Full textOur study on end-of-life issues followed four distinct phases: an analysis of end-of-life legislations in Europe and the United States, a study of relevant European and American cases, an exploration of Christian standards regarding suffering and suicide, and an analysis of secular moral standards concerning these subjects. Subsequently, we found that even the most progressive laws currently in force regarding the right to choose one's end of life have shortcomings, especially concerning the assessment of mental suffering. However, they have the merit of recognizing the unbearable physical pain of individuals at the end of life, without hope of recovery. In fact, this recognition has been catalyzed by court decisions addressing various cases. Consequently, it appears that favoring a case-by-case approach regarding end-of-life issues is more appropriate. This approach allows for a more careful consideration of individual circumstances as well as specific existential beliefs of each individual

Full textThe object of this study consists in examining the case-law of the Court of Justice of the European communities relating to the demarcation of normative competences between the Community institutions and national authorities. Within the community legal order, the Court of Justice assumes the functions of a Constitutional court invested with the task of umpiring the proper balance of powers between the Community and its component entities. The first major aspect of the case-law concerns the contribution of the Court of Justice to the formation of a global system of competences which facilitates the effective attainment of the objectives set out by the EC treaty. The second major feature of the judicial umpiring of the division of powers concerns the decisive role played by the Court of Justice in safeguarding the essential checks and balances inherent in the Community system

Full textThe constitutional and political organization of the American States is not well-known in France. In comparaison to the very high number of studies focusing on the legal system of the United States, this lack of interest toward the States can not be justified. Once independent in 1776, the thirteen former English colonies directly inspired the Philadelphia delegates who, eleven years later, would give birth to the united States of America. Since then, Americans are governed much more under state law than under federal law. It makes sense that a knowledge of state law should then be a prerequisite to the learning of federal law. Meanwhile, the main difficulty to understand state law comes from the diversity of the American States. Despite similar administrative and constitutional frameworks, the states are much more different than close, and it would be unrealistic to attempt the description of a model State. However, facing a federal government whose tendancy to centralization is always alive and the consequences of direct democracy legislations that threaten their representative democracy, the States have reacted in the same direction : a resfusal to admit the slightest right to an effective self-local governance and, since the seventies, a professionalization of their respective legislatures and governors

Full textIraqi law defines the contract as the union of an offer made by the contracting party with the acceptance of another party and that in order to establish the effects in the contract. The place of the sales contract under Iraqi law is important. When the parties come from different legal orders, their relations are governed by the private international law which determines the court will decide. This thesis research aims to test the ability to apply the international rules of conflict of jurisdiction under Iraqi law on the virtual contract, which is paperless. We shall see, this is not to mean however that the contract is not real, as clearly specifies Iraqi law. It remains attached to the territory. In contrast, the Iraqi law does not recognize its immaterial that meanwhile ignores borders and notions of territoriality. This reality in the texts and practices therefore makes transactions that occur on the Internet are not taken into account by the rules of international jurisdiction conflicts. That is why, we wanted to check and understand the capacity and effectiveness of international jurisdiction conflict rules in the context of Internet disputes. So we will try to find the most appropriate rules, consistent with the nature of the virtual contract, namely its immateriality. This search will reveal developments in litigation of the Internet. Thus, it takes two directions: first at the national legislation, such as French and US law. Second, at the stage of international conventions such as the United Nations Conventions 2005, Hague Convention, the Brussels Convention 1968 and the 2000 and 2012 regulations
