Australian Unaccompanied Trumpet Music." Thesis, The University of Sydney, 2020. https://hdl.handle.net/2123/24566.

Full text
Abstract:
This research focuses on the body of unaccompanied trumpet music written by contemporary Australian composers. Australian unaccompanied works were analysed with the objective of identifying and categorizing thematic material and overall influences over the works, focusing on those that relate to the portrayal of Australian musical characteristics as defined after a thorough literature review surrounding the development of Australian music. The characteristics relate to the portrayal of Australian: fauna and flora; landscape and climate; people and culture – both individual and as a whole; a composer’s personal experiences and personality; national psyche; geographical position; geographical ties; history and historical ties; and musical-cultural ties. Analysis focused on pitch, rhythm, intervals, melodic contour, structural influence, programmatic material, and use of silence, followed by, if possible, an interview with the work’s composer. Compositional context and interpretational intent behind the works were discussed. Analysis of works by Alan Holley in particular allowed for the development of a basis for depiction of bird song, bird movement, insect life, landscape, and the influence of Australian people. Other works could be compared in order to find commonalities within the cohort, as well as differences in depiction and interpretation. Some works displayed characteristics unrelated to Australian musical characteristics, rather displaying influences such as unnatural landscapes, the nature and historical context or role of the trumpet, as well as formulaic techniques. Identification of multifarious influences present allowed for development of a possible performance context and interpretational basis for each work. It highlighted different compositional trends within the body of works. These works have in general not been submitted to this type of analysis before and so this information could prove invaluable to performers coming to these works in the future.

Full text
Abstract:
This thesis examines the explanatory power of social capital theory as an aid to understanding disadvantaged socio-economic circumstances prevailing in many contemporary remote Aboriginal communities. The term ‘social capital’ refers to social resources that fuel human cooperation such as relationships, civic engagement, support and norms of reciprocity and trust. There are several strands of ‘social capital’ theory, but it is Putnam’s take that is my main focus. His ‘Bowling Alone: America’s Declining Social Capital’ (1995) analysed the state of community relatedness in the United States. By contrast my thesis explores the extent to which a social capital framework might be useful in seeking to understand the nature of connections between Aboriginal people in remote Australia. How is social capital formed and eroded in this vastly different context? The contemporary relevance of the thesis is that it is occurring against the backdrop of widespread concern about wellbeing and cohesion in remote communities. By seeking to explain the phenomena through a social capital analytic lens, the thesis provides a relational perspective on Aboriginal advantage and disadvantage. The focus is on the quality and nature of relationships. The significance of social capital theory is that it purports to account for “why some societies or groups work better than others, despite having comparable economic or material resources” (Cox & Caldwell, 2000: 58). It is the development of an understanding of remote Aboriginal community disadvantage through the prism of a social capital theoretical framework that is this study's original contribution to knowledge. While the concept is not new, its application in this context is. The thesis occupies contentious intellectual territory because ‘social capital’ is a ‘white western’ concept that may have little cross-cultural applicability or resonance. Yet despite limitations, it is nevertheless argued the concept provides useful analytical insights into the functioning of remote Aboriginal communities. A perspective informed by theorising about social capital, at least as Robert Putnam understands that term, might guide strategies that make for ‘stronger’ (thriving and prosperous) communities

Abstract:
The article provides for an analysis of the legal nature of Article 30 of the Charter of Fundamental Rights of the European Union, which declares "the right to protection against unjustified dismissal". In the focus of attention is the question, whether this right constitutes a human or a fundamental right or it is a right without the status of being fundamental or alternatively only a basic principle. The considerations are based on the legal theory of human rights and particularly social rights, as well as on the understanding of this right in the various international treaties and the constitutional traditions of the Member States. Furthermore, the article addresses the question of implementation of Article 30 in the national laws, scrutinizes the interpretation of Art. 51 Abs 1 of the Charter and highlights the deficiencies and possibilities. Also the image of this right mirrored in the European Union's law and the case law of the Court of Justice of the European Union is examined.

Nisan, Yüce. "Right to be forgotten as a fundamental human right." Thesis, National Aviation University, 2021. https://er.nau.edu.ua/handle/NAU/53732.

Full text
Abstract:
Purpose: the main objective of this paper is to study the right to be forgotten as a fundamental human right and its legal basis. Methods of research: general scientific, philosophical and specially-legal methods of scientific research have been used. A system analysis method was used to determine the term of the right to be forgotten and regulations related to the right. The case method and doctrinal research method were used for determining the general understanding of the right. A dogmatic method was valuable to formulate conclusions and recommendations of practical character within the research issues concerning the correct and effective usage of the right. Results: the growing pace and place of the Internet have put the processing of personal data in a new light, and it is now accepted as a fundamental human right to request to be removed from any databases under the provisioned circumstances, thus, “to be forgotten.” To examine the right further, studies have been made both by international and national authorities. While the right to be forgotten must be exercised with the utmost care, it must be ensured that it does not conflict with the freedom of expression and freedom of the press; the balance between legal interest and rights must be maintained. Discussion: it was based on the scope and limitations of the right to be forgotten and the effectiveness of current laws.

Abstract:
Bibliography: pages 64-65.
It was our aim, in this thesis, to give a proof that the smooth right Puppe sequence exists and is right exact, following the methods used by Whitehead in (30], and where he shows that the usual continuous right Puppe sequence exists and is right exact. We have only partially been able meet this aim. We have attempted to follow the general approach of Steenrod [27], where he defines neighbourhood deformation retracts, but there are some difficulties involved in the theory of smooth neighbourhood deformation retracts that have made it necessary for us to assume the existence of a 'suitable' smooth structure on products such as I x X x Y, where (X, A), and (Y, B) are smooth neighbourhood deformation retracts, such that the product, defined as (X x Y, Ax Y U X x A), is an SNDR pair under this 'suitable' product structure. This enables us to develop the theory of smooth neighbourhood deformation retracts in a similar way to the theory of continuous neighbourhood deformation retracts.

Abstract:
Since the beginning of the 21st century, the deaths of migrants have become a regular occurrence in southern Arizona where an average of 170 bodies are recovered from the desert each year. This dissertation examines the causes and effects of death and disappearance along the U.S.-Mexico border, seeking to address the contradiction present in the fact that thousands of people have died or disappeared in one of the world’s most heavily surveilled landscapes. It interrogates the ways in which the dead, the missing, and their families are simultaneously erased and exposed in a biopolitical process that has powerful implications beyond the space of the borderlands. The observations for this dissertation are drawn from nearly a decade of both ethnographic research and applied humanitarian assistance in the field of forensic human identification, primarily at the Pima County Office of the Medical Examiner, in Tucson, Arizona. Although the majority of migrant fatalities have been determined by the medical examiner to be accidental, resulting from exposure to the elements or unknown causes, a historical analysis reveals the violent nature of these deaths and disappearances, which are a structured result of U.S. border and immigration policies. From their homes to their destinations, migrants in the Americas face a particular kind of structural violence and social invisibility that is revealed when they disappear at the border. This disappearance is then made more thorough by the structured lack of access for families of the missing to services to assist them in their search. Practices of care, whether occurring within families of the missing and dead, during the desert crossing itself, or in the forensic work to identify the dead, powerfully contest the invisibility and erasure experienced by migrants in the Americas today.

Abstract:
Many public health and social issues faced by society today are multifaceted and require joint and collaborative efforts through health promotion partnerships. Community-based participatory research (CBPR) is one strategy that consists of engaging community stakeholders from various sectors to pool their expertise and resources in addressing health and social issues holistically. The literature indicates that the effectiveness of partnerships, such as those established within CBPR initiatives, is influenced by collaborative mechanisms that promote the creation of synergy among partners. There is, however, a lack of knowledge with regards to synergy and its key determinants in the context of health promotion partnerships. This qualitative thesis study is conducted as part of The EnRiCH Project, a CBPR initiative conducted in four communities across Canada, which aims at enhancing resilience and preparedness for disasters among high-risk populations. It explores the creation of synergy through the study of dynamics of collaboration shaping the EnRiCH-Québec City partnership and influencing its ability to leverage community resources for emergency preparedness. Emergent themes highlight that optimal collaboration in the EnRiCH-Québec City partnership is about having the “right people, in the right place, at the right time”. These findings provide evidence to inform community stakeholders, researchers and decision-makers on the dynamics of synergy creation and its implications for partnership growth and effectiveness.

Full text
Abstract:
The emergence of Radical Right Parties (RRPs) has been one of the most studied European political phenomena in the last thirty years, producing a prolific flow of research on both the ideological outlook of the radical right party family and the characteristics of its voters. Nonetheless, the academic debate on these issues is far from being appeased. The following work contributes to the debate by looking at the rise of RRPs in Europe through the perspective of their ideological outlook and by investigating both the supply side and the demand side by means of a data-driven machine learning approach. The literature on RRPs ideological outlook has been prolific and discordant, yet most scholars tend to agree on two main core ideological features that appropriately characterize the radical right family and set it apart from others: nativism and authoritarianism. These core features are complemented by other ancillary elements, on which the debate is more open. The most discussed example is represented by the evolution of RRPs’ positions on economic issues. On this concern, some scholars claim that we are facing a real differentiation within the radical right that needs to be included in the ideological definition of the family, while others argue we are witnessing a series of blurrying processes that intervene on secondary issues holding limited definitory power. As far as radical right voters are concerned, their behavior has been analyzed under many different lenses, still the only condition on which all scholars agree is the centrality of individual attitudes towards immigration in shaping radical right voting. In a few words, we describe the awkward situation where ideologically complex parties, which are not considered single-issue parties, seem to mobilize voters on the basis of a single issue. The aim of the study is to put theoretical studies on the radical right ideology to an empirical test, starting from party-level data and by checking whether those who have been defined as the core features of the radical right family have a crucial role in defining the ideological borders of the radical right or not. Then, we define the potential voting base by following the ideological characterization that emerged empirically. Results confirm the centrality of both nativism and authoritarianism (and Euroscepticism, in addition) in shaping the radical right ideological outlook, while economic positions are the main division line that shapes heterogeneity within the family. The empirical clusters based on the criteria defined previously produce a classification which is coherent with the ones provided by the literature. Results also give empirical evidence of a process of radicalization that characterizes a group of center-right parties, which progressively get close to nativist and authoritarian positions, in continuity with the findings of studies on center-right radicalization. We also confirm that the emergence of a nativist, authoritarian and Eurosceptic set of attitudes among the public, which significantly shapes the probability to vote for a RRP.

Scolnicov, Anat. "Freedom of religion or belief : group right or individual right?" Thesis, London School of Economics and Political Science (University of London), 2006. http://etheses.lse.ac.uk/1925/.

Full text
Abstract:
Freedom of religious and belief is a recognized right in international law. In order to understand, interpret, develop and implement this right, it is important to go back and analyse the fundamental reasoning behind this right. Freedom of religion and belief is a contradictory right: a freedom for self-constraint. It is a double-sided right, a right of expression and a right of identity, two aspects related to individual and group perceptions of this right. Therefore, this right must be understood through a conflict between competing conceptions of individual and group rights. International law should protect the religious freedoms of individuals, and should protect groups only as derivative from the rights of individuals, and never in contravention of them, and generally does so. Current tendencies towards recognising group rights raise concerns, highlighting the importance of this determination. The conceptual analysis of the right serves as a critical tool for discussion of specific conflicts of rights regarding religious freedom, in different area of legal regulation. Different state constitutional structures concerning religion have important implications for analysis of the group/individual conflict. A categorization of constitutional arrangements shows that each presents problems for guaranteeing religious freedom. The constitutional analysis shows religions have public characteristics, and so must abide by human rights norms. The recognition of group rights compromises state neutrality, central to liberal theory. Whatever their constitutional arrangement, states must allow participation in religious communities while protecting individual rights. Particular conflicts are analysed: A conflict between group and individual rights exists between community religious autonomy and women's rights. While international law has been decisive in mandating supremacy of individual rights in this conflict, it has not addressed some of the root causes undermining women's individual rights. Children's religious freedom, in conflict between state, religious group, family, and child, has not always been amply protected in international law, due to absence of differentiation between group and individual interests. Lastly, use of speech by individuals directed against, or in conflict with, religious groups, such as blasphemy, proselytism or hate speech, is addressed. Discussion of these conflicts examines difficulties created, and shows that although some states, based on their respective histories, religions, and cultures, protect the group over the individual, ultimately only an individualistic approach of international law is a coherent way of protecting religious freedom as a human right.

Abstract:
Data acquisition is one of the most important processes used in order to gather and digitize information. The purpose of this project is the design of a Stand-alone Data Acquisition Board specialized for optical communication. Printed Circuit Board (PCB) design is one of the most demanding fields in electronics system design, especially when it includes high speed signals such us the connection of a Double Data Rate RAM memory. Throughout this report we present in detail the steps that we followed so as to create a complete PCB design. The very first step in this process is to acquire the necessary background that one need to understand in order to create PCBs, background that is briefly covered in the report. In addition, there is a detailed description of the criteria based on which we chose the components of the board, as well as of the interconnection of each component. Finally throughout the report we present some of the basic rules that PCB designers need to follow in order to ensure signal integrity, which is vital for the proper operation of the system.

Abstract:
This review aims to critically evaluate the recent literature on the impact of living alone on the well-being of older adults. A literature search was completed in order to identify relevant peer reviewed articles. Fifteen studies were reviewed, forming a heterogeneous group which included: comparing well-being and loneliness in older adults living alone with those living with others, exploring the experiences of older women living alone, predictors of quality of life in those living alone, investigating gender differences, comparing rural with urban living, the impact of social networks and illness on well-being, and the impact of being house-bound on sense of self. Conflicting evidence emerges. In general, living alone appears to have a negative impact on well-being, though not exclusively. Further research is suggested to explore the personal experiences and meanings of their lives to individuals who live alone.
