Rules controlling State aid and subsidies on the EU and the WTO level can have a decisive influence on both regulatory and distributive decision-making. This field of law has grown exponentially in importance and complexity over the past decades. Rules on State aid and subsidies control are one of the key instruments to ensure that public spending and regulatory measures do not lead to discriminatory distortions of competition. As a consequence, hardly any part of national law is free from review under criteria of State aid and subsidy regulation. In turn, State aid and subsidies law is linked to economic, constitutional, administrative law of the EU and the Member States as well as to public international law. This book provides expert opinion and commentary on the diverse dimensions of this complex and vital area of law. Critically analysing and explaining developments and current approaches in State aid law and subsidies, the chapters take into account not only the legal dimensions but also the economic and political implications. They address the EU law applicable to State aid in the aftermath of the recent State Modernisation reform, and coverage includes: an in-depth analysis of the notion of State aid as interpreted by the Court's cases-law and the Commission's practice; the rules on compatibility of State aid with the internal market; the rules governing the procedure before the Commission; the litigation before the Court of Justice of the European Union; and analysis of the other trade defence instruments, including WTO subsidy law and EU anti-subsidy law.

Abstract:
The euro’s launch in 1999 accelerated the integration of Europe’s financial markets. Upheavals in the banking sector and debt markets since 2007 have, however, both reinforced (regulatory and supervisory reforms) and halted (government protectionism) this development. The latter ‘renationalization’ process was accentuated by the enormous amounts of state aid that national governments channelled to banks through public loans, capital injections, and guarantees. The European Union consequently faced two equally important and complex challenges—plugging regulatory and supervisory gaps to prevent future crises, while limiting the economic damage of the crisis—which the chapter reviews from a depositor protection perspective. The chapter examines the guiding 1994 Deposit Guarantee Schemes Directive, and identifies relevant regulatory and supervisory reforms that have taken place since 2007, including the 2014 recast Directive and creation of the European Banking Authority. It concludes by offering an overview of the main critiques of these regulatory and supervisory developments.

On 30 May 2017, the European Parliament, Council, and Commission reached a political agreement on the package of regulatory reforms of the European securitisation market. The package is aimed at facilitating the development of a securitisation market in Europe. The package represents the latest development of a negotiation process that started back in September 2015. The application date is expected to be 1 January 2019. Meanwhile, market participants have expressed uncertainties as to its effectiveness. This chapter considers the risk that the package will have a negative effect on the European securitisation market, resulting in further contraction. The primary focus of the chapter is on the rules on long-term securitisations as opposed to the short-term securitisations (asset-backed commercial paper).

Abstract:
The book examines the role of the United Kingdom (UK) in shaping post-crisis financial regulatory reform, and assesses the implications of the UK’s withdrawal from the European Union (EU). It develops a domestic political economy approach to examine how the interaction of three domestic groups—elected officials, financial regulators, and the financial industry—shaped UK preferences, strategy, and influence in international and EU-level regulatory negotiations. The framework is applied to five case studies: bank capital and liquidity requirements; bank recovery and resolution rules; bank structural reforms; hedge fund regulation; and the regulation of over-the-counter derivatives. We conclude by reflecting on the future of UK financial regulation after Brexit. The book argues that UK regulators pursued more stringent regulation when they had strong political support to resist financial industry lobbying. UK regulators promoted international harmonization of rules when this protected the competitiveness of industry or enabled cross-border externalities to be managed more effectively, but were often more resistant to new EU rules when these threatened UK interests. Consequently, the UK was more successful at shaping international standards by leveraging its market power, regulatory capacity, and alliance-building (with the US). But it often met with greater political resistance at the EU level, forcing it to use legal challenges to block reform or secure exemptions. The book concludes that political and regulatory pressure was pivotal in defining the UK’s ‘hard’ Brexit position, and so the future UK–EU relationship in finance will most likely be based on a framework of regulatory equivalence.

Abstract:
Although commodity derivatives are a small segment of the overall global derivatives markets, their regulation attracted more public attention than any other single issue on the post-2008 derivatives reform agenda. The goal of regulatory reform in this sector in the United States, European Union, and G20 went beyond that of bolstering of transparency and resilience to include the more market-constraining objective of strengthening “position limits” that set a ceiling on the number of contracts that traders are allowed to hold. The initiatives to strengthen position limits after 2008 demonstrated the importance of a complex interplay of domestic, inter-state, and transnational political dynamics in shaping regulatory trends. Reform initiatives in this sector also highlighted some unexpectedly long delays and inconsistencies in the implementation of reforms.
