Full textMy thesis "discourse against violence of young Palestinians refugees and French people" aims two objectives Firstly, the identification of the processes of this undergone violence. Secondly, the violent strategies or not which these young people display in the individual and\or collective scale to survive or to find a place in the society. The questions which are the object of this research are the following ones: why we talk about violence? What we mean when we use the term of violence? 1s all the violence is equal? At what moment do we act with violence? Let us specify that it is not a question here of understanding the causes or the genesis of the notion of violence, but to wonder about the problem which puts the existence of the violence as the social phenomenon. In this research, I consider the violence as a conflict in the same way as the other conflicts. They distinguish themselves from it however by the presence of two factors which can go together to the same situation of violence, either the recourse to the strength as the means to impose its will, or the ultimate state or political power in a society. Indeed, the violence puts in the grips of the social groups or the individuals who take issue, claim, resist or quarrel the power. Even if sometimes we can identify a cause or a particular immediate situation with an act of violence, this one allows to explain or to plan with certainty the explosion of the violence. The explanation of the violence must be envisaged in terms of process, like discrimination, segregation, marginalization, racism or depolitisation, instead of emphasizing the causes which constitute in fact only the initial stage of this process

Full textThis study compares the ethical proposals of two contemporary social movements: the animal cause and the cause of refugees in Europe. On the one hand, activists and animalist thinkers advocate the inclusion of animals in the sphere of moral consideration by emphasizing that respect for animal lives will lead us towards the abolition of all kinds of suffering and exploitation, to wit that of animals and that of men. On the other hand, the sinking of boats in the Mediterranean Sea illustrates the indifference of European leaders and part of civil society towards refugees who, according to the spirit of international treaties, embody the image of human vulnerability. The indifference towards these individuals, without forgetting the hunting of which they are victims, their imprisonment, and the deprivation of their fundamental rights, will result in their metamorphosis into a biopolitically ambiguous figure: the humanimal. Despite its anthropomorphic physicality, its speech, and its human face, the humanimal is a living being whose status is closer to that of animals than that of men. A proximity that calls into question the need to politicize the animal cause to guarantee respect for animals, since the exclusion of the humanimal is precisely based on political criteria.More than a criticism of the ethical statements of animalists thinkers, this work wishes to think the animal cause with the help of the humanimal and thus stop the anthropogenic machine which has been characterized, since its origins, by the inclusion of a life in the sphere of moral consideration together with expulsion of another life. Bringing the humanimal closer to the animal represents an opportunity to think differently the being that Western epistemology, since Antiquity, has considered as a possession belonging only to man. The conclusion of this work aims to expose some elements allowing the construction of a new ethical perspective where “differences” will not constitute a reason for discrimination, above all a means to justify the oppression of the others. In our terminology, it is a question to be open to other ways of conceiving the “being” to build a humanimalist ethics, that is to say an ethics that transcends all geopolitical and biopolitical borders

Full textThe purpose of this thesis is to test, in the specific context of French law, the veracity and durability of feminist and gendered review of the refugee definition, which consists in denouncing the failure to take into account persecutions suffered by women and sexual minorities in the election process. It is a mixed conclusion that emerges from the study because, despite the numerous international and European pressures calling for a gendered analysis of the concept, these criticisms inherited from the 1980s still appear, to a large extent, to be relevant. Admittedly, the exclusion of gender-related persecution that they denounced has somewhat weakened, because persecutions suffered by women and members of sexual minorities are no longer excluded, as a matter of principle, from the scope of the refugee definition. However, there is still no political or jurisdictional will to fully integrate them into the analysis. Indeed, the efforts made to take them into account are still insufficient, leaving subtle obstacles to their integration, obstacles that are all the more difficult to identify and overcome
