Abstract:
The article deals with the features of enterprise restructuring in bankruptcy. Ukrainian and foreign scientific literature, periodicals and materials existing legislation are analyzed. We have investigated the concept, analyzed the common signs of enterprise restructuring, as well as specific properties that reflect the essence of restructuring in bankruptcy. Special attention is paid to this form of restructuring as a division of the debtor to transfer debt to third parties not subject to rehabilitation. On the basis of these features suggested a definition of enterprise restructuring in bankruptcy.

Abstract:
The article analyzes the legal means of rehabilitation during the extrajudicial procedure for restructuring an enterprise in German law, as well as the provisions of the Russian law draft that introduces a similar judicial procedure. The purpose of this study is to formulate the main provisions of the rehabilitation procedures of insolvency (bankruptcy) in the national Russian legislation on the basis of the normative regulation and doctrinal concepts prevailing in Germany, where both debtor and his enterprise can be rehabilitated. The main research methods used were comparative legal and historical legal methods in combination with the systematic method. The methods of synthesis, interpretation, and the teleological method were also used to assist in selecting the appropriate legal means to achieve the goal of rehabilitating the debtor or his enterprise. The legal nature of the law of the restructuring plan is analyzed as well as its main elements and the procedure for adoption and approval that takes into account creditors’ interests of. It is concluded that rehabilitation can be carried out in the form of extrajudicial rehabilitation both within the framework of a special procedure and in a free form on the basis of an agreement between the debtor and his creditors in regard to debt restructuring. The legal means of reorganization of the debtor and his enterprise are highlighted. It is substantiated that the Russian legislation needs to change its concept of rehabilitation procedures. First of all, it is necessary to complement the goal of rehabilitation procedures by translatable rehabilitation if the debtor cannot be rehabilitated and to use appropriate legal means of stabilizing and preserving the debtor’s business or part of it to minimize the negative consequences of insolvency.

Abstract:
The purpose of this study is to formulate the main elements of the legal model for reforming the Russian insolvency legislation based on the analysis of regulatory decisions of foreign legal orders, where the idea of the sanation of the debtor and its enterprise is successfully implemented. Comparative-legal and sociological methods of scientific cognition were used as a methodological basis. The results of the work were the analysis of the experience of the United States and Germany, the legislation of which contains effective models for resolving the conflict between the debtor and its creditors within the framework of sanation. In addition, the authors formulated and substantiated the conclusion regarding the urgent need to change the Russian concept of insolvency legislation through the transition from the liquidation of insolvent entities, mainly to the sanation of debtors or its enterprises. The authors also proposed key elements of a possible legal model for such reform, including establishing a unified restructuring competitive procedure for debtors – legal entities; preserving the powers of the debtor in the course of this procedure to handle its corporate management; solving the most significant issues of the restructuring procedure mainly by reaching an agreement between the main participants in the procedure – the debtor, the beneficiaries of the debtor and various classes of creditors. The novelty of the work lies in formulating the problem and substantiating the requirement to transform the Russian legal mechanisms for the rehabilitation of the insolvent debtor, taking into account the legal solutions presented, first of all, in American and German insolvency legislation.

Abstract:
Sustainable development of the enterprise is characterized by stable, balanced functioning of its three subsystems – economic, social and environmental. However, development is impossible without ups and downs, which disrupts stability. Recently, the spread of the pandemic has had a negative impact on the world economy and jeopardized the level of its sustainable development. In Ukraine, the impact of the pandemic has exacerbated the crisis due to the stratification of the unstable economic and political situation in the country. As a result, this led to a rapid growth in the number of unprofitable enterprises. Statistics show an increase in the number of initiated bankruptcy proceedings of enterprises and even their liquidation due to insolvency. The article hypothesizes that development cannot occur constantly, and therefore does not exclude the possibility of volatile states. Unsustainable development of the enterprise is characterized by its financial insolvency, which is identified with its bankruptcy. At the same time, bankruptcy of enterprises in Ukraine is quite common. Bankruptcy of the enterprise – the inability of the debtor to restore its solvency through the procedure of rehabilitation and restructuring and is a consequence of unsustainable development. It arises due to external (economic, scientific and technical, political, legal, international, environmental, pandemic, infrastructural) and internal factors (poor management of the founders of the debtor and its management). Internal factors are the main ones. Economic and legal means that can help identify in the early stages of negative trends in financial condition and prevent them – the development plan of the enterprise. One of the components of this plan is the economic analysis of the financial condition of the enterprise. The legislator has significantly simplified the requirements for filing a lawsuit to declare a company bankrupt. This can lead to abuse of the right to file such a lawsuit (raider seizures, tax evasion and unfair competition). In our opinion, a safeguard against abuse can be not only certain restrictions for the initiating creditor in the right to file for bankruptcy, but also the establishment by the legislator of increased liability for him in case of establishing the facts of abuse of such a right. In addition, the article emphasizes that the current methodological approaches to assessing the probability of bankruptcy of enterprises do not allow establishing the approach of this event taking into account the time factor, but only indicate the possibility of its occurrence. In this case, the range of possible time affects the choice of top management of urgent measures to correct the financial condition of the enterprise, the implementation of which will prevent the opening of bankruptcy proceedings or to delay the likelihood of its occurrence. The proposed methodological approaches allow determining the probability of bankruptcy of Ukrainian enterprises in order to predict the development of events in the early stages of bankruptcy.

Abstract:
Problems related with increase of forests lands in Ukraine and on the globe are in focus of many domestic scientists, power and business entities, industrialists and others. Considerable interest to forestry products is shown by power bodies, local self-government bodies, private businesses. One of the most significant factors affecting rehabilitation and preservation of forest resources is the model of forestry sector operation in Ukraine as a whole and the Carpathian macro-region in particular. It refers to the principles of rehabilitation process, outlined in the period of the command-administrative model of management, but embedded in the current market mechanism. However, the studies confirm that market and command-administrative models of management are incompatible. It is demonstrated that highly effective use, rehabilitation, preservation and protection of forest resources is conditional on the involvement of government and local territorial communities. First and foremost it refers to formulating new operative principles for providing financial assistance, subsidies to forestry enterprises, private owners. Unprofitability of forestry enterprises and organizations shows the need in constructing and implementing a new model for organization and management in this important economic sector. It is demonstrated that such model cannot be built without relevant and reliable information base, which requires improvements in the existing system of collection, processing and analysis of statistical data. Chronic unprofitability in the domestic forestry sector in parallel with the increasing scales of forest felling, growing timber sales and enrichment of selected persons associated with power offices and local power bodies is a sign of the existence of shadow and corrupted entities in the domestic forestry sector. This requires not only revision of the current forestry policy, but setting a new one, along with adapting global practices in organizing preservation, use, rehabilitation and protection of forestry resources, of which the most important is land. First and foremost, priorities of organization and management in the forestry sector need to be changed. An important step towards optimization of the rehabilitation process of forest land plots in the studied macro-region should be restructuring, with returning private property to former owners. This change has to ensure the profitability of forestry enterprises, diversification of ownership forms, preservation and protection of forest resources for current and future generations.

Abstract:
BACKGROUND: The spread of COVID-19 around the world has caused many undesirable effects on human health. The pandemic forced the employees to resort to Remote Work (RW)/Work from Home (WFH) according to the nature of the jobs. Consequently, organizations, business process and results are affected and organizational and commercial activities are significantly reduced. OBJECTIVE: This study investigates the impact of work stress and organizational climate on employee performance in the context of WFH in the era of the COVID-19 pandemic in micro, small and medium enterprises (MSMEs). METHOD: This study used a purposive sampling strategy and determined using the Slovin equation and equals 95 employees in marketing, business restructuring and finance. The Partial Least Square (PLS) approach and and the SmartPLS version 3.0 software for data analysis processing procedures for hypothesis testing were used. RESULTS: The results revealed that the organizational environment has a negative and significant effect on job stress. Furthermore, job stress had a negative impact on employee performance and the organizational climate had a favorable and considerable impact on employee performance. CONCLUSION: The lower the level of work stress, the higher the employee performance, and vice versa. Organizational climate has a positive and significant effect on employee performance, which means that the organization’s climate is conducive, so the employee performance will increase and vice versa.

Abstract:
The study describes the legal regulations concerning insolvency in the period of the Second Polish Republic. The political system of the Republic of Poland in the years 1926–1935 is described as authoritarian in order to distinguish it from the total fascist system. The difficult economic and financial situation of the Polish state during the post-partition period required state interference in introducing legal regulations ensuring protection of creditors, while taking into account the rights of debtors who became insolvent for no fault of their own. Bankruptcy became a society-wide problem, albeit of varying severity. The study describes legal regulations concerning insolvency, which are included both in the Ordinance of the President of the Republic of Poland of 24 October 1934, the Law on Settlement Proceedings (Journal of Laws of 1934, No. 93, item 836, with binding force from 1 January 1935), and in the Ordinance of the President of the Republic of Poland of 24 October 1934, the Bankruptcy Law (Journal of Laws of 1934, No. 93, item 834, with binding force from 1 January 1935). The above-mentioned legal acts contained regulations adjusted to the state of insolvency, which is the result of the debtor’s difficult economic and financial situation. The state of the debtor’s insolvency or the threat of insolvency determined whether it was possible to conduct a procedure in which the debtor entered into an arrangement with creditors or whether the debtor should be declared bankrupt. In the case of bankruptcy, a trustee appointed by the bankruptcy court managed the assets of the bankrupt, constituting the bankruptcy estate, and the bankrupt was deprived of the right to manage their assets. The main purpose of bankruptcy proceedings was to sell the assets included in the bankruptcy estate and to achieve equal satisfaction of creditors of the bankrupt debtor. The course of these proceedings was different and depended on whether it was possible to make an arrangement with the creditors or whether it was necessary to implement procedures related to the liquidation of the bankrupt debtor’s assets. Although both legal acts were enacted in the interwar period, they were in force until the entry into force of the Act of 28 February 2003, the Bankruptcy and Reorganization Law (Journal of Laws of 2003, No. 60, item 535), that is, for almost 60 years. Therefore, regardless of the changes in the political system of the Polish state, the insolvency regulations from the authoritarian period in the Second Republic remained in force for many decades. The timelessness of these regulations is confirmed by the fact that some of the legal regulations that were enacted in 1934 are still applied today, although they have been partially modified and adapted to the current economic situation. The entry into force on 1 January 2016 of the Law of 15 May 2018 on Restructuring Law (Journal of Laws of 2015, item 978) resulted in a return to the separation of legal regulations that can be implemented depending on the debtor’s difficult financial situation. The Restructuring Law currently regulates the proceedings enabling an insolvent debtor or a debtor at risk of insolvency to enter into an arrangement with creditors, the effects of an arrangement as well as the conduct of the rehabilitation proceedings. The purpose of the various types of restructuring proceedings is to avoid declaring bankruptcy. On the other hand, the Bankruptcy Law, similarly to the period of the Second Polish Republic, regulates the procedure, the main purpose of which is to achieve equal satisfaction of the creditors of the debtor in the bankruptcy to the highest possible extent, and only if rational considerations allow the debtor’s current enterprise to be retained.

Сформовано науково-практичні рекомендації щодо визначення факторів впливу на ефективність діяльності промислових підприємств, які передбачають оцінку генерації економічної доданої вартості та імітаційне моделювання закономірностей і взаємозв‘язків показників функціонування та розвитку підприємства. The dissertation on achieving a scientific degree of the candidate of economic sciences on a specialty 08.00.04 - economics and management of the enterprises (on kinds of economic activity). - National Technical University "Kharkiv Polytechnic Institute", Kharkiv, 2020. The dissertation is devoted to the development and scientific substantiation of theoretical and scientific-methodical approaches to the development of organizational and economic support for the reorganization of industrial enterprises. The world tendencies of development of mechanical engineering in the world and in the national economy, the basic theoretical approaches concerning the formation of organizational and economic maintenance of carrying out of the reorganization of the industrial enterprise are investigated. Justified the definition of «reorganization of an industrial enterprise» is substantiated, which takes into account the key competencies of the functioning and development of the socio-economic system with the separation of end-to-end business processes to ensure the generation of added economic value. Justified necessity to take into account the functional components (marketing, design, production preparation, procurement and logistics, quality monitoring, product sales, support, and maintenance) of the end-to-end business process, which reflects the implementation of key competencies of the business entity, structural elements (management, main, auxiliary), the formation of functional areas and organizational circuits. The main forms and types of the reorganization of an industrial enterprise are singled out in coordinates: technology, space, time, structure, clients, result, which is the basis for developing methodological approaches to assessment, diagnosis of its financial and economic condition, and formation of reorganization measures. Theoretical and methodological provisions for the formation of organizational and economic support for the reorganization of industrial enterprises, containing: the allocation of functional components of end-to-end business processes; formation of functional zones and organizational contours; identification of goals, forms, and types of the reorganization of activities. The financial condition and economic activity of economic entities of the machine-building complex of Ukraine are analyzed. Scientific and practical recommendations for determining the factors influencing the efficiency of industrial enterprises, which include the assessment of the generation of economic value-added and simulation of patterns and relationships of indicators of operation and development of the enterprise. An improved scientific and methodological approach to assessing the levels of economic development and activity, which is based on the construction of models of factors that characterize the functional areas and organizational contours of the reorganization of the industrial enterprise. The formation of organizational and economic support for the reorganization of the industrial enterprise is based on economic and mathematical modeling and game theory in determining the sets of targeted measures of reorganization by areas and takes into account the relationship and interdependence of their impact on internal and external factors of efficiency. combinations of financial, economic, and organizational tools for the reorganization of the industrial enterprise with certain parameters of influence. The approach to the formation of organizational and economic maintenance of reorganization of activity and forecasting of results of the introduction of levers of the reorganization of activity of the industrial enterprise based on the scenario approach, taking into account restrictions of financial and economic character and definition of the period of achievement of the target level of generation of economic added value is developed. application and implementation in the medium term. The developed proposals are brought to the level of methodical approaches, and their practical implementation in the context of the development of organizational and economic support of the reorganization of industrial enterprises of the Kharkiv region proved their practical significance and expediency of further use of the formed tools.

Дисертацію присвячено розробці та науковому обґрунтуванню теоретичних і науково-методичних підходів щодо розвитку організаційно-економічного забезпечення реорганізації промислових підприємств. Досліджено світові тенденції розвитку машинобудування в світі та в національній економіці, основні теоретичні підходи щодо формування організаційно-економічного забезпечення проведення реорганізації промислового підприємства. Обґрунтовано сутність дефініції «реорганізація діяльності промислового підприємства», яке враховує ключові компетенції функціонування та розвитку соціально-економічної системи з виокремленням наскрізних бізнес-процесів для забезпечення генерації доданої економічної вартості. Обґрунтовано необхідність при реорганізації діяльності промислового підприємства враховувати функціональні складові (маркетинг, проектування, підготовка виробництва, закупівлі та логістика, моніторинг якості, реалізація продукції, підтримка та супроводження) наскрізного бізнес-процесу, що відображає реалізацію ключових компетенцій суб‘єкта господарювання, структурних елементів (управлінських, основних, допоміжних), формування функціональних зон і організаційних контурів. Виокремлено основні форми й види проведення реорганізації промислового підприємства в координатах: технологія, простір, час, структура, клієнти, результат, що є у підґрунтям розробки методичних підходів до оцінки, діагностики його фінансово-економічного стану та формуванні заходів проведення реорганізації. Розроблено теоретико-методичні положення формування організаційно-економічного забезпечення реорганізації діяльності промислових підприємств, що містять: виділення функціональних складових наскрізних бізнес-процесів; формування функціональних зон і організаційних контурів; виокремлення цілей, форм й видів реорганізації діяльності. Проаналізовано фінансовий стан та економічну діяльність суб‘єктів господарювання машинобудівного комплексу України. Розроблено підхід до формування організаційно-економічного забезпечення реорганізації діяльності та прогнозування результатів запровадження важелів реорганізації діяльності промислового підприємства,що ґрунтується на сценарному підході, врахуванні обмежень фінансово-економічного характеру та визначенні періоду досягнення цільового рівня генерації економічної доданої вартості, що дозволяє підвищити ступінь обґрунтованості доцільності їх застосування та реалізації у середньостроковій перспективі. Justified necessity to take into account the functional components (marketing, design, production preparation, procurement and logistics, quality monitoring, product sales, support, and maintenance) of the end-to-end business process, which reflects the implementation of key competencies of the business entity, structural elements (management, main, auxiliary), the formation of functional areas and organizational circuits. The main forms and types of the reorganization of an industrial enterprise are singled out in coordinates: technology, space, time, structure, clients, result, which is the basis for developing methodological approaches to assessment, diagnosis of its financial and economic condition, and formation of reorganization measures. Theoretical and methodological provisions for the formation of organizational and economic support for the reorganization of industrial enterprises, containing: the allocation of functional components of end-to-end business processes; formation of functional zones and organizational contours; identification of goals, forms, and types of the reorganization of activities. The financial condition and economic activity of economic entities of the machine-building complex of Ukraine are analyzed. Scientific and practical recommendations for determining the factors influencing the efficiency of industrial enterprises, which include the assessment of the generation of economic value-added and simulation of patterns and relationships of indicators of operation and development of the enterprise. An improved scientific and methodological approach to assessing the levels of economic development and activity, which is based on the construction of models of factors that characterize the functional areas and organizational contours of the reorganization of the industrial enterprise The formation of organizational and economic support for the reorganization of the industrial enterprise is based on economic and mathematical modeling and game theory in determining the sets of targeted measures of reorganization by areas and takes into account the relationship and interdependence of their impact on internal and external factors of efficiency. combinations of financial, economic, and organizational tools for the reorganization of the industrial enterprise with certain parameters of influence. The approach to the formation of organizational and economic maintenance of reorganization of activity and forecasting of results of the introduction of levers of the reorganization of activity of the industrial enterprise based on the scenario approach, taking into account restrictions of financial and economic character and definition of the period of achievement of the target level of generation of economic added value is developed. application and implementation in the medium term. The developed proposals are brought to the level of methodical approaches, and their practical implementation in the context of the development of organizational and economic support of the reorganization of industrial enterprises of the Kharkiv region proved their practical significance and expediency of further use of the formed tools.

Abstract:
The purpose of this baseline study was to determine the effectiveness of a cognitive restructuring program in reducing recidivism of offenders under supervision in a communitybased setting. The study also sought to determine the relationships between three outcomes (no recidivism within one year of release from the community-based supervised setting, violation of Home Detention requirements resulting in incompleteness of court ordered supervision, and recidivism within one year of release from Home Detention) and risk predictor variables including hours of participation in a cognitive restructuring program (Criminal Intervention), gender, race, age, previous criminal history, educational attainment, and history of substance abuse.The population of the study included offenders under sentence of community-based supervision during a two-year period from November, 1992 to October, 1994. One group of 297 offenders participated in the cognitive restructuring intervention program; another group of 346 offenders did not participate. Chi-square analyses based in contingency tables determined statistical significance of the categorical variables, and stepwise discriminant analysis was utilized to create a model that best differentiated between three outcome groups.When using 16 predictor variables, the results of discriminant analyses indicated that outcomes between groups could be differentiated by a function that accounted for 94% of the variability between groups and resulted in no statistically significant residual discriminations. Pearson product-moment correlational analyses indicated only modest correlations between the variables, and chi-square analyses resulted in the rejection of seven out of ten hypotheses concerning outcome and the categorical risk variables.Two important findings relating to the treatment program, Criminal Intervention, were found. Post-release recidivism of offenders was reduced by 7%. However, offenders participating in the treatment program were terminated from supervision due to violations of the conditions for that supervision at an additional rate of 10% over the nonparticipating violators. The review of the literature and research findings confirmed that individual differences were important to successful rehabilitation; therefore, appropriate matching between intervention program and offender risk and need was warranted. Follow up studies, comprehensive offender assessments, and development, utilization, and validation of a comprehensive risk assessment tool was recommended for future research.

Our understanding of enterprise restructuring in a transition context is predominantly drawn from the ex-communist countries of Europe. Those countries have their own cultural values, social structures, were subject to the Soviet political and economic managemet styles and had their own political and economic reasons to move to the free market system. Without doubt, these factors had influenced their enterprise restructuring and its determinants. Given this influence, our understanding of enterprise restructuring and its determinants can be considered limited especially when one takes into consideration the fact that mnay developing countries with centrally planned economic systems had moved to the free market system almost at the same time as the ex-communist countries. Very important, the restructuring behaviour of their state and privatised enterprises and the determinants of their behaviour have been neglected by researchers. This neglect was, indeed, a stimulus to carry out a research study on enterprise restructuring and its determinants in Algeria. The aim of this research study was to develop an understanding of the kind of restructuring taking place in the state enterprises slated for privatisation in Algeria and the factors that stimulated or hindered their restructuring from 1990 to 2005. Algeria is a country that combines a mixture of historical backgrounds. It has a history of more than one hundred years of French colonial rule and has a deep rooted link with the Arab and Islamic cultures. It is also a country which had followed, after gaining independence from the colonial rule in 1962, its own style of socialism where the private sector,in light manufacturing and some service industries, was tolerated and workers of the state-owned enterprise were given the power to share the decision makings with management. More significantly, Algerial was and still is a country where almost 90 percent of its foreign revenues come from hydrocarbons export. Its move to the free market in 1989 came as a result of the sharp drop in the price of oil and therefore a sharp decrease in its foreign revenues. It was a move imposed by the IMF in return for the extension of its debts repayment and the provision of fresh loans. With these socio-cultural, political and economic characteristics of Algeria, it was expected that the restructuring behaviour of the enterprises under investigation and the determinants of this behaviour would exhibit some differences from those experienced in the transition countries of Europe. The investigation was carried out on three enterprises operating in different industries: Saidal in pharmaceuticals, the SNVI in heavy vehicles and Eriad Alger in wheat processing and manufacturing. The data was collected and analysed using qualitative and quantitative research strategies. Semi-structured and unstructured interviews were used to collect data on the restructuring actions and their determinants. They were carried out with senior managers at the head offices, divisions and functional departments of the enterprises; managers at the trade union (UGTA); managers at one state-owned consultancy organisation called CNAT; managers at the ministry of industry; two visiting managers at the trade union (UGTA); and a small number of workers of the three enterprises under investigation. A survey using a self-completion questionnaire was also used to investigate the characteristics of the top management teams of the three enterprises. Primary documents such as state, private company and media reports and secondary document such as journal articles and books were also used. The findings drawn from the study reveal that Saidal was the only enterprise that restructured effectively despite the strong competition in its market. This was possible through the determination of Saidal's president general manager and his top management team to restructure and through the enterprise partnership with many multinational firms. The findings also indicate that controllable and uncontrollable factors had significant impact on the restructuring behaviour of the three enterprises. The controllable factors were the corporatisation of the state enterprise and the underdevelopment of the institutional environment. Corporatisation was an important incentive that encouraged effective restructuring but this was possible only when the enterprise was financially healthy, as was the case with Saidal. The financial autonomy of Saidal reduced the intervention of the government administration in its internal affairs. Government intervention was strong when the enterprise was perceived by the government as strategically important, as was the case with the SNVI, or when the government intended to totally privatise the enterprise, as was the case with Eriad Alger. The underdevelopment of the institutional environment, especially corruption, the shortage of technical skills and the lack of adequate market information hampered competition and slowed down effective restructuring. The uncontrollable factors were the trend in the market and the cultural values. The growing market for pharmaceuticals in Algeria was a stimulus for attracting foreign investment in Saidal which consequently encouraged effective restructuring. As for the cultural values, the family and friendship ties, the social responsibility stemming from religious belief, the regional belonging and the legacy of French colonial rule in Algeria played a significant role in the selection and recruitment of managers and workers, in slowing down the progress of shedding workers surplus and in slowing down foreign participation in privatisation. Future research on enterprise restructuring and its determinants in Algeria should be carried out on a larger sample of enterprises with different ownership using quantitative and qualitative research strategies. Research should also explore enterprise restructuring and its determinants in other developing countries which moved to the free market system and in countries which share similar cultural and social structures with Algeria. It is time for researchers to move away from exploring effective and ineffective enterprise restructuring and concentrate more on exploring how partnership with foreign firms, the shortage of technicla skills, the lack of market information and the cultural values, be it religious beliefs, customs of the legacy of colonialism, affect the restructuring behaviour of state, privatised and private enterprises and the determinants of this behaviour.

Voucher privatisation was designed to effect a rapid transformation of state-owned enterprises into private ownership with as limited state intervention as possible. Premised on neo-classical economic theory, the Czech government anticipated new private owners would emerge with greater incentives than the state to undertake restructuring and ensure the efficient operation of these firms. However, this thesis argues that for restructuring to occur, formal ownership patterns are less important than an ability to exercise control because of institutional influences. The de jure and de facto roles of owners, managers, and labour are discussed, showing how endogenous and exogenous factors affect their ability to dictate and control restructuring outcomes in voucher privatised firms. The thesis argues that observed post-privatisation restructuring outcomes cannot be understood without considering the institutional environment within which firms are situated. Institutions are conceived to comprise formal, informal and enforcement aspects, but also with a temporal dimension encapsulated by the use of path- dependency and embeddedness. The explanatory framework offered here is a modified version of new institutionalism perspectives, termed "embedded institutionalism". Case studies of seven firms privatised by voucher are presented in this study to demonstrate how the interaction of institutional influences, understood through embedded institutionalism, is the most appropriate framework for understanding postprivatisation restructuring processes in post-communist countries. This approach provides a synthesis between the theoretical expectations of neo-classical economic theory and the practical outworking of post-privatisation restructuring in Czech firms. Voucher privatisation was a novel scheme, and became the central aspect of the Klaus government's economic transformation. Important historical and contemporary institutional influences impacted on its design and implementation. However, it is argued that understanding privatisation and its effects on restructuring through embedded institutionalism negates the view that a unique Czech way of privatisation exists, and that observed outcomes are simply responses to the surrounding institutional environment.

Uranium prospecting in Romania has started some 50 years ago, when a bilateral agreement between Romania and the former Soviet Union had been concluded and a joint Romanian-Soviet enterprise was created. The production started in 1952 by the opening of some deposits from western Transylvania (Bihor and Ciudanovita). From 1962 the production has continued only with Romanian participation on the ore deposit Avram Iancu and from 1985 on the deposits from Eastern Carpathians (Crucea and Botusana). Starting with 1978 the extracted ores have been completely processed in the Uranium Ore Processing Plant from Feldioara, Brasov. Complying with the initial stipulations of the Nuclear National Program launched at the beginning of the 1980s, the construction of a nuclear power station in Cernavoda has started in Romania, using natural uranium and heavy water (CANDU type), having five units of 650 MW installed capacity. After 1989 this initial Nuclear National Program was revised and the construction of the first unit (number 1) was finalized and put in operation in 1996. In 2001 the works at the unit number 2 were resumed, having the year 2005 as the scheduled activating date. The future of the other 3 units, being in different construction phases, hasn’t been clearly decided. Taking into consideration the exhaustion degree of some ore deposits and from the prospect of exploiting other ore deposits, the uranium industry will be subject of an ample restructuring process. This process includes workings of modernization of the mines in operation and of the processing plant, increasing the profitableness, lowering of the production costs by closing out and ecological rehabilitation of some areas affected by mining works and even new openings of some uraniferous exploitations. This paper presents the actual situation and the prospects of uranium mining industry on the base of some new technical and economical strategic concepts in accordance with the actual Romanian Program for Nuclear Energetics.

Abstract This paper presents an overview of various approaches to enterprise modeling, illustrated by present and future applications of enterprise modeling technology. A taxonomy derived from different objectives of enterprise modeling is proposed. Preliminary experiences from a large-scale enterprise modeling and organizational restructuring project are reported. The project was conducted at a natural gas process plant operated by the Norwegian oil company Statoil. We argue that the potential of enterprise modeling in business process improvements only can be utilized when the methodology is brought to the heads and hands of the inhabitants of the enterprise. Finally, a coordination environment denoted “the control room metaphor” is presented as a futuristic view of enterprise model development and application.

Considering the performance of growth, it is observed that the Central Asian Turkish republics achieved their income levels of 1991, the year they gained political independence, very lately as compared to the other transition economies. It is argued that those factors such as enterprise restructuring and insufficient political rights and individual freedoms came into play for their failure. Thus, it can be said that reflections which are described as economic growth flourishes privately from the lack of entrepreneurship, and also lack of entrepreneurship stems mostly from insufficient libertarian structures. In this paper, enterprise restructuring and price liberalization values published periodically by European Bank for Reconstruction and Development and the indicators of political rights and civil liberties published by Freedom House are taken into consideration, and the effects of these on economic growth and/or on human development as a much comprehensive indicator are investigated. In this perspective, instead of the effects of quantitative variables, the effects of four important qualitative variables on Central Asian Republics’ growth/human development are studied.
