Esszémben John Rawls mára kanonikus státusba került politikaelméleti főművét abból a szempontból faggatom, hogy a radikális, illetve metafizikai rosszat miként tudja kezelni. Az első részben bemutatom, hogy a Könyv miért releváns a politikai teológia számára, s hogy a rossz lényegét miért és hogyan kapcsolja össze az önbecsülés megsértésével. A második részben Jonathan Swift nevezetes Gulliveriádájának negyedik utazását használom a rawlsi elképzelés mélyebb vizsgálatához. A lovak társadalmának működése ugyanis meglepően pontosan tükrözi az igazságosságelmélet föltevéseit. Swift segítségével azonban pontos különbséget tudunk tenni a rossz három síkja – a természetes, a kívülre helyezett és a belső, kitéphetetlen rossz – között, sőt, azt is beláthatjuk, hogy a rawlsi politikai teológiai megoldások a rossz kezelésére súlyos implicit veszélyeket hordoznak, végső soron pedig kudarcot vallanak.

Abstract:
In A Theory of Justice, John Rawls’s first argument for the inherent stability of a well-ordered society seeks to establish that citizens of such a society would come to share the same or similar senses of justice. In his late work, Rawls significantly revised his second argument for stability, but he repeatedly pronounced himself satisfied with the first. However, the pluralism that so drastically reoriented Rawls’s mature theory also creates destabilizing forces absent in Theory. These destabilizing forces suggest that a shared sense of justice among citizens will be more difficult to achieve. This paper examines Rawl’s late theory in detail to reconstruct how Rawls, despite his stated satisfaction, addressed the destabilizing effects of pluralism through revisions to his first argument for stability. It argues that in his late theory Rawls no longer claims that a well-ordered society could achieve inherent stability. Instead, a more fragile stability is achieved through a disciplined commitment to public reason.

Abstract:
In A Theory of Justice (1971) John Rawls attempted to solve the problem of distributive justice by combining self-interest, ignorance and risk-aversion. He argued that if self-interested persons in a situation of uncertainty imposed by a veil of ignorance were choosing principles for the basic structure of society, then they would be risk-adverse and choose two principles – The Principle of Equal Liberty and the Difference Principle. Critics have argued against this risk-adverse element of Rawls’ theory but those critics as well as Rawls made certain presuppositions about risk-aversion, risk-taking and gambling. This thesis also examines the risk-aversion in Rawls’ theory but addresses the previous shortfall by exploring the issue of risk and gambling in two interrelated ways. It applies a Foucauldian approach to the history of risk and gambling in order to contextualise the current views and then investigates the contemporary meaning by drawing on research leading up to the UK Gambling Act 2005. Drawing on these findings it argues that not only might risk-taking occur in the original position but that different types of participants could show different degrees of risk-taking behaviour. By exploring the theoretical debates between essentialism and anti-essentialism, it further argues that it is unlikely that the veil of ignorance would be able to screen out those differences. It then employs theories of identity and difference in the work of Heidegger, Deleuze and Lyotard in an attempt to overcome that weakness in Rawls’ theory but finds that this may not be possible. After highlighting a connection between impartiality and gambling, it concludes, in contrast to Rawls, that risk-taking rather than risk-aversion lies at the heart of social justice. The implication of this reversal is that it may have an impact on policy-decisions in other areas of the justice system.

Abstract:
There is a tension within liberalism between the ideal of equality on the one hand and the respect for freedom (in the form of non-interference) on the other. I shall try to show that in liberalism?s efforts to simultaneously realize its goals of freedom and equality it must ultimately settle for less than the ideal of each. Since Rawls? theory of justice is a liberal one, it suffers from this tension as well. However Rawls? theory has also been accused of forcing some members of society to subsidizing the choices of others. I shall argue that one of the more recent attempts to defend his theory, by Walter Schaller, against such accusations, falls short of its goals. I shall also argue that Rawls? suggestion, in Political Liberalism, that a principle guaranteeing a social minimum ?may easily precede? the principle guaranteeing the basic liberties, should be rejected because it does not provide adequate protection of the basic liberties, especially freedom of the person.

Esta dissertação tem como finalidade verificar em que medida a teoria da justiça, constituída na obra de John Rawls apresenta elementos suficientes para uma compreensão do direito. Assim, o ponto-chave da pesquisa será o locus do direito na filosofia da justiça de Rawls, a fim de explicitar elementos próprios do direito que encontram-se implícitos na sua teoria da justiça e no liberalismo político, demonstrando que a filosofia da justiça, bem como o seu liberalismo político, tem implicações para o direito. Nessa perspectiva, esta dissertação busca uma interpretação do direito na obra de Rawls. Em especial nos textos de Uma Teoria da Justiça, O Liberalismo Político, O Direto dos Povos e Justiça e Democracia. Desta forma, busca-se em primeiro lugar compreender os conceitos básicos da teoria da justiça, bem como as suas interações. Num segundo momento, expõe-se o tema do liberalismo político, no qual se faz uma análise dos principais eixos da tese rawlsiana. Cabe ressaltar que já nestes capítulos são levantados alguns indícios da necessidade de um aparato jurídico. Por fim, busca-se compreender o direito dentro da teoria rawlsiana com uma exposição dos temas diretamente relacionados ao direito, a concepção de estado de direito e a necessidade de obediência às leis. Frente a tais análises, é possível destacar que a teoria da justiça como eqüidade, proposta por Rawls, contém elementos, ainda que implícitos, suficientes para uma compreensão do direito. Destaca-se, ainda, que a teoria da justiça de Rawls tem alguns elementos que configuram tanto uma filosofia quanto uma teoria do direito, pois é perceptível que a teoria da justiça necessita do direito como complemento para garantir a estabilidade de uma sociedade plural bem-ordenada, uma vez que o consenso sobreposto por si só não oferece essa garantia. Assim, conclui-se que Rawls apresenta uma relação de complementaridade entre a justiça e o direito, dessa forma, a justiça forneceria ao direito a sua legitimidade contida nos princípios de justiça e o direito forneceria à justiça a eficácia contida no poder de coagir.

Abstract:
Globalization, the coalescence of the economies and cultures of this planet, has raised new ethical issues. Information Technology (IT) is an enabler of globalization, but IT also produces new ethical problems. There is already a substantial literature in philosophy and political theory on globalized ethics, but not much on IT’s special impact on globalized ethics. This paper is a sketch of the main argument of a book I am writing on this topic. I first give examples of to show how these IT-enabled global ethical problems come about. Then, in the second and third parts of the paper I briefly summarize the main theories of globalized ethics and show their inadequacies in dealing with IT-enabled global ethical problems. In the final part, I sketch a social contract approach which can begin to deal with these IT-enabled global ethical problems. This approach derives from the work of John Rawls (1999a) on justice.

Virtue ethics is not typically invoked by academics today for the evaluation of political systems or political action. We could, however, recognize its potential role in this regard, turning to the history of its use as illustration. Interpreters who have attempted to theorize about political rights apart from moral psychology fail to recognize the support the underlying moral psychology provides to the notion of rights. Contemporary objections to the use of ethical theory in justifying rights may assume political theory is adequate enough when kept in terms that abstract away from any particular aspects of moral psychology. Yet a virtue-based approach to political system recognizes the desires for freedom, the risk of preferences being subsumed into a consequentialist assessment, and more readily enables agents themselves to assess what is necessary to condemn political systems as well as political efforts, such as the Russian invasion of Ukraine. Abstract:
The black rail (Laterallus jamaicensis) is the most secretive of the secretive marsh birds and one of the least understood species in North America. On the east coast, eastern black rails historically bred in tidal and freshwater marshes along the Atlantic coast from Massachusetts, south to Florida. Within the mid-Atlantic region suitable black rail habitat is concentrated in the high marsh along the upper elevational zone of salt marshes. This zone is dominated by salt meadow hay (Spartina patens), saltgrass (Distichlis spicata), and is often interspersed with shrubs such as marsh elder (Iva frutescens) or saltbush (Baccharis hamilifolia). North Carolina has been a stronghold for eastern black rails within the mid-Atlantic region, with the marsh complexes associated with the lower Pamlico sound supporting one of largest concentrations and highest densities of eastern black rails throughout their range. However, even within these marshes, eastern black rail populations have experienced declines marked by reductions in occupied sites and decline in numbers within historic strongholds. Evidenced by increasing confinement to the highest portions of the high marsh in recent years, sea-level rise and increased rates of high marsh inundation are likely a major contributing factor to declines. With the population of eastern black rails declining over 75% in the last 10-20 years, the U. S. Fish and Wildlife Service formally listed the eastern black rail as threatened under the endangered species act on 9 November 2020 (USFWS 2020). To fulfill the need for information to guide management decisions on projects at Cape Lookout and Cape Hatteras National Seashores and to aide in (potential?) future designations of critical habitat, we conducted widespread, systematic surveys for black rails and other secretive marsh birds within the parks during the breeding seasons of 2022 and 2023. A total of 1,222 surveys were conducted at 431 points over the course of 2 years. In addition to recording detections of all focal species, we recorded detections of 6 eastern black rails on North Core Banks where they were not previously known to occur. The population of black rails occupying the high marsh habitat on North Core Banks could account for 5-10% of the North Carolina black rail population and increase the known sites occupied within the state.
