Full textIt is well known that gas price follows a mean reverting dynamics with jumps. It is less known that jumps can happen when the demand of gas is high and storage levels are low, which usually occurs during the winter period when the consumption for heating purposes, especially in the residential sector, necessarily increases. It is then reasonable to assume that gas price is influenced by the atmospheric temperature. Mu (2007) was the first to study the dependence between the Henry Hub futures price and the temperature measured in the United States. [Stoll and Wiebauer, 2010] performed a somehow similar analysis on the price quoted in the Title Transfer Facility trading hub and the temperature measured in Germany, and found that temperature has an impact on the value of a gas storage contract/facility. In this work we propose to model the gas price as a mean reverting jump-diffusion process with temperature dependent stochastic jump intensity, in order to evaluate gas storage contracts/facilities in the US market. As first proposed by Boogert and De Jong (2008), we compute the no arbitrage value of the contract by a real options approach. The ensuing discrete time stochastic optimal control problem is solved by dynamic programming. We compute the continuation value of the dynamic programming algorithm by Fast Fourier Transform (FFT), generalizing the approach proposed by Kiely et al. (2015). A no arbitrage approach requires the specification of a no arbitrage pricing measure and a calibration procedure that make the model consistent with the observed market prices of liquid derivatives contracts at the valuation date. However, the low liquidity of the options market can make the classical calibration procedure of implied volatilities unreliable in practice. For this reason we first specify gas and temperature dynamics under the real world measure, and estimate them using the relative time series. Then we derive the no arbitrage dynamics for the gas price by a suitable change of measure, which introduces in the dynamics new parameters that can account for market prices of risk implicits in futures and option prices. Finally, we present some numerical results about the calibration of the model and the valuation of a gas storage contract.

Full textThe study about the subjective side of the legal relationship is pivotal in the theory of the obligation. The question is whether the modification of one or even both parts always entails its extinction or whether its objective unity is preserved. The answer has been different depending on historic ages. In the Roman law, the variation of any subject entailed the extinction of the relationship and the constitution of a new obligation (subjective novation). Such solution has been opposed by modern legislators, for whom, in case of modification of the personae, not the extinction of the relationship, but only the change of one of its elements happens. As for the property secutities, especially the mortgage, the essential general principles are the specialty and the accesority. The latter feature is crucial in case of subjective modification of the relationship, and this emerges in the dissertation about the singles typologies of the Italian Civil Code that determines it, in both active and passive point of view. In order to quicken the transfer of the credit, in the 2007 the “Bersani Decree” (on the portability of the loan), that allowed to remove the ties of the credit circulation in the banking relationships area, was approved. The features of the modification of the obligatory relations, however, can undermine the effectiveness of the Bersoni reform. This is the reason why some scholars support a vast review of the whole mortgage law, removing, in the light of what occurred in other European systems, the requirement of the acessority of the tie. Nevertheless, due to the risks related to this reform, refining the mechanism of improvement of the portability is considered preferable, while removing the criticalities without compromising the certainties of the present system, of which the acessority of the mortgage is an important foundation.

Full textThe research aims to analyse the regime of the appeals on merit in the preventive seizure proceedings (riesame and appello cautelare)¸in order to examine their legal status; the analysis has been developed reconstructing both legal standards and jurisprudence. Elements collected displayed to be referred to the type of “new judgment on merit” and “legal control of the judicial decision”. The research has also examined innovations introduced by L. 47/2015, which is referred to personal precautionary measures, to verify if they should be applied also to real ones (misure cautelari reali). Basing on the analysis about the legal status of different appeals on the merits and proceedings for withdrawing the real precautionary measure (art. 321 § 3 criminal procedural code), the research examines also the event that the mentioned attacks should be assume the status of legal control on precautionary measures (instead of “new judgment on the fact”).

Full textThe development of next-generation sequencing technologies in the past ten years has deeply revolutionized all the branches of genetic, including population genetics. The possibility to produce a huge amount of data at reasonable price has changed the focus of population genetic studies, moving from few markers to whole-genomes or representations of the genome. The improvement of the sequencing technologies is still ongoing, and the so-called “second-generation sequencing technologies”, the engines of this decade of huge improvements, are nowadays being challenged by a new generation of technologies, which promise higher throughput, lower sequencing times, longer reads lengths, smaller amount of starting materials (single-molecule approach) and lower costs. Notable examples of these new sequencing technologies, the third-generation, are Pacific Biosciences SMRT and Oxford Nanopore. Like most technological innovations in science, NGS approaches required the development of new statistical methods. For example, when genomes are sequenced in non-model organisms (lacking reliable polymorphism information) or at low coverage, high level of uncertainty in genotype calling has to be properly considered. This problem led for example to the development of ANGSD, a software able to deal with this uncertainty by estimating genotype likelihoods from multiple reads. Massive information about genomes required also the development of specific methods for the inference of demographic history or for genomic scans of selection. These new methods takes into account features like the allele frequency spectrum or the local density of heterozygous sites changes across the genome to estimate demographic parameters, or are able to detect alleles that have risen to high frequency rapidly enough that long-range association with nearby polymorphisms has not been eroded by recombination. The evaluation of the performances of these methods is necessary but rather difficult, and often produce contrasting results. This is definitely a rapidly developing research area, where new approaches able to deal with conceptually simple but practically very relevant problems such as the speed of computation of simple statistics in large data sets, or with more complex issues such as the rate of false positives or the identification of the best statistics to identify selection signatures, are strongly wanted. In my thesis I tried to address some of these general problems in four different projects focused on A) the efficient estimation of population genetics statistics from large data sets using parallel computation; B1) the identification of genes in the common bean (Phaseolus vulgaris) under selection explicitly modeling the neutral demographic processes; B2) a refined version of the previous selection analysis in a smaller dataset of genes in the common bean (Phaseolus vulgaris); C) the identification of genes under selection in the lizard (Zootoca vivipara) using a consensus approach among different statistics; D) the assembly of complex genomic regions using a combined experimental approach based on Illumina and Nanopore sequencing. These approaches represent ad hoc solutions developed by exploiting the specific information available in each project.

Full textL’adiudicatio del communi dividundo iudicium e i titolari di diritti reali limitati - Abstract La presente ricerca si propone come obiettivo l’approfondimento dello studio dell’adiudicatio del communi dividundo iudicium da una particolare prospettiva, quella dei titolari di diritti reali limitati. Punto di partenza è costituito dall’analisi della funzione dell’adiudicatio nel processo per formulas e, in particolar modo, nel communi dividundo iudicium. Si procede, poi, all’individuazione dei legittimati all’esercizio dell’azione divisoria, nel tentativo di ricostruire il quadro delle categorie di soggetti cui fu concessa inizialmente l’actio communi dividundo nel diritto romano classico, distinguendoli da coloro che poterono usufruirne in via utile. Identificato il principio guida che fu alla base dell’originaria legittimazione e della successiva espansione, si evidenziano i limiti di tale espansione, mettendo in rilievo i testi che si presume essere stati corrotti dalla mano dei compilatori giustinianei. Cambiando, infine, ulteriormente punto di osservazione, si considerano i titolari di diritti reali limitati non come parti potenziali di un giudizio divisorio, bensì come destinatari degli effetti dell’adiudicatio del communi dividundo iudicium svoltosi fra comproprietari della res communis sulla quale detti titolari esercitavano i loro diritti. Si scoprirà che l’adiudicatio del processo formulare non incideva sui diritti reali limitati di chi era rimasto estraneo al giudizio, continuando tali diritti a gravare su una quota pro indiviso anche a seguito della divisione della cosa comune, giungendo alla conclusione che, per tutta l’età classica, la giurisprudenza accordò a costoro il massimo favore, salvaguardando i loro interessi anche a fronte degli effetti costitutivi della sentenza divisoria.

Full textThe research topic carried out during the three years of the PhD course is mainly focused on the study and development of Internet of Things solutions for monitoring and energy efficiency. These solutions consist of networks of smart wireless devices, on which appropriate sensors are installed for sampling electrical quantities. The research topic, is not only limited to energy monitoring, but also to monitoring environmental parameters such as: lighting, temperature, humidity, construction and structural parameters. Data measured by the different types of sensors are sent by the network to a designated cloud platform, which takes care of their storage and use through a management system developed within the research period. The latest technologies and protocols related to the Internet of Things have been studied and implemented for the development of the monitoring network. Starting from the physical and data link layer of the ISO/OSI protocol stack, implemented with the IEEE 802.15.4 standard, proceed with the network layer using the IPv6 protocol, then with the transport described by the TCP and UDP protocols, up to application layer where HTTP and CoAP protocols are used. Using the developed monitoring system, experiments on the field were conducted in different application scenarios, not only in the context of industrial energy monitoring but also in the lighting and structural monitoring context. In order to evaluate the realized Internet of Things system, specific tests were conducted to analyze the performance obtained.

Full textLa ricerca in oggetto si è prefissata, quale scopo immediato, quello di indagare l’incidenza del criterio dell’utilitas contrahentium sul regime della responsabilità nei contratti reali gratuiti di comodato e deposito, nell’intento di contribuire alla ricostruzione storico-giuridica dell’utilitas contrahentium nel diritto romano classico, attraverso l’analisi delle fonti classiche e postclassiche in materia. L’esame delle fonti della Collatio legum Mosaicarum et Romanarum e del Digesto – cui è dedicato il capitolo terzo – ha permesso di evidenziare come l’utilitas contrahentium sia una regola casistica, la cui enunciazione prende le mosse dai contratti gratuiti di comodato e deposito: depongono in tal senso, in particolare, Coll. 10.2.1 e D. 13.6.5.2. Anche dall’analisi dei passi gaiani – specialmente, Gai 3.205-207, D. 13.6.18 pr. e D. 44.7.1.4-5, cui è dedicato il capitolo quarto –, è emerso come gli stessi riguardino esclusivamente i contratti di comodato e deposito. L’esame dei brani gaiani presi in considerazione ha mostrato come il canone dell’interesse non sia mai espresso in termini di utilitas, che compare per la prima volta nei passi di Modestino e di Ulpiano (rispettivamente, Coll. 10.2.1-3 e D. 13.6.5.2-3). Tale circostanza, tuttavia, non può far dubitare della ravvisabilità nei primi del criterio in questione: ad esso, semplicemente, ci si sarebbe riferiti attraverso l’uso di parole diverse, come commodum in Gai 3.206, o gratia in D. 13.6.18 pr. e in D. 44.7.1.5. Il mero dato letterale, allora, non può aver avuto un peso decisivo nella ricostruzione della teoria dell’utilitas, al punto da negare ogni incidenza di quest’ultima sulla determinazione dei criteri di imputazione della responsabilità contrattuale prima dell’età tardoclassica, in cui si collocano i contributi di Ulpiano e Modestino. Piuttosto, attraverso la valorizzazione di alcune testimonianze indirette – in particolare quelle contenute in D. 13.6.5.3, in D. 19.2.31 e in D. 50.17.23 – si è rilevato come quello dell’interesse fosse un canone di cui già si servivano i giuristi repubblicani, come Quinto Mucio Scevola, il cui pensiero è riportato da Ulpiano in D. 13.6.5.3, e Alfeno Varo, a cui è attribuita la paternità di D. 19.2.31; nonché quelli del primo principato, come Sabino, a cui si fa risalire il contenuto di D. 50.17.23. A ciò si aggiunga la constatata incomprensione del criterio in esame nelle epoche successive: sono state evidenziate le medesime incongruenze in Coll. 10.2.1-3 e in D. 30.108.12, nei quali si scorge un tentativo di generalizzazione, che si rivela però inevitabilmente imperfetta, della regola dell’utilitas. Quest’ultima, che nasce come regola casistica, conserva tale natura, rifuggendo ogni tentativo di teorizzazione. La menzione dell’utilitas nelle fonti, dunque, è destinata progressivamente a perdersi, come dimostrato dal fatto che alla stessa si fa espresso riferimento in D. 13.6.5.3 e in D. 19.2.31 – il cui contenuto è riconducibile a due giuristi repubblicani – mentre non è più nominata, ma è di certo presupposta, in D. 50.17.23: tali osservazioni, che muovono dal presupposto dell’autenticità dei brani presi in considerazione, hanno costituito lo spunto per concludere che tale canone era già ai tempi di Sabino ben radicato, al punto da rendere superflua ogni sua espressa menzione. A scomparire non sarebbe stata la regola dell’utilitas, che è rimasta sempre ben presente ai giuristi e sottesa ai discorsi sulla responsabilità, ma la sua espressa enunciazione. Questa circostanza, come è stato detto, trova spiegazione in relazione all’emersione, sul piano processuale, dei giudizi di buona fede – si è notato (nel capitolo terzo), infatti, che tra la seconda metà del I secolo a.C. e l’inizio del II secolo d.C. le formule in ius di buone fede, prima del deposito e poi del comodato, vanno ad affiancare quelle pretorie in factum –, il cui definitivo affermarsi comporta il venir meno della necessità di esplicitare il criterio sostanziale dell’utilitas, la cui considerazione può dirsi ormai inglobata in quelli. L’esistenza dell’originario legame tra l’utilità e la gratuità si accompagna al dato, anch’esso attestato dalle fonti, per cui i rapporti ai quali l’operatività dell’utilitas viene progressivamente estesa rientrano nel novero dei iudicia bonae fidei. Come si è visto, i rapporti obbligatori elencati in Coll. 10.2.1-3 e in D. 13.6.5.2-3 danno tutti luogo a giudizi di buona fede; inoltre, in D. 30.108.12 Africano, richiamandosi a Giuliano, stabilisce un collegamento diretto tra contractus bonae fidei e utilitas. Ne è emerso che, proprio grazie al carattere flessibile della buona fede, i prudentes potevano graduare diversamente la misura della responsabilità delle parti, pur in relazione al medesimo tipo contrattuale, qualora il criterio dell’utilitas giustificasse la diversa soluzione. Full textProblems with data that have a natural origin require specific data analysis techniques. In this thesis we develop new mathematical and computer science models to work, specifically, with data with natural origin, and we apply them to the study of water, food, and atmospheric resources. Specifically, we focus on designing dynamic pre-processing techniques seen as multivariate optimization problems, to improve the performance of learning algorithms and the interpretability of their results. We obtain a comprehensive methodology that includes feature selection, outlier detection, lag selection and, in a limited way, feature engineering, and we give it a mathematical formalization, which allows us to study its properties and generalizations. At the other end of the optimization process we use classical regression, classification and clustering algorithms, and we focus on evolutionary algorithms (specifically, the well-known algorithm NSGA-II) to perform the optimizations themselves. By applying our method, in general we obtain more relevant and interpretable results than those already existing in literature, and we are able to solve problems that could not be tackled with classical tools. To show that our methods can be applied to a variety of real-world situations, we consider problems of environmental pollution, characterization of aquifers, detection of illegal fishing, characterization of medieval buildings, and identification of local-production olive oils; all such problems, and their data, come from existing, real, and current projects of different nature.

Full textThis research project aims to investigate covariation understood not only as the ability to visualize two or more magnitudes while co-varying simultaneously (Thompson & Carlson, 2017), but in a broader epistemological sense, as the ability to grasp relationships of invariance between two quantities. The need to better characterize more complex forms of reasoning performed by students in mathematical modelling activities, led us to introduce second-order covariation, a form of covariation that consists in describing relations in which not only variables are involved but also parameters (Arzarello, 2019). These enable to represent families of relationships between variables that is classes of real phenomena characterized, from a mathematical standpoint, through parameters, which determine the specificities of the mathematical model. The discussion of this theme arises not only from research needs in the field of Mathematics Education, i.e., the existence of a theoretical framework only partially useful to describe the covariational reasonings of students, but above all by its relevance in terms of teaching practices. There is a wide literature showing that in mathematical modelling situations the ability to reason covariationally is essential because it allows to visualize the invariant relationships that exist between quantities involved in dynamic situations (Thompson, 2011). The indications for teaching mathematics in high schools (MIUR, 2010) underline the relevance of introducing mathematical modelling as a representation of classes of real phenomena. However, despite the acknowledged relevance of covariation for the learning of numerous mathematical concepts, in the National Indications, as well as in most textbooks, references to this approach are generally absent. The teachers themselves have little knowledge of covariation and therefore struggle to introduce it into their teaching practices. The data analyzed in this project come from three didactical experiments developed in some classes of a scientific high school and whose aim is the mathematical description of some real situations: specifically, the motion of a ball along an inclined plane and the relationship between temperature and humidity described in the so-called psychrometric diagram. Using appropriate technological tools, the students were guided in deriving a mathematical formula that described such phenomena and in recognizing the different role played by variables and parameters in the writing and reading of different registers of mathematical representations. Students' reasoning processes and the evolution of the different semiotic aspects (spoken, gestural, representational) involved in the teaching-learning processes were analyzed; as well the support of technology and the role of the teacher in enhancing covariational reasoning through appropriate adaptive teaching strategies, were considered. This study led us not only to the elaboration of a broader theoretical framework, which consistently includes second-order covariation, but also to hypothesize the existence of a third-order covariation. In addition, some research studies complementary to the main one described above, allowed us to explore the theme of assessment of covariation as a form of conceptual understanding and to elaborate a mathematical interpretation of the covariation construct using category theory (MacLane, 1978) and the cognitive mechanisms of conceptual blending (Fauconnier & Turner, 2002).

Full textThe recent European legislation on real estate credit for consumers has obliged the Italian legislator to specifically introduce into our legislation a hypothesis of Patto Marciano. This proves that the European Union (EU) has an interest to legislate in the field of collateral in order to pursue its target of harmonisation and integration of the single market, and therefore can directly intervene. This also shows that the Italian collateral system is out-dated and requires a radical change, starting from the most notorious collateral: the mortgage. Monitoring the needs of the market actors and the European trends in the field, one finds out that to make the whole mortgage system more efficient, the mortgage regulation must be updated in its spe-cial and accessory nature. The aim of the present work is to understand what can be done in the Italian law, waiting for the EU to regulate directly on the matter. We will start with a verification of the compatibility with our legal system of a mortgage with a mitigated accessory nature, capable of being assigned independently of the credit. Having ascertained that there are no legal reasons against such an effect, it is nevertheless concluded that an intervention of the legislator is necessary for this purpose, as this result cannot be achieved by interpretation. Following a careful analysis of the disciplines of the Euromortgage and of the French hypothèque re-chargeable - both institutions endowed with considerable flexibility - and drawing from them, an at-tempt is made, finally, to reconstruct a possible regulation of this new transferable mortgage, which balances the interests of all parties potentially involved in such an operation.
