Abstract:
In the 1950s, the Bureau of Indian Affairs (BIA) managed the Navajo Reservation's feral dog population by scheduling semi-annual “dog shoots.” After one gruesome dog shoot resulted in seventeen slaughtered dogs in Chinle, Arizona, community members pressed local BIA authorities to reform reservation dog control, an effort that pitted the interethnic community against an authoritarian form of settler-colonial governance. Because citizenship on the reservation—for Navajo and non-Navajo alike—was effectively rendered inferior to that of citizens outside the reservation, substantive changes to local BIA policies required an alliance with a constituency beyond the reservation’s borders, one with full access to state power—in this case, the National Dog Welfare Guild. This article thus demonstrates Native American grass-roots activism and boundary politics against oppressive federal authority.

Abstract:
Blood samples from 1,822 dogs residing on Native American reservations in 10 states were collected between February 2004 and August 2007. Samples were examined using a commercial enzyme-linked immunosorbent assay (ELISA) antigen capture test. All ELISA-positive samples were subsequently examined for microfilaremia. All dogs were asymptomatic for Dirofilaria immitis infection, resided outside (except for winter in the Northern latitudes), not on prophylaxis for D. immitis, and had not traveled off of the reservation. Reservations were characterized by degrees of north latitude, true prevalence of D. immitis, and a reproductive index calculated by multiplying the number of months of the year in which infective stage larvae (L3) could develop in 30 days or less for each reservation by the 30 yr mean annual rainfall in centimeters recorded for that community. The prevalence of heartworm was directly related to the reproductive index on each reservation.

Literaccy kuzyni „Reservation dogs”: analiza komparatystyczna utworów Louise Erdrich i Shermana Alexie Artykuł przedstawia analizę komparatystyczną współczesnej prozy rdzennych Amerykanów (powieści Love Medicine i The Bingo Palace Louise Erdrich oraz wyboru opowiadań The Lone Ranger and Tonto Fistfight in Heaven Shermana Alexiego) oraz serialu Reservation Dogs Taiki Waititi i Sterlina Harjo. Celem artykułu jest wykazanie podobieństw na poziomie konstruk­cji młodych bohaterów w tekstach literackich i dziele filmowym z uwzględnieniem takich kategorii jak dekonstrukcja stereotypów Indian, humor umożliwiający przetrwanie (survival humor – Lincoln 1993) oraz kwestii gatunkowych. Ta ostatnia kategoria obejmuje opowieści o dojrzewaniu, opowieści drogi, opowieści o powrocie do domu (homing novels – Bevis 1987) oraz realizm magiczny. Wykorzystana metodologia to studia kulturowe, postkolonializm i postmodernizm. Autorka artykułu zamierza wykazać, że wiele środków stylistycznych wykorzystanych do konstrukcji postaci w serialu Reservation Dogs pojawiło się znacznie wcześniej w kanonicznych utworach współczesnej prozy rdzennych Amerykanów i twórcy serialu wydają się podejmować inteligentny dialog z tradycją literacką, ponieważ podobnie stawiają na afirmację współczesnej kultury indiańskiej, podkreślają jej związki z popkulturą i bardzo często wprowadzają czarny humor, oddając rdzennym Amerykanom sprawczość i kontrolę nad własną opowieścią. ABSTRACT The article is a comparative analysis of contemporary Native American fiction (Louise Erdrich’s novels Love Medicine and The Bingo Palace, Sherman Alexie’s short story collec­tion The Lone Ranger and Tonto Fistfight in Heaven), and the series Reservation Dogs by Taika Waititi and Sterlin Harjo. The aim of the article is to indicate similarities in the construction of young protagonists of the selected literary texts and the series, with an emphasis on Indian stereotype deconstruction, survival humour and the genres. This last category encompasses bildungsroman, road novel/story, homing novel/story and magical realism. The methodology used in the article includes cultural studies, postcolonialism and postmodernism. The author of the article wants to argue that many stylistic devices used in the character construction in Reservation Dogs have appeared much earlier in the canonical works of Native American fiction and Waititi and Harjo seem to enter into an intelligent dialogue with the literary tradition because similarly to it, they affirm contemporary indigenous culture, stress its connection with popular culture and very often introduce the black humour which turns Native Americans into subjects of their narratives and gives them back control over their own stories.

SummaryObjectives: Lameness after metacarpal and metatarsal fractures in dogs is reported to occur with an incidence of 18% to 70%. On the basis of long-term results, the prognosis of these injuries was re-evaluated retrospectively.Methods: Medical records of 100 dogs with complete clinical and radiographic follow-up examinations after an average of four years (4 months – 14 years) were evaluated. According to their treatment, patients were allocated to three groups (Group 1 = conservative, Group 2 = surgical, Group 3 = combined). Assessment included complications during the healing period and the final radiographic and functional outcome, which was statistically compared for differences between groups (Fisher exact test, exact Wilcoxon-Mann-Whitney test). Further, risk factors for each bone were analyzed (stepwise, multiple logistic regression model). In 15 dogs, kinetic data (relative stance phase, peak vertical force and impulse) were investigated by computed gait analysis.Results: Complications were observed in 11 of 67 (16%) conservatively, in three of 25 (12%) surgically, and in three of eight (37%) conservatively and surgically treated dogs. Overall frequency of lameness evaluated by visual clinical assessment was three percent. Frequency of osteoarthritis and nonunion was also low, accounting for three percent and one percent respectively, although healing of mainly single-bone fractures resulted in malunions in 14% radiographically. Synostoses were found in 19% of patients, and significantly more frequent in surgically treated dogs. A higher risk of complications was identified for metatarsal compared to metacarpal fractures. Further, an increased risk for complications was detected for a higher degree of displacement and instability.Clinical significance: According to the longterm results found in this study, the prognosis for metacarpal and metatarsal fractures is better than reported in the literature to date. With the reservation that more severe injuries are generally treated surgically, and these fractures more frequently developed synostosis, no significant difference could be detected between conservative and surgical treatment.

Abstract:
Rabies remains a constant threat to humanity in many parts of the world. At the same time, scientifically grounded antiepizootic measures should be based on the peculiarities of the regional epizootology of this zooanthroponosis. The authors studied the epizootological and statistical reporting data of the Kropotkin Regional Veterinary Laboratory, presented an analysis of the registration of rabies in animals in Krasnodar region. From the obtained data, it should be noted that despite the wide range of animals involved in the epizootic process of rabies infection in Krasnodar region, dogs, cats and foxes play a major role in the reservation and spread of infection, which account for 78.6. Of the total number of registered cases, 15.5% falls on foxes, that indicates the natural focus of the disease, along with the manifestation of the disease in an urban form. At the same time, stray and neglected dogs and cats, which occupy a significant place among the total number of sick animals, are also sources and spread of the infection. Thus farm animals (8.3% of the total number of infected animals) are a biological dead end for the infection. Isolated cases of the disease were noted in muskrat, donkey, raccoon, raccoon dog, marten, ferret and jackal. The authors also established the specific morbidity of various animal species with rabies infection, that is an important aspect in the development and implementation of antiepizootic measures complex

In an urban transportation network, congestion occurs in the form of a queue behind a bottleneck. Many studies have considered a reservation-based optimization approach for queuing systems. To control the traffic density behind a bottleneck so that it does not exceed the link capacity, and to reduce the emissions and improve the sustainability of cities, we propose a new mobility service system to offer a Pareto-improving schedule for both the portion of agents making reservations and others with fixed departure time schedules. This reservation system takes the agents’ (i.e., users or vehicles here) actual arrival and departure times from a conventional system without reservations as the preferred time windows at both the origins and destinations. Such a centralized mobility service system could maintain or improve the end-to-end traveling performance for all users. The proposed reservation and end-to-end timetabling problem is formulated as a multicommodity flow optimization problem in a discretized space–time network. We use a modified dynamic programming method for the reservation strategy on the space–time network and further adopt the alternative direction method of multiplier (ADMM) based on prime and dual theory to solve the large-scale instances. A comprehensive discussion is also provided regarding the technical challenges and potential solutions when operating such a system in a real-world setting.

Abstract:
The charging infrastructure for electric vehicles faces the challenges of insufficient capacity and long charging duration. These challenges decrease the electric vehicle users’ satisfaction and lower the profits of infrastructure providers. Reservation systems can mitigate these issues. We introduce a reference architecture for interoperable reservation systems. The advantages of the proposed architecture are: it (1) considers the needs of the most relevant electric mobility stakeholders, (2) satisfies the interoperability requirements of existing technological heterogeneity, and (3) provides a classification of reservation types based on a morphological methodology. We instantiate the reference architecture and verify its interoperability and fulfillment of stakeholder requirements. Further, we demonstrate a proof-of-concept by instantiating and implementing an ad-hoc reservation approach. Our validation was based on simulations of real-world case studies for various reservation deployments in the Netherlands. We conclude that, in certain high demand situations, reservations can save significant time for electric vehicle trips. The findings indicate that a reservation system does not directly increase the utilization of the charging infrastructure.

Abstract:
When Iceland became a party to NATO, the Icelandic government seems to have believed that it made a reservation to the core obligation of the North Atlantic Treaty – the “one for all and all for one” obligation — in a speech held during a dinner celebrating its signature. A few decades later, this belief prevails, to some extent, in Icelandic politics. This opinion has no substance in international law. As is discussed, the reservation does not conform to formal and substantive requirements that international law makes to reservations. Consequently, Iceland is bound by the North Atlantic Treaty in the same way as other member states.

Abstract:
American Indian reservations have per capita incomes $9,000 lower than adjacent counties. This paper seeks to explain why using an approach akin to the analysis of country-level data. I estimate differences in levels of income and income growth for a decade where Indian economies were transformed greatly by casino gambling - the 1990s. I test several recent innovations in the theory of economic growth within the context of American Indian economies and assess how economic performance depends on veto players, human capital investment, and windfall wealth. I find that measures of rule of law, rent seeking, and human capital are the most economically significant predictors of the per capita income gap. In addition, the size of Indian casinos is strongly correlated with convergence and economic growth, suggesting that tribal investment in Indian casinos plays an important role in reservation economies. From the work done here, promoting economic growth through enhancing a stable investment climate appears to be the most successful development strategy. Moreover, this study contributes to the broader literature on economic growth by providing new insight into the way institutional quality affects the speed of, or potentially lack of, convergence.

Abstract:
Reducing deer vehicle collisions (DVCs) on highways is an issue facing highway planners and wildlife managers. In western Montana, federal, state and tribal governments intend to reduce DVCs along a 51-mile stretch of US Highway 93 (US 93) on the Flathead Indian Reservation using on site reconstruction and highway engineering. This project was part of pre-construction wildlife monitoring that forms the baseline for evaluating effectiveness of mitigation measures associated with the US 93 reconstruction project. Road and landcover variables were recorded at randomly sampled locations along US 93. DVC site selections were made based on Montana Department of Transportation maintenance and Montana Highway Patrol accident reports from 1998- 2003. Observed crossing areas were based on 32 sand tracking beds (each 100 m long) placed randomly in three key areas along the route. Variables collected included habitats types, topography, and rural residential developments and anthropogenic effects. A geographic information system was used to determine proportion of landcover variables at three spatial scales centered on the highway, encompassing 0.16 km (0.5 mi), 0.32 km (1 mi), 0.64 km (2 mi). Local scale habitat characteristics were collected in the field including presence of specific variables directly adjacent and up to 100 meters from the pavement edge. A priori models were developed to determine useful variables for predicting deer crossing and collision locations. Akaike's Information Criterion for small sample size (AICc) was used to rank best overall models and determine variables with a greater ability to predict crossing or collision occurrence. The results showed that landcover variables could be used to predict crossing or kill location. Top predictors included a positive correlation to forest cover, distance to the nearest city, and low intensity residential development. Negative correlations were found for distance to nearest water and population density. Results of this project will be used for comparison to post-construction movement patterns. This project is unique in that data are available from another related concurrent project providing OCA data, which allows us to look at both observable crossing rates as well as collision rates, in relation to landscape and road variables.

This master s degree dissertation concerns an extremely relevant subject, a subject that wakes people to a feeling of respect for individuality and survival at any cost. On the basis of the principle of equity, it seeks to address the rights of persons with disabilities, focusing particularly on the effectiveness of their individual rights. In this sense, it deals with the divergence between inclusion and integration, in addition to the bringing of awareness to society for persons with disabilities to be treated in an egalitarian manner, without any form of discrimination. From the beginning of this work, attention has been paid to the form of treatment of such individuals by using the expression that most suits the purpose of this study, and for this reason the form of treatment elected is the one adopted by the International Convention on the Rights of Persons with Disabilities, ratified by Brazil with constitutional amendment status on 10 July 2008. The expression person with disability has been adopted on the assumption that a disability should not be an adjective (as in the case of disabled person ) or a temporary state (as in the case of person having a disability ), since a disability is with a person or in a person. We seek to highlight the protection of the rights of such persons in three complementing areas: in the international context, through the analysis of international treaties on the subject; in the domestic constitutional scenario, through the study of the development of the matter in the light of the Federal Constitutions addressing in particular the rights brought about by the current Constitution; the insertion of the rights of persons with disabilities within human rights, focusing particularly on the dignity of human beings. A parallel is drawn with international law through the concept of reserve of the possible, with references to the domestic infra-constitutional law that sets forth a legal quota for employment of persons with disabilities. As such, the thesis concerning the factual impossibility of the subject matter of a required legal transaction is adopted, on the grounds of section 104, item II, of the Civil Code which regards with restriction the legal obligation to employ persons with disabilities, since in such case the State transfers to the private initiative the responsibility to provide citizens with minimum social rights. The conclusion is that indeed the inclusion of persons with disabilities in all social scenarios is, prior to any obligations on the part of private parties, obviously without declining their moral if not legal portion of such duty, a responsibility on the part of the State to provide the minimum conditions as are necessary for a dignified life, qualifying such persons for the labor market and as such satisfying where families fail. In the context of employment law, the State should prepare persons with disabilities for the labor market by creating public policies that provide minimum social rights. Only then would it be the case for private parties to have to satisfy their portion of responsibility by complying with the legal quota
A presente dissertação de mestrado versa sobre um assunto de extrema relevância, assunto que desperta nas pessoas um sentimento de respeito à individualidade e sobrevivência a qualquer custo. Pelo princípio da equidade, busca tratar dos direitos das pessoas com deficiência, com especial enfoque para a efetivação dos seus direitos fundamentais. Nesse sentido, aborda a divergência entre a inclusão e a integração, além da conscientização da sociedade para que as pessoas com deficiência sejam tratadas de modo igualitário, sem nenhuma forma de discriminação. Desde o início do trabalho houve o cuidado com a forma de abordagem desses indivíduos, mediante o uso da expressão que mais se ajustasse à finalidade do presente estudo, razão pela qual se optou pela nomenclatura adotada pela Convenção Internacional sobre os Direitos das Pessoas com Deficiência, ratificada pelo Brasil com valor de emenda constitucional em 10.07.2008. Adotou-se a expressão pessoa com deficiência , assumindo-se sobretudo que a deficiência não deve ser um adjetivo (como no caso de pessoa deficiente ) ou um estado momentâneo (como no caso de pessoa portadora de deficiência ), pois a deficiência está com a pessoa ou na pessoa. Procura-se destacar a proteção dos direitos das pessoas, em três esferas complementares: no âmbito internacional, mediante análise dos tratados internacionais sobre o tema; no cenário interno constitucional, por meio de estudo sobre a evolução do assunto à luz das Constituições Federais, abordando especificamente os direitos trazidos pelo texto atual; a inserção dos direitos das pessoas com deficiência nos direitos humanos, com enfoque especial para a dignidade da pessoa humana. Traça-se um paralelo com o direito internacional, por meio do conceito de reserva do possível, com alusão à legislação interna infraconstitucional que prevê a cota legal para a contratação de pessoas com deficiência. Adota-se, assim, a tese da impossibilidade fática do objeto do negócio jurídico exigido, com fundamento no artigo 104, inciso II, do Código Civil, que vê com restrição a obrigatoriedade legal de se contratarem pessoas com deficiência, já que nesta situação o Estado transfere para a iniciativa privada a responsabilidade pela concessão de direitos sociais mínimos aos cidadãos. Concluiu-se que, de fato, a inclusão das pessoas com deficiência em todos os cenários da sociedade é, antes de obrigação do particular, obviamente não declinando a sua proporção de dever senão legal moral, responsabilidade do Estado em conferir o mínimo necessário a uma vida digna, capacitando essas pessoas para o mercado de trabalho e, desse modo, suprindo as falhas das famílias. No âmbito do direito do trabalho, o Estado deve preparar a pessoa com deficiência para o mercado de trabalho, com a criação de políticas públicas que confiram direitos sociais mínimos. Dissertação de mestrado em Psicologia Aplicada
O presente estudo explora a interação entre os julgamentos de justiça e o feedback no salário de reserva. Os participantes foram distribuídos aleatoriamente por 4 condições experimentais (justiça/injustiça X feedback/não feedback), começando por avaliar a justiça de situações relacionadas com o trabalho (justas/injustas), e de seguida resolvendo mentalmente conjuntos de 5 operações numéricas (com/sem feedback), com pagamento decrescente. O ponto em que os participantes paravam, definia o salário de reserva. Pretende-se mostrar a existência de um efeito combinado da exposição a situações de justiça e do feedback na realização da tarefa na média do salário de reserva, sendo esperado que a presença de feedback, tal como a exposição a situações justas, diminua a média do salário de reserva. Os resultados mostraram que os participantes foram sensíveis à justiça das situações apresentadas, e à presença de feedback, mas que, contrariamente às previsões, apenas este último teve o efeito esperado no salário de reserva, baixando a sua média. Também não se observou qualquer interação entre estas variáveis. O padrão de resultados é discutido no âmbito deste procedimento, sugerindose que os efeitos dos julgamentos de justiça não são generalizados para fora do contexto em que são gerados.
The present study investigates the interaction between justice judgments and feedback on the reservation wage (RW). Participants were randomly assigned to 4 conditions (fair/unfair X feedback/without feedback); they first evaluated the fairness of a number of work-related situations (fair/unfair); next, they performed a number of sets of 5 mental, (with or without feedback) with decreasing payments. RWs were defined by the set at which participants decided to stop. We expected a lower RW in the feedback/justice condition. The results showed a main effect of feedback (lower RW in the feedback condition), no effect of the justice variable and no interaction between the two variables. This pattern of results is discussed, suggesting that the effect of judgments of justice do not generalize from one context to another.

Abstract:
Nowadays, the negotiation of international Conventions between different States is clearly on the increase. States, which have very different characteristics among them, not only at the legal level but also at the historic and cultural level, among others, have the right to reject or modify certain effects of a clause which can potentially collide with their own ideals or interests. It is based on this principle that the practice and regime of the Reservations in International Public Law came into being, in which a State is allowed, at the point of the institution of the Clause, to reject or modify the impact of that Clause. However, the formulation of reservations can be dangerous, in the sense that they can potentially violate basic principles of public international law, rules of treaty law, or even the object and aim of the treaty itself. In order to prevent this from happening, the reservations' regime is very complex in that it establishes limits which protect not only the integrity of the treaty itself, but also of international law. Moreover, the same regime grants the remaining Parties to the Convention the right to formulate objections, by which they express their opposition to the formulated reservation and decide in which way those reservations will impact their relationship with the State which formulated it. Thus, the present report aims at clarifying the reservations' regime in order to solve potential problems which may arise, as well as those already existing problems which I had the opportunity to analyze during my six month internship at the Portuguese Ministry of Foreign Affairs.
Nos dias de hoje é cada vez mais crescente a negociação de Convenções internacionais entre vários Estados. Esses Estados, que apresentam características muito diferentes entre si, não só a nível jurídico como também histórico e cultural, têm o direito de afastar ou modificar os efeitos de certa cláusula que possa vir a colidir com os seus ideais ou interesses. Com este fundamento nasceu a prática e o regime das reservas no Direito Internacional Público – é permitido a um Estado, no momento da sua vinculação, afastar ou modificar o efeito dessa disposição. No entanto, a formulação de reservas pode apresentar perigos, na medida em que essas desrespeitem princípios basilares de direito internacional público, regras do direito dos tratados, ou até o fim do próprio tratado em questão. De forma a prevenir que tal aconteça, o regime das reservas apresenta uma grande complexidade na medida em que estabelece limites que protegem não só a integridade do tratado em causa, como do próprio direito internacional. Ademais, o mesmo regime garante aos restantes Estados Parte na Convenção o direito de formularem objeções, através das quais demonstram o seu dissenso perante a reserva formulada e decidem quais as suas consequências na sua relação com o Estado que formulou a reserva. Desta forma, o presente relatório de estágio visa clarificar o regime das reservas e objeções, de modo a resolver potenciais problemas que possam surgir, assim como os que já existem e que tive a ocasião de analisar ao longo do meu estágio de seis meses no Ministério dos Negócios Estrangeiros.

No Brasil, tem-se verificado um aumento significativo de demandas judiciais que pleiteiam a concretização de serviços públicos, transferindo para o Judiciário o debate de temas antes voltados exclusivamente à arena política. Prova de que os brasileiros encontram-se insatisfeitos com a qualidade das prestações estatais disponibilizadas. O presente trabalho procura investigar justamente quando e como o Poder Judiciário brasileiro deve agir na solução de desacordos constitucionais que tratam das omissões do Poder Público, no campo dos deveres prestacionais. Por sua vez, ao fazê-lo, pretende-se analisar o problema sob um olhar mais atento à temática orçamental. Com efeito, a qualidade de vida dos cidadãos relaciona-se, em grande medida, às intervenções estatais e, em última ratio, ao orçamento público, ferramenta a serviço do planejamento financeiro do Estado. Se por um lado a boa governança não depende apenas de dinheiro, de outro, toda e qualquer atividade governamental possui custos, sendo os recursos públicos limitados para o atendimento das múltiplas necessidades sociais. Assim, não há dúvida de que o manuseio do orçamento público corresponde a uma atividade de fundamental relevância, não somente pelo volume de recursos que aloca, como também e principalmente pela imprescindibilidade dos objetivos que, por seu intermédio, almeja-se realizar. A efetividade dos direitos fundamentais, essencialmente os prestacionais, depende de finanças públicas sólidas e voltadas aos fins constitucionais, os quais não são alcançados pela mera proclamação formal de direitos fundamentais na Constituição. Sem dúvida, trata-se de uma construção que exige o engajamento real e contínuo de todos os poderes constituídos, inclusive da Justiça Constitucional. O desafio é justamente delinear os limites de tal intervenção, a fim de que sejam respeitadas as competências orçamentais dos demais poderes e, concomitantemente, haja a preservação da força normativa da Constituição. Nesse contexto, o enfrentamento do tema orçamental é essencial, pois permite avaliar, com maior precisão, as justificativas estatais em casos de descumprimento dos deveres prestacionais, bem como identificar e coibir os eventuais abusos de poder. Pode-se afirmar, inclusive, que sem investigar o orçamento, dificilmente se a dentrará no âmago dos desacordos constitucionais travados nesses domínios. Isto porque não se pode admitir o cometimento de arbitrariedades na condução dos recursos públicos, mesmo quando praticadas sob o crivo da Justiça Constitucional. O Brasil precisa avançar no campo da concretização dos direitos fundamentais, mas deve fazê-lo com sustentabilidade, coerência e, acima de tudo, em deferência à Constituição Federal.
In Brazil, there has been a significant increase in the number of lawsuits demanding the implementation of public services, transferring to the Judiciary the debate on issues previously focused exclusively on the political arena. Proof that the Brazilians are dissatisfied with the quality of the state services provided. The present work seeks to investigate precisely when and how the Brazilian Judiciary should act in the solution of constitutional disagreements that deal with the omissions of the Administration, in the field of the duties involving public services. In turn, in doing so, it was intended to analyze the problem with a closer look at the budget theme. In fact, citizens' quality of life is largely related to state interventions and, ultimately, to the public budget, a tool in the service of State financial planning. If on the one hand good governance does not depend only on money, on the other, every government activity has costs, and public resources are limited to meet the multiple social needs. Thus, there is no doubt that the handling of the public budget corresponds to an activity of fundamental importance, not only for the volume of resources it allocates, but also and especially for the in-dispensability of the objectives that, through it, it is desired to achieve. The effectiveness of fundamental rights, essentially those involving the provision of public services, depends on sound public finance coherent with constitutional purposes, which is not achieved by the mere formal proclamation of fundamental rights in the Constitution. Undoubtedly, it is a construction that requires the real and continuous engagement of all constituted powers, including Constitutional Justice. The challenge is precisely to delineate the limits of such intervention, so that the budgetary competences of the other powers are respected and, at the same time, the normative force of the Constitution is preserved. In this context, tackling the budget issue is essential, since it allows for a more precise assessment of state justifications in cases of noncompliance with the provision of public services, as well as identifying and restraining any abuse of power. It can even be said that without investigating the budget, it will hardly enter into the heart of the constitutional disagreements in these areas. This is because one cannot admit the committing of arbitrariness in the conduct of public resources, even when practiced under the scrutiny of Constitutional Jus-tice. Brazil needs to advance in the field of the realization of fundamental rights, but must do so with sustainability, consistency and, above all, in deference to the Federal Constitution.

This chapter investigates the structure of the rights and obligations running within human rights treaties as legal instruments designed for the realization of common humanitarian interests. It does so from a legal-positivist point of departure. The chapter first deconstructs the mantra of the so-called ‘objective’ human rights treaty obligations. It then analyses the legal position of the individuals whose rights are consecrated in human rights treaties and identifies these rights as genuine treaty entitlements. This is followed by a concise depiction of the specific legal consequences derived from the characteristics of the treaties, focusing on the hotly debated topic of reservations. The chapter concludes by comparing its views with those expressed in chapter 39 on the topic of sources of international human rights law.

This chapter examines some of the legal problems resulting from the entry of the ‘new’ states (mainly the Afro–Asian countries) into the family of nations. The orthodox view is that such states have no choice as to the law which shall apply to them since they are born into the existing international order and must accept its tenets. However, the practice of the ‘new’ states does not supply sufficient evidence of such a fait accompli. There are legal rules that they tend to reject as well as rules they wish to have included. Among the existing principles that ‘new’ states refuse to accept or that they accepted with far-reaching reservations are the legal principles relating to economic relations. Other branches of international law that are under revisionist pressure from the ‘new’ states are the law of state succession and the law of the sea.

It contains the third exception from the general application of the lex concursus that relates to sales of assets where title does not pass from the seller to the buyer on delivery, but where the seller validly reserves title unless and until the price is paid. The commentary outlines rules that deal with the insolvency of the purchaser and the insolvency of the seller. It highlights the rationale for Article 10, which is to protect the rights of the seller in the event of the insolvency of the purchaser. It addresses the question of whether there is an asset or assets within the meaning of the EIR.

As Indonesian hospitality market is growing, Indonesian customer preferences need to be understood more deeply by hotels to stay competitive. This research aims to examine the relationship between room service, room comfort, and reservation process factors to the performance of in-room dining, front office service, room amenities, hotel access and safety. Survey method was employed in this study, consisting of offline surveys distributed to the individuals who have stayed in one of the prominent hotels in Jakarta. The results indicated that room service does have a direct linear relationship on the performance of in-room dining, but room service does not have a direct linear relationship to the room amenities and hotel access and safety. Room comfort was shown to have a direct linear effect on the performance of in-room dining, room amenities, hotel access and safety. On the other hand, reservation process does have a direct linear effect on the performance of front office service as well as to the room amenities and hotel access and safety.

This chapter explores a number of philosophical issues raised by the possibility of arriving at moral views by relying on other people. I defend the Moral Inheritance View, according to which a person whose earliest moral views are inherited from her social environment might very well have substantial moral knowledge even before she is in a position to begin critically reflecting upon or reasoning about those views. More generally, I argue that other people are in principle potentially rich sources of moral knowledge. To the extent that we have reservations about the propriety of forming moral views by relying on others—as opposed to through the exercise of our own autonomous judgment—what is legitimate in those reservations does not derive from its being impossible to acquire moral knowledge in this way, but rather from other sources.

Among speakers of the dialects in China's deep south, it is a commonplace that their languages preserve the authentic sound of Táng dynasty pronunciation. That is an expression of identity, worthy in itself of respect without reservation, but respect does not tell us whether the claim is actually true. To gain the means to consider whether it is true, the dialect fieldworker and philologist David Prager Branner transcribes and analyses an authoritative 21st century performance of a major ninth century ballad of Bái Jūyì 白居易, a performance composed by the renowned Hóng Zénán 洪澤南 of Taiwan. (Hóng is a scion of two nineteenth-century schools of literati cantillation wénrén yínsòng 文人吟誦: the “Sword-House Studio” Jiànlóu Shūfáng 劍樓書房 of Zhào Yìshān 趙益山 and the “Pipes of Heaven Cantillation Society” Tiānlài Yínshè 天籟吟社 of Lín Shùsān 林述三.) Based on the analysis, Branner considers the ways in which Taiwan’s abiding literary performance tradition matches or departs from what we know of the sound of the Táng.

Even as most Americans fix their gaze on the actions of the federal government, states and localities are the cornerstones of the US federal system. “What state and local governments do” explains that states are free to design their own governments so long as their structure does not violate the US Constitution. All states have designed their governments to somewhat resemble the national government, with an elected governor, elected legislatures, and state supreme courts. However, each of these structures can operate in different ways, with different powers from state to state. The governments of the Native American reservations and those of the five permanently inhabited US territories are also discussed.

Chapter 3 assesses the underlying political logic of community-based affirmative action and reservation that is promoted as the new ameliorative policy, addressing the deprivation of Indian Muslims under conditions of economic reforms. It does so by engaging with the findings and policy prescriptions of the Sachar Committee Report, the Ranganath Misra Commission Report, and the post-Sachar Evaluation Committee Report. Besides, the chapter points out the missing links of the Sachar Committee Report and presents a host of other suggestions that the committee did not recommend for the socio-economic development of Indian Muslims. While evaluating the merits of the Sachar and Misra Commission reports along with defending the ethical grounds for the affirmative action for Muslims in India, this chapter also tries to unearth the limitations of the approach of the government towards Muslim minorities in the context of neoliberal dispensation.

Chapter 11 provides an account of Strauß’s main work on Christian theology, his 1840 Die christliche Glaubenslehre. This work was Strauß’s critique of Christian dogma and therefore concerned more than the historical reliability of the New Testament. But the work was marred by a deep ambivalence: Strauβ‎’s work was meant as a compendium and therefore needed to provide the student with an introduction to Christian dogma; but Strauß also had deep personal reservations about Christianity which resurface in the text. The work contains a severe critique of the Christian beliefs in miracles, immortality, the trinity, and incarnation; but it also provides a demonstration of the existence of God. Though Strauß now distances himself from Hegel, he still does not completely disavow him.

This book has investigated whether the existence of telephone law rendered law irrelevant for Russians in their everyday lives. It has shown that Russians are not as nihilistic as usually assumed, but neither are they free of skepticism when it comes to their legal system. Their attitudes and behavior vary depending on the situation. Their primary reservation about using the courts is not concern over telephone law, but dread of the inevitable red tape and emotional turmoil that accompany litigation. This concluding chapter returns to the theoretical dilemma of how we should conceptualize legal systems like that of Russia in which law can—but does not always—matter. In particular, it considers how a dualistic legal system, in which politicized law exists side by side with law that is enforced and obeyed based on its written terms, should be evaluated in terms of the rule of law. It argues that a rethinking of the very concept of the “rule of law” in Russia is needed.

The paradoxes of evolution are considered from the perspective of self-organization theory. The S-elements having several modalities, and this circumstance will help to understand why evolution is happening exactly this way. The evolution does not stop at the formation of human of a modern type. Slight changes in the human body and huge changes in his mind have occurred; the evolution markers should be defined. Behavior is another aspect of evolution. A simple criterion for determining psychological types may be the relative development of channels of human-environment interaction. The way of interaction determines preferential needs, motivations, and patterns of behavior, what, in turn, determines social structure and place of a specific human in it. Here a reservation is necessary - of course, the ideology, origin, historical and other circumstances are of great importance, after all, a particular human may have two or more dominant channels, but his inclinations will still determine his social behavior.

The use of electronic medical record (EMR) systems is transforming health care delivery in hospitals. Perioperative nurses work in a unique high-risk health setting, hence require specific considerations for EMR implementation. This research explored perioperative nurses’ perceptions of facilitators and barriers to the implementation of an EMR in their workplace to make context-specific recommendations about strategies to optimise EMR adoption. Using a qualitative exploratory descriptive design, focus group data were collected from 27 perioperative nurses across three hospital sites. Thematic analyses revealed three themes: 1) The world is going to change; 2) What does it mean for me? and 3) We can do it, but we have some reservations. Mapping coded data to the Theoretical Domains Framework identified prominent facilitators and barriers, and informed recommended implementation strategies for EMR adoption by perioperative nurses.

Many stakeholders, however, have reservations regarding group-based assignments, in particular about whether or not individual group members are rewarded appropriately for their contribution to the overall group achievement. The success of group-work is dependent on both extrinsic factors, such as assignment design, management, assessment, etc. as well as intrinsic factors, such as the knowledge, skills, etc. of individual group members.In this paper the challenges presented by the extrinsic factors that impact on the success of group-based assignments are considered against the background of the of formal summative assessment of group-based assignments on BSc Computing undergraduate courses in the Department of Computing at Canterbury Christ Church University in the United Kingdom. In particular the effectiveness of group-work in terms of improved learning, improved development of non-cognitive skills and assessment validity/reliability are considered.

In recent years, speech interfaces have been proposed for making shopping order or restaurant reservations while transmitting information only by speech. It is easy to imagine that such a system will be installed in cars soon. However, to use the speech interface that can realize such tasks while the driver is driving, the system needs to understand the driving situation of the driver and control the speech guide timing accordingly. We focused on the fact that there are scenes (SCD: Scenes of Concentrate Driving) where the driver temporarily interrupts the speech operation unconsciously to concentrate on driving operations. However, one does not yet know in which scenes the voice dialogue becomes a burden. In this study, we identified driving scenes where dialogue is a burden (SCD), clarified the relationship between SCD and driving behavior, and considered a method to estimate SCD automatically. In this research, we define SCD as a situation in which the driver temporarily suspends the speech operation and wants to perform only the driving operation, although the system can perform both the speech operation and the driving operation. Under SCD circumstances, even if the speech interface presents some guidance, the driver can not understand its contents. Also, even if the system prompts for an answer by speech input, the driver does not answer. To confirm the existence of SCD, we have created nine driving scenes that require different driving operations (lane change, overtaking, narrow road, right turn, etc.) and reproduced these scenes using a Driving Simulator (DS). We also created some tasks to prompt the driver's voice input, and present them just before the driving scene, such we could check whether the driver interrupts or not the dialogue during the driving operations needed to pass the scene. We recorded speech and collected driving signals (steering angle, throttle opening, etc.) for 15 men and women in their 20s (11 men and 4 women) with a driver's license. First, for each driving scene, we checked whether the driver could answer the immediately preceding question presented by an operator and confirms that SCD occurs in various driving scenes. In the driving scenes involving lane change, the utterance was interrupted for more than 40% of the tasks. On the other hand, in the driving scenes in which the driver steers left and right curves, while driving in the same lane as the preceding vehicle, the utterance was seldom interrupted. These results confirm the existence of driving scenes in which speech is likely to be interrupted, that is, SCD. Next, we considered a machine learning model to estimate the occurrence of SCD automatically, using only the driving signal. We compared the classification accuracy of SCD occurrence according to several analysis window lengths, from 0.5seconds to 5 seconds with a 0.5seconds increment. The results showed that a trained Support Vector Machine (SVM) could provide a classification accuracy of about to 85% for two classes (SCD or not), and 82% for three classes (SCD, semi-SCD, regular) with a window size of 2seconds.

Abstract:
The genesis of the Copyright Amendment Bill was in 2009, when the Department of Trade and Industry (DTI) initiated various studies and impact assessments. In July 2015, the DTI published a Draft Copyright Amendment Bill for public comment. The final 2017 version of the Bill was approved by Parliament in 2019 and it was sent to President Cyril Ramaphosa for action in terms of Section 79(1) of the Constitution. Section 79(1) states that “The President must either assent to and sign a Bill passed in terms of this Chapter or, if the President has reservations about the constitutionality of the Bill, refer it back to the National Assembly for reconsideration”. The President referred the Bill back to Parliament for review on 16 June 2020, on constitutionality issues. In response to the President’s reservations, Parliament’s Portfolio Committee on Trade and Industry has invited stakeholders and other interested parties to submit written submissions on certain sections of the Bill by no later than 9 July 2021. The current copyright law is outdated and does not address the digital environment. The Academy of Science of South Africa seeks to take into account the status of the copyright legislation and the anticipated effects of the amendment Bill on different issues and thereafter, provide recommendations to the President.
