Abstract:
This thesis offers a comprehensive examination of the dilemmas posed by cyberspace for contemporary social research and in how far current ethical frameworks can manage the risks that may emerge in this new research environment. The study is situated in the period of 1998 to 2010, during which the social uses of rapidly converging technological tools led to the extension of the social world into a new social sphere of social interaction called cyberspace. Social scientists have been quick to explore this sphere; however, as the dominant discourses are based on ideas of newness and difference there is uncertainty over what kind of space it is, whether we can transfer existing methods and ethics and what rules apply in the conduct of research. The thesis first investigates the extent to which the technological tools and ethical dilemmas encountered in cyberspace are in fact new or different. This then necessitates a detailed engagement with the conceptualisation of cyberspace. Thereafter it closes a gap in dominant conceptualisations of cyberspace by offering insights into its legal and regulatory foundations. Next, the thesis reflects on legislation and regulations to identify emerging risks that emerge in everyday social research practice in the online environment. These risks are then used as vignettes to test current ethical guidance’s ability to manage them. The thesis argues that disciplines within the social sciences need to be continually reflexive about their encounters with new spaces, and concludes that cyberspace demands significant engagement with the difficulties posed by the rapid pace of change of technological development and regulatory and legislator foundations in order to manage risk in online social research. Thus while online research is the focus, the potential of this thesis is to offer a historical insight into the reflexivity of the discipline in particular in how successfully it encounters new spaces of/for research.

Abstract:

This mixed methods study employed an instrumental single-bounded case approach to explore how a policing executive develops and sustains an ethically performing organization, given the phenomenological "policing power-public trust" relationship. Policing is foundational to rule of law and ethical performance in policing is fundamental to developing and sustaining a healthy policing power-public trust relationship. A review of relevant policing literature reveals a history of tension and conflict in this complex relationship. The literature review included relevant social contract theory, history of policing and the policing power-public trust relationship, relational leadership, servant leadership, transformational learning and leadership and change management. Organizational related literature included relevant aspects of organizational learning, performance, change and transformation.

Qualitative interviews were conducted with the policing executive and a quantitative survey instrument was pilot study validated and subsequently administered to the organization's sworn personnel. From qualitative and quantitative data collected, analyzed and integrated, 26 findings emerged. Further analysis of the findings resulted in four emergent themes. Results suggest that in a highly dynamic environment, a pragmatic role-modeling and holistic leadership strategy to drive ethical performance by leveraging a culture of accountability, best practice, and change readiness has potential external ecological application. In turn, ethical performance may generate public trust when an organization leverages innovative capacity to connect with its community through a robust strategy of active communication and transparency.

Although emergent findings or themes may have limited ecological application with similarly situated chiefs, organizations and communities, external generalizability is not foreseeable. Recommendations for future research include use of a multiple case study methodology to focus on one or more themes identified in this inquiry. A study could be undertaken to identify how leaders in organizations with relatively stable environments lead their respective organizations to perform ethically and build public trust. Given this organization's current success and expected future benefits from having developed and implemented a robust community engagement strategy, a study of similarly effective external communication strategies could be undertaken to identify the relative value and community impact.

Abstract:
The purpose of this study was to examine the perceptions that differ among university personnel and students with disabilities regarding the vagueness in the legal definition of the term reasonable accommodations. The theoretical framework that guided this study was the social model of disability. Using a sequential mixed-method design, the first strand surveyed 98 students and 93 personnel; then 10% of each group participated in an interview or focus group. The main research questions explored the different accommodations offered by university personnel versus those that were used by students and the different perceptions of the term reasonable accommodations in accordance with ADA law. A chi-square test was used to analyze yes/no survey data and a t test was used for the Likert scale question. In the first strand there were statistically significant findings in distribution and perception of 35 specific accommodations, including advocacy and counseling. Both focus group and interview data were analyzed and themes emerged, such as specific accommodations. An important finding from the qualitative strand was that more than half the students thought they were not receiving reasonable accommodations while the majority of university personnel thought they provided reasonable accommodations. The key result was the lack of a clear consensus between students with disabilities and university personnel in definitions of reasonable accommodations. Disseminating the results of this research study can create positive social change in the legislative and academic arenas by creating a better understanding of the impact of the current standard of reasonable accommodations. One recommendation is the creation of federal and state level commissions to administer, manage, and maintain policies for colleges.

Abstract:
Although replication is considered an indispensable part of the scientific method in software engineering, few replication studies are published each year. The rate of replication, however, is not surprising given that replication theory in software engineering is immature. Not only are replication taxonomies varied and difficult to reconcile, but opinions on the role of replication contradict. In general, we have no clear sense of how to build knowledge via replication, particularly given the practical realities of our research field. Consequently, most replications in software engineering yield little useful information. In particular, the vast majority of external replications (i.e., replications performed by researchers unaffiliated with the original study) not only fail to reproduce the original results, but defy explanation. The net effect is that, as a research field, we consistently fail to produce usable (i.e., transferable) knowledge, and thus, our research results have little if any impact on industry. In this dissertation, we dissect the problem of replication into four primary concerns: 1) rate and explicitness of replication; 2) theoretical foundations of replication; 3) tractability of methods for context analysis; and 4) effectiveness of inter-study communication. We address each of the four concerns via a two-part research strategy involving both a theoretical and a practical component. The theoretical component consists of a grounded theory study in which we integrate and then apply external replication theory to problems of replication in empirical software engineering. The theoretical component makes three key contributions to the literature: first, it clarifies the role of replication with respect to the overall process of science; second, it presents a flexible framework for reconciling disparate replication terminology; and third, it informs a broad range of practical replication concerns. The practical component involves a series of replication studies, through which we explore a variety of replication concepts and empirical methods, ultimately culminating in the development of a tractable method for context analysis (TCA). TCA enables the quantitative evaluation of context variables in greater detail, with greater statistical power, and via considerably smaller datasets than previously possible. As we show (via a complex, real-world example), the method ultimately enables the empirically and statistically-grounded reconciliation and generalization of otherwise contradictory results across dissimilar replications—which problem has previously remained unsolved in software engineering.

Abstract:
The law defines the sexuality of bodies in limited terms. The law draws lines across the body which force it into identification and categorisation (male, female, straight, gay, human, non-human). These definitions conflict with the materialities of the body and the materialities of the encounter of sex, which are inclined to ‘push’ at and reterritorialize these boundaries. Legal and ethical frames restrict the ability of law and of research to access the encounter of sex, where bodies push these limits by moving, touching, kissing, fucking, caressing and becoming. I claim that ethics as contextual laws that derive from encounters carry the potential to subvert the subjugation of bodies from law’s inside. This subversion is dependant on establishing access to the encounter, which I argue is possible through methodologically radical sexuality research. The researcher’s body is also a sexed body, and I claim that by situating, and tracing the process of situating the ‘I’ within research, the ‘soul’ of the individual finds itself connected to the collective, through lines drawn across it by law. These lines can be ‘ruptured’ through their reconnection to the encounter of sex, which draws law deeper into the encounter itself, such that law can be disrupted through desire into becoming radically ‘ethical’. Through the deployment of Deleuzian Conceptual and Methodological Tools, I frame the basis through which law can become-ethical. The creation of this theoretical frame brings me and my thesis to wade through the ‘waves’ of real encounters with the field, at a nudist beach at Cap D’Agde in Southern France. In the course of doing so, I become reflexive and critical of the Deleuzian conceptual and methodological tools and whether even radical and immanent philosophy is equipped to assist the law in becoming-ethical in its judgment of sex. I claim that access to the encounter and to disrupting law towards radically bodily-sensitive judgment and ‘measuring’ of encounters is a ‘practical’ endeavour. This is the radically ethical responsibility of the Researcher-Practitioner: A lawyer-researcher body who is deployed into the field to subvert the spectres of law and sexuality through practice, which is traced presence within the real, fleeting, everlasting, intimate, joyful, painful, banal, profound, hot, heavy, fast, slow, violent, gentle and sand-drenched encounter of sex itself.

Abstract:
Neural interface devices are artificial devices that are controlled by the human mind. Neural interface systems encompass sophisticated technology that enables integration of machine with the human brain and body. The complexity of the brain and neural system is so great that full understanding of how these work is still being discovered through neuroscientific research. Interfacing with the human brain and neural system is far from perfect so the ways in which they work and the limitations of neural interface devices must be recognised when a dispute comes before a court of law. The research hypothesis tested in this thesis is that when a person who has a neural interface device is involved in circumstances where harm to another person or another person's property occurs, the Australian law will require re evaluation and adaptation to resolve subsequent civil action. Complexity will arise because of the existence of the neural interface device and what might be regarded as a merging of mind and machine. This will make it difficult to determine factual causation and as a result, the law will need to adapt to these circumstances. Thomas Kuhn's concept of revolutionary science, involving paradigm shift, is applied to determine this hypothesis. While doctrinal methodology is applied in the analysis of the law, policy considerations that will impact on the judicial decision making and legislative action are also discussed. Delphi Method research has been undertaken to obtain the insight of legal experts regarding the legal issues that will arise in the context of civil disputes and how the current law will address these issues. The information upon which the participants in the Delphi Method research based their responses purposely excluded malfunction of the neural interface device as the law will have most difficulty determining liability when the device does not malfunction. In the analysis of the legal issues, scenarios have been introduced to better assess the application of the law and identify the difficulties that will require re-evaluation and adaptation of the law. While the facts that arise in disputes differ, identification of the difficulties the current law will have in resolving a dispute presented in this thesis will provide insight for future civil proceedings where the person with a neural interface device is involved. Throughout this thesis, the person with the neural interface device is regarded as a defendant in a civil proceeding. The issues involving neural interface devices are multifactorial, so while neuroscientist and engineers develop neural interface devices, lawyers, academics and politicians must consider the ethical, legal and social frameworks within which innovation can exist and thrive. This thesis concludes with recommendations, based on the legal issues identified and analysed, to assist the judiciary, the legislature and the legal profession with this new area of technological advancement. The challenges that the melding of mind and machine through neural interface present at law are analysed throughout this thesis. This thesis seeks to provide a substantial contribution to the legal literature that is both innovative and pioneering. This new, developing field of inquiry provides the opportunity for ground breaking advances in legal analysis of the existing legal frameworks that, in particular circumstances, will require re-evaluation and adaptation.

Abstract:
For the past decade, EU’s gender equality policies have undergone some changes that have affected the way in which the problem with gender equality is now represented. This case study analysis explores what the problem with gender inequalities is represented to be in EU’s Strategy for Equality between Women and Men, 2010-2015, and whether there are any presuppositions or assumptions underlying EU’s representation of the problem. The method used for analysis is Carol Lee Bacchi’s approach: What’s the Problem (represented to be)?, which is a post-structuralist approach that pays much attention to language and discourse. EU’s gender equality policy is then compared with Sylvia Walby’s theory on the patriarchy, that explains gender inequalities as being systematically produced through a system of social structures. The main conclusion is that EU’s gender policies are tailored to fit the political priorities of the union, which are to achieve the objectives of the EU 2020 Strategy.  The problems are mainly being represented from an economic perspective, and furthermore the EU dismisses the notion that gender inequalities are a result of our social structures, and rather explains the problem of gender inequality as being the problem of women.

This study explored multiple aspects of social support from patients, caregivers and healthcare staff’s perspectives in the Vietnamese haemodialysis context. The study identified the interconnection of roles of patients, caregivers and healthcare staff as members of caregiving triad or support network in providing support in haemodialysis. Contextual factors including financial burden and family culture were found to be important factors affecting the provision of social support. This study’s novel contribution could lead to improving the provision of social support for people on haemodialysis which is crucial due to the growing global burden of end stage kidney disease.

Law enforcement officers can come into conflict with suspects when they need to act fast under time pressure. Improving such a decision¬-making skill is a challenge in a police academy. Academies can train future officers in correct psychomotor responses to attacks by a suspect. However, the ability to anticipate such attacks, and thereby make more appropriate defensive and control responses, is often assumed to come only with experience. The purpose of this study is to investigate the perceptual–cognitive sub-skill of attack recognition, which contributes to the anticipation that police officers should have in order to handle potentially violent situations appropriately, and thus take the situation under control without using extreme or lethal force. This study examines the feasibility of using the temporal video-occlusion method as a training tool to accelerate the law enforcement officer’s performance by de-coupling the perception–action link and concentrating on the perceptual–cognitive aspect of the full defensive and control performance. Once the video-occlusion task is calibrated and validated to differentiate expert from non-expert performers, then instructional designers and trainers can be confident is repurposing video-occlusion research method by employing instructional strategies such as deliberate practice and progressive difficulty to train law enforcement trainees and officers.

La presente investigación doctoral “objetnografía: una investigación narrativa sobre una práctica educativa en las artes” apertura una indagación autobiográfica que me permite posicionarme desde una mirada docente-investigadora para emprender una acción educativa autoetnográfica que se concreta en una práctica de campo. A partir de una vivencia educativa en el aula de clase y con un colectivo de veinticinco estudiantes (25), se traza una narrativa sobre los procesos creativos y la necesidad de ejercitar la escritura en jóvenes estudiantes de las artes visuales. La objetnografía bosqueja un movimiento de indagación metodológica que nos conecta con la investigación narrativa y que nos permite transitar por una pedagogía creativa, detectando en la implicación del objeto, la memoria y las emociones que modelan, la introspección de un sujeto vinculados con las artes.
This research “objetnography: a narrative research on educational practice in the arts” unfolds an autobiographical inquiry that allowed to position myself from a teacher-researcher regard in order to undertake an educational autoethnographic action on a fieldwork. Plotted from an educational lived experience in the classroom and with a group of twenty-five students (25), this narrative traces the creative process and the need to exercise the writing of young art students. Objetnography outlines a motion of methodological inquiry that connect us with narrative research and allows us to transit through creative teaching, discovering into the implication of the object, the memory and the emotions that shape the introspection of a subject related to the arts.

Abstract:
The problem explored in this dissertation report was that at the time of this study, there were no design principles or methodologies based on design science research (DSR) available to use for artifact construction, implementation, and effective evaluation of cloud-based networking lab environments that can be used to foster hands-on technology skills in students. Primarily based on Hevner’s 7 guidelines of DSR, Peffer’s design science research methodology (DSRM), and Gregor’s IS design theory, this study forms the groundwork for the development of procedures and specifications derived from DSR literature to facilitate the construction, implementation, and evaluation of a comprehensive cloud-based computer and information systems (CIS) laboratory artifact that is globally accessible 24 hours a day and 7 days a week. Secondarily, this study guided the construction and implementation of a prototype cloud-based lab environment using the procedures and specifications derived from DSR. The cloud-based lab environment was then evaluated based on the skill level attained by students enrolled in courses that leveraged the proposed system. Results of this study showed that the overwhelming majority of the students who participated in the experiment using the cloud-based lab environment showed statistically significant gains in pretest and posttest scores compared to the students who participated in the experiment using the classroom-based physical equipment. These results fully supported the first hypothesis for this study, that participation in the cloud-based lab environment would promote positive student outcomes. The second hypothesis also was supported. The majority of the experimental group students completed most of the labs and significantly spent more time on the system compared to the control group students using the traditional classroom-based physical lab equipment, which indicated the specifications derived from DSR positively influenced the use of the cloud-based system. An argument was made that the proposed study advances IS and education research through artifact construction and evaluation by correlating Hevner’s 7 steps of effective DSR theory, Peffer’s DSRM, and Gregor’s IS design theory to the problem statement, research questions, and hypothesis in order to develop guiding principles and specifications for building and assessing a cloud-based lab environment.

Abstract:
eDNA is a fast and popular method to collect information about species presence in the environment. eDNA is DNA that is collected from environmental samples, such as water, from DNA that is expelled from organisms interacting with their environment. eDNA is an effective way to find species with small populations and alien species. There are two ways to analyze eDNA, with high-throughput DNA sequencing methods and DNA metabarcoding or use of species-specific primers and PCR. In this study, we focus on the latter, designing species-specific primers for Burbot, Brown trout, and Atlantic Salmon, testing their validity in detecting eDNA of these species with functional PCR. We also evaluated eDNA collection methods, testing different scenarios in aquarium tanks with different number of dead and alive fishes. Primers and experimental setup such as use of different temperatures of the PCR reaction used in this study didn’t result in a functional PCR as determined by electrophoresis gel. There are some problems with the design of the PCR methods for eDNA since the purpose is to design methods that can identify certain species. However, future development of eDNA methods will probably include sequencing and not detection of PCR product sizes. eDNA methods will complete traditional trapping methods like net and electrofishing, but not replace them.
eDNA är en snabb och populär metod för att samla information om arters abundans i miljön. eDNA är DNA taget från miljö prover, så som vatten, från DNA som frigörs från organismer som intrigerar med deras miljön. eDNA är ett effektivt sätt att hitta arter med små populationer och främmande arter. De finns två olika sätt att analysera eDNA, med DNA-sekvenseringsmetoder med hög genomströmning och DNA-metabarkodning eller användning av artspecifika primrar och PCR. I denna studie fokuserade vi på den senare, designade artspecifika primers för lake, lax och öring, testa deras validitet vid detektering av eDNA hos dessa arter med funktionell PCR. Vi utvärderade också eDNA-insamlingsmetoder, testa olika scenarier i akvarietankar med olika antal döda och levande fiskar. Primers och experimentell uppställning, såsom användning av olika temperaturer för PCR-reaktionen som användes i denna studie, resulterade inte i en funktionell PCR såsom bestämd av elektroforesgel. Det finns några problem med utformningen av PCR-metoderna för eDNA, eftersom syftet är att utforma metoder som kan identifiera vissa arter. Emellertid kommer framtida utveckling av eDNA-metoder troligtvis att inkludera sekvensering och inte detektering av PCR-produktstorlekar. eDNA-metoder kommer att komplettera traditionella fångstmetoder som nät- och elektrofiske, men inte ersätta dem.

The rise of “zero tolerance” discipline practices in US primary and secondary schools has become increasingly well documented by the media and empirical studies. Despite the extensive scholarship that has emerged from these conversations, many of these analyses are limited in their scope and do not connect the phenomena of zero tolerance in schools to the diverse, shifting forces at play within American politics and policy today. As such, the goal of this work is to synthesize ideas about zero tolerance across disciplines by integrating historical thought, philosophical frameworks of punishment, shifting policy goals within the US education system, the sociological constructions of “deviance” and “disorder” in the context of the US criminal justice system, and empirical data directly from a school district to develop particular policy recommendations accordingly. The primary research question of this analysis is: What are the effects of zero tolerance discipline policies on educational outcomes? To answer this question, Chicago Public Schools will be employed as a case study from which lessons for the nation at large will be drawn. Ultimately, this analysis ends up revealing the ways in which zero tolerance policies stem from much deeper forces at play between dominant and marginal groups, and what comes to be defined as “deviance” in relation to a socially constructed system of “order.”

El presente estudio narra el camino de transformación y aprendizaje que supone ahondar en la educación como experiencia. Se trata de una investigación narrativa que, desde un enfoque autobiográfico con aportes de la fenomenología-hermenéutica y el pensamiento de la diferencia sexual, pretende profundizar en los procesos vitales que movilizan el pensamiento de la experiencia y la influencia de éste en la relación educativa. Esta indagación se dio a partir del acompañamiento a la experiencia educativa de las mujeres en el máster en Estudios de la Libertad Femenina del Centro de Investigación de Mujeres Duoda (curso 2010-2011), y de mi propia experiencia como investigadora y como profesora, junto a la experiencia de mis estudiantes, de la Facultad de Educación de los Grados de Pedagogía y de Educación Social (desde el curso 2015-2016 hasta la actualidad). Por tanto, es un tejido coral, a varias voces, que busca atender una captación singular del mundo de la experiencia pedagógica y de sus significados (Gadamer, 1977) para posibilitar y repensar otros modos de enseñanza y aprendizaje en el proceso formativo universitario compuesto por lo que he llamado historias pedagógicas de mujeres, construidas a partir de mis diarios de campo, relatos de estudiantes y profesoras y, material recogido durante la investigación. Utilizo la palabra historia porque es más precisa, ya que engloba sucesos, sujetos y contextos que se comparten sobre recorridos ocurridos, vividos y pensados en clave pedagógica en el transcurso de las clases. Son historias que hablan de sus/de nuestras vidas, historias que son ese “portal a través del cual una persona ingresa al mundo, y mediante el cual su experiencia del mundo se interpreta y se hace personalmente significativa” (Conelly & Clandinin, 2006, p. 477). Las historias pedagógicas que aquí se narran invitan a pensar y profundizar el sentido de la educación y de las relaciones educativas que la sostienen y la significan. Buscan relatar el carácter vivo y libre de algunas prácticas docentes y profundizar en el estudio de la educación como experiencia, la diferencia sexual como fuente de saber y de aprendizaje, y sobre cómo el pensamiento de la experiencia deviene en aprendizaje. Para ello se pregunta: ¿qué valor educativo supone pensar la experiencia?, ¿qué sentido tiene considerar la experiencia como fuente y como mediación para el aprendizaje?, ¿cómo se puede pensar la experiencia?, ¿por qué y para qué hacer pensamiento de la experiencia en la universidad? El tejido de estas historias intenta dar cuenta de la experiencia que dibuja y desdibuja lugares para transitar el pensamiento, mostrando otros modos de estar en la relación educativa. Modos que se sustentan en momentos claves de la relación educativa (inicio, acompañamiento y cierre) y en cualidades como el cuidado, el reconocimiento, la confianza, el sentido del cuerpo y de la lengua que se habla, la conciencia de sí y la reflexión para acompañar los procesos de aprendizaje personales y conjuntos.
This study narrates the path of transformation and learning that delving deeper into education as experience implies. It is a piece of narrative research that, from an autobiographical standpoint informed by phenomenology-hermeneutics and the thinking of sexual difference, seeks to go deeper into the life processes that are put into movement by the thinking of experience and its influence on the educational relationship. This research took place through the accompanying of the educational experience during the Master in Studies of Female Freedom at the Duoda Women’s Research Centre (academic year 2010- 2011), and my own experience as researcher and lecturer, together with the experience of my students, at the Faculty of Education in the Degrees of Pedagogy and Social Education (from the 2015-2116 academic year to the present day). It is, therefore, a choral weaving, one that seeks to pay attention to a singular catchment of the world of pedagogical experience and of its meanings (Gadamer, 1977) to make possible and rethink other ways of teaching and learning in the university formative process, made up of what I have called pedagogical stories of women, constructed on the basis of my field diaries, stories from students and lecturers, and material collected over the course of the research. I use the word story because it is more accurate, given that it includes happenings, subjects and contexts that are shared on journeys that took place, were lived and thought in a pedagogical key in the course of the classes. They are stories that speak of their/our lives, stories that are that “gateway through which a person goes into the world, and through which their experience of the world is interpreted and made personally meaningful” (Connelly & Clandinin, 2006, p. 477). The pedagogical stories that are narrated here invite us to think and look more deeply at the meaning of education and the educational relationships that sustain it and give meaning to it. They seek to relate the living and free character of some teaching practices and to go deeper into the study of education as experience, sexual difference as a source of knowledge and of learning, and, on how the thinking of experience becomes learning. In order to do this, the following is asked: What educational value does it have to think experience? What meaning does it have to consider experience as a source and as mediation for learning? How can experience be thought? Why do thinking of experience in the university and for what? The weaving together of these stories seeks to tell of the experience which brings in and out of focus places to transit thinking, showing other ways of being in educational relationship. Ways that are supported in key moments of the educational relationship (beginning, accompaniment and closure) and in qualities such as care, recognition, trust, the meaning of the body and the language that is spoken, the awareness of self and the reflection to accompany personal and shared processes of learning.

La presente tesis doctoral está adscrita a las líneas de trabajo del Observatorio sobre la Didáctica de las Artes (ODAS) del Departamento de Historia del Arte de la Universidad de Barcelona. ODAS es un grupo de investigación consolidado reconocido por la Generalitat de Catalunya (2017SGR342) y grupo de innovación docente consolidado por la Universidad de Barcelona (GIDCUB-13/103). La tesis ha sido financiada por el programa de ayudas para la formación de doctores correspondiente al año 2014 del Ministerio de Economía y Competitividad. La investigación consiste en el análisis de las representaciones sociales acaecidas durante el proceso de aplicación de una rúbrica por parte de un grupo evaluador de un mismo ámbito académico. Dicha rúbrica ha sido diseñada por ODAS para valorar la calidad de las guías docentes y sirve como eje vertebrador de la investigación. Las guías sobre las que se aplica el recurso corresponden a diversas asignaturas de másteres oficiales de arte impartidos en la Universidad de Barcelona. El estudio utiliza un enfoque cualitativo que emplea el método de la fenomenografía sobre un estudio de casos múltiples. Los resultados se fundamentan en el discurso del equipo evaluador participante –miembros expertos y no expertos en rúbricas–, que surgió de la verbalización concurrente al proceso de aplicación de la rúbrica, esto es, de la utilización de la técnica del pensamiento en voz alta. La propuesta ha permitido explorar las posibilidades del recurso y analizar las ideas educativas del grupo participante. Entre las conclusiones del estudio destacan, por un lado, las oportunidades que ofrece la rúbrica para guiar el proceso de evaluación y favorecer la reflexión profunda sobre el objeto evaluado, y por otro, la relevancia que adquiere la formación previa en el recurso para su plena utilización y aprovechamiento.
This doctoral thesis is part of a research carried out by the Observatorio sobre la Didáctica de las Artes (ODAS) of the Department of Art History of the University of Barcelona. ODAS is a consolidated research group recognized by the Catalonia Government (Generalitat de Catalunya. 2017SGR342) and a teaching innovation group consolidated by the University of Barcelona (GIDCUB-13/103). The research is an analysis of the social representations occurred during the application of a rubric by a rater group belonging to a same academic field. The research adopts a qualitative approach that uses the phenomenology method in a multiple case study. The results are based on the discourse of the participating rater team - expert and non-expert members -, which emerged from the concurrent verbalization to the rubric application, that is, from the use of the thinking aloud technique. The research has allowed exploring the possibilities of the resource and analyzing the educational ideas of the participating group. Among the conclusions of the study are, on the one hand, the opportunities offered by the rubric to guide the evaluation process and to foster a deep reflection on the teaching guides, and on the other, the relevance of previous training on rubric use for a complete utilization of the resource.

El propósito de llevar a término una investigación para mejorar la calidad de las sesiones expositivas-magistrales impartidas en el aula universitaria mexicana se ha concretado en un estudio evaluativo de baja intervención concebido en el marco metodológico de la observación sistemática que incorpora la perspectiva mixed-methods. El abordaje teórico- empírico se sustenta en los estudios de interacción instruccional y en el marco general de un enfoque pragmático, discursivo y simbólico de la comunicación humana. El diseño observacional implementado es nomotético, puntual con seguimiento intrasesional, y multidimensional. Para representar, clasificar y analizar la interacción participativa se ha construido el instrumento de observación LUniMex-2017, que combina formato de campo con sistemas de categorías. Los registros de observación sistemática realizados a cada uno de los cuatro participantes corresponden a cuatro sesiones de clases expositivas que imparten distintos docentes-ponentes sobre materias diferentes, pero en condiciones académicas muy semejantes. El flujo de conducta interactiva-comunicativa codificada y analizada tiene una duración media de 4.724 segundos/sesión y la media/sesión de configuraciones multidimensionales identificadas es de 657 contribuciones interactivas. La calidad de los datos observacionales se ha comprobado mediante coeficientes kappa > 0,90. A partir de los análisis estadísticos realizados, se informa sobre: las diferencias significativas en el cómputo de frecuencias, la formación de patrones secuenciales, su influencia excitatoria o inhibidora, y la trama episódica de la interacción instruccional vista como un problema de ajuste en el proceso de comunicación oral-aprendizaje del material académico. Se han incorporado, además, los datos contextuales y la opinión de los actores a la hora de interpretar y situar los resultados de los análisis estadísticos. Es común a los cuatro casos observados que el enlace de cooperación dialógica más utilizado exprese la posición instruccional de DAR&TOMAR (DA) puesta al servicio de las estrategias de elaboración (CAM, CAT y SIN) y otros tipos de ayuda: en los casos B, C y D se activan varias estrategias de los grupos establecer puentes y atribuir sentido; mientras que en el caso A sólo la estrategia CIN, del grupo establecer puentes, se vincula positivamente con el acto instruccional-verbal de incidir en el conocimiento y la información (DA) del emisor-destinatario. La ayuda sociocognitiva en el caso C se expresa con señales de proximidad o distanciamiento, indistintamente; en el caso D la conducta de ayuda es distante; y en los casos A y B es próxima. El tono emocional, tanto si es frío como si es cálido, se expresa de forma profesional con momentos de calidez familiar en el caso B. Los casos observados han aportado evidencias de que los docentes y estudiantes han desarrollado la clase expositiva-magistral de acuerdo con los principios de interacción participativa (alteridad y colaboración) y los objetivos estructurales de facilitar el recuerdo y la comprensión del contenido disciplinario-curricular presentado, pero los actores pueden mejorar el plan expositivo ejecutado reflexionando sobre: i) la fundamentación disciplinaria-curricular y su aplicación a los objetivos estructurales del aprendizaje significativo oral; ii) la transformación de los contenidos bajo el criterio de comunicar para y con el otro; iii) los diferentes niveles de lazos dialógicos (modos de intercambio, marcadores de la secuencia de ajustes, señales reguladoras de la actividad dialógica); y iv) la capacidad de respuesta de los actores ante las contingencias. Con la incorporación y adaptación de estas cuatro dimensiones, que enmarcan la herramienta Knowledge Quartet, a la fase de devolución de las recomendaciones, se plantea, de acuerdo con el propósito inicial, la oportunidad de formar docentes y estudiantes en la observación, evaluación y gestión de la interacción participativa instruccional.
This research aims to improve the quality of lecture classes given in Mexican universities, and constitutes a low intervention evaluation study within the systematic observation methodology incorporating mixed methods approach. The theoretical-empirical review is based upon instructional interaction studies and the general framework of a pragmatic, discursive and symbolic perspective to human communication. The observational design is nomothetic, point with intra-sessional follow-up, and multidimensional. The observation instrument LUniMex-2017, that consists of a combination of a field format and category systems, was designed to represent, classify and analyze the participatory interaction. The systematic observation recording of each of the four participants corresponds to four class lecture sessions given by several university professors on varying subjects, but under very similar academic conditions. The flow of codified and analyzed interactive communicative behavior lasts an average of 4.724 seconds/session and the average number of identified multidimensional configurations per session is 657 interactive contributions. Reliability was assessed using kappa coefficients: > 0.90. The statistical analyses carried out provide information on significant comparison proportions, the formation of lag sequential patterns, their activation or inhibition influence, and the episodic plot of instructional interaction as an adjustment problem in the oral communication-learning process with academic material. Additionally, contextual data and the participants’ opinions have been included through the interpretation of results of the statistical analyses. A commonality to the four observed cases is that the most utilized dialogic cooperation expresses the instructional position GIVE&TAKE (DA) used in the elaboration strategies (CAM, CAT and SIN), and in other types of help: in the B, C and D cases various strategies are activated in the establish bridges and attribute meaning groups. In contrast, in the A case, only the strategy CIN, in the establish bridges group, is linked positively to the instructional verbal act of influencing the knowledge and information of the sender-receiver. The socio-cognitive help in case C is expressed with proximity or distancing signals, indistinctly. For case D the helping behavior is distant, and for cases A and B it is proximate. The emotional tone, whether cold or warm, is expressed professionally with moments of familiar warmth in case B. The observed cases have contributed evidence that professors and students have developed the lecture class according to participatory interaction principles (alterity and collaboration), and the structural objectives of facilitating memory and comprehension of the academic content presented. Nonetheless, the participants can improve the implemented expository plan by reflecting on: i) the curriculum-discipline foundation and its application to the structural objectives of meaningful oral learning; ii) the transformation of contents through the criterion of communicating for and with the other; iii) the different levels of dialogic bonding (exchange modes, adjustment sequence markers, regulating signals of the dialogic activity); and iv) the participants’ response capacity concerning contingencies. By incorporating and adapting these four dimensions, that comprise the Knowledge Quartet tool, to the recommendation stage, the opportunity arises to train professors and students in observation, evaluation and instructional participatory interaction management.

Background: Sudden Infant Death Syndrome (SIDS) is a problem worldwide. In North Jordan, SIDS rate was high as 1.32 per 1,000 live births and contributed 6% to the infant mortality rate (Bataineh, Shawagfeh, & Twalbeh, 2008). However, SIDS risk factors are preventable and can be reduced by improving knowledge and changing relevant behaviours of parents and healthcare providers (American Academy of Pediatrics, 2013; American SIDS Institute, 2011; Bataineh, Hussein Shawagfeh, & Twalbeh, 2008; Bredemeyer, 2004; Grazel, Phalen, & Polomano, 2010b; Moon, Oden, & Grady, 2004; NICHD, 2010). Still educating Jordanians about SIDS has not been a national health policy priority. Currently, Jordanians demonstrate infant care practices that increase the risk of SIDS, such as side sleep position and excessive bedding and clothing being the most common practices. Commonly, home environments also are not SIDS safe because of smoking and poor ventilation. Healthcare providers can assume the role of information provider and change agent by working with mothers, families and the community to change practices. Aims: This study aimed to determine whether a hospital-based SIDS education intervention program, relevant to Jordanian settings, would encourage Jordanian neonatal healthcare providers to revise parent education and training practices regarding SIDS prevention. The long-term goal was to reduce the incidence of SIDS by influencing Jordanian lifestyles and infant care practices. Methods: This mixed method intervention study included both quantitative and qualitative data collection methods and was conducted at a major education hospital in Jordan, King Abdullah University Hospital (KAUH), over three phases. Phase-1 used two main surveys, an observation-survey explored baseline data on SIDS-safe sleeping positioning practices using an audit of sleeping positions of healthy and medically stable infants in open cots in the neonatal units. The questionnaire-survey explored baseline data on available SIDS teaching resources and staff knowledge and their parental/family instruction regarding SIDS and relevant prevention practices. Phase-2 investigated the development, implementation, and impact of a Jordanian SIDS Infant Education Package (JSEP) among a sample of neonatal healthcare providers at the hospital using the same tools as in the pre intervention phase. This phase examined the impact the JSEP on neonatal healthcare provider SIDS-knowledge, access to appropriate SIDS resources, SIDS-safe sleeping positioning practices in the neonatal units at KAUH. Phase-3 used focus groups of the JSEP participants to explore participants’ experience in undertaking the JSEP. Results: Phase-1 revealed that high proportion (47%) of a total of 403 infant positioning observations; infants were placed in a high SIDS risk sleeping position. In addition, 33% of a total 231 neonatal healthcare providers who completed the questionnaire-survey had never accessed information or resources for SIDS at baseline. Moreover, 40% of the 231 neonatal healthcare providers who completed the questionnaire-survey did not have any knowledge about national SIDS prevention guidelines released by the American Academy of Paediatrics. In addition, the neonatal healthcare providers had not played an active role in the education of parents and families in Jordan regarding SIDS prevention practices. Only 21% of neonatal healthcare providers sometimes provided SIDS information to parents and families and another 33% rarely advised them. The questionnaire-survey discovered that most advice provided for parents and families regarding infant sleep care practices were inappropriate and, in fact, could heighten the risk of SIDS. The JSEP in phase-2 resulted in significant improvement in infant positioning practices at KAUH. The proportion of infants who were placed in a high SIDS risk sleeping position decreased to only 21% of the total post-intervention infant positioning observations (N=400), and this change was statistically significant (Chi-square= 40.777; df= 1; p Conclusions: The SIDS education program targeted at neonatal healthcare providers within the Jordanian context was effective in improving staff knowledge, practices and preparedness to instigate parental/family education. Healthcare providers were identified as an effective education and training group for community health promotion. However, challenges were identified in achieving this goal, including overwork, time limitations, staff shortages, and hospitalisation policies, as well as resistance from Jordanian families to adopting SIDS-safe infant sleep care or having a SIDS-safe home environment. Recommendations: SIDS education programs for health care providers need to be extended, with continued research and evaluation on the effectiveness of specific initiatives in Middle Eastern countries. Further research is needed to explore the incidence of SIDS, SIDS risk factors and associated cultural issues. Furthermore, research need to targeted potentially high risk groups such as refugees, rural and remote residents, and Bedouin families living in isolated regions of Jordan.

The current national economic development has gone through the "factor-driven", "efficiency-driven" and "performance-driven" stages toward the "knowledge-driven", "innovation-driven" and "value-driven" new generation. The critical resources expand to intangible assets, and even the intellectual assets and valued assets, including those assets to create , manage, use, diffuse and produce, also actually showing off its innovative processes, products and services to contribute intellectual capital into products or services, even industries. In this study, in view of existing research lack of common dialogue between law and economy, firstly tries in the projection in the legal system and legal reality, and applies the qualitative and quantitative research methods such as mixed research methods incarnating the recycle of theory criticism and theory construction. Reviewing the difference of the formal theory and substantive theory of the law responds the legitimacy, relevance and harmony to shape the more dialogue channels and the more research topics, also to create new research methods. For legislators, this research could acquire the value chain of the intellectual property law as the reference to formulate and amend. For authorities, it could react to the Legitimacy, relevance and harmony of the law making the legal system operate effectively. For the judiciary, it could adjust the judicial systems adjudicate the dispute. For the enterprises, it could outline the arrangement of the intellectual assets and the intellectual property rights creating the competitiveness and value. Finally for the researchers, it could shape the novel research methods for the cross domain issues.

Early diagnosis is a promising strategy to reduce premature mortalities and for optimal use of resources. But the absence of mathematical models specific to the data settings in LMIC’s impedes the construction of economic analysis necessary for decision-makers in the development of cancer control programs. This thesis presents a new methodology for parameterizing the natural history model of breast cancer based on data availabilities in low and middle income countries, and formulation of a control optimization problem to find the optimal screening schedule for mammography screening, solved using dynamic programming. As harms and benefits are known to increase with the increase in the number of lifetime screens, the trade-off was modeled by formulating the immediate reward as a function of false positives and life-years saved. The method presented in thesis will provide optimal screening schedules for multiple scenarios of Willingness to Pay (numeric value assigned for each life-year lived), including the resulting total number of lifetime screens per person, which can help decision-makers evaluate current resource availabilities or plan future resource needs for implementation.

Dans cette thèse, nous construisons un modèle épidémiologique de la dissémina- tion de normes juridiques. L’objectif est d’expliquer la transmission de normes juridiques américaines régissant les tests de dépistages pour drogues au travail vers le Canada ainsi que la propagation subséquente de ces normes à travers la jurisprudence canadienne. La propagation des normes régissant les tests de dépistages pour drogues au travail sert donc à la fois de point de départ pour une réflexion théorique sur la transmission de normes juridiques et pour une étude de cas empirique. Nous partons de la prémisse que les explications du changement juridique, telles celle de la transplantation et celle de l’harmonisation, sont essentiellement métaphoriques. Ces métaphores explicatives fonctionnent en invitant des comparaisons entre les domaines connus et inconnus. Quand ce processus de comparaison est systématisé, la métaphore devient un modèle. Dans la thèse, nous appliquons cette procédure de systématisation afin de transformer la métaphore de la propagation virale en modèle épidémiologique. Après une revue de la littérature sur les épidémies sociales, nous décrivons les éléments pertinents de la théorie épidémiologique pour, ensuite, les transposer au domaine juridique. Le modèle est alors opérationnalisé en l’appliquant à une base de données composée de la jurisprudence pertinente (n=187). Les résultats soutiennent les hypothèses du modèle. 90 % des décisions qui citent les sources américaines sont infectées selon les critères du modèle, alors que seulement 64 % des décisions qui ne citent pas de sources américaines sont infectées. Cela soutient l’hypothèse d’une épidémie dite de « réservoir commun ». Nous avons également démontré une corrélation positive entre la référence à ces décisions et l’état d’infection! : 87 % des décisions qui citent des décisions qui réfèrent aux sources américaines sont infectées, alors que le taux d’infection parmi la population restante est de seulement 53 %. Les résultats semblables ont été obtenus pour les décisions de troisième génération. Cela soutient l’hypothèse selon laquelle il y a eu propagation à travers la jurisprudence suite aux contacts initiaux avec le réservoir commun. In this thesis, I construct an epidemiological model to explain the transmission of legal norms governing drug testing in the workplace from the United States to Canada and their subsequent spread across the jurisprudence. Employment drug testing norms thus serve as both the starting point for a reflection on how norms spread and a case study for the empirical testing of a theoretical model. I begin with the premise that many explanations of legal change – such as transplant and harmonization – are grounded in metaphors, and then argue that such metaphors work by inviting the hearer to make comparisons between the familiar and the unfamiliar. When this process of comparison is systematized, the metaphor becomes a model. This process of systematization is applied; extending a viral metaphor into an epidemiological model. After reviewing the literature on social epidemics, I set out those aspects of epidemiological theory that may be profitably transposed to the domain of law. I then operationalize the model by applying it to a dataset composed of tribunal decisions (n=187) using computer assisted text analysis. The results support the hypotheses generated by the model. 90% of decisions that cited American sources met the model’s criteria for infection, compared to only 64% of those that didn’t cite American sources. This supports the hypothesis of a common reservoir epidemic. Citation to those infected decisions was also positively correlated to infection: 87% of the citing population was infected, compared to only 53% of the remaining population that cited neither an American source nor one of the infected decisions that cited an American source. Similar results were obtained for third generation decisions. This supports the hypothesis of a serial-transfer epidemic subsequent to contact with the reservoir. Positive correlation to infection was also demonstrated for particular sub-populations hypothesized to be act as points of infection and to a hypothesized vector. In the conclusion, I argue that it is only after we have gone through the process of constructing a model and seen the strengths and limits of its application, that we have access to the full scope of the insights into the role of metaphors and models in the explanation of legal phenomena.

Abstract As forms of mounting Chinese paintings, the handscroll, the hanging scroll, and the album-style mounting are culturally-unique decorations among other Eastern art forms. Besides the aesthetic value, these forms of mounting can also protect the painting itself. The album-style can be categorized, in accordance with the layout of the painting, into horizontal and vertical bindings—the horizontal binding can be flipped sideways, whereas the vertical binding is browsed up and down. The various forms of mounting can be traced alongside the development of book-binding techniques. In the early times the words were written on bamboo slips or silk. These texts were written from right to left and downwards, and therefore for storage the pages were scrolled from left to right. It was not until the Tang Dynasty that a shift in the materials and habits of writing revolutionized the way books were bound, and thus the Jingzhe Zhuang appeared. In the Sung Dynasty, the development of printing technology enabled the realization of horizontal book-binding, which in turn brought about the horizontal binding style of paintings. The change in form is often due to changes in habit, which interact with the socio-cultural circumstances to gradually evolve. This thesis takes the repairing project of 「(Ming)Lan Ying's Album」 as an example, choosing an appropriate way to investigate the actual condition and treat. With the renovation and preservation in mind, this thesis shall attempt to understand the historical evolution of album style, taking the cultural and technical elements of「(Ming)Lan Ying's Album」into consideration and juxtaposing its repairing project with the historical progress and protection of forms of album style. Contemplating some common damages among the leaves of albums, this thesis shall present some suggestions in the methods and protection of the material, in order to minimize the damage. abstract: Within ethics, a number of scholars advocate an interdisciplinary approach of combining the two traditionally different professions of science and philosophy with the confidence that this collaboration will be a mutually beneficial experience. Current ethicist-scientist interactions include embedded-ethicists and research ethics consultation services. Both methods are employed with the hope that they will reduce social and ethical problems that could arise from scientific research, and enhance the reflective capacity of investigative teams. While much effort has been put forth in the endeavor of creating ethicist-scientist interactions, there remains opportunity to refine these new interaction models to make them more robust. There is need for ethicists to understand the context of ethical decision-making in the laboratory. By extension, before interacting with scientists in a research lab, research ethicists ought to have the ability to understand the science and also be familiar with the different factors that influence scientific research, such as funding, productivity requirements, time constraints, politics of laboratories and institutional reward structures. Through literature review and the analysis of qualitative data obtained from the ethnographic study in a neuroscience laboratory, this thesis explores the strengths and weaknesses of ethicist-scientist interactions and aims to understand the culture, traditions and values of this community and their perspectives on their role as scientists and their relationship to ethics. This study shows that the quantity and quality of ethics discussions in the lab are limited and dictated by time constraints and minimal incentives. Other influencing factors are the researchers' perspectives on ethics and how they view their role as a scientist in relation to the public.

In the fields of formal and informal online adult education, the absence of a social context for instruction has been found to present significant limitations for learner persistence and retention. In the field of online psychoeducational intervention, self-administered and self-paced individualized prevention programs have been developed for delivery to large populations of anonymous users. These delivery models provide limited social context for instructional activities, due in part to the anonymity of their participants. When social interaction is included in their prevention programs through voluntary, asynchronous self-help/mutual aid discussion forums, anonymity may still limit social interaction, in favor of observational learning advantages for self-efficacy appraisals derived from "lurking". When these large-group models have been applied to online psychoeducation intervention programs for the purposes of encouraging mutual aid, interactive participation has been limited. This mixed methods study focused on a model for the design of an online small group psychoeducational intervention that integrated individual and social learning in a parent management training program. Self-paced participation was replaced with facilitator-led participation in an asynchronous discussion forum where topics were prioritized and sequenced with learning content from individual web-based training modules. Social interaction was facilitated through online problem-based learning discussion group. Despite assertions that interactive participation in online psychoeducational discussion forums may only be accomplished once a subscriber threshold of several hundred participants has been reached, this study found that small group participation through the program's integrated design resulted large effects for increases in parent self-agency and reduction of over-reactive, coercive parenting behaviors. Participation in the online problem-based group discussion forum was found to have contributed to participant outcomes when posting characteristics revealed the presence of both mutual aid processes and the application of individual learning module content.

Abstract Recently, the information technology has been expectantly applied to teaching work and the assessment for learning performance of student is changed thereby. In this manner, this research is a case study on the basketball course of health and physical education in grade 1-9 curriculum. Three kinds of assessment have been made for the study, which includes conventional test with paper and writing (convention), on-line multimedia test (multimedia), and exercise examination (exercise).. First, the researcher collected the related material concerning basketball course of grade 1-9 curriculum and developed thirty queries of word, to be a pre-test exam. After the pre-test examination, twenty of more discriminating queries were picked up and transformed into multimedia queries which were put on the on-line system for testing the examinees. The exercise examination was then conducted according to “the standard assessment table of lay-up technique in basketball”. The examinees were sixty students of grade 5, equivalent of boys and girls. They were divided as three groups, A, B, and C. The group A was tested in the sequence of convention→multimedia→exercise, the group B in the sequence of multimedia→exercise→convention, and the group C in the sequence of exercise→convention→multimedia. The total assessment completed in six weeks: once in a week and taking a break in next week. The assessment data were analyzed by statistical method and thus showed the following results: (1) the athletic performance of examinee is much better in multimedia than in convention or in exercise; (2) the performance of boy is better than the girl’s in the assessment of exercise; (3) the multimedia test could be used to evaluate examinees’ real performance than two others; and (4) the strong examinees also present a better performance in the exercise assessment. It can be concluded that the application of multimedia is an effective assessment for evaluating the athletic performance of students.

X-ray micro computed tomography (CT) is a useful tool for imaging 3-D internal structures. It has many applications in geophysics, biology and materials science. Currently, micro-CT’s capability are limited due to validity of assumptions used in modelling the machines’ physical properties, such as penumbral blurring due to non-point source, and X-ray refraction. Therefore many CT research in algorithms and models are being carried out to overcome these limitations. This thesis presents methods to improve image resolution and noise, and to enable material property estimation of the micro-CT machine developed and in use at the ANU CTLab. This thesis is divided into five chapters as outlined below. The broad background topics of X-ray modelling and CT reconstruction are explored in Chapter 1, as required by later chapters. It describes each X-ray CT component, including the machines used at the ANU CTLab. The mathematical and statistical tools, and electromagnetic physical models are provided and used to characterise the scalar X-ray wave. This scalar wave equation is used to derive the projection operator through matter and free space, and basic reconstruction and phase retrieval algorithms. It quantifies the four types of X-ray interaction with matter for X-ray energy between 1 and 1000 keV, and presents common assumptions used for the modelling of lab based X-ray micro-CT. Chapter 2 is on X-ray source deblurring. The penumbral source blurring for X-ray micro-CT systems are limiting its resolution. This chapter starts with a geometrical framework to model the penumbral source blurring. I have simulated the effect of source blurring, assuming the geometry of the high-cone angle CT system, used at the ANU CTLab. Also, I have developed the Multislice Richardson-Lucy method that overcomes the computational complexity of the conjugate gradient method, while produces less artefacts compared to the standard Richardson-Lucy method. Its performance is demonstrated for both simulated and real experimental data. X-ray refraction, phase contrast and phase retrieval (PR) are investigated in Chapter 3. For weakly attenuating samples, intensity variation due to phase contrast is a significant fraction of the total signal. If phase contrast is incorrectly modelled, the reconstruction would not correctly account the phase contrast, therefore it would contribute to undesirable artefacts in the reconstruction volume. Here I present a novel Linear Iterative multi-energy PR algorithm. It enables material property estimation for the near field submicron X-ray CT system and reduces the noise and artefacts. This PR algorithm expands the validity range in comparison to the single material and data constrained modelling methods. I have also extended this novel PR algorithm to assume a polychromatic incident spectrum for a non-weakly absorbing object. Chapter 4 outlines the space filling X-ray source trajectory and reconstruction, on which I contributed in a minor capacity. This space filling trajectory reconstruction have improved the detector utilisation and reduced nonuniform resolution over the state-of-the-art 3-D Katsevich’s helical reconstruction, this patented work was done in collaboration with FEI Company. Chapter 5 concludes my PhD research work and provides future directions revealed by the present research.

Grounded theory analysis, informed by a socio-cultural lens, was applied to the narratives of eighteen motorcycle riders in order to understand, from the rider’s perspective, receptivity to warning messages regarding motorcycle helmet use. This study relied upon narrative analysis to identify patterns in communication that surround motorcycle riders’ experiences. Socio-cultural cues identified importance in the process of interest development in motorcycle riding, search for information regarding motorcycle riding, response to danger within the motorcycle riding experience, and attitude toward protection messages. Narratives specific to danger, or experiences of motorcycle accidents were analyzed for comparison with fear appeal theory. Special focus was applied to Terror Management Theory (TMT) and applied to the communication surrounding the real experiences of motorcycle accident and the perceived threat of danger while motorcycle riding. Communication evidencing relational influence was examined for examples of socially constructed interpretation of social identity and an individual rider's perspective of their lifeworld. The analysis revealed evidence of the TMT concept of burying or denying thoughts of danger. The TMT concept of lifeworld influence on behavior was evidenced in riders who did not accept warning messages involving helmet use. Examples of attitude and behavior change where present in two study participants’ narratives that described experience of severe injury and also the death of a friend. The riders cited these occurrences as experiences that inhibited their previous behavior of placing thoughts of motorcycle injury and death in the back of mind. Although small in number, this participant group offered multiple categorizations of rider descriptions. The narratives offered distinction in time of life when riding interest developed. As well, motorcycle training facilities were often noted as a source of communication from which riders obtained influence on their future behaviors. From this information insight was gained to offer suggestions for future research on time of message delivery. Riders who develop interest in riding as adults represent a category on which to focus preliminary educational messages. Individuals who have not yet developed an interest in motorcycle riding may benefit from societal cues that demonstrate safe riding behavior. Future research in mass media appeals focused on motorcycle riders are suggested, as is development of educational programs for delivery to high school audiences.

Дисертацію присвячено дослідженню господарсько-процесуальних норм щодо встановлення та зміни способу і порядку виконання рішення господарського суду як інституту, що забезпечує судове сприяння виконуваності судових актів, та потребує вдосконалення у процесі модернізації господарського процесуального законодавства. Виокремлено провадження з виконання рішення господарського суду у господарському процесі України як цілісної процесуальної форми, якій притаманні самостійні цілі, учасники, строки, процесуальні особливості та форми документообігу порівняно із розглядом справи по суті. Спосіб та порядок виконання рішення господарського суду співвідносяться як родове та видове поняття. Диссертация посвящена исследованию хозяйственно-процессуальных норм по установлению и изменению способа и порядка исполнения решения хозяйственного суда как института, обеспечивающего судебное содействие выполнимости судебных актов, и нуждается в совершенствовании в процессе модернизации хозяйственного процессуального законодательства. Выделено производство по исполнению решения хозяйственного суда в хозяйственном процессе Украины как целостной процессуальной формы, которой присущи самостоятельные цели, участники, сроки, процессуальные особенности и формы документооборота по сравнению с рассмотрением дела по существу. Способ и порядок исполнения решения хозяйственного суда соотнесены как родовое и видовое понятие. Под способом исполнения решения хозяйственного суда предложено понимать меру принудительного исполнения решения суда, которая может быть установлена и изменена только судом, исходя из требований, заявленных в ходе судебного разбирательства, и обстоятельств дела, направленную на полное и правильное выполнение судебного решения для восстановления и защиты нарушенного или оспариваемого права или охраняемого законом интереса взыскателя. Под порядком исполнения - процедуру выполнения установленного судом способа защиты нарушенного или оспариваемого права (законного интереса), предусматривающую сроки, очередность, место, последовательность и другие составляющие действий должника и / или третьих лиц по исполнению решения суда, а также форму закрепления связанных с такой процедурой прав и обязанностей участников исполнительного производства и последствий их осуществления. Выделены общие основания изменения способов исполнения решения хозяйственного суда с учетом выделения следующих критериев: направленность на установление нового механизма реализации решения суда, способность создать лучшие правовые условия для удовлетворения первоначальных требований истца; отсутствие необходимости нового исследования обстоятельства дела, привлечения новых лиц или возврата к иным стадиям рассмотрения дела по существу спора, кроме установления обстоятельств невозможности или затруднения исполнения решения суда и оценки правомерности нового способа исполнения; соответствие нового способа или порядка исполнения решения суда способу защиты, определенному судом в первоначальном решении; наименьшая обременительность для должника и соответствие критериям адекватности, справедливости, соразмерности, выполнимости и добросовестности сторон; направленность на быстрое и эффективное исполнение решения суда Обоснованы направления совершенствования хозяйственного процессуального законодательства в части установления и изменения способа и порядка исполнения решения хозяйственного суда. Предложено расширить основания уплаты судебного сбора при подаче заявления об изменении способа и порядка исполнения решения суда; урегулировать условия отсрочки или рассрочку исполнения решения суда на стадии принятия судебного решения; истребования информации от ответчика; расширение полномочий суда об отмене отсрочки / рассрочки исполнения решения и тому подобное. Thesis deals with the economic and procedural rules for the establishing and amending the method and order of Economic Court decision enforcement as an institute, which aims to promote the feasibility of judicial decisions, and needs to be improved in the modernization of the economic procedural legislation. It is singled out a special procedure to implement the decision of Economic Court of Ukraine in the economic process as a whole procedural form, which is characterized by independent objectives, participants, timing, procedure and forms proceeding features in comparison with the consideration of the main proceeding. The method and procedure of the decision Economic Court correlate as general and species concepts. The author justifies the areas of improvement of economic procedural legislation in terms of establishing and amending the method and order of Economic Court decision enforcement. The author proposes to expand the cases of court fees payment when applying to amending the method and order of Economic Court decision enforcement; to regulate conditions of deferred installments or execution of the award on the stage of a judicial decision; to entitle the court to demand information from the defendant; expand the powers of the court to abolish the suspension / installments of a judgement and more.
