Lacan recomienda la lectura de Kierkegaard, un autor que Freud no cita, con lo cual nos invita a una experiencia transdisciplinaria sobre la noción de repetición, como elemento de lo inconsciente, en un intento de dar mayor profundidad filosófica al propio Sigmund Freud. Se parte de la pregunta de Kierkegaard si la repetición es posible. Para los presocráticos no era posible ya que el mundo es inmóvil para ellos, mientras para Heráclito estaba en un continuo devenir dialéctico, la cual se anticipaba a Hegel, filósofo bastante estudiado por Lacan. Para Kierkegaard, la repetición es la vida misma. Nasio nos muestra dos tipos de repetición: la sana y la patológica, asunto que tratamos de dilucidar aquí, de la que podemos liberarnos por la elaboración a través de la reviviscencia, síntesis de la inmovilidad presocrática y el devenir heraclitiano.Abstract Lacan recommends reading Kierkegaard, an author who Freud has not cited at all, which invites us to a transdisciplinary experience on the notion of repetition, as an element of the unconscious mind, in an attempt to provide greater philosophical depth to Sigmund Freud. Our starting point is Kierkegaard's question whether repetition is actually possible. For pre-Socratics, it was not possible since the world was immobile for them, while for Heraclitus, the world was in a continuous dialectical state of becoming, which anticipated Hegel, a philosopher Lacan has studied thoroughly. For Kierkegaard, repetition is life itself. Nasio shows us two types of repetition: the healthy one and the pathological one, an issue that we hereby try to elucidate. We can liberate ourselves from repetition by elaborating through reviviscence, synthesis of the pre-Socratic immobility and the Heraclitian becoming.

Resulta habitual que muchas cofradías penitenciales tengan como titular una imagen de Nuestro Padre Jesús Nazareno. Esta invocación puede resultar extraña, sobre todo en el campo teológico. ¿Se trata de una reviviscencia patripasiana? No lo parece. En el presente artículo se pretende fijar el momento histórico en el que comienza a utilizarse, el siglo XVII, rastreándola en los autores espirituales y en la oratoria sacra precedente y coetánea. Por último, se apuntan algunas líneas de interpretación de este peculiar título cristológico.

La ricerca sul tema “Disponibilità degli effetti della risoluzione e reviviscenza del contratto” analizza se, e come, gli effetti della risoluzione possano essere oggetto di disposizione ad opera delle parti. In particolare, se, ed in che modo, il contraente non inadempiente che abbia agito in risoluzione, in via giudiziale o stragiudiziale, possa incidere unilateralmente sulla sorte finale del vincolo contrattuale paralizzando l’effetto risolutivo già in atto attraverso una tardiva richiesta di adempimento. La questione della reversibilità dell’effetto risolutivo, che si è posta in forma paradigmatica nell’ambito della diffida ad adempiere, ha diviso dottrina e giurisprudenza per oltre trent’anni: laddove la giurisprudenza ha costantemente ammesso il creditore a recuperare il contratto risolto e a pretenderne ancora l’esecuzione, ritenendo che la risoluzione concreti un vantaggio unilaterale del creditore, da lui sempre liberamente disponibile, la dottrina ha optato per la irreversibilità dell’effetto risolutivo, in ossequio al principio di tutela dell’affidamento dell’inadempiente ad aver certezza sulla sorte finale del vincolo e a non rimanere esposto a tempo indefinito agli arbitri di controparte. Sono di recente intervenute le Sezioni Unite (Cass., sez. un., 14 gennaio 2009, n. 553), che, in direzione diametralmente opposta rispetto al granitico orientamento giurisprudenziale, hanno integralmente accolto i rilievi critici della dottrina ed escluso la disponibilità dell’effetto risolutivo derivante dallo spirare inutile del termine fissato in diffida, con ciò precludendo al contraente non inadempiente di tornare a esigere l’adempimento a risoluzione avvenuta.

Abstract:
L’oggetto della ricerca è la reviviscenza delle norme, intesa come ripresa in vigore di norme già abrogate a seguito del venir meno della norma abrogatrice, soprattutto in relazione ai profili della certezza del diritto. Si individuano le varie tipologie di reviviscenza possibile a seconda della causa che la determina (per abrogazione della norma abrogatrice, per illegittimità della norma abrogatrice…), specificando caso per caso quali siano gli effetti prodotti in concreto nell’ordinamento. Si cerca infine di dare una risposta al quesito se la reviviscenza sia una causa o una conseguenza della crisi della certezza del diritto e, al contempo, se essa sia sempre e comunque da considerarsi come fattore di incertezza. Si evidenziano casi in cui la reviviscenza può essere considerata un fenomeno che garantisce esiti più solidi e certi rispetto ad altre soluzioni (ciò, in particolare, con riferimento alla reviviscenza a seguito di illegittimità di norma abrogatrice).
The subject of the research is the restoration of laws, which happens when an abrogated law re-enter into force following the repeal of the original abrogating law; the research particularly analyses the above subject in relation to legal certainty. The research identifies the restoration of laws according to its causes (ex: restoration due to the repeal of the abrogating law or due to the illegitimacy of the abrogating law…) by specifying how each case would impact the legal system. The research also tries to answer the question whether the restoration is the cause or, on the contrary, the effect of the legal certainty crisis and whether it should always be considered as an element of uncertainty. It will also highlight that in some situations the restoration could be rather considered as a positive factor to guarantee a better outcome than other solutions (especially regarding the restoration due to the illegitimacy of the abrogating law).

40 000 disparitions de personnes sont signalées chaque année en France mais que signifie disparaître aujourd’hui ? Nous verrons à travers ce travail de thèse que derrière cette appellation se cache une multitude de scénarios que doivent envisager les enquêteurs pour résoudre l’énigme de l’absence. Alors, parmi toutes les hypothèses qu’ils vont soulever se situe l’objet spécifique de notre recherche : les disparitions criminelles que nous étudierons à partir des différents actes d’enlèvement, de séquestration et d’homicide. Nous en ferons une étude qualitative basée sur des affaires parues dans la presse, des écrits de victimes comme Natascha Kampusch et Sabine Dardenne mais aussi sur des cas issus de notre pratique clinique en milieu carcéral. Enfin, dans cette recherche exploratoire nous analyserons et interrogerons d’après une lecture analytique les mécanismes psychiques inhérents à ces actes criminels du point de vue des auteurs, des victimes et de leurs familles en fonction des modes opératoires
40 000 disappearances of people are reported every year in France. But what does it mean to disappear today? We will see through this thesis that behind this appellation there is a multitude of scenarios that must be envisaged by investigators to solve the absence’s enigma. And among all explored tracks there is the specific object of our research : criminal disappearances. We will analyze it from various acts of kidnapping, sequestration and murder. We will do a qualitative study based on press reports, written testimonies of victims such as Natascha Kampusch and Sabine Dardenne and also from our clinical practice in jail. Through this methodology of research and analytic method we will answer psychic mechanisms putting into this criminal acts by criminal operational modes and from point of view of perpetrators, victims and their families

Abstract:
Une importante recherche bibliographique a permis de faire une synthese des principales connaissances sur la reviviscence et de discuter les implications biologiques de ce terme. Afin de pouvoir etablir des criteres ultrastructuraux d'anhydrobiose et de reviviscence chez des hepatiques du genre riccia, des caracteristiques cytologiques des differents tissus des thalles en vie active ont tout d'abord ete determinees. Cette analyse a revele l'existence de cellules jamais signalees jusqu'a ici: les cellules rhizoidogenes, a l'origine des rhizoides. Puis, l'etude ultrastructurale de thalles desseches, conserves en herbier depuis 15 jours a 50 ans a permis de distinguer des manifestations cellulaires de senescence, variables en intensite, notamment en fonction de la nature du tissu, des conditions de dessiccation et de la duree de conservation des echantillons. Les differentes methodes de rehydratation utilisees confirment l'importance de cette phase sur le maintien de l'aptitude a la reviviscence. Le suivi ultrastructural de thalles rehydrates provenant des memes lots que ceux d'echantillons desseches deja etudies, a permis de differencier les hepatiques viables des hepatiques non viables. Des criteres d'anhydrobiose et de reviviscence ont ete determines. Ce travail montre egalement les sequences de reactivation cellulaire suivies chez des thalles conserves depuis quelques mois, mais aussi pour des cas extremes de thalles gardes en herbier depuis 25 ans. L'importance du nucleole au cours de la reviviscence et ce, des les premieres minutes de rehydratation, est soulignee, notamment dans les cellules meristematiques apicales et rhizoidogenes. La comparaison des resultats obtenus avec ceux tires de la synthese bibliographique, permet de redefinir la notion de reviviscence

Dans l'extrême-sud de Madagascar, l'Androy, il existe une croyance populaire à la reviviscence des morts ou le Lolo selon le terme vernaculaire. Cette reviviscence, héréditaire et collective dans certains clans, sporadique et individuelle dans d'autres, viendrait d'une malédiction proférée à cause d'une faute grave. La variété des cas dépendrait de la formulation de la malédiction. L'intérêt du sujet est double. Dans le domaine de l'anthropologie, nous connaitrons le fondement de cette croyance discriminatoire envers ceux à qui est imputée la reviviscence. Quant au théologique, dans le sillage de l'inculturation, nous saurons l'incidence de cette croyance sur la foi en la résurrection. Pour ce faire, nous avons étudié deux clans : les Anatsosa et les Ntantotobato. Puis, comme l'évangélisation est à sa première phase dans l'Androy, nous avons pris connaissance de la manière dont les premiers chrétiens, selon le témoignage du nouveau testament, ont proclame et élaboré leur foi en la résurrection. Et cette recherche nous a amenés à suggérer quelques propositions pratiques pour la pastorale catéchétique et liturgique dans l'Androy
At Androy, in the far-south of Madagascar, there exists a popular belief of the coming back to life of the dead or the Lolo according to the vernacular term. This coming back to life of the dead, hereditary and collective in some tribes, sporadic and individual in others, would be a result of curse uttered because of a grave offense. The type of case would depend on the formulation of the curse. Interest in this subject is two-fold. In the anthropological domain, we know the foundation of this discriminatory belief towards those to whom this coming back to life imputed. As for the theological, in the wake of the enculturation, we will know the effect of this belief on faith in the resurrection. In order to accomplish this, we have studied two tribes: the Anatsosa and the Ntantotobato. Then, since evangelization is in its primal phase in Androy, we have perused the manner in which the first Christians, according to New Testament testimony, have proclaimed and elaborated their faith in the resurrection and this research has brought us to recommend some practical suggestions for catechetical and liturgical ministry in Androy
