Abstract:
A theoretical account of property rights needs to identify what, if anything, is distinctive about property rights as opposed to other sorts of rights; what makes them the sorts of rights that they are. An important and prominent account of the distinctiveness of property rights claims that they are rights to things. I argue against this view: I show that a government-issued licence (to fish or to drive a taxi or to operate a radio station, say) is not a right to a thing but should nevertheless count as a property right. I consider two different arguments for this rights-to-things view: one is based on the Hohfeldian structure of property rights, and one relies on the importance of information costs in the law of property. While each of these arguments teaches us important lessons about property, none can properly support the conclusion that property is rights to things. I suggest that abandoning the rights-to-things view of property can lead to important insights into property theory more generally.

Abstract:
In the paper the property rights of spouses are studied, their specific features are identified, as well as the features of individual property rights of spouses. On the basis of the conducted scientific research, the author came to the conclusion that the property rights of spouses are those powers of a property nature, which are defined by family legislation or other sources of family law, arise in connection with the state registration of marriage and can be exercised by the spouses or one of them as bearers of these rights; rights that arise in connection with the exercise of the right of joint ownership of the property of the spouses or the right of personal private ownership of the property of one of the spouses or from alimony obligations of the other spouse. The paper highlights the general and special features of property rights of spouses, including that can be alienated in a contractual manner (regarding rights to proper property), inalienability and personal character (regarding the right to maintenance). The property rights of spouses include: property rights of spouses arising from the right of personal private ownership of certain property, property rights of spouses arising from the right of joint ownership of property acquired during marriage, the right of one of the spouses to enter into an agreement with the other person regarding the disposal of their a share of the right of joint co-ownership of the spouses in the case of its determination and allocation in kind or determination of the procedure for using joint property, the right of the spouses to divide the property that is the object of the right of joint co-ownership, as well as to determine the methods and procedure for dividing the corresponding property, the right to dispose of joint property and determine its legal regime after the death of one of the spouses and both of them by concluding a will of the spouses, the right to maintenance in the event that the disabled spouse needs financial assistance, the right to maintenance of the wife during pregnancy, the right to maintenance of one of the spouses with whom the child lives, the right to determine the methods of providing maintenance to one of the spouses.

Abstract:
This article addresses over the regulation of the surface right in the Peruvian Law along with its main points of contact with other important institutions in the field of real estate. The author points the evolution of this figure in the Peruvian legislation and determinates its legal nature and its characteristics, establishing its relation with the principle of real estate accession property and the implications of the transitional division that the surface generates. In other relevant aspects, the article addresses the ways of acquisition of such ownership, the role of inscription in the configuration of the surface, the reimbursement of the value of the buildings and the extinction of this property right.
Este artículo trata sobre la regulación del derecho real de superficie en el Derecho peruano y sus principales puntos de contacto con otras importantes instituciones en el ámbito inmobiliario. El autor aborda la evolución de dicha figura en la legislación peruana y determina la naturaleza jurídica y características del referido derecho, estableciendo su relación con el principio de accesión inmobiliaria y las implicancias de la división transitoria predial que genera la superficie. En otros aspectos relevantes, en este artículo se desarrollan las formas de adquisición de dicha titularidad, el papel de la inscripción en la configuración de la superficie, el reembolso del valor de las edificaciones y la extinción de este derecho real.

When we think on initiatives on access to and reuse of data, we must consider both the European Intellectual Property Law and the General Data Protection Regulation (GDPR). The first one provides a special intellectual property (IP) right – the sui generis right – for those makers that made a substantial investment when creating the database, whether it contains personal or non-personal data. That substantial investment can be made by just one person, but, in many cases, it is the result of the activities of many people and/or some undertakings processing and aggregating data. In the modern digital economy, data are being dubbed the ‘new oil’ and the sui generis right might be con- sidered a right to control any access to the database, thus having an undeniable relevance. Besides, there are still important inconsistences between IP Law and the GDPR, which must be removed by the European legislator. The genuine and free consent of the data subject for the use of his/her data must remain the first step of the legal analysis.

Abstract:
The article considers contractual designs aimed at transferring exclusive rights to industrial property. The problem of the contractual process was identified when concluding a contract on the transfer of a set of exclusive rights. Based on the study, a number of changes to Russian laws have been proposed. First of all, this applies to a commercial concession contract. The author proposes to amend the Civil Code of the Russian Federation by supplementing the article on commercial concession with the right of organizations that do not conduct commercial activities to conclude the same contracts on a general basis. The appropriateness of applying the classification of transactions into real and consensual ones in relation to this contract is justified. The peculiarities of transfer of the complex of exclusive rights to objects of industrial property with participation of social enterprises under the legislation of the Russian Federation are studied.

Abstract:
As part of an overarching effort to better identify the problems faced today by low-income people and by those with limited access to basic housing, this paper assesses the property rights system in Guyana and the way it affects the real estate/property/ land market and the overall security of the wealth base of individuals. The assessment is based on the methodology of Reality Check Analysis (RCA). RCA allows for a breakdown and mapping of the variables that have contributed to the current bottlenecks in Guyana and as well as poverty, malaise, and lack of affordable housing. With RCA it is possible to identify the correct questions that lead to the appropriate answers regarding policy recommendations.
