過去我國實務見解始終否認公司得發行複數表決權特別股,2015年公司法正式引進閉鎖性公司專節後,方承認閉鎖性公司得發行複數表決權特別股,更進一步,2018年修法時放寬至非公開發行之一般股份有限公司均得適用,逐步提供閉鎖性公司及非公開發行公司股權規劃上有更彈性的空間,以符合現今鬆綁管制之國際趨勢,並有利於新創事業籌集資金。本文首先介紹我國特別股規定之演進過程,並討論增訂複數表決權規定後於公司法後將發生之問題,進而介紹美國法相關制度之運作及公司實務之作法作為借鏡,最後歸納數項修正方向建議,以其複數表決制度之適用能更加完備。In the past, the opinions of the courts in Taiwan have always denied that the corporations could issue multiple voting rights shares. Until 2015, the Corporation Law in Taiwan finally amended to include “Close Corporation Section”, it was acknowledged close corporations could issue multiple voting right shares. Moreover, the rules applied to non-public corporations after the amendment of the Corporation Law in 2018, gradually providing more flexible space for the equity planning in close corporations and non-public corporations. The amendment of multiple voting right shares is also in line with the current trend of the world to ease restrictions. The article first introduces the evolution of the rules of preferred stocks, and discussed the problems that may occur after the amendment of multiple voting right shares. Furthermore, it would make a thorough inquiry into the practice of multiple voting right shares in America to conclude some suggestions for the legal system in Taiwan.

The Taiwan e-Learning and Digital Archives Program (TELDAP) is one of the few large-scale national programs focusing on cultural heritage among the world. It is unique due to its inter-disciplinary program that will enhance the cultural, academic, social-economic and educational values of Taiwan Digital Archives. TELDAP is archiving the repository to preserve culture heritage and to support innovative researches and applications. It is crucial that users be able to access the right content at the right context while ensuring the integrity and utility of data. How to sustain the accomplishment of TELDAP becomes an important issue. Linked data, sustainable business model and international collaboration are the keys to lead Taiwan Digital Archives to the next decade. Linking up with new data infrastructure such as DARIAH and RDA, digital archives in Taiwan could continue its work in new ways.

Abstract:
Covid-19, which has attacked the world since the end of 2019, has had a global impact both economically and socially to the world community. Taiwan is one of country categorized as quite successful in dealing with Covid-19. From December 2019 until March 2021 there were 177,578 reported cases in Taiwan with a total of 976 positive cases and resulted in 10 deaths. A very small number compared to other cases that occur in other parts of the world. However, behind all that successful story, migrant workers in Taiwan are still forgotten during the pandemics. Migrant workers, particularly Indonesian migrant workers, who make up the majority in Taiwan, receive the least sympathy and understanding from the community. Several human rights issues confronted Indonesia Migrant Workers during the Covid-19 pandemic, including discrimination, loss of spatial public space, strict mobility limitations, concern for the family in Indonesia, a higher burden of common mental health, and a lower quality of life than local society, difficulty accessing health services and masks, and difficulty returning home. The purpose of this paper is to demonstrate how Indonesian migrant workers' rights were violated in Taiwan during the two phases of the Covid-19 pandemic. The data was collected through interviews, observation, and then was analyzed using the "rights-based" approach. The first phase lasted from December 2019 to March 2020, when the pandemic was still in its early stages, and the second phase lasted from March 2020 to January 2021, after the Taiwan government succeeded in controlling the pandemic

The most typical and catastrophic car-motorcycle crash occurs when a car manoeuvres into the path of an approaching motorcycle at an intersection, which involves a car driver violating motorcycle’s right of way (ROW). In Taiwan, however, motorcyclists are frequently the ROW violator—they are observed to frequently infringe upon the ROW of oncoming vehicles at intersections. Such a ROW crash in which a left-turn motorcyclist crosses in front of approaching traffic appears to be a safety problem in terms of its frequency and accident consequence. Using the National Taiwan Crash Database, the present study estimates a logistic regression model to predict the likelihood of an approach-turn motorcycle-turning crash (relative to a car-turning crash). Results indicate that given a ROW crash where the rider was female, old, drunk, unlicensed, riding a moped, and on a NBU roadway, the likelihood of a motorcycle-turning crash tends to increase. Our study contributes to the existing motorcycle safety research by reporting the determinants of the unique crashes in which the motorcyclist is the ROW violator.

The Financial Supervisory Commission in Taiwan has advocated the importance of corporate governance for several years. The purpose of this study is to act in concern with the policy through the test of the relationship between the corporate governance mechanism, especially Board of Directors’ composition and ownership structure, and the involuntary delisted firms. The study extracts 58 involuntary delisted firms from Taiwan Securities Exchange (TSE) during 1997 to 2007 and matches with 112 similar control firms. The results from probit regression suggest that Board of Directors (BOD) with more number of outside independent directors, larger board size, lower ratio of shares pledged to the total shares, higher seats over control right, and lower control right over right for cash flow may reduce the likelihood of delisting. The study could become monitoring indices for internal examination system, the warning signals for investors, and the reference for the policy makers

Abstract:
A healthy and safe public health environment is a fundamental responsibility of government; achieving it requires collaboration across multiple sectors. Public health services include, forexample, vaccination and quarantine for infectious diseases; health promotion, such as anti-smoking campaigns for noncommunicable diseases; and health insurance for universal health coverage. All these services require intersectoral actions in which the government must play a fundamental role, either partially or totally. The Taiwanese outlook on governmental public health infrastructure and professionalization of public health is given in this paper. It also describes the national governmental public health measures that were employed during the Covid-19 pandemic and discusses the challenges ahead for the country’s governmental public health. Governmental public health is essential and should not be affected by changes in political forms or socioeconomic development. Instead, effective governmental public health will promote these developments while protecting citizens’ right to health.

The subject of this research is the theoretical and practical aspects of legal qualification of virtual property – digital online objects (cryptocurrencies, game property, user accounts, etc.) in Russia and abroad. Virtual property is viewed through the prism of the concept of “asset” / “economic asset”, established in the national and foreign legislation and doctrine. Real right to game objects in online games are considered through the lens of John Locke’s labor theory of property (acquisition), M. Radin’s theory of personality, theories of utilitarianism (deterrence of negative behavior and economic efficiency), law enforcement practices and legislation (South Korea, China, etc.). Real right to online accounts (Google, Yahoo etc.) are examined in the context of allowability of transferring personal and business accounts from the perspective of property and conventional law. The relevance, theoretical and practical importance of this research is are substantiated by supplementing the tangible objects of proprietary right with digital, created in modern reality with the use of digital technologies (cryptocurrencies, tokens, etc.), which requires clarification of their legal regime in the context of the effective legislation of the Russian Federation and foreign countries, ideas for its amendment, and law enforcement practice. The author concludes that the legal doctrine of a number of countries, distinguishing tangible and intangible, virtual objects (game objects, user accounts) recognized the existence and legal status of virtual property (Hong Kong, European Union, South Korea, Russian Federation, Taiwan), qualifying it as the analogue of digital information and content; legally - movable (Taiwan) or other (Russian Federation) property; property (the European Court of Human Rights) or utilitarian (mandatory) digital (Russian Federation) rights; economically – virtual (financial, in form of future income), and material (in form of commercial ties, domain names, etc.) assets (the European Court of Human Rights, Russian Federation).

AbstractBoth general publics and elites have long used labels of left and right as cues for political communication and vote choice in Western democracies. This study examines the utility of these spatial semantics as means of encapsulating major political cleavages in East Asian democracies. Through analysis of public opinion surveys, we investigate the influence of organizational affiliation; views on socio-economic, religious, and ‘new politics’ issues, as well as attitudes toward the political system, as anchors of public understanding of the left–right dimension in Japan, South Korea, the Philippines, and Taiwan. Patterns found in these countries are compared with two ‘Western’ nations in the region, Australia and New Zealand. Results show that citizens’ left–right positions in Japan and the Australasian countries are more clearly structured by well-defined cleavages, such as socio-economic issues and post-materialism, and that parties in these countries compete on the basis of clearer ideological profiles. In contrast, despite high rates of cognition of the left–right scale in South Korea, the Philippines, and Taiwan, left–right orientations are less firmly anchored in attitudes and policy preferences. These differences in publics’ level of ideological conceptualization are likely related to party system development and democratic experience.

This article focuses on the experiences of aging returnees who have moved back to Taiwan after retiring in the United States to illustrate how older return migrants develop a set of narratives about their membership in the homeland. Drawing on data collected from life history interviews with 58 aging return migrants, the author argues that the encounter between aging returnees and a drastically evolving home society demands that aging return migrants carefully negotiate insider-versus-outsider boundaries. These boundary-making practices represent the efforts and struggles of older migrants to justify their decision to resettle in their homeland and to construct social rights as returning migrants. On the one hand, the respondents engage with various forms of ‘inclusionary boundary work’ to explain why they wanted to move back and become part of Taiwan after spending decades overseas. On the other hand, returnees in this study sense striking differences between themselves and their co-ethnics in contemporary Taiwan. These findings point to the ways in which aging migrants grapple with traditions, modernity, and membership when trying to fulfill their right to seek an ideal life across borders.

Colorectal cancer (CRC) is the third most common cancer worldwide. The incidence and mortality rates of CRC are significantly higher in Taiwan than in other developed countries. Genes involved in CRC tumorigenesis differ depending on whether the tumor occurs on the left or right side of the colon, and genomic analysis is a keystone in the study and treatment of CRC subtypes. However, few studies have focused on the genetic landscape of Taiwanese patients with CRC. This study comprehensively analyzed the genomes of 141 Taiwanese patients with CRC through whole-exome sequencing. Significant genomic differences related to the site of CRC development were observed. Blood metabolomic profiling and polygenic risk score analysis were performed to identify potential biomarkers for the early identification and prevention of CRC in the Taiwanese population. Our findings provide vital clues for establishing population-specific treatments and health policies for CRC prevention in Taiwan.

While the mainstream discourses of global climate strikes focus on the issue of generational justice, the experience in the context of East Asia has been under-researched. This study explores the local experience and interpretation of this movement among the young activists in Taiwan. The results show that climate strike is currently impossible in Taiwan. This study discusses this from the intersectionality of age and culture, namely, obsession with academic performance, low awareness of the right to strike, and parental intervention. It also highlights the strategies that young activists employ to reduce these barriers.

Dividend tax policy is one of the important tools of government taxation. Observing the dividend tax policy and the behavior of stock prices around ex-rights will not only shed light on investment strategies, but also give us a clearer understanding of the microstructure of the capital market. Taiwan went through dividend tax policy and National Health Insurance (NHI) supplementary premium changes from 2014 to 2016. Therefore, this paper adopts the event study method to conduct empirical research on this major event period. The research conclusion points out: (1) During the research period, the company studied had a positive cumulative abnormal return before and on the ex-right day, and there was a negative cumulative abnormal return after the ex-right day. (2) When the tax reduction effect is more favorable to investors, there will be only a positive relationship with positive abnormal returns. (3) There is no statistical significance between the dividend tax reform policy and the negative abnormal return after ex-rights. The empirical results of this paper can help to better understand the pricing process of stocks by market microstructure systems such as dividend tax policies and help build a more stable stock market transaction structure. On the other hand, investors and companies can also gain their own investment or dividend policy inspiration from this research.

e22067 Background: Personalized cancer therapy is based on the precept that detail molecular characterization of tumors as well as tumor microenvironment will enable tailored therapies to improve outcomes and decrease toxicity. The goal of personalized therapy is to target aberrations driving tumor growth and prolongs survival, by administering the right drug combination for the right person. However, several practical and technological challenges including tumor heterogeneity, molecular evolution, costs and morbidity of biopsies as well as technical limitation critical for molecular testing. In addition, development of biomarkers should be considered all aspects of drug development, from discovery through to clinical trials. Methods: In Taiwan, we have established a well-qualified reference laboratory with ISO15189 certification for molecular testing of personalized therapy in clinical practice. Based on our innovation, we utilized DNA mass spectrometry platform to develop high sensitive EGFR mutation identification system. Recently, KRAS, BRAF, HER2 together with EGFR were also combined into multiplex gene testing for biomarker-assessed therapeutic decision. To this end, the National Science Council of Taiwan government had supported this project through NRPB (National Research Program of Biopharmaceutical) at the middle of 2011. This facility performed selected molecular tests for cancer patients from medical centers and regional hospitals. Results: A specific program had also been implemented to anticipate the launch of molecular targeting therapy (MTT) and reduce time-to-assess to MTT drugs and experimental therapies. From Jane 2011 to Dec 2012, more than 2,500 patients with lung cancer in Taiwan benefited from this facility. Conclusions: The Taiwan nationwide initiative for tumor molecular profiling is a tool to fight inequalities in access to molecular testing and target therapy, and demonstrates that molecular stratification of tumor for therapeutic decisions is a cost-effective strategy that can be integrated into the national health-care system.

Background: Mifepristone (RU-486) has been approved for abortion in Taiwan since 2000. Mifepristone was the first non-addictive medicine to be classified as a schedule IV controlled drug. As a case of the “misuse” of “misuse of drugs laws,” the policy and consequences of mifepristone-assisted abortion for pregnant women could be compared with those of illicit drug use for drug addicts. Methods: The rule-making process of mifepristone regulation was analyzed from various aspects of legitimacy, social stigma, women’s human rights, and access to health care. Results and Discussion: The restriction policy on mifepristone regulation in Taiwan has raised concerns over the legitimacy of listing a non-addictive substance as a controlled drug, which may produce stigma and negatively affect women’s reproductive and privacy rights. Such a restriction policy and social stigma may lead to the unwillingness of pregnant women to utilize safe abortion services. Under the threat of the COVID-19 pandemic, the US FDA’s action on mifepristone prescription and dispensing reminds us it is time to consider a change of policy. Conclusions: Listing mifepristone as a controlled drug could impede the acceptability and accessibility of safe mifepristone use and violates women’s right to health care.

A new species Tharybis kueishanensis sp. n. (Copepoda: Calanoida: Tharybidae) is described from the inshore surface waters of Kueishan Island off northern Taiwan, which is the first report of Tharybis from the China Seas. Its female is distinguished from the other species of Tharybis by the total body length (1.89–2.12 mm) larger than the other species, the shape of the genital double-somite, which is slightly asymmetrical with a small notch on the distal margin of the right side, and the length of the inner terminal spine of leg 5, which is about 1.5 times of the terminal spiniform projections. The male is distinguished by the presence of 3 triangular projections at the inner middle margin and the tip of the distal segment of the right leg 5.

Abstract:
According to an investigation done by Taiwan Ministry of the Interior in 2013, there was more than 90% of the disability care institutions mainly based on life care. Previous studies have shown that individuals can effectively improve physical and cognitive training, improved in independent living and everyday competence. The purpose of the study was to investigate influence of the intervention program applying functional fitness and cognitive training to disabled residents in the institution. The subjects were disabled persons of a care institution in southern Taiwan and were randomly divided into training and control groups, both having 17 subjects. The age of the subjects was between 56 and 98 years with a mean age of 79.08 ± 10.04 years; the subjects of training group implemented 12 weeks of training on physical and cognitive training, while the control group subjects did not have any training program. The results revealed that subjects of the training group have significantly improved their functional shoulder rotation flexibility of left and right anterior hip muscle group flexibility of right, sitting functional balance of left and right, naming, attention, delayed recall, orientation, and Montreal cognitive assessment (MOCA). The study suggested developing physical fitness programs and physical and cognitive prescriptions for the disabled people of the institutions.

A new species of Cirsium, C. taiwanense Y.H.Tseng & Chih Y.Chang from central-northern Taiwan is reported in this article. This species is similar to C. hosokawae Kitam. in having a densely cobwebby abaxial leaf surface, but differs in its yellow (vs. vivid purplish red) corolla and the angle between the midrib and the lateral veins of the leaf, which is acute as opposed to nearly at a right angle in C. hosokawae. Cirsium taiwanense has 2n = 32 chromosomes, which is different from the other species in the Taiwanese subsect. Australicirsium Kitam. (2n = 34). An identification key to the Cirsium taxa of Taiwan is presented.

Abstract:
This article intends to examine the background of Taiwan’s legalization of same-sex marriage in 2019 and its implications for the Asian region. It argues that such legalization is not only to ensure marriage equality in Taiwan but is also likely to create a snowball effect on the regional level. This study utilizes the concept of equality to discern the struggle of same-sex couples in advocating for their right to marry. The success of Taiwan can undoubtedly proffer a new spirit for the LGBT community in the region. This study was conducted in qualitative research, while the data collected from secondary sources include relevant articles, books, and webpage on a website. This article found that Thailand, Cambodia, and Vietnam are potentially the following countries to approve same-sex marriage after Taiwan. The reasons are that they are considered open-minded countries, their track record in responding to the issue of same-sex marriage, and the struggles of non-governmental organizations, activists, the LGBT community, and pride festivals in these countries. Tortanus (Atortus) taiwanicus may be distinguished from other species of the subgenus by the thoracic somites 4 and 5 being fused and protruding middorsally in the female, and by urosomal somite 2 of the male being furnished on the right side with postero-lateral and postero-ventral processes of unequal size, as well as by the shape of the male's fifth legs. This species may be endemic to Taiwan. Une nouvelle espece, Tortanus taiwanicus, de la famille des Tortanidae (Copepoda, Calanoida) est decrite et illustree du zooplancton des eaux cotieres de Hualien, Taiwan. AbstractThis paper investigates elite-level partisan differences along the socioeconomic dimension in three developed East Asian democracies – Japan, South Korea and Taiwan. On the one hand, the mainstream literature in welfare studies and party politics expects left- and right-leaning parties should vary significantly in utilizing social policy promises. On the other hand, the path dependency logic tells us that left–right difference should be found over particularistic benefits, such as agricultural subsidies or construction projects, considering that these were central means for right-leaning parties to maintain their power during the developmental state period in the three countries. Using an original bill-sponsorship data set between 1987 and 2012, we find that there has not been any substantial difference in the agenda setting of conventional social welfare bills between left- and right-wing government periods. However, a clear elective affinity can be observed between established right-wing parties and particularistic benefits. The paper shows that contextualizing key political actors' preferences can lead to a more systematic understanding of political dynamics behind the socioeconomic dimension in non-Anglo-European countries.

From the early 1990s, the study of Taiwan has flourished into what is almost a field in its own right. Yet, despite this growth, Taiwan Studies remains an unstable and inchoate area of scholarship. Beyond key issues like democratization, national identity and the “miracle economy,” it has no dominant problematics, discursive structures or proscribed methodologies. And, unlike Chinese Studies, it is too small a field to be clearly demarcated into sub-fields.As a result, the study of Taiwan is unusually open to any and all possible topics for study. Indeed, the free play of the range of subjects in Taiwan studies is one aspect of the continuing establishment and consolidation of the meaning of “Taiwan” itself, and of a Taiwanese identity, over the last ten to 20 years.The Minor Arts of Daily Life: Popular culture in Taiwan is in the first instance an excellent contribution to this developing field, but it is also indicative of the challenges to producing legitimate academic knowledge of Taiwan.The book begins with a review of Taiwanese history, which, even now, is a necessary opening step to establish the discursive boundaries of a scholarly project on Taiwan. The introductory chapter presents what has become a received history of Taiwan, organizing it by ruling regimes over the last four centuries. This history was established most clearly in English by the work of Thomas Gold in the mid-1980s and here it is filled out with much detail and nuance.The body of the book is divided into four sections organized into generalizing categories: religion, the public sphere, economic life and popular entertainment. The methodologies include social history in Morris's chapter on baseball, anthropology in Katz's work on chicken-beheading rites, and media studies in Chu's chapter on talk-back television. Simon's work on gay and lesbian identity and Chin-ju Lin's chapter on Filipino domestic workers in Taiwan also add important critical dimensions.

AbstractIn the foreland area of western Taiwan, some of the pre-orogenic basement-involved normal faults were reactivated during the subsequent compressional tectonics. The main purpose of this paper is to investigate the role played by the pre-existing normal faults in the recent tectonics of western Taiwan. In NW Taiwan, reactivated normal faults with a strike-slip component have developed by linkage of reactivated single pre-existing normal faults in the foreland basin and acted as transverse structures for low-angle thrusts in the outer fold-and-thrust belt. In the later stage of their development, the transverse structures were thrusted and appear underneath the low-angle thrusts or became tear faults in the inner fold-and-thrust belt. In SW Taiwan, where the foreland basin is lacking normal fault reactivation, the pre-existing normal faults passively acted as ramp for the low-angle thrusts in the inner fold-and-thrust belt. Some of the active faults in western Taiwan may also be related to reactivated normal faults with right-lateral slip component. Some main earthquake shocks related to either strike-slip or thrust fault plane solution occurred on reactivated normal faults, implying a relationship between the pre-existing normal fault and the triggering of the recent major earthquakes. Along-strike contrast in structural style of normal fault reactivation gives rise to different characteristics of the deformation front for different parts of the foreland area in western Taiwan. Variations in the degree of normal fault reactivation also provide some insights into the way the crust embedding the pre-existing normal faults deformed in response to orogenic contraction.

Purpose This study established the performance-intensity function for Beijing and Taiwan Mandarin bisyllabic word recognition tests in noise in native speakers of Wu Chinese. Effects of the test dialect and listeners' first language on psychometric variables (i.e., slope and 50%-correct threshold) were analyzed. Method Thirty-two normal-hearing Wu-speaking adults who used Mandarin since early childhood were compared to 16 native Mandarin-speaking adults. Both Beijing and Taiwan bisyllabic word recognition tests were presented at 8 signal-to-noise ratios (SNRs) in 4-dB steps (−12 dB to +16 dB). At each SNR, a half list (25 words) was presented in speech-spectrum noise to listeners' right ear. The order of the test, SNR, and half list was randomized across listeners. Listeners responded orally and in writing. Results Overall, the Wu-speaking listeners performed comparably to the Mandarin-speaking listeners on both tests. Compared to the Taiwan test, the Beijing test yielded a significantly lower threshold for both the Mandarin- and Wu-speaking listeners, as well as a significantly steeper slope for the Wu-speaking listeners. Conclusion Both Mandarin tests can be used to evaluate Wu-speaking listeners. Of the 2, the Taiwan Mandarin test results in more comparable functions across listener groups. Differences in the performance-intensity function between listener groups and between tests indicate a first language and dialectal effect, respectively.

However, recognizing the director has the information right does not mean the director could arbitrarily request any information he/she wants. Rather, such right is with limitation. Besides, the discussion whether to explicitly provide director information right reveals that the community in Taiwan does not have consensus on certain fundamental issues, such as the role a director play, the meaning and scope of the director's supervision right, etc., that lead to misunderstanding to the director's information right; furthermore, the discussion regarding the scope of the director's information sharing and the remedial measures available are absent. This article considers the above issues to fill the vacuum.

However, few studies have focused on the neuroscientific facet of suicide in the context of late-life depression (LLD).Methods:We recruited 114 participants of LLD (28 with history of suicide attempt and 86 without) and 47 elderly controls. They received MRI scanning and behavioral assessment. White matter hyperintensity (WMH) was quantified by an automated segmentation algorithm and graph theoretical analysis was applied to resting-state fMRI. We used ANCOVA to compare group difference in WMH loading and multivariate generalized linear model to compare global and local topological parameters in fMRI signals, controlling for demographics. Partial correlation was conducted between imaging parameters and behavioral data in group of suicide attempters.Results:We found significant higher WMH in suicide attempters than those of LLD without suicide attempts and elderly controls (F =7.091; p = 0.001). Suicide attempters also had increased betweenness centrality (BC) in right superior occipital gyrus (SOG) (Bonferroni corrected), right precuneus (False positive corrected) and right superior temporal gyrus (uncorrected) and decreased BC in left hippocampus (uncorrected). In suicide attempters, higher BC in right SOG correlated with higher WMH, higher depression severity, higher illness awareness and insight, and lower cognitive function (digit backward), while higher BC in right precuneus correlated with higher decrease awareness and insight and higher cognitive function (digit backward).Conclusion:Resonating with the vascular hypothesis in LLD, higher WMH was found in those having history of suicide attempts. However, the re-organized brain topology changes are related with divergent cognitive function and convergent heightened disease insight.

AbstractDriven by the need to address the immediate public health threats of the COVID-19 pandemic, this has seen a rise of the technocratic mode of governance around the world. A technocratic approach is evidence-based and relies upon the guidance of experts to respond to the public health crisis. The rise of technocracy reflects a utilitarian calculus that seeks to preserve the greater good. Taiwan’s pandemic response exemplifies the strengths and weaknesses of this type of governance. Based on an analysis of the relevant case law of the Taiwan Constitutional Court, legislation, and political developments this Article takes a legal-historical look and traces the current technocratic approach—defined for this Article as an experts-driven and procedural-driven process—which is a hallmark of Taiwan’s pandemic response. Examining Taiwan’s pandemic response through a human rights lens sheds light on a more complex relationship between the collective right to health and life, and the individual rights to health, work, privacy, and liberty during the pandemic.

To understand the gaps between current bioethics education and the requirements of practicing nurses, a semistructured questionnaire was used to invite the directors of nursing departments at all 82 teaching hospitals in Taiwan to participate in this survey. The response rate was 64.6%. Through content analysis we obtained information about previous bioethical training, required themes and content, recommended teaching strategies, and difficulties with education and its application. The results suggest that Taiwanese nursing personnel need to be instilled with both self-cultivation of morality and mental cultivation to acquire nursing virtues and the right attitudes toward bioethical issues. Good communication skills to prevent damage to the harmonious relationships between patients, their families and medical team members, policies that support the provision of systematic formal knowledge of ethics, small group training, and clarification of values were also shown to be important in bioethics education.

This article examines the performance of university research commercialisation in Taiwan and Malaysia and specifically discusses the role of incubation intermediaries. Through case study and patent analysis, this article draws lessons from Taiwan and further discusses the mechanisms in place for the successful commercialisation of university research. Lessons from the case offer insights for Malaysia on how university incubation intermediaries can be reorganised to promote better commercialisation outcomes. The Taiwanese experience illustrates that in the right institutional settings—and particularly with the presence of innovative science and technology parks—university incubators tend to promote favourable commercialisation outcomes. More importantly, the ability of university incubators to source for external knowledge and risk capital support positions them to be more effective as intermediaries. Other key success factors include establishing an adequate intellectual property management system and having adequate human resources equipped with intellectual property knowledge. This article further deliberates policy implications.

Reports of envenomation induced by Daboia siamensis, a medically important venomous snake in Taiwan, are rare, and species identification might not be definitive. This article reports the complete course of a definite D. siamensis bite. The patient in this report was one of the authors who was bitten on the right palm near the base of the index finger by D. siamensis. The patient experienced local effects, neurological manifestations, and acute kidney injury. The laboratory analysis revealed elevated D-dimer and coagulopathy. The patient was administered 8 vials of antivenom and did not undergo surgical intervention or endotracheal tube intubation, but serum sickness occurred 8 days after antivenom administration. The horse immunoglobulin produced by the Centers for Disease Control, R. O. C. (Taiwan), against D. siamensis was effective and safe in the treatment of the patient. However, the best antivenom administration strategy remains unclear and requires further study.

A high quality workforce with global competence is the key to survive today’s globalized market. The Taiwan government published its White Paper of International Education for Primary and Secondary Schools in 2011. This research examined the relative importance of objectives of international education announced by the government, and to determine the most efficient international academic exchange approaches for achieving the objectives. Analytic hierarchy process (AHP) was adopted as the major calculation instrument, and a self-developed questionnaire was administered to school principals in Taiwan. The research results indicated that cultivating keen observation capability for international comparison, understanding critical global issues, and understanding interdependence of global relationships are the most important objectives for international education at the primary and secondary levels. Moreover, as different implementation approaches may contribute to different objectives, it is important for school principals to select the right implementation approaches to fit their unique environmental and educational focus.

This research differentiates counter-public non-parks from public parks to look into the spatial politics and social processes behind the productions of urban parks and open green in the city of Taipei. The colonial modernity ushered in the concept of public parks in Taiwan, though under the authoritarian ruling the meaning of publicness was problematic and the discourse of public sphere underdeveloped. The democratization of Taiwan activated the grassroots engagement in politics and further nurtured the bottom-up mechanism of counter-publics in conservation movement and in claiming their right to the city. The paradigm of counter-public non-park defied the general definition and use patterns of public parks, and advocated a more socially inclusive and culturally diverse program for the alternative public green. It also motivated the transformation of settlement-into-park to settlement-park and responded to the call for dynamic urban conservation.

Abstract. In this study, the extreme rainfall event on 2 June 2017 along the northern coast of Taiwan is studied from a modeling perspective. While a peak amount of 645 mm was observed, two 1 km experiments produced about 400 and 541 mm, respectively, using different initial and boundary conditions, and thus are compared to isolate the key reasons for a higher total amount in the second run. While the conditions in the frontal intensity and its slow movement are similar in both runs, the frontal rainband remains stationary for a long period in this second run due to a frontal disturbance that acts to enhance the prefrontal southwesterly flow and focuses its convergence with the postfrontal flow right across the coastline. Identified as the key difference, this low-pressure disturbance is supported by the observation, and without it in the first run, multiple slow-moving rainbands pass through the coastal region and produce more widely spread but less concentrated rainfall, resulting in the lower peak amount by comparison. To explore and test the effects of Taiwan's topography in this event, two additional 1 km runs are also used. It is found that the removal of the terrain in northern Taiwan allowed the postfrontal cold air to move more inland and the rainfall became less concentrated, in agreement with a recent study. Also, when the entire island topography of Taiwan is removed, the result showed significant differences. In this case, the blocking and deflecting effects on the prefrontal flow are absent, and the heavy rainfall in northern Taiwan does not occur.

Abstract:
Three to four tropical cyclones (TCs) by average usually impact Taiwan every year. This study, using the Developmental Tested Center (DTC) version of the Hurricane WRF (HWRF) model, examines the effects of Taiwan’s island surface heat fluxes on typhoon structure, intensity, track, and its rainfall over the island. The numerical simulation successfully reproduced the structure and intensity of super Typhoon Haitang. The model, especially, reproduced the looped path and landfall at nearly the right position. Sensitive experiments indicated that Taiwan’s surface heat fluxes have significant influence on the super Typhoon Haitang. Compared to sensible heat (SH) fluxes, latent heat (LH) is the dominant factor affecting the intensity and rainfall, but they showed opposite effects on intensity and rainfall. LH (SH) flux of Taiwan Island intensified (weakened) Typhoon Haitang’s intensity and structure by transferring more energy from (to) surface. However, only LH played a major role in the looped path before the landfall of the Typhoon Haitang.

This qualitative case study explores the experiences of two book sales representatives when introducing textbooks to university English teachers in Taiwan. The participants were two experienced book sales representatives working for two large book companies. Analysis of semistructured interviews showed that the two sales representatives had considerable influence on teachers’ decision-making concerning textbook evaluation and selection. These two representatives not only used information from previous users and publishers to introduce textbooks to teachers and students, but they also used their professional positions and social networks to connect teachers across institutions. They collected feedback from previous users (teachers and students) to aid their introduction of textbooks to prospective users. By analyzing the needs of students and teachers across institutions, the two representatives helped teachers choose the right textbooks for students. This study sheds new light on research investigating the views and experiences of key stakeholders in English textbook evaluation, promotion, and consumption.

Abstract:
Colorectal cancer (CRC) is the third most commonly diagnosed malignancy and the second leading cause of cancer-related deaths in the world. It has been the most prevalent malignancy in Taiwan for consecutive thirteen years. Despite the diversity of its etiologic and pathophysiologic factors, a biological process named as epithelial-mesenchymal transition (EMT) is indispensable in the progression of epithelial cancer. Our aim is to investigate the correlation between the expression of 8 EMT-related proteins (E-cadherin, β-catenin, claudin-1, CD44, N-cadherin, fibronectin, vimentin, S100A4) and the clinicopathologic features of CRC in Taiwan, along with the DNA CpG epigenetic status of CD44 gene. In immunohistochemical assessment, decreased expression of E-cadherin is statistically associated with the progression of cancer stage, while decreased expression of claudin-1 as well as increased β-catenin nuclear translocation and N-cadherin expression is statistically associated with the progression of histopathologic grade. E-cadherin, nuclear β-catenin and claudin-1 are also associated with other important prognostic factors, including nodal metastasis, tumor deposits, and elevated serum CA 19–9 levels. In addition, the left-sided colon and rectal cancers show increased nuclear translocation of β-catenin compared to the right-sided colon cancers, while the rectal cancers show increased fibronectin expression compared to the right-sided and left-sided colon cancers. Moreover, vimentin is aberrantly expressed in one case of signet-ring cell carcinoma. The DNA methylation levels of CD44 gene promoter between the tumoral and non-tumorous tissues by NGS comparison showed statistical difference on six CpG sites. However, such difference may not be sufficient because these DNA methylation proportions are too low to inactivate CD44 gene. Our results demonstrate the expression of E-cadherin, claudin-1, and nuclear β-catenin is closely related to the clinicopathologic prognostic determinants of CRC in Taiwan. The DNA methylation level of CD44 gene and its protein expression, however, show no correlation with the clinicopathologic features in CRC.

AbstractTropical cyclones (TCs) tend to change translation direction and speed when moving across Taiwan’s Central Mountain Range (CMR), which makes forecasting of landfalling points a challenging task. This study examines the statistical characteristics of unusual TC tracks around Taiwan Island during the 66-yr period of 1949–2014. Results show that 1) about 10% more TCs were deflected to the right than to the left as they moved across the CMR, but with more occurrences of the latter on Taiwan’s eastern coast and southern strait; 2) TCs around Taiwan Island moved slower than the average speed over the western North Pacific Ocean but then exhibited anomalous acceleration along Taiwan’s eastern coast and anomalous deceleration over the southern Taiwan Strait; 3) about 33% of TCs passing the island were accompanied by terrain-induced secondary low pressure centers (SCs), more favored in the northwestern, southwestern, and southeastern quadrants, with the TC–SC separation distance varying from 33 to 643 km; 4) about 36% of landfalling TCs experienced discontinuous tracks, with an average separation distance of 141 km at the time when TC centers were replaced by SCs, and smaller Froude numbers than those associated with continuous-tracking TCs; and 5) a total of 12 TCs had looping movements near Taiwan Island, most of which were accompanied by SCs on their southern or western sides. Results also indicate that a stronger SC was likely to take place when a stronger TC approached the CMR with a shorter separation distance and that a weaker SC was likely to take place when a weaker TC approached the CMR with a longer separation distance.

On 2 April 2007, a strong bow echo struck southern Taiwan, with a peak surface wind speed of 26 m s−1. On observation, the rear inflow jet (RIJ) was located at the northern flank and only one anticyclonic vortex dominated behind the bow structure. This case was different from commonly occurring cyclonic–anticyclonic pairs of bookend vortices, and was investigated through data analysis, model simulation, and vorticity budget diagnostics. The present bow echo formed at the leading edge of a cold front, with favorable ingredients of instability, large west-southwesterly vertical wind shear, and dry air aloft. Farther behind the front, however, stable conditions could not support deep convection and the portion north of the RIJ was therefore missing. Within a frontal flow structure, the developing mechanism of the anticyclonic vortex also differed from typical cases. As the low-level (west-southwesterly) vertical shear pointed from right to left of the line, and the tilting effect of updrafts generated positive (negative) vorticity at the front (rear) side. South of and below the RIJ, the anticyclonic vorticity was enhanced by the stretching and tilting effect of system-generated horizontal vorticity via a sinking motion. These sources of vorticity were then advected downward and southwestward by the postfrontal flow near the surface.

China, while insisting that the definition of "international waters" does not apply to the entire Taiwan Strait, especially emphasizes which maritime zones of sovereignty and jurisdiction predominantly comprise its water area - the territorial sea and the exclusive economic zone. The article examines in detail the restrictions that exist both at the level of national legislation of the PRC and on the part of other states concerning the exercise of the right of innocent passage of foreign warships through the territorial sea. In addition, it shows how the implementation of various types of naval activities, including reconnaissance activities, within the exclusive economic zone of a coastal state has become the stumbling block that has divided certain countries into two opposing camps. The PRC and the United States, in this case, are the main antagonists on this issue. It is concluded that the existence of these contradictions, which could not be agreed even with international mediation, significantly increases the level of conflict both in the South China Sea in general and in the waters of the Taiwan Strait in particular.
