Abstract:
Forced migrations, as well as the related issues of refugees and asylum, profoundly impact the relationship between the countries of origin and the countries of destination. Traditionally, the essential quality of a refugee was seen to be their presence outside of their own country as a result of political persecution. However, the historical evolution of the definition of a refugee has gradually become more restricted and defined. Commentators have challenged the current refugee protection regime along two principal lines. The first is idealist in nature and entails the argument that the refugee definition as contained in the 1951 Refugee Convention is not sufficiently broad and thus fails to protect all those individuals deserving of protection. The second line of argument is a realist one, taking a more pragmatic approach in addressing the insufficiencies of the Convention. Its advocates emphasize the importance of making refugee protection requirements more palatable to states, the actors upon which we rely to provide refugees with protection. With regard to the question of how to design more effective burden-sharing institutions, the literature has traditionally focused on finding ways to equalize refugee responsibilities directly by seeking to equalize the number of asylum seekers and refugees that states have to deal with.

Abstract:
Chapter 8 concludes with a summary of the book’s main findings, which relate to the initial impetus for a regional refugee instrument, the meaning of key terms of the 1969 Convention, its relationships with the international refugee convention and with regional human rights law, and the institutional architecture supportive of this treaty framework. It also addresses several overarching issues: the lack of formal supervision of the 1969 Convention, the challenge of effective implementation, and both negative and constructive forms of international responsibility sharing. Finally, it suggests a protection priority the AU and states should focus on going forward: fostering the local integration of refugees in protracted situations, including by respecting refugees’ work rights and their freedom of movement.

Abstract:
This chapter takes a closer look at some of the main components of international refugee law and some of the recent European practices in order to see how they resonate the notion of community obligation and convey a commitment to the common protection of human rights, in a way that deviates from a purely consent-based conception of the norms. It addresses four main points: (1) a broad interpretation of the definition of refugee in the convention relating to the status of refugees as an expression of a notion of community obligation; (2) non-refoulement as an expression of a notion of community obligation; (3) the duty to refrain from rejecting asylum-seekers at the border as an expression of a notion of community obligation; and (4) responsibility sharing as an expression of a community obligation.

Chapter 3 first addresses the regional refugee definition according to the 1969 Convention , beginning with a description of article I(2)’s international influence and an interpretation of the definition using orthodox methods. The context and object and purpose of the 1969 Convention are discussed, followed by analysis of the ‘every person’ term and each of the 1969 Events and the test for refugee status under article I(2), including a discussion of internal flight alternative, ongoing risk, and sur place claims. Section B then addresses how article I(2) has been invoked in practice. Section B also addresses prima facie refugee status determination. Section C covers further key features of the 1969 Convention: whether it advances an individual right to asylum; non-refoulement; the formalization of responsibility sharing, temporary protection, and voluntary repatriation; and the Convention’s prohibition of subversive activities. Section D concludes.

By projecting their stories into the public arena, undocumented storytellers refute mainstream discourse, trade anonymous narratives for individuality, and reveal the determination of those who elsewhere have been vilified by stereotype and presupposition. Taking a holistic approach to the role of storytelling in the immigrant rights movement, Bishop chronicles the ways young people uncover their lack of legal status experientially—through interactions with parents, in attempts to pursue rites of passage reserved for citizens, and as audiences of political and popular media. She provides both theoretical and pragmatic contextualization as activist narrators recount the experiences that influenced their decisions to cultivate public voices. Undocumented Storytellers offers a critical exploration of the ways undocumented immigrants harness the power of storytelling as a means of self-actualization, to mitigate the fear and uncertainty of life without legal status, and to advocate immigration reform. The book draws from a mixed methodology of forty in-depth interviews with undocumented immigrants from eighteen unique nations of origin, critical-rhetorical ethnographies of immigrant rights events and protests, and narrative analysis of immigrant-produced digital media to interrogate the power and limitations of autobiographical narrative activism. Offering an unparalleled view into the ways immigrants’ stories appear online, this book illuminates the power and limitations of digital narrative strategies by detailing how undocumented storytellers reframe their messages when stories have unintended consequences. The resulting work provides broad insights into the role of strategic framing and autobiographical story-sharing in advocacy and social movements.
