Full textThe subject of this research work focuses on the reaction to educational reforms from Travaux Personnels Encadrés (Tutorial Personal Work, TPE) by secondary-school teachers belonging to a Union. This work studies this phenomenon from the local teaching point of view. At the teaching level, strategies or local teaching approaches are confronted by paradoxical constraints. Teaching practices are, on the one hand, controlled by national regulations and on the other, encouraged to move towards more independence. The reaction and the role of the local union representative, and the manner in which the reforms are presented or filtered down is significant. The scope of the role of these elected representatives leads one to believe that a filtering process has an impact on the whole pedagogical team. Apart from this role, unions, in the school, co-ordinate local action, they are also the means to link local problems to major issues. Added to the union view, several variables have an impact on how a reform is received ; first of all, the recognition of the TPE with its expected evolution for and valorisation of good teaching practices. In fact, the response is always an interpretation, by the parties concerned, from their own point of view. In that sense, the process is a contextual phenomenon as well as a relative one. Teachers have become involved on the ground locally, while trying to influence the global educational policy. This local involvement of experienced teachers increases their determination to act more widely, beyond their own school. This determination emphasizes the possibility of change being initiated locally. As such the meaning of “local” evolves. In the future, local experience could be the catalyst to develop educational policies and not a dead end for government actions

Full textLiving at the precapitalist period and juridically supported by habits and customs as well as by muslim law, morocco has received from the french protectorate (in 1913), the capitalist way of production and its juridical consequence, the french labor law. At the begening, the law will be applied to the settlers living in morocco. After the independance time, it will be maintened and corrected, and finally extended to the moroccan in their labor relationships. Moreover, that law will be quite conformed to the line of international labor norms. That law, which corresponds to a democratic society, homogeneous and seculor, is facing up to the juridical and extra-juridical norms of moroccan society, due to its heterogeneous features. The moroccan society experiences, even a juridical and judicial pluralism which held up the accepted law to spread out, that its heterogeneous way of production reduces its own sphere of implementation. Besides those different oppositions towards the accepted law which are based, as well as on the law, that into the moroccan society, others have emerged from the practice of the judicial and administrative authorities. Trade unions which the main goal consists in the defense of economical and professionnal rights of its members experiences many difficulties to have this law respected by managers few involved in social problems. The intervention of public lawers in the field of the labor reduces the action of trade union to its simplest terms

Full textThe integration of States is a topical question whose outlines and contents are ignored by the African peoples and insufficiently understood by the lawyers. At the end of the independences, African Countries have created continental, regional and sub regional organizations with essentially an economic purpose. However, if the economic integration is advocated above all, the social dimension is not entirely absent. Thus, within these organizations and especially within the WAEMU, we notice a potential evolution of the conception of integration. The present thesis identifies two situations of a potential influence of economic integration on the reception of the international labor standards and reciprocally. Firstly, economic integration has a limited effect on the reception of international labor standards within the member states of WAEMU. The question of the international labor standards is widely marginalized even if it is undeniable that the union provides an opportunity for a better reception. On the other hand, the international labor standards if well received, can improve economic integration. Even if organizations remain dependent on their initial objectives, some international labor standards can be considered as the pillars of economic integration

Full textConceived to organize the reports of work within a simple company, the labor law meets, today, difficulties to frame these reports on the level of the group of companies. Origin of these difficulties comes owing to the fact that the company employer subjects to a domination exerted by a company known as parent company of the group. Because of this domination, identification of employer and articulation of the collective reports of work within the group of companies cause difficulties. In the same spirit, the labor law encounters difficulties to protect the employees with interior of the group of companies. An interrogation is posed relating to the catch in consideration of the group for the protection of the employees. This thesis is fixed like objective, analysis of the reception of the group of companies by the labor law. It's a matter of decipher, a side, the position of the labor law with regard of the structuring of the reports of work to interior of the group of companies (First part), and, another side, its position with regard of the protection of the employees on the level of this economic structure (Second part)
