Full textLa ricerca ha come oggetto le relazioni che si instaurano tra media non mainstream, il loro pubblico e la loro rete di sostenitori. Nel momento in cui con l’avvento del web 2.0 l’interattività tra media e utenti sta radicalmente mutando l’agire sociale e interessante individuare i processi che creano una comunità attorno a un media. Per fare questo l'attenzione si è rivolta sull'esperienza di una Radio locale veneta, Radio Cooperativa di Padova, una radio basata sul volontariato puro, che non ricava introiti da inserzioni pubblicitarie e viene mantenuta con i contributi volontari di ascoltatori e sostenitori. Come mission dichiarata, l'emittente ha il “dare voce a chi non ha voce” e si occupa, principalmente, di temi legati ai diritti civili, alla salvaguardia dell'ambiente e alla pace. La scelta di una radio dipende dal fatto che questo media ha da tempo reso possibile una maggiore interazione con gli ascoltatori rispetto ad altri media grazie all'utilizzo del telefono

Full textDurante la scrittura della mia tesi di laurea ho iniziato a studiare il legame che intercorre tra la crudeltà verso gli animali e la violenza verso gli umani. La mia ricerca era ed è mossa dalla speranza di sviluppare un nuovo tipo di educazione basato sulla consapevolezza dell'importanza di educare i bambini di oggi a proteggere ogni forma di vita, sia umana che non. Questo contribuirà a farli diventare adulti rispettosi delle diverse forme di vita con le quali condividiamo il Terra. Gli animali infatti sono vittime, e vengono a trovarsi abitualmente nella stessa posizione delle donne e/o dei bambini, in quanto membri a pieno titolo del gruppo che si denomina usualmente "soggetti deboli". Ben presto mi sono resa conto che parlare di formazione indirizzata allo sviluppo della compassione verso gli animali in un paese come l'Italia, che anche ad oggi sembra mantenere un pensiero rurale radicato, sarebbe stato complesso. Nonostante questa intuizione, la conoscenza dell’argomento scaturita da studi pluriennali mi porta oggi a poter evidenziare che chi è violento verso un soggetto più debole di lui non esprime forza, e se continua a suscitare questo immaginario collettivo allora è arrivato il momento di iniziare a lavorare per migliorare l'appeal sociale di alcuni valori: la protezione contro la prevaricazione, la cura vs danno, ecc. La violenza ripetuta non rappresenta una inspiegabile coincidenza, la violenza è un habitus e in quanto habitus può venire depotenziata solamente attraverso l’educazione. Noi abbiamo come educatori le risorse per cambiare e volgere lo sguardo non violento su ogni forma di vita, dando per primi l’esempio quotidiano alle nuove generazioni. La mia ricerca ha confermato la mia intuizione circa la necessità di costruire un modello sociale condiviso nel quale la forza sia esprimere compassione verso i più deboli. Dobbiamo instillare l'imperativo morale di proteggere i più deboli, al di là della specie, solo considerando chi è detentore di vita. Una generazione pronta a combattere per il bene, astenendosi dalla violenza sul debole ma che punta a quella forza che protegge e non a quella che distrugge. A questo punto è stato utile per studiare la filosofia non violenta e il movimento ad essa connesso. Mi sono così immersa nello studio di diversi autori non violenti trovando nei loro pensieri l'idea della non-violenza estesa anche ai cosiddetti "animali non umani". Dalle interviste e dalle ricerche bibliografiche è emersa la necessità (da parte della società) di costruire un nuovo modello di persona che sia un modello attrattivo, desiderabile soprattutto per i più giovani. Abbiamo bisogno di un nuovo modello di essere umano, ma per realizzare questo ideale si erge la necessità di instillare nell’individuo dall'infanzia il rispetto, la compassione e la protezione verso gli animali, verso tutte le forme di vita più deboli. L’ideale del “rispettare ogni tipo di vita" è alla base della costruzione della futura società pacifica.

The research has followed a path of diachronic type, rebuilding the conditioning exerted by sport on the evolution of the Italian radio-television system and of a synchronic type, observing recent television products, identified as acknowledged true super-genres. Sport is thus object of a presentation by television following time linearity in the development of the game; here the stages of preparation and progress of the performance find a complete communicative realization.

Full textThe aim of the following thesis is to analyze and evaluate the specific needs which a family can have when one of its members has a cancer. Another goal is to consider the educative dimension concerning the services of CasAmica Onlus. The first and the second chapter treat health and illness topics, moreover they explore the impact of a serious illness on the familiar relationships. In the third chapter are described the characteristics of CasAmica, together with its purposes and values. The fourth chapter analyzes 35 interviews which have been addressed to the relatives of sick people hosted in CasAmica Onlus. It has been used a specific type of interview, the narrative interview, in order to facilitate the free expression of each personal and emotional experience. From the interview analysis the following urgent needs came out: the need of fondness and support, of comparison and sharing, of familiarity and daily life; moreover has came out the need of an economic support. Regarding these needs, CasAmica stands out as an Onlus able to offer solidarity values: CasAmica takes care of the sick person and his/her family, assuring all the elements which characterize familiar bonds, such as reciprocity and unselfishness. Therefore, the guests of CasAmica experience a positive stay thanks the familiar context that grants their needs.

Full textThe present study focuses on the nexus between active citizenship, social participation and Third Country Nationals volunteering in non-ethnic organizations. The theoretical framework integrates the paradigm of relational sociology and the capability approach with the specific aim to integrate the social, participatory and relational dimension of citizenship with its request to be continuously supported by the different actors of the civil society, so that it can configure itself as a competent citizenship. The analysis is done by conducting two case studies focusing on the experience of engagement of Third Country Nationals in non-ethnic voluntary organization, in order to identify factors and conditions promoting or hindering the implementation of active citizenship practices. Main results concern: a) the importance to take into consideration the diverse concepts of and attitude towards volunteering and the implicit cultural understandings of volunteering which affect the way in which volunteering is practiced and understood within society and b) the key role of the receiving society into the integration process of migrant.

Full textIn Italy, families are the main providers of primary care to non self-sufficient people, who often resort to hiring care workers, especially foreign women who come to Italy looking for employment. To support the care activities carried out by families, some Regions and local authorities have promoted the ‘sportelli’, services for care work that are elements of a offer of projects and initiatives that attempt to govern the private care market. The purpose of this study is to get to know these services in depth, with a focus on understanding the methods and measures adopted by professionals to improve and support the relationship with and between caregivers, non self-sufficient people and care workers. The research will highlight both the organisational and professional elements that make these services either worthwhile or problematic. The research was implemented through a qualitative case study of the “Sportello” (service for care work) managed by the Solidarity Center of Reggio Emilia. An activity of observation was carried out, monitoring the daily work of professionals, in particular their meetings with both caregivers and care workers. Subsequently, 25 interviews were conducted with both professionals and a sample of caregivers and care workers. Finally, a thematic analysis of the content of the field notes and of the interviews was carried out. The study allowed to compare the Sportello – as represented by professionals, caregivers and care workers – with the legislation of Emilia-Romagna related to services for care work, the previous research conducted in the field and the strengths and weaknesses of domestic care work in general. In addition, the methods adopted by the professionals in the interventions aimed at caregivers, non self-sufficient people and care workers have been reinterpreted in the light of the theoretical framework offered by the Relational Paradigm. Reflecting around the role of the Sportello also helped to identify some recommendations and operational ideas that could improve the Sportello itself and other similar services for care work, as well as qualify domestic care work provided by care workers in general.

Full textNegli attuali contesti glocali, liquidi, complessi e plurali, la capacità di intessere relazioni positive e costruttive con e tra le differenze si presenta sempre più nei termini di un bisogno umano e, nel contempo, di un obiettivo di convivenza e di partecipazione democratica, caratterizzanti i molteplici territori locali di fatto multiculturali. La ricerca ha inteso esplorare, in chiave pedagogica, se, come e in che grado si realizzino effettive pratiche di mediazione interculturale all'interno di quel contesto educativo che, per motivi di diritto-dovere di istruzione e formazione, è luogo quotidiano di incontro-scontro tra differenti anche per cultura: la scuola. Lo scopo è stato quello di evidenziare se e come, a livello formativo, sia importante intervenire per promuovere, negli insegnanti-educatori, competenze professionali nella mediazione interculturale. Il problema dal quale il lavoro ha preso avvio dall' "ambiguità semantica" nell'uso delle espressioni "mediazione linguistica e/o culturale" e "mediazione interculturale", rinvenibile nella letteratura interculturale, nei documenti e nella normativa nazionale e europea, e all'nterno del contesto scolastico. Dopo aver esplorato, dal punto di vista teorico, il concetto di mediazione così come esso si declina sul piano etico-filosofico, degli studi sulla gestione del conflitto, della scienza pedagogica, dell'educazione e dell'intercultura, si sono individuati i "luoghi" propri di una mediazione educativo interculturale nelle tre direttrici esistenziali tipiche del discorso pedagogico: quella antropologica, quella etico-valoriale, quella sociale e culturale. Strutturandosi come una "ricerca empirica orientata alle decisioni", il lavoro ha seguito una strategia di tipo qualitativo, afferente a un paradigma interpretativo. Individuata come campo di indagine una Rete scolastica per l'intercultura, comprensiva di 18 realtà scolastiche, distribuite in 7 Comuni, la raccolta dei dati si è articolata in tre fasi successive e complementari: il monitoraggio degli alunni non italiani presenti nelle scuole della rete scolastica, lo svolgimento di 16 interviste semi-strutturate, rivolte a testimoni privilegiati (insegnanti referenti e/o figure strumentali per l'intercultura della Rete), la realizzazione di 21 interviste narrative focalizzate, rivolte ad alcuni insegnanti e operatori scolastici delle scuole comprese nella Rete. Nel ribadire come la mediazione interculturale sia una funzione propria dell'insegnante-educatore, la ricerca ha permesso di evidenziare, in particolare, come il concetto e le pratiche a essa legate non si esauriscano unicamente nell'ambito della gestione dei conflitti, generati dall'ambiguità e/o non conoscenza delle rispettive cornici culturali, ma richiedano anche - e soprattutto - all'educatore, competenze utili a gestire i processi che, a livello cognitivo e socio-affettivo, caratterizzano le relazioni che ciascuna delle persone coinvolte nell'interazione vive con quella differenza che percepisce, ad un tempo, fuori e dentro di sé

Full textRelazioni tra coleotterofauna saproxilica, struttura forestale e legno morto nei microhabitat di Abeti Soprani. L’obiettivo del presente studio è stato valutare l’influenza che la struttura del bosco, le caratteristiche del legno morto e i microhabitat esercitano su abbondanza, distribuzione e diversità della coleotterofauna saproxilica in un ecosistema forestale. Le attività sono state realizzate presso l’abetina di “Abeti Soprani”, localizzata nel territorio dell’Alto Molise. Il monitoraggio è stato condotto su un’area boschiva di 230 ettari, in 50 punti di campionamento, utilizzando due metodi di cattura: trappole a finestra per gli insetti in volo ed eclettori per gli insetti presenti all’interno del legno. Per le stesse aree di campionamento è stata quantificata e descritta la struttura forestale, le componenti di necromassa e la presenza di microhabitat. Si sono analizzate le relazioni tra i parametri strutturali forestali e la coleotterofauna del luogo. Inoltre, specifiche analisi geostatistiche sono state condotte per evidenziare la variabilità spaziale dei parametri esaminati e la distribuzione dell’entomofauna monitorata. I risultati ottenuti hanno confermato l’esistenza di correlazioni significative tra insetti, componente forestale e tipologia di microhabitat. In particolare, le seguenti associazioni sono risultate più ricorrenti: massa viva (m³\ettaro) con il numero di specie, le specie saproxiliche, Elateridae, Cerambycidae e Curculionidae; alberi troncati in piedi (alberi\ettaro) con il numero di individui, di famiglie e Staphylinidae; microhabitat su legno morto con il numero di famiglie, gli Staphylinidae e i Cerambycidae.
Studies on the Lepidoptera of the subfamily Geometrinae collected in Ethiopia. The purpose of the research was to study the geometrid moths collected in several scientific expeditions carried out between 2009 and 2012 in Ethiopia, with the collaboration of Afrotropical fauna entomologists based at the Zoologische Staatssammlung München (Germany). In addition to the material collected by the University of Molise, specimens in the Zoologische Staatssammlung München collections were included in the research. Among the Geometridae, in particular, investigations focused within the subfamily Geometrinae, tribes Pseudoterpnini, Comibaenini and Hemistolini. Six species belonging to the tribe Pseudoterpnini and two species belonging to the tribe Comibaenini, one described as new: Comibaena theodori sp.n., were found. In the tribe Hemistolini, the genus Prasinocyma was investigated. Seventeen species and five subspecies were described as new to science: Prasinocyma pedicata aethiopica subsp. n., Prasinocyma angolica pseudopedicata subsp. n., Prasinocyma stefani sp. n., Prasinocyma omoensis sp. n., Prasinocyma getachewi sp. n., Prasinocyma baumgaertneri sp. n., Prasinocyma shoah yabellensis subsp. n., Prasinocyma amharensis sp. n., Prasinocyma batesi distans subsp. n., Prasinocyma monikae sp. n., Prasinocyma fusca sp. n., Prasinocyma leveneorum sp. n., Prasinocyma aquamarina sp. n., Prasinocyma beryllaria sp. n., Prasinocyma lutulenta sp. n., Prasinocyma septentrionalis sp. n., Prasinocyma fallax sp. n., Prasinocyma trematerrai sp. n., Prasinocyma trematerrai simienensis subsp. n., Prasinocyma androzeugmoides sp. n., Prasinocyma angulifera sp. n., and Prasinocyma maryamensis sp. n. The results of the research allowed expanding knowledge on Afrotropical lepidopterofauna and to identify and describe new taxa, many of them Ethiopian endemism.
Studio dei Lepidotteri della sottofamiglia Geometrinae raccolti in Etiopia. Lo scopo della ricerca è stato studiare i lepidotteri Geometridae raccolti in varie spedizioni effettuate in Etiopia, tra il 2009 e il 2012; le attività si sono svolte anche con la collaborazione di entomologi specialisti della fauna Afrotropicale presenti nello Zoologische Staatssammlung München (Germania). Oltre al materiale tenuto presso il Dipartimento Agricoltura, Ambiente e Alimenti dell’Università degli Studi del Molise, sono stati osservati anche i lepidotteri presenti nelle collezioni del museo tedesco. In particolare, si è scelto di prendere in considerazione, nell’ambito della sottofamiglia Geometrinae, le tribù Pseudoterpnini, Comibaenini e Hemistolini. Sei specie sono risultate appartenere alla tribù Pseudoterpnini e due alla tribù Comibaenini, di cui una è stata descritta come nuova: Comibaena theodori sp.n. Per la tribù Hemistolini si è indagato il genere Prasinocyma. This observation supported the idea of a significant role of MI in the immunological reconstruction after HSCT and in the genesis of acute Graft-versus-Host-Disease(GvHD). We therefore conducted the first longitudinal study on the role of MI in the onset of GvHD in pediatric patients undergoing HSCT. 10 patients were enrolled, including 5 with GvHD. For each patient were collected seriated fecal samples every 10-15 days up to 100 days after HSCT. The phylogenetic profile of MI was characterized by pyrosequencing 454 of the hypervariable V4 region of the 16S rRNA subunit. The functional profile was evaluated by analysis of fatty acid-fat-to-short-chain using the gas chromatography-mass spectroscopy. After HSCT a profound structural and functional destruction of the normal position mutualistic gut ecosystem was observed. The reconstruction of the trajectory of the MI after HSCT was significantly different between patients with and without GVHD. In particular, in patients without GVHD, a precise of the MI signature before the HSCT was highlighted, characterized by a high concentration of Bacteroidetes and Parabacteoidetes(p <0.05, Fig. 1). In parallel in patients without GVHD it was observed a significant increase of the fatty-acid-to-short-chain and in particular propionate(p <0.05). This characteristic signature was projected after HSCT, persisting to the intestinal ecosystem destruction and demonstrating the high adaptability of these germs. Our data indicate that the intestinal microbial ecosystem dynamics can be a factor influencing the onset of GvHD. In particular, the presence of a mutualistic profile pre-HSCT of the MI, characterized by the presence of germs producers of acid-fat-to-short-chain recognized with immunomodulatory, seems to mitigate the risk of developing GVHD. These results therefore open new perspectives on the possibility of manipulating the MI pre-HSCT to modulate the reconstruction of the immune system.

The objectives are the methodological and theoretical study of the relational reflexive evaluation approach, with attention to the connections between evaluation and organizational dimensions services to individuals and families. This multidimensional and multi-vision quality model refers to some macro-organizational dimensions of relational well-being generated by social services: efficiency, effectiveness, quality integration, the quality of ethical purposes. This reflective and participatory evaluation perspective is an opportunity to capture, describe and assess the common good relationship generated by a service to individuals and families, which are strategic to the familiarization and customization in a context of changing social needs. In addition, relational quality evaluation pays particular attention to the transformative and morphogenetic potential of evaluation. Methodologically, the analysis was quanto-qualitative. Semi-structured interviews were conducted with operators of the Centre and a detailed analysis of the documentation was done. The work led to the construction of a questionnaire of 35 variables, which 167 beneficiary families have responded to. Besides monovariata analysis of the results of the questionnaire, some synthetic indexes of some critical dimensions of relational quality were constructed.

Full textWhat is justice? What about the meaning of justice at school? What are the teachers' representations of justice and injustice and what is the relationship between their representations and teachers' work in the classroom? How do the students describe teachers' behavior during the lesson? Many branches of philosophy (Aristotele; Platone; Kant, 1788; Kelsen, 1952), of sociology (Rawls 1977; Boudon, 2002) and of psychology (Piaget, 1932; Kohlberg, 1958) have studied the topic of justice in depth and recently it has became the object of search of educational science (Dalbert, 2006; Mikula, 2005; Chory Assad, 2002, 2007, 2013; Berti, Molinari, Speltini, 2010; Kanizsa, Garavaglia, .Mosconi, 2013; 2014), with reference to organizational justice theory (Cropanzano & Greenberg, 1997; Greenberg, 1990; Folger & Cropanzano, 2001; Cropanzano, 1993). Organizational studies highlight three concepts of justice: distributive justice that is a subjective perception elicited by a comparison between actual and deserved rewards; procedural justice refers to the fairness of the mean by which distributions are made; interactional justice refers to perception of fairness in the interpersonal treatment received by individuals, mainly in the communicative and relational requests. The aim of this research, with particular reference to social representations theory (Moscovici, 1989; Palmonari, Emiliani, 2009) is therefore to identify and analyse teachers’ meanings about the concepts of justice and injustice through the narration of their past and their experiences in the classroom. Secondly, the aim is to understand their representations of justice, which they unconsciously use in their daily work in the classroom and to understand how they affect, even by implication, their educational and teaching relationships. At least, we hope to verify the possible discrepancies between the teachers' and students thought of justice. The subjects were 12 secondary school teachers belonging to different school in the urban area of Milan and in the hinterland of the same city, and 48 students belonging to the same classroom as the teachers. The teachers were teaching different subjects (philosophy, sciences, math, law and economy and italian literature). The data was collected during the 2014-2015 school year and was obtained during low-structured interviews for the teachers and with 6 focus groups for a total of 48 students. A mixed-method approach was used: the qualitative data collected was coded into categories to facilitate quantitative analysis, while the same of text was subjected to co-word analysis conducted using T-lab software. The results indicated that teachers and students share the same conception of justice. The teachers, on one hand, according to the organizational justice theory, especially in regards to principles of interactional justice, declare themselves to be “just” and fair teachers, because they are respectful to the students and their needs and they have paid attention to the teacher-student relationship. On the other hand, the students' descriptions of their teachers, highlight the discrepancies between the teachers' representations and beliefs and their actual behaviour in the classroom. The results of current research confirm the importance that teachers need to be involved in vocational training or in training courses in which they become aware of a possible inconsistency between their beliefs and their behavior in the classroom. Only a coherent teacher can be “just” and can entertain a fair teachers-students relationship. Briefly, justice can only be achieved if both teachers and students see each other as coherent and just.

The time we live in is characterized by the migration phenomenon , the stable presence of citizens of foreign origin living in the Italian territory and by a globalization of the human person. The present work has examined, within the framework of qualitative research and the current social context, the life stories of Ghanaian-born parents living in the province of Bergamo and Brescia. This was carried out in an attempt to problematize multiple pedagogical categories related to the parenting function. The result is an interesting cross- section that shows the importance for these parents to maintain a bond with the country of origin, the need to open up to the context in which they live, and the challenge found in the relationship with their children born and/or raised in their country of residence. The research has shown how pedagogy, by accepting these experiences, is able to promote reflections and spaces of interest in which mutual differences are an opportunity for common growth within the multiplicity of cultures.

This is a socio-anthropological research that outlines the cognitive orientation of both sides in the international cooperation: who provides and who receives Aid. The locus of the investigation is an international cooperation project in Mozambique, along with interviews with Italian NGOs practitioners. The thesis argues that international cooperation not only provides projects apt to change situation in developing countries, but unites cultures that mutually exchange meanings, disagreements, habits, etc., in a continuous process of cultural ‘miscegenation’. Although most NGOs propose bottom-up approach to development, usually projects start from the top, and they face difficulties to stimulate the agency to change from below. International cooperation also generates new lines of though, and usually gives voice to counter-current social movements. In a macro perspective, globalization continues to play a dominant role in the poorest countries, and Mozambique has not been fully decolonized yet. The meaning of the term Development still maintains an Eurocentric and evolutionary bias. However, development should not be anymore associated to economic growth and if we really want to achieve an equal world, there is also the need to ‘disempower’ the rich.

Full textA presente tese tem por objetivo analisar o conceito e as espécies de desequilíbrio excessivo da relação jurídica de consumo, bem como a possibilidade de correção de uma das espécies de desequilíbrio excessivo – o exercício abusivo de posição jurídica dos fornecedores – por meio da cláusula geral de proibição de vantagem excessiva, prevista no Código de Defesa do Consumidor (Art. 39, V c/c art. 51, IV e §1º). Trata-se, em essência, de um estudo sobre a própria relação jurídica de consumo, razão pela qual se impõe, inicialmente, uma análise acerca de seus pressupostos fático-normativos, elementos constitutivos e característica fundamental (Parte I, Capítulo 1) para, só então, enfrentar o tema dos “desequilíbrios” (estrutural e excessivo) existentes nesse tipo de relação jurídica (Parte I, Capítulo 2), quando se busca demonstrar que o desequilíbrio excessivo não se confunde com o desequilíbrio estrutural (intrínseco), na medida em que este é realidade constitutiva da própria relação jurídica de consumo, sendo, por isso mesmo, reconhecida e tolerável pelo direito; ao contrário, o desequilíbrio excessivo é realidade que ultrapassa os limites do “juridicamente tolerável” – isto é, do estado de desequilíbrio estrutural - e, por este motivo, precisa ser corrigida por meio da ordem jurídica (no caso brasileiro, pelo sistema jurídico de proteção e defesa dos consumidores, centralizado nos valores e normas constitucionais e sistematizado no Código de Defesa do Consumidor – Lei n. 8.078, de 11 de setembro de 1990). E para a correção das situações de desequilíbrio excessivo da relação de consumo geradas pelo exercício abusivo da posição jurídica dos fornecedores o legislador brasileiro, atento à necessidade de compreensão do direito privado como um sistema jurídico aberto (Parte II, Capítulo 3) construiu o Código de Defesa do Consumidor como um microsssistema dotado de normas casuísticas e de normas abertas (as chamadas “cláusulas gerais”), destacando-se, quanto a estas, a cláusula geral de probição de vantagem excessiva, que se entende ser a “cláusula fundamental de correção do abuso nas relações jurídicas de consumo” (Parte II, Capítulo 4), na medida em que seu âmbito de aplicação, fixado pelo próprio legislador (CDC, art. 51, §1º), abarca, por sua grande generalidade, o âmbito das demais cláusulas gerais de correção do abuso, como as de função social e econômica do direito, boa-fé objetiva, bons costumes e lesão enorme, tutelando, enfim, a globalidade dos legítimos interesses dos consumidores – isto é, seus interesses de natureza patrimonial e existencial – lesados pela atuação abusiva dos fornecedores no mercado de consumo.
The present thesis aims to analyze the concept and the species of excessive unbalance of the legal consumption relationship, as well as the possibility of correction of one of the species of excessive unbalance – the abusive use of the legal position of the suppliers – by the inclusion of the general clause of prohibition of unfair advantage, set out in the Consumer Defense Code (Art. 39, V c/c art. 51, IV and §1º). It is, essentially, a study on the legal consumption relationship itself, a reason for which it is imposed, initially, an analysis concerning its phaticnormative presumptions, constitutive elements and key characteristic (Part I, Chapter 1) for, only then, face the topic of “imbalances” (structural and excessive) existing in this type of legal relationship (Part I, Chapter 2), when willing to demonstrate that the excessive imbalance is not confounded with the structural imbalance (intrinsic), inasmuch as this is a constitutive reality of the legal consumption relationship itself, being, therefore, acknowledged and bearable by the law; on the contrary, the excessive imbalance is a reality which overcomes the limits of the “legally bearable” – that is, the structural imbalance status - and, for this reason, it has to be corrected by the law (in the Brazilian case, by the legal system of protection and defense of consumers, centered in the values and constitutional norms e ordered in the Consumer Defense Code – Law n. 8.078, from September 11th, 1990). And for the correction of excessive imbalance situations in the consumption relationship caused by the abusive practice of the legal position of the suppliers, the Brazilian legislator, attentive to the need of understanding of the private law as an open legal system (Part II, Chapter 3) created the Consumer Defense Code as a microsystem with cauistic norms and open norms (the so-called “general clauses”), highlighting, concerning these, the general clause of prohibition of unfair advantage, which is understood as the “key clause of abuse correction in the consumption legal relationships” (Part II, Chapter 4), inasmuch as in its scope of application, set by the legislator (CDC, art. 51, §1º), embraces, due to all things considered, the scope of the other general clauses of abuse correction, such as the law social and economic function, bona fide intentions, good manners and serious harm, tutoring, then, the whole of legitimate interests of the consumers – that is, their interests of property and existential nature – harmed by the abusive practice of suppliers in the consumer market.

Full textThis works takes as a departing point the idea that authenticity is an important issue in pedagogical theorization as well as a relevant goal for education, and particularly so in the current historical era when the human being is increasingly bewildered, fragmented and subject to the risk of losing oneself and never attaining selfhood. Beside being an important aspect of existential wholeness, authenticity may act as a directional goal able to steer and provide meaning to an educational journey aiming to bring into actuality the person’s potentials. Authenticity also provides epistemological and methodological directions through which the educator respects the individuality of the person to be educated. The theoretical approach here adopted mostly refer to phenomenological-existential pedagogy (including developments in hermeneutics and philosophies of the person), with additional references to the main exponents of such perspective in philosophy, psychology and, mostly, theory of education. During the research process many themes have been thoroughly investigated, because of the boundary spanning nature of authenticity, which touches upon several educational fields, including: relationships, communication, care, ethics, identity, project, choice, freedom, temporality, death, sorrow, emotional life, time, body, space. The thesis consists of two sections that go from theoretical-pedagogical considerations to practical-educational directions.

Dall'età moderna alla Restaurazione le politiche assistenziali dei brefotrofi mutarono profondamente. Come dimostra il caso dell'Ospedale Maggiore di Milano, fu centrale, in questo percorso, il ruolo svolto dalla presenza femminile. Le varie iniziative adottate dagli amministra-tori per dare una collocazione sociale alle loro "figlie istituzionali" sempre più numerose dei maschi si intrecciarono alla volontà di valorizzarne il lavoro (manifatturiero, domestico o ospedaliero), ai tentativi di contrastarne le trasgressioni e le resistenze, ma anche alla necessità di liberarsi del loro «insopportabile peso». Nel XVII secolo, questa necessità indusse i deputati milanesi a rinunciare quasi completamente all'internamento dei minori e a preferire l'inserimento presso famiglie affidatarie. Nel periodo che va dall'età delle Riforme alla fine dell'epoca napoleonica la relazione fra amministratori milanesi e assistite divenne più complessa, sia per la presenza dovuta ai processi di pubblicizzazione dell'assistenza e di medicalizzazione delle strutture ospedaliere di nuove autorità esterne e interne, sia per l'effetto delle norme civili che avevano ridisegnato il sistema dei rapporti di filiazione. Emerse, inoltre, la contraddizione fra il tentativo di applicare i nuovi regolamenti che proibivano la riammissione delle esposte dopo i quindici anni (1784), il tradizionale utilizzo delle adulte per i servizi infermieristici in un'ormai anacronistica condizione di assistite-dipendenti e la difficoltà di imporre, in un ambiente promiscuo, la segregazione a decine di donne sole e maggiorenni. Contemporaneamente, gli amministratori furono sollecitati dai governi a elaborare progetti, perlopiù rimasti incompiuti per mancanza di risorse, miranti a rendere i loro "figli" e "figlie" «utili a se stessi e alla società». Durante la Restaurazione, l'amministratore unico, Carlo Bellani riuscì temporaneamente, attraverso le nuove norme disciplinari e l'espulsione protetta delle esposte-serventi più ribelli, sostituite da infermiere esterne, ad avviare un vasto progetto riformatore, inteso a migliorare l'efficienza ospedaliera e a recuperare il valore morale dell'assistenza ai poveri infermi.
