La protection de la vie privée des salariés constitue une préoccupation récente en droit du travail : alors qu'elle était pratiquement absente de la législation sur le travail et des conventions collectives, elle s'y est néanmoins imposée à la faveur de la montée des normes internationales et de l’application des chartes des droits de la personne et des lois sur la protection des renseignements personnels. Elle pose des enjeux considérables non seulement au moment de la sélection du personnel, mais aussi dans la détermination des conditions de travail, notamment en matière de surveillance des travailleurs, d'administration d'examens et de tests de toutes sortes, de tenue des dossiers du personnel, ainsi qu'à propos des multiples intrusions dans la vie et les choix personnels et intimes des salariés.

L’auteure est d’avis que le droit au respect de la vie familiale est un droit de la personnalité, un droit fondamental, même s’il n’est pas l’objet d’un texte législatif précis en droit privé québécois. Une démonstration visant la reconnaissance d’un tel droit s’opère en deux temps. Suivant une démarche axiologique, l’auteure confronte le droit au respect de la vie familiale avec la panoplie des valeurs qui cimentent la société, telles que nous pouvons les percevoir dans l’ordre international, constitutionnel et quasi constitutionnel, afin de vérifier que cet ordre juridique n’est non seulement pas incompatible avec un « droit fondamental de la personnalité au respect de la vie familiale », mais qu’il serait incomplet sans la reconnaissance d’un tel droit. Suivant une démarche axiomatique, l’auteure confronte le droit au respect de la vie familiale avec les caractéristiques des autres droits de la personnalité protégés dans la tradition juridique québécoise, notamment le droit à la vie privée, pour en déduire qu’il s’agit bien d’un droit de la personnalité et d’un droit fondamental.

La perception du respect de la vie privée apparaît comme l’un des pivots de l’adoption du e-commerce. Le présent article vise à synthétiser la littérature en la matière, tout en dégageant les critères susceptibles d’être retenus pour évaluer la politique des sites français. En effet, il semble que cette question du respect de la vie privée ne devrait pas constituer un frein à condition que les entreprises observent des pratiques équitables. Une étude empirique est menée sur les 80 sites français les plus fréquentés. Le bilan est contrasté. Il montre que la majorité des sites développe une politique de respect de la vie privée mais que le contenu de cette politique présente encore de nombreuses faiblesses .

Le principe du droit au respect de la vie familiale au sens de l'article 8 de la Convention européenne est bien connue de nos jours, il ne faut pas oublier que l'on peut retrouver ce principe dans d'autres textes internationaux dont le plus emblématique est sans aucun doute la Déclaration Universelle des droits de l'homme dont il convient de rappeler l'absence de force obligatoire. La jurisprudence relative au droit au respect de la vie familiale s'est peu à peu développée, en particulier en matière de droit des étrangers : désormais, le droit au respect de la vie familiale intègre l'ensemble des questions relatives aux mesures d'éloignement des étrangers comme par exemple les questions d'expulsions, de reconduite à la frontière, de refus de visa, etc. Les questions relatives à l'adoption d'enfants par des homosexuels ont été soumises à la Cour européenne des droits de l'homme sur le fondement de l'article 8 de la Convention. A ce jour, le droit à l'adoption par des homosexuels n'est pas reconnaître la juridiction européenne. Le Conseil d'Etat a d'abord consacré le principe du droit de mener une vie familiale normale pour tout étranger sur le territoire national, en lui reconnaissant de droit de faire venir de manière définitive son conjoint et leurs éventuels enfants ; la notion de droit au respect de la vie familiale a été ainsi élevée au rang de Principe Général du Droit par le Conseil d'Etat. Puis, il a refusé pendant de nombreuses années d'appliquer ce principe sous l'angle des dispositions de l'article 8 de la Convention européenne. Ce n'est qu'au début des années 1990 qu'il a accepté de modifier sa jurisprudence tout en faisant une application pour le moins restrictive du principe. Le Conseil d'Etat applique le principe du droit au respect de la vie familiale, au sens de l'article 8 de la Convention européenne, à l'ensemble du contentieux des étrangers ; le fait d'appliquer ce principe ne revient pas forcément à donner raison à chaque fois aux requérants. Le Conseil constitutionnel a accordé, par une célèbre décision de 1993, une valeur constitutionnelle à la protection du principe. Cette notion est reconnue au niveau international et en droit interne. Mais, elle finit par atteindre ses limites : la protection de la vie familiale ne passe t-elle pas par une notion plus vaste : celle du droit au respect de la vie privée ?

Le @droit au respect de la vie familiale bénéficie, en milieu carcéral, d'une protection affirmée, tant sur le plan national qu'international. Mais en milieu pénitentiaire, certaines difficultés d'application existent, tant à l'égard du droit de fonder une famille, qu'à celui de maintenir des liens avec celle-ci, notamment eu égard au paragraphe 2 de l'article 8 de la Convention européenne des droits de l'Homme et à la surpopulation carcérale. A ce titre, on peut constater, en ce qui concerne le droit de fonder une famille, la fréquente absence de consommation de leur mariage par les détenus bien qu'ils aient le droit de se marier, en vertu de l'article 12 de la Convention européenne des droits de l'Homme. De même, les détenus éprouvent d'importantes difficultés, voir une totale impossibilité à bénéficier réellement du droit à l'enfant. Poutant ce droit ne manque pas de bases légales. Les constatations sont similaires concernant le droit de maintenir des liens avec les membres de sa famille. Si le bilan diffère quelque peu, ce n'est qu'en ce qui concerne le bénéfice effectif de ce droit, mais pas quant à son résultat. En effet, les chiffres montrent que la majorité des personnes placées en détention parviennent à entretenir des relations avec leur famille. Mais les difficultés qu'ils rencontrent sont telles, notamment en raison de la lourdeur du système pénitentiaire dans le domaine des visites, que la distention des liens familiaux est fréquente.

Le respect de la vie privée par construction est de plus en plus mentionné comme une étape essentielle vers une meilleure protection de la vie privée. Les nouvelles technologies de l'information et de la communication donnent naissance à de nouveaux modèles d'affaires et de services. Ces services reposent souvent sur l'exploitation de données personnelles à des fins de personnalisation. Alors que les exigences de respect de la vie privée sont de plus en plus sous tension, il apparaît que les technologies elles-mêmes devraient être utilisées pour proposer des solutions davantage satisfaisantes. Les technologies améliorant le respect de la vie privée ont fait l'objet de recherches approfondies et diverses techniques ont été développées telles que des anonymiseurs ou des mécanismes de chiffrement évolués. Cependant, le respect de la vie privée par construction va plus loin que les technologies améliorant simplement son respect. En effet, les exigences en terme de protection des données à caractère personnel doivent être prises en compte au plus tôt lors du développement d’un système car elles peuvent avoir un impact important sur l'ensemble de l'architecture de la solution. Cette approche peut donc être résumée comme « prévenir plutôt que guérir ». Des principes généraux ont été proposés pour définir des critères réglementaires de respect de la vie privée. Ils impliquent des notions telles que la minimisation des données, le contrôle par le sujet des données personnelles, la transparence des traitements ou encore la redevabilité. Ces principes ne sont cependant pas suffisamment précis pour être directement traduits en fonctionnalités techniques. De plus, aucune méthode n’a été proposée jusqu’ici pour aider à la conception et à la vérification de systèmes respectueux de la vie privée. Cette thèse propose une démarche de spécification, de conception et de vérification au niveau architectural. Cette démarche aide les concepteurs à explorer l'espace de conception d'un système de manière systématique. Elle est complétée par un cadre formel prenant en compte les exigences de confidentialité et d’intégrité des données. Enfin, un outil d’aide à la conception permet aux concepteurs non-experts de vérifier formellement les architectures. Une étude de cas illustre l’ensemble de la démarche et montre comment ces différentes contributions se complètent pour être utilisées en pratiquePrivacy by Design (PbD) is increasingly praised as a key approach to improving privacy protection. New information and communication technologies give rise to new business models and services. These services often rely on the exploitation of personal data for the purpose of customization. While privacy is more and more at risk, the growing view is that technologies themselves should be used to propose more privacy-friendly solutions. Privacy Enhancing Technologies (PETs) have been extensively studied, and many techniques have been proposed such as anonymizers or encryption mechanisms. However, PbD goes beyond the use of PETs. Indeed, the privacy requirements of a system should be taken into account from the early stages of the design because they can have a large impact on the overall architecture of the solution. The PbD approach can be summed up as ``prevent rather than cure''. A number of principles related to the protection of personal data and privacy have been enshrined in law and soft regulations. They involve notions such as data minimization, control of personal data by the subject, transparency of the data processing, or accountability. However, it is not clear how to translate these principles into technical features, and no method exists so far to support the design and verification of privacy compliant systems. This thesis proposes a systematic process to specify, design, and verify system architectures. This process helps designers to explore the design space in a systematic way. It is complemented by a formal framework in which confidentiality and integrity requirements can be expressed. Finally, a computer-aided engineering tool enables non-expert designers to perform formal verifications of the architectures. A case study illustrates the whole approach showing how these contributions complement each other and can be used in practice

La notion de gouvernance semble recouvrir des thèmes proches du terme «gouverner», de la prise de décision et de l’évaluation.La gouvernance d’entreprise propose une nouvelle conception du processus de décision, accordant toute sa place à la concertation entre les parties prenantes. Le délégué syndical intervient dans ce sens, en effet, il a une mission de revendication (par exemple concernant la hausse des salaires), il est l’interlocuteur du syndicat auprès de l’employeur, il négocie avec ce dernier les normes de l’entreprise (accords et conventions collectives)Encadrée par des lois assurant l'indispensable transparence, la gouvernance d'entreprise serait théoriquement le moyen d'assurer au mieux les intérêts multiples des acteurs concernés (salariés et employeurs).C’est la raison pour laquelle il parait opportun de faire un parallèle entre l’exercice de la gouvernance d’entreprise par les acteurs concernés et le respect de la vie privée des salariés.Ce parallèle entre vie privée et gouvernance de l’entreprise a notamment été mis en exergue avec l’affaire Novartis (6 octobre 2004).L’entreprise Novartis a mis en place en 1999 un code de bonne conduite pour rappeler certains principes éthiques, seulement ce texte a été complété en juillet 2004 par de surprenantes dispositions jugées attentatoires à la vie privée des salariés par le Tribunal de Nanterre. Ce code de conduite demande notamment aux salariés de Novartis " qu'ils consacrent tout leur temps et toute leur attention au travail de Novartis pendant les heures de travail habituelles... Le temps requis pour une occupation extérieure peut générer une baisse de la productivité ". En outre, le groupe estime que "le temps requis pour une occupation extérieure, qu'elle soit de type gouvernemental, politique ou bénévole, peut générer une baisse de la productivité et de l'efficacité d'un collaborateur créant ainsi un conflit d'intérêts" Aussi Novartis exige également " une autorisation préalable " de la direction pour ce type d'activités.Le tribunal des référés de Nanterre va rendre une décision qui va porter en outre sur le fond en jugeant que ces " alinéas sont susceptibles de nuire à la santé mentale des salariés et portent atteinte à la vie privée ".La direction ne fera finalement pas appel et soumettra au Comité de groupe ainsi qu'au comité d’hygiène, de sécurité et des conditions de travail une nouvelle version de son code éthique.La gouvernance d’entreprise peut donc être limitée par le respect de la vie privée des salariés.La vie privée est l'ensemble des activités d'une personne qui relève de son intimité par opposition à la vie publique.Il parait plus juste de mentionner un "droit à l'intimité de la vie privée".En effet, il s’agit d’un droit fondamental, proclamé par la loi, inscrit dans la déclaration des droits de l'homme de 1948 (article 12), la Convention européenne des Droits de l’Homme et des libertés fondamentales (article 8), à l’article 9 du Code civil et à l’article 226-1 du Code Pénal.Les composantes de la vie privée n'ont pas fait l'objet d'une définition ou d'une énumération limitative afin d'éviter de limiter la protection aux seules prévisions légales. Les tribunaux ont appliqué le principe de cette protection, au droit à la vie sentimentale et à la vie familiale, au secret relatif à la santé, au secret de la résidence et du domicile, et au droit à l'image. Les croissances constantes de l’Internet et des services associés ont conduit à des problématiques naturellement liées au domaine de la cryptographie, parmi lesquelles l’authentification et le respect de la vie privée des utilisateurs. L’utilisation désormais commune d’appareils connectés (smartphone, tablette, montre, …) comme moyen d’authentification amène à considérer la génération et/ou la gestion de clés cryptographiques par de tels appareils pour répondre à ces besoins. Les résonances cryptographiques identifiées de ces deux cas d’étude sont respectivement le domaine des Fuzzy Extractors (« Extracteurs de Flous » en français) et les schémas de signature de groupe. D’une part, cette thèse présente alors le premier Fuzzy Extractror non basé sur la distance de Hamming à être réutilisable (dans le modèle de l’oracle aléatoire non programmable). Ce faisant, nous avons alors pu concevoir un module de génération de clés cryptographiques permettant d'authentifier un utilisateur à partir des ses appareils. D’autre part, deux schémas de signature de groupe basés sur la théorie des codes, respectivement en métrique de Hamming et en métrique rang sont également proposés. Ces deux schémas constituent des alternatives crédibles aux cryptosystèmes post-quantiques équivalents basés sur les réseaux euclidiensInternet constant growth has naturally led to cryptographic issues such as authentication and privacy concerns. The common usage of connected devices (smartphones, tablet, watch, …) as authentication means made us consider cryptographic keys generations and/or managements from such devices to address aforementioned needs. For such a purpose, we identified fuzzy extractors and group signature schemes. On the one hand, this thesis then presents the first reusable fuzzy extractor based on set difference metric (in the nonprogrammable random oracle). In so doing, we were able to design a key generation module performing authentication from users’ devices. On the other hand, we came up with two group signature schemes, respectively based on Hamming and rank metrics, that seriously compete with post-quantum concurrent schemes based on lattices

L'augmentation rapide du nombre de transactions en ligne dans le monde moderne numérique exige la manipulation des informations personnelles des utilisateurs, y compris sa collection, stockage, diffusion et utilisation. De telles activités représentent un risque sérieux concernant le respect de la vie privée des informations personnelles. Le travail actuel analyse l'utilisation des architectures d'identité fédérées (AIF) comme une solution appropriée pour simplifier et assurer la gestion des identités numériques dans un environnement de collaboration. Cependant, la contribution principale du projet est la proposition d'un modèle de respect de la vie privée qui complète les mécanismes inhérents de respect de la vie privée de la AIF afin d'être conformes aux principes de respect de la vie privée établis par un cadre législatif. Le modèle de respect de la vie privée définit une architecture modulaire qui fournit les fonctionnalités suivantes : spécifications des conditions de respect de la vie privée, représentation des informations personnelles dans un format de données standard, création et application des politiques en matière de protection de la vie privée et accès aux informations personnelles et registre d'évènement. La praticabilité pour déployer le modèle de respect de la vie privée dans un environnement réel est analysée par un scénario de cas pour le projet mexicain d'e-gouvernement.

Les mécanismes de réputation sont des outils très utiles pour inciter des utilisateurs ne se connaissant pas à se faire confiance, en récompensant les bons comportements et, inversement, en pénalisant les mauvais. Cependant, pour que la réputation des fournisseurs de service soit précise et robuste aux attaques, les mécanismes de réputation existants requièrent de nombreuses informations qui menacent la vie privée des utilisateurs; par exemple, il est parfois possible de traquer les interactions effectuées par les clients. Des mécanismes de réputation préservant aussi bien la vie privée des clients que celle des fournisseurs sont donc apparus pour empêcher de telles attaques. Néanmoins, pour garantir des propriétés fortes de vie privée, ces mécanismes ont dû proposer des scores de réputation imprécis, notamment en ne permettant pas aux clients de témoigner de leurs interactions négatives.Dans cette thèse, nous proposons un nouveau mécanisme de réputation distribué préservant la vie privée, tout en permettant aux clients d'émettre des témoignages négatifs. Une telle construction est possible grâce à des outils issus des systèmes distribués -- des tierces parties distribuées qui permettent de distribuer la confiance et de tolérer des comportements malveillants -- et de la cryptographie -- par exemple des preuves de connaissance à divulgation nulle de connaissance ou des signatures proxy anonymes. Nous prouvons de plus que ce mécanisme garantit les propriétés de vie privée et de sécurité nécessaires, et montrons par des analyses théoriques et pratiques que ce mécanisme est utilisableReputation mechanisms are very powerful mechanisms to foster trust between unknown users, by rewarding good behaviors and punishing bad ones. Reputation mechanisms must guarantee that the computed reputation scores are precise and robust against attacks; to guarantee such properties, existing mechanisms require information that jeopardize users' privacy: for instance, clients' interactions might be tracked. Privacy-preserving reputation mechanisms have thus been proposed, protecting both clients' privacy and the providers' one. However, to guarantee strong privacy properties, these mechanisms provide imprecise reputation scores, particularly by preventing clients to testify about their negative interactions. In this thesis, we propose a new distributed privacy-preserving reputation mechanism allowing clients to issue positive as well as negative feedback. Such a construction is made possible thanks to tools from the distributed systems community -- distributed third parties that allow for a distribution of trust and that tolerate malicious behaviors -- as well as from the cryptographic one -- for instance zero-knowledge proofs of knowledge or anonymous proxy signatures. Furthermore, we prove that our mechanism guarantees the required privacy and security properties, and we show with theoretical and practical analysis that this mechanism is usable

L'objectif principal de la thèse est de proposer une méthode de recommandation prenant en compte la vie privée des utilisateurs ainsi que l'évolutivité du système. Pour atteindre cet objectif, une technique hybride basée sur le filtrage par contenu et le filtrage collaboratif est utilisée pour atteindre un modèle précis de recommandation, sous la pression des mécanismes visant à maintenir la vie privée des utilisateurs. Les contributions de la thèse sont trois : Tout d'abord, un modèle de filtrage collaboratif est défini en utilisant agent côté client qui interagit avec l'information sur les éléments, cette information est stockée du côté du système de recommandation. Ce modèle est augmenté d’un modèle hybride qui comprend une stratégie basée sur le filtrage par contenu. En utilisant un modèle de la connaissance basée sur des mots clés qui décrivent le domaine de l'article filtré, l'approche hybride augmente la performance de prédiction des modèles sans élever l’effort de calcul, dans un scenario du réglage de démarrage à froid. To achieve this goal, an hybrid technique using content-based and collaborative filtering paradigms is used in order to attain an accurate model for recommendation, under the strain of mechanisms designed to keep user privacy, particularly designed to reduce the user exposure risk. The thesis contributions are threefold : First, a Collaborative Filtering model is defined by using client-side agent that interacts with public information about items kept on the recommender system side. Later, this model is extended into an hybrid approach for recommendation that includes a content-based strategy for content recommendation. Using a knowledge model based on keywords that describe the item domain, the hybrid approach increases the predictive performance of the models without much computational effort on the cold-start setting. Finally, some strategies to improve the recommender system's provided privacy are introduced: Random noise generation is used to limit the possible inferences an attacker can make when continually observing the interaction between the client-side agent and the server, and a blacklisted strategy is used to refrain the server from learning interactions that the user considers violate her privacy. The use of the hybrid model mitigates the negative impact these strategies cause on the predictive performance of the recommendations

La vie personnelle consiste en une logique d'autodétermination et de monopole informationnel sur les données intimes. La respecter signifie octroyer de l'autonomie et réduire la surveillance et le dépistage d'information sur les salariés. Il existe des zones de flous et d'imprécisions juridiques qui octroient une marge de manœuvre aux dirigeants : Jusqu'où peuvent-ils prôner le respect de la vie personnelle de leurs employés sans compromettre l'objectif de performance ? Selon la théorie standard de l'agence, les incitations réduisent l'opportunisme et stimulent la motivation extrinsèque. En psychologie, la théorie de l'autodétermination et de l'évaluation cognitive explique qu'un environnement de travail qui ne respecte pas la logique d'autodétermination de la personne, sape sa motivation autorégulée. Nous montrons que chaque situation de travail nécessite un certain équilibre entre ces deux types de motivations, dont on peut déduire les formes d'encadrement et de surveillance souhaitables – et par conséquent, le niveau optimal de respect de la vie personnelle à mettre en place. Nos hypothèses se trouvent globalement validées par un modèle d'équations structurelles élaboré sur la base de 568 questionnaires distribués auprès de salariés travaillant en France. Respecting it means conceding autonomy and reducing monitoring and information screening on employees. There are legal vaguenesses in which managers find the possibility to choose between different levels of respect of workers' personal life: To what extent can they promote employees privacy without compromising organizational efficiency ? According to standard agency theory, incentives reduce opportunism and foster extrinsic motivation. In psychology, theory of self-determination and cognitive evaluation explains that a work environment which doesn't respect the logic of a person self-determination, crowds out her self-regulated motivation. We find that every work situation requires a particular equilibrium between those two types of motivations which implies appropriate forms of management and monitoring – and therefore, the optimal level of privacy. Our hypotheses are globally validated by a structural equations model based on 568 questionnaires distributed to French workers. Results show the crowding-out / crowding-in effect of self-regulated motivation by a type of management perceived as controlling / informative and autonomy supportive. Situational management appears to be a solution to conciliate the respect of employees' privacy with the firm's performance

La jurisprudence relative au droit au respect de la vie familiale couvre de nombreux domaines: filiation, droits parentaux, placement des enfants, expulsion des étrangers, protection du domicile familial. La première partie de cette thèse envisage la consistance de la notion de vie familiale ainsi que ses empiétements sur d'autres droits protégés par la Convention européenne des droits de 1 'homme. La seconde partie concerne le respect de la vie familiale par les autorités publiques; elle inclut une analyse critique des méthodes d'interprétation et des solutions choisies par la Cour.

AbstractPhilosophers have defined autonomy in a variety of ways. In this chapter, we present a Kantian account of personal autonomy as the capacity to set and pursue your own ends (which Kant refers to as “humanity”). We explain how this involves two distinct components: capacity and authenticity. To have autonomous capacities, you must possess baseline abilities (to form intentions, evaluate commitments, etc.); be free of external constraints; be free of certain cognitive inhibitions, and you must have a sufficiently wide range of options. In order for your desires to count as authentic, they must be free of manipulation and coercion, consistent with other motivational states, free from alienation, and they must not be adaptive preferences. After developing our conception of autonomy, we explain and defend Kant’s view that we are morally obligated to respect humanity in ourselves and in others. We conclude by briefly explaining why other moral theories have similar commitments to the moral significance of autonomy.

Limitarianism is the view that justice requires the limitation of wealth, at least under certain conditions. In its original form the view was developed by Ingrid Robeyns and normatively justified by the use of two arguments, the democratic argument and the argument from unmet urgent needs. In this chapter I want to contribute to the justification of limitarianism by providing a novel argument for limitarianism which is distinct from the two arguments developed by Robeyns. This argument is based on self-respect as a primary basic good. According to this argument, limitarianism is needed to protect the social basis of self-respect of all members of society so that they can develop a sense of self-worth and pursue their personal projects. Since this kind of self-respect is a more important basic good than wealth above a certain threshold, limitarianism can be justified either as a principle of justice or as a direct policy implication of the principles of justice, if it turns out to be required to secure the social basis of self-respect.

In the CLLP, living together is approached as celebration of diversity intertwined with solidarity, equality, and human rights. The analysis reveals that students often approach living together from their own point of view, but are able to see others’ perspectives. The chapter discusses how learning about solidarity requires sensitivity for difference and thus lessons on the subject need to be planned carefully to ensure inclusive cultural practices and respect for diversity and difference.

Abstract Although the vibration generated by high speed dynamic movement of a valve train (VT) in an overhead camshaft SI engine is not a major source of engine noise, it still affects the overall sound quality of the engine, which is important to the subjective response of the customer. The purpose of this research is to determine the specific mechanism of the valve train dynamic behavior, which is responsible for noise generation, and the vibration transmission characteristic to engine surfaces. Dynamic simulation with a lumped mass model is developed to analyze the dynamic behavior of VT during operation, and reveal the resonance frequencies of VT modeshapes excited by the cam harmonics. Also, experimental measurements of the valve acceleration, transfer functions of vibration, and the structural response have been performed in the valve train rig. Based on the spectral analysis, two distinct noise generating mechanisms are determined. Vibration from VT components’ interaction, which is mainly excited by the harmonics of the cam profile during valve opening period, is dominant in the frequency range less than 6 kHz. On the other hand, valve seating is the dominant source in the frequency range from 6 kHz to 20 kHz. The more vibration energy from these two sources is transmitted through the structure via the VT system, rather than directly via the valve seat to the surfaces where sound is radiated, especially around the frequency of 5 kHz and 11 kHz. This fundamental investigation on the vibration sources and its transmission characteristics provides a new insight on the VT noise, which is an essential step toward the design of an engine with better sound quality.

Economic, social and cultural rights (ESCR) are materialised through public goods and services, which are produced and provided, respectively, through public expenditures. The public expenditures with an impact on respecting ESCR are evaluated through the prism of basic objectives of public financial management, namely the following: maintaining strict financial discipline, allocating public financial resources in conformity with government’s priorities, efficient provision of public services. From the theoretical-scientific perspective, the research has been done in the context of a complex and systematic approach to modern economic and social concepts. The complexity of social, economic and financial phenomena, which have been studied, necessitated the use of statistical methods, in particular the correlation and simple regression analysis. At the same time, the comparative analysis was used for the same purpose. The central public administration and local public administrations from the Republic of Moldova are relatively more successful in consolidating fiscal discipline than in providing the efficient use of public expenditure in conformity with strategic priorities. The research argues a positive effect which can be made by improvement of public expenditure management on respecting ESCR in the Republic of Moldova.

La Ville de Neuchâtel s’engage à donner l’exemple et à veiller au respect d’une administration exemplaire et ouverte à la diversité, respectueuse de la dignité et du bien-être de ses employé·e·s. En menant une enquête auprès de ses employé·e·s, la Ville de Neuchâtel a fait preuve d’une démarche innovatrice en Suisse dans le traitement des questions de diversité et de discrimination au sein de l’environnement professionnel. L’enquête a révélé une diversité parmi les employé·e·s, comprenant le genre, le pays de naissance, et l’origine migratoire : une exclusion systématique de certains groupes n’a pas été observée, mais il est légitime de se demander si la représentativité pourrait être augmentée afin de profiter des compétences de toute la population active. Au total, 36 pays de naissance et 25 nationalités sont représentés parmi les répondant·e·s de l’enquête. Parmi les nationalités non suisses, on trouve principalement des nationalités d’Europe de l’Ouest. La grande majorité des employé·e·s parle le français à la maison, soit 95%. Cependant, l’expérience de la discrimination est une réalité pour une minorité importante des employé·e·s de l’État. Parmi celles et ceux qui ont subi une forme de discrimination, les raisons mentionnées le plus fréquemment sont le genre et l’âge, suivis de l’origine nationale et l’apparence physique. La conciliation entre la vie professionnelle et la vie familiale reste un sujet important, surtout parmi les répondant·e·s avec des responsabilités de soutien de tierces personnes. De manière générale, davantage de flexibilité dans les offres et dans les horaires de travail est souhaitée afin de pouvoir répondre à des impératifs familiaux sans prétériter le travail.

Existing and emerging applications of artificial intelligence in armed conflicts and other systems reliant upon war algorithms and data span diverse areas. Natural persons may increasingly depend upon these technologies in decisions and activities related to killing combatants, destroying enemy installations, detaining adversaries, protecting civilians, undertaking missions at sea, conferring legal advice, and configuring logistics. In intergovernmental debates on autonomous weapons, a normative impasse appears to have emerged. Some countries assert that existing law suffices, while several others call for new rules. Meanwhile, the vast majority of efforts by States to address relevant systems focus by and large on weapons, means, and methods of warfare. Partly as a result, the broad spectrum of other far-reaching applications is rarely brought into view. One normatively grounded way to help identify and address relevant issues is to elaborate pathways that States, international organizations, non-state parties to armed conflict, and others may pursue to help secure greater respect for international law. In this commentary, I elaborate on three such pathways: forming and publicly expressing positions on key legal issues, taking measures relative to their own conduct, and taking steps relative to the behavior of others. None of these pathways is sufficient in itself, and there are no doubt many others that ought to be pursued. But each of the identified tracks is arguably necessary to ensure that international law is — or becomes — fit for purpose. By forming and publicly expressing positions on relevant legal issues, international actors may help clarify existing legal parameters, pinpoint salient enduring and emerging issues, and detect areas of convergence and divergence. Elaborating legal views may also help foster greater trust among current and potential adversaries. To be sure, in recent years, States have already fashioned hundreds of statements on autonomous weapons. Yet positions on other application areas are much more difficult to find. Further, forming and publicly expressing views on legal issues that span thematic and functional areas arguably may help States and others overcome the current normative stalemate on autonomous weapons. Doing so may also help identify — and allocate due attention and resources to — additional salient thematic and functional areas. Therefore, I raise a handful of cross-domain issues for consideration. These issues touch on things like exercising human agency, reposing legally mandated evaluative decisions in natural persons, and committing to engage only in scrutable conduct. International actors may also take measures relative to their own conduct. To help illustrate this pathway, I outline several such existing measures. In doing so, I invite readers to inventory and peruse these types of steps in order to assess whether the nature or character of increasingly complex socio-technical systems reliant upon war algorithms and data may warrant revitalized commitments or adjustments to existing measures — or, perhaps, development of new ones. I outline things like enacting legislation necessary to prosecute alleged perpetrators of grave breaches, making legal advisers available to the armed forces, and taking steps to prevent abuses of the emblem. Finally, international actors may take measures relative to the conduct of others. To help illustrate this pathway, I outline some of the existing steps that other States, international organizations, and non-state parties may take to help secure respect for the law by those undertaking the conduct. These measures may include things like addressing matters of legal compliance by exerting diplomatic pressure, resorting to penal sanctions to repress violations, conditioning or refusing arms transfers, and monitoring the fate of transferred detainees. Concerning military partnerships in particular, I highlight steps such as conditioning joint operations on a partner’s compliance with the law, planning operations jointly in order to prevent violations, and opting out of specific operations if there is an expectation that the operations would violate applicable law. Some themes and commitments cut across these three pathways. Arguably, respect for the law turns in no small part on whether natural persons can and will foresee, understand, administer, and trace the components, behaviors, and effects of relevant systems. It may be advisable, moreover, to institute ongoing cross-disciplinary education and training as well as the provision of sufficient technical facilities for all relevant actors, from commanders to legal advisers to prosecutors to judges. Further, it may be prudent to establish ongoing monitoring of others’ technical capabilities. Finally, it may be warranted for relevant international actors to pledge to engage, and to call upon others to engage, only in armed-conflict-related conduct that is sufficiently attributable, discernable, and scrutable.

En menant une enquête auprès de ses employé·e·s, la Ville de La Chaux-de-Fonds a fait preuve d’une démarche innovatrice en Suisse dans le traitement des questions de diversité et de discrimination au sein de l’environnement professionnel. L’enquête a révélé une diversité parmi les employé·e·s, comprenant le genre, le pays de naissance et l’origine migratoire. Si les nationalités les plus nombreuses de la ville sont présentes parmi les répondant·e·s de l’enquête, on observe une absence des personnes d’origine érythréenne (1% de la population) et turque (0.8% de la population). Il est légitime de se demander si la représentativité des groupes sous-représentés pourrait être augmentée afin de profiter des compétences de toute la population active. Au total, 34 pays de naissance et 22 nationalités sont représentés parmi les répondant·e·s de l’enquête. Parmi les nationalités étrangères, on trouve principalement des nationalités d’Europe de l’Ouest. La grande majorité des employé·e·s parle le français à la maison, soit 94%. Cependant, l’expérience de la discrimination est une réalité pour une part importante des employé·e·s de la Ville. Parmi ceux·celles qui ont subi une forme de discrimination, les raisons mentionnées le plus fréquemment sont le genre et l’âge, suivis de l’origine nationale. La conciliation entre la vie professionnelle et la vie familiale reste un sujet important, surtout parmi les répondant·e·s avec des responsabilités de soutien envers des personnes tierces. De manière générale, davantage de flexibilité dans les offres et dans les horaires de travail est souhaité afin de pouvoir répondre à des impératifs familiaux sans prétériter le travail.

Economists recognize that results from simulation models are dependent, sometimes highly dependent, on values employed for critical exogenous variables. To account for this, analysts sometimes conduct sensitivity analysis with respect to key exogenous variables. This paper presents a practical approach for conducting systematic sensitivity analysis, called Gaussian quadrature. The approach views key exogenous variables as random variables with associated distributions. It produces estimates of means and standard deviations of model results while requiring a limited number of solves of the model. Under mild conditions, all of which hold with respect to the GTAP model, there is strong reason to believe that the estimates of means and standard deviations will be quite accurate.

This report describes the tests results carried out on five natural gas gross calorific value analyzers depending on the calibration model. Three analyzers were conventional gas chromatographs. Two analyzers were new generation gas chromatographs. Twenty-three gas blend were used for this study including three calibration gas blend. Therefore, the report enables the most suitable linear calibration model to be chosen, in order to minimize gross calorific value measurement errors with respect to methods. This paper uses seven nationally representative time use surveys in Latin America to identify key stylized facts regarding the quantity and quality of parental time investment on the skill formation of their children. Traditional models of household behavior have failed to account for the differential behavior of parents with respect to skill formation of their children vis-à-vis home production. This paper finds that, similarly to higher-income countries, there is a positive education gradient, as more educated parents spend more time on skill formation than their less educated counterparts. This pattern is observed across all countries. The paper further extends this literature by showing that more educated parents also provide better care for their children, thus increasing the socioeconomic gap.

La demande croissante à laquelle font face les systèmes de santé combinée à la rareté des ressources disponibles rend impératif leur optimisation pour effectuer des choix éclairés. Le concept d’année de vie ajustée par la qualité (AVAQ) s’inscrit dans ce cadre et utilise des instruments de mesure de qualité de vie reliée à la santé (QVRS), parmi lesquels des instruments génériques. Cependant, de nombreuses différences peuvent être observées entre ces instruments. Le constat général est que quasiment tous les instruments génériques contiennent une ou plusieurs dimensions liées à la santé physique (p. ex. incapacité, inconfort, douleur) au détriment d'autres dimensions d’ordre mentales ou sociales. Afin de pallier cette limite, un nouvel instrument a été créé, son but étant d’être plus complet et plus équilibré dans la mesure de la qualité de vie reliée à la santé globale (QVRS-G). Ce rapport présente les étapes clés de la création de cet instrument ainsi que les résultats obtenus dans la mesure de la QVRS-G des québécois au printemps 2021. Ainsi un nouvel outil générique, le 13-MD, composé de 33 items avec 5 à 7 niveaux chacun a été mis sur pieds. La création d’un value set permettant la conversion des états de santé en scores d’utilité permettra son utilisation dans les analyses coût-utilité.

This paper focuses on the performance of IDB projects between 1996 and 2011 disbursements. We present evidence on the evolution of disbursements with respect to the available funds and the evolution of disbursements with respect to the historic disbursement curve of IDB projects. We also identify the main factors driving disbursements. Our findings show that disbursements improved in the last 10 years; in particular, they improved after the organizational changes instituted after 2006. With respect to the factors driving disbursements, we find that: (i) Country is more important than sector in understanding performance. (ii) Most of the remaining variance in project performance can be explained by variance within each country. (iii) The team leader plays an important role in understanding project performance. (iv) The effect of team leader location on disbursement performance has not been constant over time. The effect is negative for projects approved after 1996. However, if we focus on projects approved after 2009 the effect is positive. This result also provides evidence on the success of the organizational changes undertaken after 2006. (v) Projects that underwent a change in team leader show an improvement in performance after one year of the change. (vi) Team leader characteristics related to the experience or seniority of the team leader are non-significant, though in the expected direction. For at least a decade, States, humanitarian bodies, and civil-society actors have raised concerns about how certain counterterrorism measures can prevent or impede humanitarian and medical activities in armed conflicts. In 2019, the issue drew the attention of the world’s preeminent body charged with maintaining or restoring international peace and security: the United Nations Security Council. In two resolutions — Resolution 2462 (2019) and Resolution 2482 (2019) — adopted that year, the Security Council urged States to take into account the potential effects of certain counterterrorism measures on exclusively humanitarian activities, including medical activities, that are carried out by impartial humanitarian actors in a manner consistent with international humanitarian law (IHL). By implicitly recognizing that measures adopted to achieve one policy objective (countering terrorism) can impair or prevent another policy objective (safeguarding humanitarian and medical activities), the Security Council elevated taking into account the potential effects of certain counterterrorism measures on exclusively humanitarian activities to an issue implicating international peace and security. In this legal briefing, we aim to support the development of an analytical framework through which a State may seek to devise and administer a system to take into account the potential effects of counterterrorism measures on humanitarian and medical activities. Our primary intended audience includes the people involved in creating or administering a “take into account” system and in developing relevant laws and policies. Our analysis zooms in on Resolution 2462 (2019) and Resolution 2482 (2019) and focuses on grounding the framework in respect for international law, notably the U.N. Charter and IHL. In section 1, we introduce the impetus, objectives, and structure of the briefing. In our view, a thorough legal analysis of the relevant resolutions in their wider context is a crucial element to laying the conditions conducive to the development and administration of an effective “take into account” system. Further, the stakes and timeliness of the issue, the Security Council’s implicit recognition of a potential tension between measures adopted to achieve different policy objectives, and the relatively scant salient direct practice and scholarship on elements pertinent to “take into account” systems also compelled us to engage in original legal analysis, with a focus on public international law and IHL. In section 2, as a primer for readers unfamiliar with the core issues, we briefly outline humanitarian and medical activities and counterterrorism measures. Then we highlight a range of possible effects of the latter on the former. Concerning armed conflict, humanitarian activities aim primarily to provide relief to and protection for people affected by the conflict whose needs are unmet, whereas medical activities aim primarily to provide care for wounded and sick persons, including the enemy. Meanwhile, for at least several decades, States have sought to prevent and suppress acts of terrorism and punish those who commit, attempt to commit, or otherwise support acts of terrorism. Under the rubric of countering terrorism, States have taken an increasingly broad and diverse array of actions at the global, regional, and national levels. A growing body of qualitative and quantitative evidence documents how certain measures designed and applied to counter terrorism can impede or prevent humanitarian and medical activities in armed conflicts. In a nutshell, counterterrorism measures may lead to diminished or complete lack of access by humanitarian and medical actors to the persons affected by an armed conflict that is also characterized as a counterterrorism context, or those measures may adversely affect the scope, amount, or quality of humanitarian and medical services provided to such persons. The diverse array of detrimental effects of certain counterterrorism measures on humanitarian and medical activities may be grouped into several cross-cutting categories, including operational, financial, security, legal, and reputational effects. In section 3, we explain some of the key legal aspects of humanitarian and medical activities and counterterrorism measures. States have developed IHL as the primary body of international law applicable to acts and omissions connected with an armed conflict. IHL lays down several rights and obligations relating to a broad spectrum of humanitarian and medical activities pertaining to armed conflicts. A violation of an applicable IHL provision related to humanitarian or medical activities may engage the international legal responsibility of a State or an individual. Meanwhile, at the international level, there is no single, comprehensive body of counterterrorism laws. However, States have developed a collection of treaties to pursue specific anti-terrorism objectives. Further, for its part, the Security Council has assumed an increasingly prominent role in countering terrorism, including by adopting decisions that U.N. Member States must accept and carry out under the U.N. Charter. Some counterterrorism measures are designed and applied in a manner that implicitly or expressly “carves out” particular safeguards — typically in the form of limited exceptions or exemptions — for certain humanitarian or medical activities or actors. Yet most counterterrorism measures do not include such safeguards. In section 4, which constitutes the bulk of our original legal analysis, we closely evaluate the two resolutions in which the Security Council urged States to take into account the effects of (certain) counterterrorism measures on humanitarian and medical activities. We set the stage by summarizing some aspects of the legal relations between Security Council acts and IHL provisions pertaining to humanitarian and medical activities. We then analyze the status, consequences, and content of several substantive elements of the resolutions and what they may entail for States seeking to counter terrorism and safeguard humanitarian and medical activities. Among the elements that we evaluate are: the Security Council’s new notion of a prohibited financial “benefit” for terrorists as it may relate to humanitarian and medical activities; the Council’s demand that States comply with IHL obligations while countering terrorism; and the constituent parts of the Council’s notion of a “take into account” system. In section 5, we set out some potential elements of an analytical framework through which a State may seek to develop and administer its “take into account” system in line with Resolution 2462 (2019) and Resolution 2482 (2019). In terms of its object and purpose, a “take into account” system may aim to secure respect for international law, notably the U.N. Charter and IHL pertaining to humanitarian and medical activities. In addition, the system may seek to safeguard humanitarian and medical activities in armed conflicts that also qualify as counterterrorism contexts. We also identify two sets of preconditions arguably necessary for a State to anticipate and address relevant potential effects through the development and execution of its “take into account” system. Finally, we suggest three sets of attributes that a “take into account” system may need to embody to achieve its aims: utilizing a State-wide approach, focusing on potential effects, and including default principles and rules to help guide implementation. In section 6, we briefly conclude. In our view, jointly pursuing the policy objectives of countering terrorism and safeguarding humanitarian and medical activities presents several opportunities, challenges, and complexities. International law does not necessarily provide ready-made answers to all of the difficult questions in this area. Yet devising and executing a “take into account” system provides a State significant opportunities to safeguard humanitarian and medical activities and counter terrorism while securing greater respect for international law.
