Abstract:
The monograph is devoted to the legal mechanism of implementation and the social consequences of the application of amnesty. The conducted research makes it possible to really assess the effectiveness of the amnesty, as well as to determine the directions of its improvement. The formulated conclusions and proposals complement and develop theoretical and legal knowledge in the field under study. The author's classification of amnesties has been developed, which may predetermine the conduct of separate studies for each of the types. The concept of "relapse of amnestied persons" is formulated, the signs of the amnesty act are established, the priority of the penological (penal) component in the characterization of the personality of a potentially amnestied person is justified. Separate ways of improving the mechanism of amnesty implementation in the Russian Federation are highlighted, taking into account the experience of foreign countries and modern achievements of criminal law, criminology and penal enforcement law. For students, postgraduates and teachers of law schools and faculties, as well as a wide range of readers interested in amnesty issues.

The monograph is devoted to the study of the problem of determining the permissible limits of copyright restrictions on works of science, literature and art. Limitations of exclusive rights to copyright objects, as well as their protection, have a serious impact on the formation of the general cultural context of the intellectual space and the socio-economic development of society as a whole. The free use of copyright objects acts as one of the key creative incentives and is of fundamental importance for balancing the interests of participants in legal relations arising in connection with the creation and use of works. An attempt has been made to carry out a comprehensive analysis of international, foreign and domestic experience of legal regulation in the field under consideration, covering both theoretical and practical aspects, in the context of historical retrospect and taking into account current trends in the development of modern copyright. A wide range of issues related to the functioning of the mechanism for limiting exclusive copyrights, modeling the system of criteria used to assess the permissibility of restrictions within the Romano-Germanic and Anglo-American legal traditions are considered. Special attention is paid to the development of new approaches to understanding possible ways to adjust the current legal regulation (many proposals for improving civil legislation are reflected). Based on the study of the limits of limitation of exclusive copyrights, the conceptual foundations for the formation of a restrictive mechanism have been developed, as well as a system of factors of fundamental importance for determining the nature of its functioning has been formulated. This article describes quantum methods used to study proteins and nucleic acids: Hartree–Fock all-electron approaches, density-functional theory approaches, and hybrid quantum-mechanics/molecular-mechanics approaches. In addition to an analysis of the electronic structure, quantum-mechanical approaches for simulating proteins and nucleic acids can elucidate the cleavage and formation of chemical bonds in biochemical reactions. This presents a computational challenge, and a number of methods have been proposed to overcome this difficulty, including enhanced temperature methods such as high-temperature molecular dynamics, parallel tempering and replica exchange. Alternative methods not relying on the knowledge a priori of the final products make use of biasing potentials to push the initial system away from its local minimum and to enhance the sampling of the free-energy landscape. This article considers two of these biasing techniques, namely Blue Moon and metadynamics.

Abstract:
This article examines the THz emission from high-temperature superconducting (HTS) cuprates in the mesoscopic state using the intrinsic Josephson junction model. Cuprate superconductors are high-temperature superconductors that exhibit exotic electromagnetic properties. One of the remarkable features of HTS cuprates is high anisotropy due to their layered structures. Almost all HTS cuprates are composed of stacks of CuO2 layers and blocking layers which supply charge carriers to the CuO2 layers. The crystal structures of the HTS cuprates naturally form Josephson junctions known as intrinsic Josephson junctions (IJJs). This article first describes the basic theory of IJJ and the mechanism of THz emission before discussing the effect of temperature inhomogeneity on the emission properties. It then introduces a novel IJJ-based THz emitter that utilizes laser heating. Theoretical results show that the THz emission is caused by the strong excitation of transverse Josephson plasma waves in IJJs under a direct current bias.

In a chemical system with many chemical species several questions can be asked: what species react with other species: in what temporal order: and with what results? These questions have been asked for over one hundred years about simple and complex chemical systems, and the answers constitute the macroscopic reaction mechanism. In Determination of Complex Reaction Mechanisms authors John Ross, Igor Schreiber, and Marcel Vlad present several systematic approaches for obtaining information on the causal connectivity of chemical species, on correlations of chemical species, on the reaction pathway, and on the reaction mechanism. Basic pulse theory is demonstrated and tested in an experiment on glycolysis. In a second approach, measurements on time series of concentrations are used to construct correlation functions and a theory is developed which shows that from these functions information may be inferred on the reaction pathway, the reaction mechanism, and the centers of control in that mechanism. A third approach is based on application of genetic algorithm methods to the study of the evolutionary development of a reaction mechanism, to the attainment given goals in a mechanism, and to the determination of a reaction mechanism and rate coefficients by comparison with experiment. Responses of non-linear systems to pulses or other perturbations are analyzed, and mechanisms of oscillatory reactions are presented in detail. The concluding chapters give an introduction to bioinformatics and statistical methods for determining reaction mechanisms.

A form of analysis that combines realism and constructivism presents a ‘distinctive and beneficial’ approach to the study of issues of war and peace – one that runs throughout Freedman’s work and is consciously present in Strategy, where social theory is favored and rational actors are demolished. The chapter discusses each concept, including the constructed character of realism, and attempts to bring them together, arguing that necessity is the quality that sits at the heart of a constructivist realist approach, where the socially generated character of issues and sober acknowledgement that power (and other empirical realities) combine to offer an approach with which flux and stasis in international society and international security can be profitably studied in policy-friendly ways.

Creativity is at the vanguard of contemporary capitalism, valorized as a form of capital in its own right. It is the centrepiece of the vaunted ‘creative economy’, and within the latter, the creative industries. But what is economic about creativity? How can creative labour become the basis for a distinctive global industry? And how has the solitary artist, a figment of Romantic thought, become the creative entrepreneur of twenty-first-century economic imagining? Such questions have long provoked scholars interested in economics, sociology, management and law. This book offers a fresh approach to the theoretical problems of cultural economy, through a focus on intellectual property (IP) within the creative industries. IP and its associated rights (IPR) are followed as they journey through the creative economy, creating a hybrid IP/IPR that shapes creative products and configures the economic agency of creative producers. The book argues that IP/IPR is the central mechanism in organizing the market for creative goods, helping to manage risk, settle what is valuable, extract revenues, and protect future profits.. Most importantly, IP/IPR is crucial in the dialectic between symbolic and economic value on which the creative industries depend: IP/IPR hold the creative industries together. The book is based on a detailed empirical study of creative producers in the UK, extending sociological studies of markets to an analysis of the UK’s creative industries. Abstract:
The monograph should be seen as an attempt to present changes affecting the category of family farm owners in Poland over the last 70 years, since the end of World War II. These changes brought significant social transformations, including the dismantling of the landowner class (who had large agricultural farms in their possession), moving the state border westward and changing the multiethnic Polish society into one close to ethnic homogeneity. The main goal of this reflection is to recount ways in which family farms coped with various unfavorable forces and factors in order to remain in operation. One could say that the entire study can be viewed as a manifestation of the well-known phrase that served as the title of the James C. Scott book (1990): Domination and the Arts of Resistance. The monograph presented here refers to these analyses stemming from another edition of sociological research, completed within the framework of the MAESTRO project financed by the National Science Center of Poland. The main goal of the project was to depict the functioning of agricultural family farms as the traditional sector of agriculture in Poland in the contemporary context of globalization processes. The farms were examined in terms of the principles of sustainable development as well as flexibility and resilience in reaction to various crises. The monograph is divided into four essential parts. The first part is devoted to the theoretical issues and methodological groundwork for the entire publication. The second part of the book aims to capture the changes that took place from 1994 to 2017, which was an adequate period to encompass the changes and metamorphoses that mostly happened as a result of two things: the regime transformation which began in 1990, and Poland’s accession to the European Union on May 1, 2004. The third part deals with the crucial issues of regional variations, mostly in regard to life strategies and strategies of operating agricultural farms. Finally, there is a fourth part which places the focus on select themes, such as rural lifestyles, food safety and security, farmers’ utilization of new computer and IT resources, and the potential for socio-political mobilization.
