Abstract:
Gambling is a complicated topic not only because of its addictive features but it requires knowledge of medical, social and economic field. The current public discussion about new gambling law is moreover disturbed by false arguments and manipulations coming from activists. In the first part of this thesis I focused on paper (PCP, 2014): Socio-economic costs of gambling in Czech Republic, which is considered to be a cornerstone of new gambling law. I reviewed its way of data transfering and its presumptions and found out that the original amount of the costs were overvalued by 120 %. I also analysed the impacts of proposed measures, which have been prepared by the Treasury, the main regulator of gambling market. Measures are presented as harm reducing, but they will subvert the industry instead. In the third section I consider the threats and costs of electronic gaming machines prohibition, which had been introduced in some municipalities. The data analysis as well as field research did not validate the positive effects of EGM ban presented by anti-gambling activists. In final chapter I'm following less common approach to gambling not as a threat but as an opportunity and trying to evaluate the potential of gamblers from Germany and Austria, who are the frequent visitors of casinos at the czech side of the borders.

Abstract:
This thesis examines gambling as one of the causes of poverty in households. Gambling is very widespread in Czech republic because of outdated legislation governing gambling. Higher availability of gambling causes higher incidence of pathological gambling, which is the worst type of gambling. Negative impacts of pathological gambling on society are described based on results of foreign empirical studies and statistics from the Czech gambling market. The following topic is the legislative regulation of gambling in Czech republic and abroad. Two approachs of regulation are described in detail and compared to each other. These are liberal approach and strict approach to the regulation of gambling. The practical part analyzes economic indicators of the Czech gambling market, approach of Czech municipalities to the regulation and upcoming drafts of mendments to the Lottery Act which should be valid in 2016 and 2017. The results of the analysis indicate that the current drafts of the new regulation do not effectively address the sissues of pathological gambling in Czech republic. In the conclusion of the thesis there are some recommendations which should be included in a new regulation. In this thesis, data published by the Ministry of Finance and the Department of Health Information from the period 2003 - 2013, is used. There are also used data published by various international bodies.

Abstract:
Thesis deals with the gambling industry in the Czech Republic since 2012, when the major amendment of lottery act was introduced, which allowed municipalities to regulate or eventually completely prohibit gambling with generally binding ordinances. The complete ban, which began to be implemented within some municipalities, caused an emergence of the black market. This economically interesting phenomenon is in terms of the thesis resolved - its origin and forms of expression. Furthermore, the thesis deals with the emergence of new laws that will gradually apply from 2016 and 2017. It analyses the impact on companies operating in the sector, the state budget and municipal budgets. There is also research of background data and economic models that the Ministry of Finance results from and in contrast to the critical analysis of the social costs of gambling it is being considered whether prepared regulation in the form of substantial increases in taxes is adequate or not. As the solution method was chosen descriptive analysis of relevant materials, especially the outputs from the Ministry of Finance, specifically established institutions, municipalities and real companies operating in the sector, as well as explanatory reports from lawmakers proposing new laws. The executed analysis provides a critical look at some of the background bases of the regulator. It impeaches the calculation of the social costs of gambling, which are further imbedded into a broader context in order to revalue the severity of the problem. Also is examined the estimation of the additional revenue from gambling after the tax increase, shifting the point of profitability and the transition to the emergence of a black market. The main contribution of this thesis is the emphasis on the greatest possible objectivity in the analyzing and processing of a wide range of inputs, which are further critically evaluated. This thesis comprehensively summarizes the situation of the gambling industry, its present and future regulation considering its bases and possible impacts.

Abstract:
In January 2015, a zero gambling tolerance came into force in Jablonec nad Nisou, which prohibited casinos and playrooms. It is generally assumed that gambling increases criminality, but the effect in the Czech Republic has not been quantified yet. Based on the regression analysis of monthly data from 2013-2016 this work examines the hypothesis of the existence of a negative relationship between gambling regulation and crime by using the difference in differences method. The town of Semily was used as a control group. This hypothesis is confirmed based on the used model - the regulation of gambling in Jablonec nad Nisou is associated with the average monthly decrease of the total crime rate by 0.3622 crimes per 1000 inhabitants (16% decrease) and the average monthly decrease of the property crime rate by 0,3871 crimes per 1000 inhabitants (30% decrease).

Abstract:
This diploma thesis is focused on comparison of two political approaches to a quite new e-commerce industry -- internet gambling. These approaches are prohibition on the one hand and regulation, free market environment, on the other hand. Internet gambling became the worldwide phenomenon. However, American legislators had passed the Unlawful Internet Gambling Enforcement Act 2006 in 2006 which outlawed an internet gambling. The declared purpose of this Act is protection of families against ill effects, such money laundering, underage gambling and problem gambling on society. This paper argues that regulation and free market environment established in Great Britain is much more effective way how to solve these key issues. There is demonstrated in the paper that free market stands for economically preferable option and contains better instruments for solving the issues at the same time.

Abstract:
Problem EGM gambling is an increasingly prevalent public health concern because of its associated psychological, financial and social problems. In recent years there has been a heightened interest in the psychology of EGM play, and more specifically, why a subgroup of people appears to lose control over their gambling. This thesis has been guided by the literature that suggests a subgroup of people may be more vulnerable to developing gambling problems than others, for example, Durand Jacobs' General Theory of Addiction (1986), and the emotionally vulnerable subgroup of problem gamblers in Blaszczynski and Nower's (2002) Pathways Model of Problem Gambling. The primary goal of the research was to explore people's phenomenological experiences during EGM gambling, in particular, the occurrence of dissociative-like states, and how excessive gambling might be linked to people's psychological states. The first study involved a preliminary investigation of the occurrences of dissociative-like experiences during EGM play. The findings from the study suggested that South Australian gamblers do report having experienced dissociative-like experiences during gambling. In particular, participants were more likely to report dissociative-like experiences during EGM gambling. The findings from the preliminary study provided the basis for subsequent studies. A qualitative study (N=18) was then conducted to explore the phenomenological experiences of problem EGM gambling and was analysed using Interpretative Phenomenological Analysis (IPA). The main findings suggested that the problem gamblers' histories were characterised by traumatic/stressful life experiences, and that they used gambling as a maladaptive form of coping. A survey-based study of regular and problem EGM gamblers (N= 190) was then conducted. The study investigated specific elements of Jacobs' (1986) General Theory of Addictions, more specifically, the emotional and physiological vulnerabilities of EGM gamblers and their within-session experiences of dissociation. The study also examined the links between dissociation and coping styles with impaired control over gambling and a number of hypothesised 'protective' factors. The results demonstrated that problem gamblers were more likely than other categories of gamblers to report psychological and physiological vulnerabilities. The results also highlighted the importance of impaired control and dissociative-like experiences in problem gambling. There was also evidence to suggest that problem gamblers may have lower levels of protective factors such as self-esteem and social support. A final pilot study was based on the thesis' earlier findings that highlighted the importance of 'narrowed' attention in the fulfilment of 'a need to escape' during EGM gambling. This concept of 'narrowed' attention was likened to 'trance' like states or altered states of consciousness. An innovation of the final study was that it attempted to obtain quantitative data on the phenomenological experiences of both regular and problem EGM players. The results from this final study suggested that EGM gamblers may experience alterations in consciousness during play, however, further research is needed to qualify this finding. The findings from each of the studies were then integrated and discussed in terms of the vulnerability model of problem EGM gambling, and particular attention was afforded to the clinical implications of the findings.

A growing body of evidence has established that smoking and gambling frequently co-occur. Despite high rates of co-occurrence, few studies have attempted to examine the extent to which nicotine can directly affect gambling behaviour. This dissertation further explores the relationship between smoking and gambling through a secondary data analysis and two laboratory-based experiments. First, a secondary data analysis was conducted using epidemiological data collected from a gambling prevalence survey in Newfoundland and Labrador. The results from this analysis revealed several associations between smoking and past 12 month gambling. Significant relationships were found between smoking and problem gambling severity scores, use of alcohol/drugs while gambling, money spent gambling, use of video lottery terminals (VLTs), and reasons for gambling related to positive reinforcement/reward and negative reinforcement/relief. Experiment 1 consists of a laboratory investigation of the acute effects of nicotine on subjective and behavioural responses to VLT gambling among gamblers who smoke. Twenty-eight (15 male) regular gamblers who smoke daily took part in two double-blind laboratory sessions where subjective and behavioural responses to gambling were assessed following administration of nicotine inhalers (NI; 4mg deliverable) or placebo inhalers (PI). It was found that NI significantly decreased tobacco-related cravings but did not affect gambling-related cravings, VLT betting, or subjective responses. In Experiment 2, the acute effects of nicotine on subjective, physiological, and behavioural gambling responses were examined in VLT players who smoke following exposure to gambling-related cues. Thirty (20 male) VLT gamblers (identified as ‘moderate risk’ or ‘problem gamblers’) who smoke daily were assigned to a nicotine lozenge (NL; 4mg deliverable) or placebo lozenge (PL) condition. Subjective and behavioural responses were assessed at baseline, following lozenge administration, following neutral cues, and following gambling cues. It was found that NL significantly reduced tobacco-related cravings but didn’t affect gambling-related cravings, the decision to play a VLT, or other subjective responses. The aggregate findings of Experiments 1 & 2 indicate that acutely administered nicotine reduced tobacco-related cravings without increasing the reinforcing value of gambling. These results suggest that use of nicotine replacement therapies (NRT) may be a safe option for gamblers who are attempting to quit smoking.

Substance users tend to pay more attention to short-term gains yet neglect long-term losses. Performance deficits on the Iowa Gambling Task (IGT), which is widely used to measure such risky decision-making, have been found among drug abusers. However, it remains rarely known about whether such risky decision-making is present among subjects who are still in the early stage of their illegal drug use career. This study aimed to examine the associations between the magnitude of substance usage and decision-making characteristics as measured on the IGT using reinforcement learning models by comparing tobacco- and drug-naive controls (N = 45), regular tobacco and alcohol users (N = 185), and illegal/non-prescription drug users (N = 55), with stratification by gender. Study subjects were the participants recruited via respondent-driven sampling (RDS) among regular tobacco and alcohol users in Taipei metropolitan area in Taiwan in 2008, 2009, and 2010. We used the Prospect-Valence Learning model to estimate three main latent components in decision-making, i.e., individuals’ loss aversion (less risky tendency), learning ability, and choice consistency in trials, with Bayesian hierarchical estimation procedure implemented. The results showed that 1) illegal/non-prescription drug users learned less from the most recent event than both tobacco- and drug-naive controls and regular tobacco and alcohol users; 2) drug users and regular tobacco and alcohol users were more risk-seeking than tobacco- and drug-naive controls; 3) regular tobacco and alcohol users made choices more randomly than the other two groups, particularly in men. These results reveal that drug users in relatively early stage of their drug use career could be differentiated from legal substance users by cognitive modeling parameters. These drug users may have lower learning ability in the most recent event and be more obstinate of their relatively risky choices. The regular tobacco and alcohol users may make risky decisions, but change their decisions as a result of being more influenced by the most recent event. The tobacco- and drug-naive subjects are more fixed on their non-risky choices. These results have useful implications for the prevention and intervention of drug use.

The Regulation of Internet Gambling This master thesis deals with the regulation of gambling operated via Internet public network. The chosen topic reflects adoption of a new framework of gambling regulation represented in particular by Act No. 186/2016 Coll., on Gambling, as amended (hereinafter referred to as "the Gambling Act") and Act No. 187/2016 Coll., on Gambling Tax, as amended (hereinafter referred to as "the Gambling Tax Act"), which introduced to the Czech legal system a systematic regulation of operation of gambling via Internet public network. The author aims to analyze and evaluate the new framework of gambling regulation (including newly introduced system of gambling taxation). Considering that both the Gambling Act and the Gambling Tax Act have entered into force only on 1 January 2017 the author further aims to point out certain unclarities regarding interpretation of several legal provisions contained therein. Finally, the author further aims to propose possible amendments to the analyzed legal regulation. The master thesis is divided into four parts. Legal regulation and taxation of gambling mechanisms in video games Abstract In connection with the development and spread of information technologies to most households, new questions arise regarding their legal regulation. The old legal norms cannot keep pace with this development, and therefore a new phenomenon may emerge, which at first glance seems to have been neglected by law. This work explores one of these phenomena of information technology, namely Loot boxes, as a new, modern form of gambling targeted at minors and other vulnerable groups. Some Member States of the European Union, in particular Belgium and the Netherlands, have already reacted correctly to Loot boxes and banned the operation of some Loot boxes on their territory. Other countries, such as the United States, have been talking about regulation for a long time, but it has not yet happened. Loot boxes are internally divided into several types, and for some we cannot talk about gambling. In particular, these are cases where the possibility of buying a Loot box for money or the possibility of selling acquired virtual items for money, or a similar value that can be expressed in money, is completely missing. Abstract:
Additional tax on gambling winnings was announced by the Minister of Finance, Mr. Pravin Gordhan in the 2010 National Budget Speech. This additional tax was proposed to discourage excessive gambling in South Africa. In 2011, it was proposed that all winnings above R25 000 will be subject to a final 15 per cent withholding tax. Gambling plays a significant role in the South African economy and contributes to job creation, infrastructure investment and overall economic growth. The Government faced negative comments from the gambling industry where the administrative challenges of implementing a withholding tax were emphasised. Challenges such as the difficulty in implementing, controlling and administering the proposed tax were mentioned. The objective of the proposal was questioned because excessive gambling declined in South Africa during the last few years. This led to the Government changing their proposed method in 2012 from a withholding tax at 15 per cent to a national gambling tax, based on gross gambling revenue, on a uniform provincial gambling tax base, which constitutes an additional 1% national levy. This raised two main problem statements. The first is which role of government, regulator versus stakeholder, is taking precedence through the implementation of the proposals to levy additional taxes on gambling in South Africa? And the second, is this role (identified above) the correct role that government should play that best supports government‟s objective of curbing excessive gambling in South Africa and does it justify the need for an additional tax to be levied on South African gambling? The two proposed methods were scrutinised to identify the ultimate role of the government. The fact that only the winnings will be subject to a withholding tax system did not contribute to a regulator role to decrease excessive gambling and thereby minimising negative externalities. Not all gamblers will be directly affected by this type of tax. The provincial tax base taxes all gambling activities, as all gamblers participating in gambling will be subject to the additional levy. The problem here is that the gambler will not be directly taxed and will then not be directly influenced to have any effect on their gambling behaviour. The government also recognised that they want to decrease the negative externalities that are associated with excessive gambling. It would seem that the main objective should rather be to address the negative externalities rather than the excessive gambling. It is debatable whether an additional tax levied in any form other than a sin tax would achieve this goal and give the role of regulator precedence. The role as stakeholder took precedence when the government decided to move to a provincial tax base. Research indicated that the main motivational factor behind the election was purely driven on how government would be successful in implementing an additional tax in the most administratively efficient and cost effective manner, while still benefiting from it through the collection of additional state revenue.

Alea Iacta Est - Starting Points of The Current Regulation of Gambling with Emphasis on Financial and Legal Aspects of Its Regulation Abstract The thesis deals with the general starting points of the current legal regulation of gambling in the Czech Republic, both from the national and international perspective. In addition to a detailed examination of the fundamentals of the legislation, attention is also paid to selected financial and legal aspects of gambling regulation, especially the area of gambling tax, the tax on winnings, and the matter of use of cryptocurrencies and blockchain technology in the gambling field. The thesis consists of three complementary interconnected parts. In the first, interdisciplinary part, the phenomenon of gambling is examined first from the perspective of non-legal disciplines. There are findings from sociology, economics, philosophy, ethics, psychology and there is also a brief look into the history and future of gambling. Interdisciplinary overlap and taking into consideration scientific knowledge from related disciplines is a prerequisite for such a creation of legislation that could achieve the objectives pursued. 1 Abstract This thesis investigates the problem of gambling in the Czech Republic. There are analyzed and discussed several aspects of gambling in relation to historical development, the existing legislative system or the specifics of interest and acting of participants by research questions. The offer of the gambling market is very wide. The work focuses mainly on gaming device with which the issue of pathological gambling is associated the most. The important methods, which are used, are pathological gambling analysis, analysis of the legal framework, the analysis of participants and analysis of relevant strategic documents. The thesis analyzes the current state of gambling in the Czech Republic, based on questionnaires addressed to the municipalities and structured interviews with other respondents. The thesis also presents specific measures that can be applied to solve the current problem of gambling in the Czech Republic. Before I start dealing with the essential topic of my thesis, I have to define the basic notion in the first part of my work, by which I mean the notion of lotteries and other similar games of chance not only according to Act No. 202/1990 Coll., but also according to the foreign legislation (e.g. Belgian).
