Cline, Erin M. The Analects: A Guide. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780190863111.001.0001.

Full text
Abstract:
The Analects (Lunyu) is not only a collection of the teachings of Kongzi (Confucius) that describes how to follow the Way; it is a sacred text. This book examines why we ought to regard the Analects as a sacred text and what it means to do so. It explores what distinguishes sacred texts from other texts, and explores the history of the Analects and how it has been regarded in the Chinese tradition and in East Asia more broadly, from its composition and compilation to the evolution of its enduring status and influence. It also examines the content of the Analects concerning the sacred, including rituals, Tian (“Heaven”), de (“moral power”), different kinds of spirits, and its presentation of Kongzi not just as a teacher but also as an exemplar. It argues that we find a deep concern in the Analects with things we might call sacred, spiritual, or religious, but that are part of our everyday lives. All of these things, together, offer good reasons to study the Analects as a sacred text.

This synthesis chapter accomplishes two goals. First, it provides an overarching guide for matching theories to contexts, particularly with regard to the nature of conflict of different situations, in pursuit of persuasion, collaboration, and ultimately long-lasting and resilient solutions to environmental problems. Readers can use this guide to select appropriate theories to consider for the specific challenges they face. Second, the chapter distills a list of fifteen key principles that stretch across the social sciences to guide ongoing efforts toward environmental sustainability.

Full text
Abstract:
The devout self is constituted as a set of relationships: to itself, to the God it perceives as its creator and guide, and to those others whom it is obligated to love. Its relation to God is freely chosen, but although the choice of devotion involves a certain self-understanding this choice is not motivated primarily by reason. Instead, it is a matter of will or, more accurately, affection, manifest in the soul’s discovery of the convenience or fittingness of devotion to its own aptitudes. Reflection is however necessary to direct its practice especially with regard to the complex social situations in which devotion is to be lived and resisting the mimetic rivalry of the surrounding society.

Abstract:
This chapter presents an overview of the Market Abuse Regulation (MAR). The MAR is based on the competence of the Union in Article 114 of the Treaty on the Functioning of the European Union (TFEU). The regulation of market abuse has a long history in the Union and dates back to the 1960s. As is the case for many European regulations such as this one, the Market Abuse Regulation is directly applicable and must be interpreted by the General Court of the European Court of Justice as the court of last instance. In this regard, autonomous interpretation is the core principle for the interpretation of the Market Abuse Regulation.

Abstract:
From a clinical viewpoint, pain can generally be classified as nociceptive, visceral, or neuropathic. This distinction is important, as it will help guide pain management strategies. In this section the authors discuss the current state of the art with regard to pain mechanisms at a neuronal and neurotransmitter level. Much has been clarified in recent years to help identify neurotransmitters involved in pain pathways, and target new drugs and treatments. The second part of the chapter discusses assessment of pain in the critical care setting. Assessment of pain severity and of response to treatment is clearly a difficult process in the patient who is unable to communicate verbally. This section discusses the various strategies and assessment protocols that have been formulated to try and assist in this difficult task.

Lucas, George. Military Ethics. Oxford University Press, 2016. http://dx.doi.org/10.1093/wentk/9780199336890.001.0001.

Full text
Abstract:
What significance does “ethics” have for the men and women serving in the military forces of nations around the world? What core values and moral principles collectively guide the members of this “military profession?” This book explains these essential moral foundations, along with “just war theory,” international relations, and international law. The ethical foundations that define the “Profession of Arms” have developed over millennia from the shared moral values, unique role responsibilities, and occasional reflection by individual members the profession on their own practices - eventually coming to serve as the basis for the “Law of Armed Conflict” itself. This book focuses upon the ordinary men and women around the world who wear a military uniform and are committed to the defense of their countries and their fellow citizens. It is about what they do, how they do it, what they think about it, how they behave when carrying out their activities, and how they are expected to behave, both on and off the battlefield (whether in, or out of, uniform) - and what everyone (and not just military personnel themselves) needs to know about this. The book also examines how military personnel are treated and regarded by those whom they have sworn to defend and protect, as well as how they treat and regard one another within their respective services and organizational settings. Finally, the book discusses the transformations in military professionalism occasioned by new developments in armed conflict, ranging counterinsurgency warfare and humanitarian military intervention, to cyber conflict, military robotics, and private military contracting. From China to Russia, author George Lucas effectively sheds light on today’s military ethics in existence throughout the world. Abstract:
It is well documented that immigrants who arrive in the United States have superior health compared with native-born individuals. However, US evidence suggests that this initial health advantage erodes over time, a process referred to as “unhealthy assimilation,” the “acculturation paradox,” or the “immigrant paradox.” Variation in terminology reflects divergence in the conceptual frameworks researchers have used to approach the study of immigrant health, and in particular, how adaptation to US culture and environment influences health. The goal of this chapter is to summarize the evidence on studies that examine these questions in US immigrants with regard to chronic disease risk, in particular obesity, diabetes, and physical activity. A theoretical framework is proposed that can guide interpretation of findings on studies of chronic disease risk in US immigrants and inform future studies that aim to examine the influence of migration on health from a global perspective.

Abstract:
This entertaining and highly readable book gives anyone writing in the sciences a clear and easy-to-follow guide to the English language. English is often regarded as one of the most difficult languages to master. Yet while the English language has a vocabulary of upwards of 500,000 words, it only uses nine parts of speech, and all of these words fall into one (or more) of those nine categories. Scientific English: A Guide for Scientists and Other Professionals, Third Edition contains many simple revelations like this that make effective scientific writing in English easy, even for those whose fluency is in another language. The book is organized around a basic guide to English grammar that is specifically tailored to the needs of scientists, science writers, science educators, and science students. The authors explain the goals of scientific writing, the role of style, and the various kinds of writing in the sciences, then provide a basic guide to the fundamentals of English and address problem areas such as redundancies, abbreviations and acronyms, jargon, and foreign terms. Email, online publishing, blogs, and writing for the Web are covered as well. This book is designed to be an enlightening and entertaining read that can then be retained as a practical scientific writing reference guide.

McGough, Michael. A Field Guide to the Culture Wars. Greenwood Publishing Group, Inc, 2008. http://dx.doi.org/10.5040/9798400650796.

Full text
Abstract:
Like any realignment in politics, the Democratic takeover of Congress in the 2006 midterm elections inspired a raft of instant analyses. One take on the results that is surely wrong is that the change in control of Congress and the spike in Democratic hopes for the 2008 presidential race mark an end to the culture wars that conventional wisdom blamed (or credited) for George W. Bush's re-election in 2004. This book sets the stage for a new consideration of the contemporary culture wars by examining their antecedents—from the Scopes trial to Prohibition to the controversy over the Supreme Court's desegregation and school-prayer rulings to loyalty-oath battles of the 1950s to the pre- Roe v. Wade campaign to liberalize abortion laws. Even during times of supposed conformism, Americans have been presented with competing claims about what sort of culture this is and how and to what extent government should reflect, and police, values. The author covers such topics as same-sex marriage, stem cell research, intelligent design, and other hot button issues that are debated not just between the religious and secular, but more and more among the ranks of the religious themselves, where a religious left has emerged to counter arguments from the religious right. Anyone interested in the intersection of religion and politics, in the rise of the so-called moral majority, and in the current state of affairs with regard to values and public life in America will gain a better understanding from reading this book.

Hayward, Rhodri. Medicine and the Mind. Edited by Mark Jackson. Oxford University Press, 2012. http://dx.doi.org/10.1093/oxfordhb/9780199546497.013.0029.

Full text
Abstract:
History maintains an ambiguous role with regard to the mind sciences. It can be used to demonstrate the universality of psychological characteristics, capacities, and illnesses or it can serve to demonstrate their relative bases by revealing the implicit assumptions that guide modern research as well as the specific configurations of theory, practice, and technology that allowed the mind sciences to emerge and their subject-matter to be articulated. This article embraces this second approach. It outlines four broad constructions of the psyche — the inscribable, the historical, the adaptable, and the statistical — and shows how their articulation has made possible new kinds of self-understanding and social interaction. It also makes broad claims for the universal basis of psychological phenomena. This discussion focuses on the specific conceptions of mental medicine that have emerged in Europe and North America since the end of the eighteenth century. This psychological language makes possible our modern experience of mind, self, and mental illness.

Koerber, Jennifer. Library Services for Immigrants and New Americans. ABC-CLIO, LLC, 2018. http://dx.doi.org/10.5040/9798400679261.

Full text
Abstract:
This up-to-date guide to developing and implementing a wide variety of services to immigrants and new Americans focuses on the practical steps of creating and promoting programs. Illustrated by success stories in libraries throughout the country, the book discusses both traditional (ESOL and citizenship classes) and transformative (legal aid and workforce development) programs and services in terms of size, type, and local political climate (e.g., sanctuary cities) at a variety of public libraries as well as in select school libraries. As changes unfold in regard to how the federal government and local communities view and treat immigrants and new Americans in their midst, this topic deserves a fresh take from the profession. The author meets that need, providing practical ideas that range from creating more accessible websites and improving wayfaring and customer service in order to overcome cultural roadblocks to dealing with backlash in communities as libraries extend outreach and partnership-building goals.

Full text
Abstract:
The new edition of this leading work continues to provide full analysis of the legal and practical aspects arising in trusts disputes, with attention to jurisdiction-specific issues covering ten of the most relevant territories. Since the last edition the law has developed at a fast pace and trust disputes continue to increase as international trusts reach the second, third and sometimes fourth generation of beneficiary. In particular, there have been changes made to the law of succession in England and Wales (Intestacy Rules 2014) and case law such as Ilott v The Blue Cross [2017] which consider the implications for family provision under the Inheritance (Provision for Family and Dependants) Act 1975. Developments relating to the position of trusts in matrimonial disputes are analysed and the issues for trust disputes and rights to information under The Data Protection Act (Dawson Damer v Taylor Wessing [2017]) are also included. Other important case law which is now considered include Pitt v Holt, re Futter [2013] and the development of the law of mistake thereafter, and the Pugachev litigation on sham trusts. International Trust Disputes provides a comprehensive and thorough treatment of this topic. Acting as a specialist guide for practitioners, it offers a survey of the special considerations that may arise with regard to trust disputes as well as a definitive guide to the issues which may be encountered in the jurisdictions where disputes are most likely to take place.

This chapter deals with statutory provisions governing human tissue and organ transplantation, with particular reference to the Human Tissue Act 2004. It first considers the position at common law with regards to property in the human body, followed by a discussion of appropriate consent given by potential donors prior to their death or by deceased donors. Organ donation from living persons and ethical issues surrounding organ transplantation are then explored. The chapter concludes by looking at alternative sources of organs, including xenotransplantation and artificial organs. Relevant court cases are cited where appropriate.

Abstract:
This chapter is designed to guide clinicians in assisting service members to navigate the return from combat with regards to post-traumatic stress disorder (PTSD) and intimacy. The service members (and, by extension, their spouses) who served during Operation Iraqi Freedom/Operation Enduring Freedom are struggling with not only physical wounds from combat but also psychological/invisible wounds, including PTSD and traumatic brain injury (TBI). The symptoms of PTSD and TBI, including fatigue, irritability, insomnia, depression and cognitive deficits, overlap, and as a result, it can be difficult for clinicians and patients alike to tease out the specific diagnoses. Thus, this chapter discusses PTSD and intimacy issues for service members and spouses and provides recommendations for designing therapeutic interventions. Three case studies illustrate these interventions. Suggestion resources are also included.

Pye, Michael, ed. Exploring Shinto. Equinox Publishing, 2020. http://dx.doi.org/10.1558/isbn.9781781799598.

Full text
Abstract:
Shinto permeates the religious landscape of Japan and is a major key to the understanding of Japanese culture and society. But what is it? If ideological shortcuts are avoided there is no simple answer. Yet this book will guide students and general readers through many aspects of Shinto both today and in its history. It contains much information about sacred Shinto shrines and the divinities (the kami) which are the focus of devotion there. These numerous divinities have been viewed in different ways in the course of time, and contributions by specialists shed much light on the role played by Buddhism in this regard. Moreover, several fascinating religious movements or “sects” which share in the wider pattern of Shinto are also introduced and discussed. Oversimplified views may be challenged here, but the result is a volume in which “Shinto” is explored in a wide and illuminating perspective by an international team of scholars. It provides a refreshing and much-needed resource for all who are interested in the subject.

Abstract:
Class, culture, and race have influenced the educational experiences of children for centuries. As a new wave of Latin American and Asian peoples enters the United States, public schools are faced with the challenge of educating children from a culture of poverty, and who have varying racial and cultural backgrounds. This reference work employs historical, anthropological, sociological, and theoretical perspectives to overview current information on class, culture, and race in U.S. schools. The volume is organized systematically, with broad sections on class, culture, race, and prospects for the future. Each section begins with an introductory chapter that defines the theme of the section and places it within a larger context. The chapters that follow then examine the impact of class, culture, or race on schooling, with special regard to particular groups. The volume focuses primarily on Hispanics, African Americans, and Asians, as they struggle to survive and prosper in the United States. Because of its approach, the book is also a guide to the effects of poverty, language, and race on the educational experiences of children.

Full text
Abstract:
One of the main elements setting the scope of application ratione persona of international investment agreements is the definition of the investor. An investment agreement applies only to investors who qualify for coverage under its relevant provisions; only they can submit a claim against the host State. The definition identifies the group of investors whose foreign investment the home country is seeking to protect through the agreement as its ‘nationals’, as well as the ‘clients’ and the investments the host country wishes to attract. This chapter deals with the nationality of the investor, whether a natural or legal person; the criteria used by investment agreements to attribute this nationality, and the arbitral awards that support this qualification. For natural persons, the issues are usually not problematic, although some may arise in particular with regard to dual nationality. For legal persons, the debate remains far more complex.

Abstract:
Investment treaty arbitration, being an arbitral process, in no way differs from international commercial arbitration in that the principle of party autonomy is the primary rule governing the arbitration, including as regards the law applicable to the substance of the dispute. When the applicable law has been chosen by the parties, the arbitrators have a duty to apply such law and nothing but such law. It is only in the absence of a choice by the parties that the arbitrators are entitled to exercise a degree of discretion in the determination of the applicable law. This chapter examines each of these situations in turn, before considering whether the specific nature of investment protection treaties has implications in terms of choice of law process.

Abstract:
This book examines emerging defense technologies such as directed energy weapons, nanotech devices, and bioscience applications that have the potential to dominate international relations in the future, just as nuclear weapons and space infrastructure-assisted conventional weapons do now. Emerging Military Technologies: A Guide to the Issues examines the potential of the United States to bring new technologies to deployment in the service of America's security and defense. The work also discusses how other international actors may regard the United States' investment in these high-tech capabilities, identifying possible resultant counter actions, and presents several divergent viewpoints on what the future may bring. The book thoroughly explores three general categories of emerging technologies: autonomous computers, nanotechnology and biotechnology, and the interrelated topics of directed energy weapons and ubiquitous space access. Security studies expert Wilson W.S. Wong balances coverage of today's cutting-edge science and engineering with treatment of real-world concerns of effectiveness, military ethics, and international relations in the 21st century. An invaluable resource for members of the military and intelligence communities, this book also provides general readers with an accessible introduction to these highly technical topics.

McDermott, Nancy A. The Problem with Parenting. ABC-CLIO, LLC, 2020. http://dx.doi.org/10.5040/9798216001515.

Full text
Abstract:
The Problem with Parenting serves as an essential guide to the recent origins and current excesses of American parenting for students, parents, and policy makers interested in the changing role of the family in childrearing. Family scholarship focuses predominately on the evolution of family structure and function, with only passing references to parenting. Researchers who study parenting, however, invariably regard it as a sociological phenomenon with complex motivations rooted in such factors as class, economic instability, and new technologies. This book examines the relationship between changes to the family and the emergence of parenting, defined here as a specific mode of childrearing. It shows how, beginning in the 1970s, the family was transformed from a social unit that functioned as the primary institution for raising children into a vehicle for the nurturing and fulfillment of the self. The book pays special attention to socialization and describes how the change in our understanding of parenthood—from a state of being into the distinct activity of "parenting"—is indicative of a disruption of our ability to transfer key cultural values and norms from one generation to the next.

Abstract:
The inventor of the School Library Writing Center makes it easy for librarians and teachers of kindergarten through sixth grade learners to provide highly effective writing instruction. Students in the early years of their development have a tremendous capacity for learning. By focusing on providing authentic writing experiences for kindergarten through sixth grade students, librarians and teachers can help transform students into competent writers well before they reach middle school. Written by the inventor of the School Library Writing Center, this book is the only one of its kind. It gives you clear and easy-to-read instructions on how to create and structure engaging and productive lessons in writing as well as reproducible worksheets that are ready to implement in your library or classroom. Each worksheet relates directly to writing lessons discussed in the book and serves to guide students (and their teachers) as they explore the exciting world of writing. Readers will learn why and how they can create and maintain a School Library Writing Center. The book moves sequentially through the grade levels, starting with kindergarten and concluding at grade six, with each chapter focusing on a specific grade level. The author explains best practices with regards to tutoring writing in each grade; discusses the developmental levels and skills expected in a particular grade with regards to writing and reading; addresses grade-specific Common Core learning standards; discusses grade-appropriate online resources and technology-enabled activities that will help students become better writers; and identifies practical tutoring methods that will help students develop as writers.
