Abstract:
This contribution deals with the co-ordination of minimum subsistence benefits in EU law. It is argued that the distinction between social assistance schemes and non-contributory benefits in EU social security law is becoming increasingly redundant. This is recognised in the case law of the CJEU, although paradoxically not in a way that strengthens the rights of mobile citizens, but in an adverse manner that undermines the co-ordination efforts of non-contributory benefits under Regulation 883/2004. In order to overcome this problem, it is argued that social assistance should be included in the material scope of application of Regulation 883/2004. This regulation should abandon the concept of special non-contributory benefits and introduce a new category of minimum subsistence benefits, which would also include social assistance schemes. Such a change could be accompanied by a single, coherent principle to govern the relationship between the right to benefits (Regulation 883/2004) and residence rights (Directive 2004/38), if necessary supported by a cost sharing mechanism for minimum substance benefits under Regulation 883/2004 and, preferably, by a recognition of minimum protection standards for economically non-active EU citizens without a legal right of residence.

Abstract This article analyses the Brey judgment of the eu Court of Justice, in which the cj had to rule on a claim for a social assistance benefit in a host Member State by an economically inactive migrant person. The legal context within which the Court had to deal with these questions differs from other cases regarding the politically highly sensitive question of the right to access to social benefits for economically inactive migrant Union citizens. It had to deal with the interpretation of the provisions in Social Security Coordination Regulation 883/2004 on the so-called ‘special non-contributory cash benefits’. This article examines the judgment in the light of previous political compromises and agreements on the relationship between Regulation 883/2004 and Citizens Directive 2004/38. It also looks into the consequences of the judgment for the concept of ‘social assistance’ in both these instruments and for the concept of ‘conflict rule’ in Regulation 883/2004. The issue of what claim should be considered as an ‘unreasonable burden’ on the host State’s social assistance system under Directive 2004/38 is assessed in more detail. The conclusion of the article is that this judgment has not only overruled previous political compromises but has also created more confusion than ever on the entitlement to social minimum benefits for economically inactive eu migrants.

The concept of ‘working time’ for a period of stand-by time according to a stand-by system applicable to firefighters was interpreted by the Court in MG (C-214/20). In the Y case (C-636/19), the Court interpreted the concept of ‘insured person’ for the purpose of reimbursement of healthcare costs under Directive 2011/24. In the TS case (C-538/19), the Court dealt with another cross-border healthcare case. This time the question was whether a Member State can require an authorisation for cross-border healthcare to be subject to the submission of a medical report drawn up by a doctor from its national public health insurance system in light of Article 20 of Regulation 883/2004 and Article 56 TFEU. In ASGI and APN (C-462/20), the exclusion of third-country nationals from the eligibility to the Italian family card was under scrutiny. In SC (C-866/19), the Court clarified that the principle of aggregation applies to the calculation of the theoretical amount of benefit but not to the calculation of the actual amount of benefit under Article 52(1)(b) of Regulation 883/2004. In K (C-285/20), the Court held that being on sick leave and receiving sickness benefits can be considered as equivalent to the pursuit of an economic activity for the purpose of applying the rules on unemployment benefits for wholly unemployed frontier workers under Article 65(2) and (5) of Regulation 883/2004.

Le silence du défendeur dans le procès international est une hypothèse fréquente qui soulève des difficultés théoriques et pratiques pendant le procès, mais aussi en amont et en aval. L’équilibre entre la protection des droits de la défense et le droit d’agir du demandeur de bonne foi est particulièrement délicat en droit international privé judiciaire. Le droit judiciaire européen, tel qu’il se dessine dans différents instruments (notamment le Règlement (CE) no 44/2001 du Conseil du 22 décembre 2000 concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale mais aussi le Règlement (CE) no 805/2004 du Parlement européen et du Conseil du 21 avril 2004 portant création d’un titre exécutoire européen pour les créances incontestées), apporte un éclairage intéressant. La protection du défendeur silencieux a été très tôt affirmée par la Cour de justice, mais se dessine progressivement un droit judiciaire au service du demandeur de bonne foi.

This article discusses the importance of free movement and the coordinating social law of the European Union (EU) inensuring that people who move between EU Member States are not left without social security coverage. The articleexplains that the EU does not have a uniform or common social law and that the responsibility for social policy primar-ily lies with the Member States. The coordinating social law of the EU is limited to the coordination of the various socialsecurity systems of the Member States. The article further explains that the coordination of social security systems isessential for the success of European integration and emphasises that the EU Member States are bound by both thebasic Regulation (EC) No 883/2004 and the implementing Regulation (EC) No 987/2009. After a primary law derivationof the social law coordination, the article explains the scope of application and the key principles of Regulation (EC)883/2004. This is followed by a discussion of the Regulation’s conflict-of-law rules, which take precedence over nationalprovisions.

During the period of reporting (1 October 2019-31 January 2020), six judgments are worth noting in the area of EU social security law. In Safeway, the Court had to decide whether Article 119 of the EC Treaty on equal treatment precluded a measure ending discrimination through the fixing, with retroactive effect, of a uniform normal pension age equal to that of the members within the previously disadvantaged category. In Bocero Torrico, the question related to the obligation on Member States, under Regulation 883/2004, to take into account equivalent benefits acquired in other Member States for the purpose of calculating an early retirement pension. WA concerned a discriminatory law that granted a pension supplement solely to women. UB was about a discriminatory law that granted additional benefits for sportspersons based on their citizenship. In ZP, the question concerned Article 62 of Regulation 883/2004 dealing with the calculation of unemployment benefits. Finally, in Pensions-Sicherungs-Verein, the Court had to interpret Article 8 of Directive 2008/94 in the context of a reduction of pension benefits following the insolvency of the employer.

In the reporting period (February 2019-June 2019), the Court of Justice of the European Union did not deliver any ground breaking rulings that really altered existing coordination rules on social security. Nonetheless, the Court did rule in various interesting cases. These include the material scope of Regulation 883/2004 ( Dreyer), the rules determining the applicable legislation ( SF), invalidity benefits ( Vester), and family benefits ( Bogatu). In addition, the Court brought about clarification of the possibility of retaining worker status (and thus claiming social benefits as a worker) under Directive 2004/38 ( Tarola) and the right of Turkish nationals to export benefits under Decision 3/80 when returning to Turkey ( Coban).

OBJETIVO: Analisar a frequência epidemiológica de fraturas mandibulares correlacionando gênero, faixa etária, fatores etiológicos, localização anatômica, e tipos de traços de fratura. MÉTODOS: Estudo retrospectivo nos prontuários de 883 pacientes portadores de fraturas faciais, atendidos no Pronto Socorro do Hospital Geral de Vila Penteado, pelo Serviço de Cirurgia e Traumatologia Buco Maxilo Facial (São Paulo - Brasil), num período de três anos (janeiro de 2004 a dezembro de 2006). RESULTADOS: Dos 883 pacientes avaliados, 270 apresentaram fraturas mandibulares (30,5 %). O gênero masculino foi o mais acometido (76,7%) na faixa etária de 20 a 29 anos (33,0%), o fator etiológico de maior freqüência foi acidente com veículos automotores (35,2%), o corpo da mandíbula foi a localização anatômica mais atingida (47,4%) e os traços únicos prevaleceram (76,7%). CONCLUSÃO: As fraturas, em sua maioria, foram simples (traço único), localizadas em corpo mandibular, e destacadas no sexo masculino, na faixa etária de 20 a 29 anos, além do que o fator etiológico mais comum foi acidente com veículos automotores.

The aim of this article is to discuss the chapter on unemployment benefits in Regulation (EC) 883/04 of the European Parliament and of the Council of 29 April 2004 on the coordination of social security schemes. This regulation is part of the ongoing simplification and modernisation of the coordination of Member States' social security schemes and will probably become applicable in 2009. The article illustrates the principal differences between the unemployment chapter of this new regulation and the existing provisions in Regulation 1408/71, and explains some of the difficulties encountered in the attempt to modernise and simplify these rules. It also shows why the extensive case-law of the Court on the provisions in the unemployment chapter of Regulation 1408/71 continues to be useful in the interpretation of the unemployment chapter of the new Regulation 883/04, since this chapter is, to a large extent, based on the provisions of the first Regulation.

The relevant rulings concern first and foremost the rules determining the applicable legislation as enshrined in Regulation 883/2004 and Regulation 1408/71. In addition, the Court of Justice has delivered important rulings concerning posted worker and the binding effect of A1 certificates, the social security rights of third country nationals holding a single-permit and the protection of social rights in the context of financial crisis and austerity measures.

Since it prescribed its first regulatory policy in 1986, the Federal government implemented a consultation process with stakeholders and the general public during the rule-making process. This process is not legally mandatory (unlike in the province of Quebec). However, failure to conduct a consultation process results in an administrative sanction: the refusal to approve the new regulation by Cabinet. This article reports on the results of an empirical research project we conducted in 2004 within the Immigration Division of the Citizenship and Immigration Canada Department [CIC]. Our general research question was exploratory in nature. We wanted to know how CIC civil servants understood their obligation to consult with citizens. Our case-study indicates that it is difficult to implement a consultative culture within a department that has a strong long-term commitment to protect the integrity of the Canadian territory.Depuis la mise en oeuvre de sa toute première politique réglementaire en 1986, l’administration publique fédérale consulte les parties prenantes et le public en général lors de l’élaboration d’un projet de règlement. Ces politiques n’ont pas pour effet de rendre la consultation légalement obligatoire (comme au Québec), mais administrativement obligatoire. La sanction du non-respect de cette obligation résulte en le refus par le Cabinet d’approuver le nouveau règlement. Dans cet article, nous faisons rapport sur les résultats d’une recherche empirique que nous avons menée en 2004 avec la section de l’immigration du ministère de la Citoyenneté et de l’Immigration du Canada [CIC]. The study of the European jurisprudence is essential to understand the legal dynamics underlying the application of European regulations. This is not only due to the complementary role that such pronouncements play, but especially because the legal-political reality that is Europe makes the Court of Justice one of the key pillars for continuing to advance its construction. Based on this idea, our essay abounds in the review of the most recent pronouncements made by the CJEU on coordination of national Social Security systems based on Regulation 883/2004, which allows us to present results that, without neglecting the economic sphere, increasingly seem to point more to the social.

El Ingreso Mínimo Vital y las rentas mínimas autonómicas presentan innegables similitudes en cuanto a sus objetivos y acción protectora, siendo la diferencia más remarcable que el primero se califica jurídicamente como prestación no contributiva de Seguridad Social sometida a prueba de ingresos. No nos cabe duda de que el Ingreso Mínimo Vital está incluido en el ámbito de aplicación material del Reglamento 883/2004 de coordinación de los sistemas de Seguridad Social y, por tanto, resulta exportable a los Estados donde se aplica el Derecho de la Unión Europea. Pero, simultáneamente, también puede ser calificado de ventaja social conforme al Reglamento 492/2011. Y como prestación de Asistencia Social a los efectos de la Directiva 2004/38. Respecto a la aplicación al Ingreso Mínimo Vital de los Convenios Internacionales de Seguridad Social vigentes en España puede existir una dicotomía entre la práctica administrativa y el ámbito material de dichos Convenios.

Leptospirosis is one of the most commonly encountered zoonoses in both Australia and the rest of the world. The incidence of leptospirosis in Queensland over the 7-year study period (1998–2004) was 3·1/100000 population. Enhanced surveillance questionnaires were used to collect patient data and facilitate an epidemiological investigation of leptospirosis in Queensland. Farming occupations comprised the majority of occupational exposure cases, however, recreational exposure accounted for 18% of the 883 cases. Rainfall and the presence of animal hosts had the most influence on the incidence of leptospirosis. Several trends in serovar numbers over this period are noted, in particular the emergence of L. borgpetersenii serovar Arborea, which accounted for 22% of all leptospirosis cases in Australia and 68% of South-East Queensland cases in 2004. Assessment of epidemiological trends in leptospirosis is important to obtain directed public health intervention and outcomes in the reduction of leptospirosis cases.

This article depicts the internal coordination of social security schemes, covered by EU Regulation no. 883/2004 in the federal state of Belgium. Since the first state reform in 1970, Belgium gradually evolved from a unitary into a federal state. Next to the federal level, there are two additional levels, the Communities and the Regions. Family allowances and long-term care insurance are, for instance, within the competence of the Communities. The article outlines the extent of federalism and decentralisation, the adjudication of competence between the federated entities and the financial arrangements between the federal state and the federated entities as well as the financial arrangements between the federated entities.

This contribution deals with the internal coordination of health care, long-term social care and social assistance schemes – covered by EU regulation no. 883/2004 – in Italy after the constitutional reform enacted in 2001, which significantly decentralised legislative and administrative machinery by strengthening the prerogatives of the Regions, especially in terms of organisation and funding of the services. This article seeks to demonstrate that, although the decentralisation of health care and long-term social care has been accompanied by mechanisms of internal coordination among the Regions (particularly in the field of inter-regional mobility), regional social assistance schemes providing money transfers lack any form of coordination.

This article considers the rights to free movement and equal treatment enjoyed by migrant work-seekers, in their capacity as Union citizens, in the light of the judgment of the European Court of Justice in Collins. The Court's approach now focuses upon the right of such lawfully resident Community nationals to challenge discriminatory restrictions on subsistence benefits under Article 39 EC as reinterpreted in light of Article 12 EC; and the potential for the Member States nevertheless to justify such restrictions by reference to their legitimate desire to ensure a ‘real link’ between economically inactive migrants and the domestic welfare systems. The article further addresses the impact of the Collins ruling upon legislative choices made by the Community's political institutions about the mutual allocation between Member States of financial responsibilities for economically inactive persons (including migrant work-seekers), in particular, as contained in Directive 2004/38 on free movement for Union citizens and their family members, and Regulations 1408/71 and 883/2004 on the co-ordination of national social security systems.

In the reporting period July-October 2018, the Court of Justice of the European Union (CJEU) delivered three rulings ( Alpenrind, Walltopia, and Commission v Belgium) concerning the conflict rule for posted workers as contained in Article 12 of Regulation 883/2004. The CJEU clarified the meaning of the `non-replacement condition', the legal status of workers who are recruited for the sole purpose of being posted to another Member State as well as procedural aspects relating to A1 certificates. In addition, the CJEU delivered judgments on the portability of personal care benefits (A), the application of the prohibition of discrimination on grounds of disability to social security provisions contained in collective agreements ( Bedi) and the protection of supplementary pension claims in the event of insolvency of the employer ( Grenville Hampshire).

This article gives a general outline of the new European coordination rules regarding social security in Regulation No. 883/2004 that came into effect on 1 May 2010. These rules have not been fundamentally changed compared to the previous rules in Regulation No. 1408/71. However, there are some important innovations, and the provisions have been simplified, rewritten, and adapted. As for the rules on the determination of the applicable legislation, the State of employment principle has been confirmed and even strengthened. In actual practice, the new rules and agreements on a better administrative collaboration between the Member States, inter alia, via electronic exchange of data, will be of the utmost importance. Yet, this new European social security coordination has not changed anything with regard to the lack of coordination with the rules on the determination of the applicable legislation in bilateral tax agreements. This can lead to situations in which a migrating person contributes in more than one State to the funding of social security that is sometimes considered to be an obstacle to the free movement of persons. However, both from the political and legal analyses in this article, it follows that a better coordination between the rules to determine the applicable legislation in social security and in tax matters will not come about easily and probable only on a case-by-case basis.

Klinikánk STD Centrumában 2004 óta végezzük a syphilis, gonorrhoea és egyéb STD-fertőzésben szenvedők ellátását. STD Centrumunkon szűrőállomás működik, ahol anonim HIV- és syphilisszűrést végzünk. 2005. január 1-jétől 2008. december 31-ig összesen 42 114 orvos–beteg találkozás történt. 25 362 HIV- és syphilisszűrő vizsgálatot végeztünk el, orvosi vizittel egybekötve (HIV: 12 337, syphilis: 13 025). Önkéntes szűrővizsgálat 18 883 esetben történt (HIV: 16 614, syphilis: 2269). Négy év alatt 600 új syphilis- és 339 új gonorrhoeafertőzést diagnosztizáltunk. A kötelezően ajánlott HIV-szűrés során a 4 év alatt összesen 47 új HIV-fertőzést találtunk, illetve ismert és gondozott HIV-szeropozitív betegek közül 63 esetben állapítottunk meg új syphilis- vagy gonorrhoeafertőzést. Országosan, a gondozói hálózat bevonásával sikeres kontaktuskutatást syphilisnél évente 400, gonorrhoeánál évi 150–200 alkalommal végeztünk. Cikkünk célja, hogy felhívjuk a figyelmet a klasszikus nemi betegségek közé számító syphilis- és gonorrhoeafertőzések, valamint a többszörös STD-betegségek jelentőségére.

La normativa sobre protección social en la UE, no resulta a día de hoy de aplicación igual para todos los Estados miembros. Ni siquiera se ha logrado una mínima armonización en esta materia. Lo que ha terminado por imponerse es un mecanismo de coordinación de las diversas disposiciones existentes en los Estados miembros. El presente estudio tratará, de conocer las normas que regulan la coordinación de la acción protectora de la Seguridad Social, en particular, el Reglamento 883/2004 y el Reglamento 987/2009. A continuación, la forma en que se amplía esta normativa a los nacionales de terceros Estados, a través del Reglamento 1231/2010; para finalizar con una propuesta encaminada a encontrar una fórmula que simplifique la aplicación de la acción protectora de la Seguridad Social. Sin embargo, debe reconocerse que aunque se trate de una aspiración interesante, no va a resultar nada fácil su puesta en funcionamiento.

Los Reglamentos comunitarios de coordinación –al fundarse en el derecho a la conservación de derechos de Seguridad Social en curso de adquisición en otro Estado– llevan la Seguridad Social más allá de la estrecha territorialidad de los regímenes nacionales. La aplicación extraterritorial de las disposiciones comunitarias en materia de seguridad social radica en la posibilidad que ofrece el Reglamento 883/2004 de totalización de periodos de seguro fuera del territorio comunitario. Por otra parte, los nacionales de terceros Estados, desplazados en el ámbito de la Unión Europea se benefician del sistema de coordinación comunitario por mor del Reglamento 1231/2010. Además, los convenios bilaterales y multilaterales han sido la vía tradicionalmente utilizada para solventar los déficits de protección de Seguridad Social resultantes de la movilidad trasnacional de trabajadores en el ámbito extracomunitario a o desde España y se aplicarán siempre que constituya una norma más beneficiosa que las normas comunitarias.

El Real Decreto-Ley 6/2019, de 1 de marzo de medidas urgentes para la garantía de la igualdad de trato y de oportunidades entre mujeres y hombres en el empleo y la ocupación, agrupa las prestaciones de maternidad y paternidad en un único subsidio que ha dejado de ser un derecho transferible entre los progenitores. Teniendo en cuenta esta nueva configuración otorgada a las prestaciones por nacimiento, es conveniente analizar si se encuentran incluidas en el ámbito de aplicación material del Reglamento 883/2004 y en el de aquellos otros Convenios Bilaterales suscritos por España que también recogían la anterior prestación de maternidad (Andorra, Argentina, Australia, Chile, Ecuador, Filipinas, Marruecos, Paraguay, Perú, República Dominicana, Rusia, Túnez, Ucrania, Uruguay y Venezuela). Es decir, la nueva prestación por nacimiento y cuidado del menor, con una regulación diferente a las anteriores, tiene que encontrar su encaje dentro los instrumentos internacionales ratificados por España.

Przedmiotem opracowania jest kognicja sądu ubezpieczeń społecznych w postępowaniach z elementem transgranicznym, prowadzonych przy zastosowaniu rozporządzeń unijnych o koordynacji krajowych systemów zabezpieczenia społecznego. Kognicja jest rozumiana jako określenie, jakimi kwestiami natury faktycznej i prawnej powinien zajmować się sąd w celu rozpoznania sprawy. W konkluzji autor stwierdza, że kognicja ta podlega istotnemu ograniczeniu, co wynika z charakteru postępowania mającego na celu ustalenie ustawodawstwa właściwego.
