Abstract Wetlands worldwide require significant restoration, especially through environmental water allocations. This article examines the Ramsar Convention (Ramsar) and the Convention on Biological Diversity (cbd) to ascertain whether they require an obligation to restore wetlands by such means. While both conventions contain a general obligation to restore, that obligation appears too uncertain, due to either the disputable status of the language of the text (Ramsar) or the qualifying language expressing it (cbd). The Ramsar obligation, arguably, amounts to a legal obligation that is potentially enforceable in the icj against another contracting party. The article recognizes that the obligation is practically difficult to enforce because: the Convention does not provide a formal dispute settlement procedure; the obligation is derived from guidance in numerous Conference of the Parties resolutions, and is subject to certain exceptions. Further, there is a judicial reluctance to find that the facts prove a breach of the obligations and warrant a remedy. The authors argue, however, that restoration goals are, in fact, achievable through Convention amendments or by an additional protocol.

Abstract:
We review the mechanisms established by the Ramsar Convention for reporting on the status and change in the ecological character of wetlands. We assess the extent of their implementation and compliance, but not issues of the adequacy of their design nor the consequences of their extent of implementation. We conclude that, with the exception of qualitative national-scale reporting in triennial Contracting Party National Reports, there is inadequate implementation and compliance with most of these mechanisms, notably concerning required reporting under Article 3.2 of the Convention and the updating of the Information Sheet on Ramsar Wetlands (RIS). This limits the ability of the Convention to assess the status, and trends in status, of designated Wetlands of International Importance (Ramsar Sites), and to inform future decision-making and priority-setting for the wise use of all wetlands. As has been recognised by the Ramsar Convention, unless compliance with these mechanisms is improved, sufficient information will not be gathered through the mechanisms of Ramsar Convention to assess fully the Sustainable Development Goal 6.6.1 indicator supported by the Convention on change in the extent of water-related ecosystems over time.

Abstract:
Wetland and waterfowl protection has become a major concern of the Indian Government recently. Among the 300 or so wildlife sanctuaries and national parks in India, wetland habitat is under-represented. There are nearly 20 bird sanctuaries, but only two wetlands—Bharatpur and Chilka—are listed under the Convention on Wetlands of International Importance especially as Waterfowl Habitat (Ramsar Convention). There is certainly great scope to add more sites to the Ramsar list of wetlands. The author has identified one candidate—Dihaila Jheel in Madhya Pradesh state—and exciting new initiatives are now being taken to protect and manage it with a view to recommending it as a Ramsar site.

We assessed trends in the ecological character of wetlands generally and of Ramsar Sites reported in 2011, 2014 and 2017 by the Contracting Parties to the Ramsar Convention on Wetlands in their national reports. There was more widespread deterioration than improvement in the ecological character of wetlands generally, with deterioration increasingly more widespread between 2011 and 2017. The ecological-character trends in Ramsar Sites were significantly better than those of wetlands generally, but an increasingly more widespread deterioration of ecological character was reported between 2011 and 2017. Trends in the ecological character of wetlands generally, and of Ramsar Sites were worst in Africa and Latin America and the Caribbean, and recently also in Oceania, and better in North America and Europe. Deterioration in the ecological character of Ramsar Site was more widespread in countries with a large average area of their Ramsar Sites. This information on trends of wetland ecological character can contribute to assessing the achievement of the 2030 Sustainable Development Goal Target 6.6 and Aichi Biodiversity Target 5. Our analysis indicated that the 1971 aim of the Ramsar Convention to stem the degradation of wetlands has not yet been achieved.

The Ramsar Convention is the world’s most important international treaty governing wetland environments. Since the 1970s, the Convention has concerned itself with listing and protecting wetlands of international significance. However, in the past three decades, a focus has shifted from the identification of potential sites, towards addressing adverse changes in their ‘ecological character’. One of the few mechanisms Ramsar has at its disposal for achieving this is the Montreux Record (MR). The MR, first established in 1990, is a kind of ‘in danger’ list for Ramsar sites that have undergone, are undergoing, or are likely to undergo, adverse ecological change. Unlike other in-danger lists, such as, for example, under the World Heritage Convention, the MR is entirely voluntary and not deployed as a disciplinary measure or reputational sanction. The empirical research presented in this paper shows the declining use and importance of the MR. The paper provides an analysis of the composition and use of the MR from 1990 to 2018 and generates recommendations for how it might be used more effectively. The findings in this paper are significant, given the rapid declines of many Ramsar sites around the world.

It is the purpose of this article to analyze the implementation of the Ramsar Convention 1971 on the peatland ecosystem protection and management at Tanjung Puting National Park, Central Kalimantan, and related to how Government efforts and policy to prevent the degradation of peatland since it was established as Ramsar Site in Indonesia.IntisariKetentuan-ketentuan dalam Konvensi Ramsar telah dilaksanakan dan ditransformasikan ke dalam peraturan perundang-undangan di Indonesia. Dalam praktiknya, masih ditemukan peraturan-peraturan yang tidak sinkron, sehingga belum dapat melaksanakan komitmen pemanfaatan lahan basah secara bijaksana dan berkelanjutan. Upaya pencegahan degradasi gambut harus dilaksanakan secara holistik dengan mengikutsertakan masyarakat dan mengintensifkan sosialisasi agar tercipta sense of belonging, dan ownership. Abstract:
The Ramsar Convention on Wetlands is an international framework through which countries identify and protect important wetlands. Yet Ramsar wetlands are under substantial anthropogenic pressure worldwide, and tracking ecological change relies on multitemporal data sets. Here, we evaluated the spatial extent, temporal change, and anthropogenic threat to Ramsar wetlands at a national scale across China to determine whether their management is currently sustainable. We analyzed Landsat data to examine wetland dynamics and anthropogenic threats at the 57 Ramsar wetlands in China between 1980 and 2018. Results reveal that Ramsar sites play important roles in preventing wetland loss compared to the dramatic decline of wetlands in the surrounding areas. However, there are declines in wetland area at 18 Ramsar sites. Among those, six lost a wetland area greater than 100 km2, primarily caused by agricultural activities. Consistent expansion of anthropogenic land covers occurred within 43 (75%) Ramsar sites, and anthropogenic threats from land cover change were particularly notable in eastern China. Aquaculture pond expansion and Spartina alterniflora invasion were prominent threats to coastal Ramsar wetlands. The observations within China’s Ramsar sites, which in management regulations have higher levels of protection than other wetlands, can help track progress towards achieving United Nations Sustainable Development Goals (SDGs). The study findings suggest that further and timely actions are required to control the loss and degradation of wetland ecosystems.

This dissertation provides a descriptive-analytic study of the reasons and influences underlying Japan's less than progressive policy record on wildlife preservation, domestically and globally, since 1980. This research is important for a number of reasons, but mainly it helps us to test a number of theoretical models about: policy-making in Japan; Japanese environmental diplomacy; social movements; and corporatism. I hypothesise that apart from a common sense of purpose that binds the different policy actors together, Japan's poor record on wildlife preservation is a derivative of the way environmental NGOs have been marginalised and excluded from the policy process. This hypothesis links to Japan's public safety, and food and economic security concerns whereby these concerns tend to frame and guide policy-making on wildlife and nature issues. Using case study and participant observation methodologies to gather empirical evidence, this dissertation analyses both Japanese state behaviour towards global and domestic wildlife issues, and the changing relationships between the Japanese state, foreign pressure and environmental NGOs, in order to confirm or deny the hypothesis. The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and the Ramsar Convention are the two environmental regimes which provide the context and issues for the analyses. The research concludes that there is convincing evidence to support the hypothesis. The research also reveals the positive, although subtle, sea changes which are occurring in Japanese environmental politics in the light of the continuing changes taking place in both Japan's broader political economy and in the international community.

La pollution phytosanitaire diffuse est un enjeu majeur à l'interface de l'agriculture et l'environnement. Ses conséquences sur la santé humaine et l'environnement ont poussé la société à interroger les scientifiques sur les outils d'aide à la décision et d'évaluation adéquats. Dans cette perspective, ce travail interdisciplinaire entre géographie et agronomie porte sur la mise en place d'outils pour une gestion concertée de la pollution phytosanitaire diffuse au niveau d'un territoire: la Merja Zerga au Maroc. Dans le cadre d'une approche participative, ce travail est basé sur l'utilisation conjointe et interactive de plusieurs outils interdisciplinaires: les Systèmes d'Informations Géographiques (SIG), l'indicateur de fréquence de traitement (IFT), un indicateur de risque de toxicité sur la santé de l'applicateur (IRSA) et environnementale (IRTE), une plate-forme technico-économique et un jeu de simulation par lesquels sont exploitées les données issues de la recherche bibliographique, des relevés de terrain et d'enquêtes auprès des acteurs du territoire. Les résultats de l'analyse multi-échelle du territoire ont permis de mettre en exergue la construction de l'espace du territoire de la Merja Zerga, les conséquences des pratiques phytosanitaires sur la santé humaine de l'applicateur et l'environnement, l'iniquité spatiale et sociale en terme de propension à polluer. En dépassant la simple évaluation, cette approche basée sur des outils génériques, constitue une étape originale pour la mise en place de stratégies de gestion des pesticides sans nuire à la viabilité économique des exploitations agricoles.

South Africa is a signatory to the Convention on Wetlands of International Importance especially as Waterfowl Habitat of 1971 (referred to as the Ramsar Convention), which is an international convention making provision for protection and wise use of wetlands. Article 3 of the Ramsar Convention requires signatories to formulate and implement their planning to promote wise use of wetlands within their jurisdiction. “Wise use of wetlands” is defined as “the maintenance of their ecological character, achieved through the implementation of ecosystem approaches, within the context of sustainable development” (Birnie & Boyle, 2009: 674). The concept of wise use has been interpreted to mean sustainable development (de Klemm & Shine, 1999: 47; Birnie & Boyle, 2009: 49; Kiss & Shelton, 2007: 93; Birnie & Boyle, 2009: 674; Sands, 2003: 604), as it pertains to wetlands. Having said this, the National Environmental Management Act 107 of 1998 (NEMA) sets out principles of sustainable development that every organ of state must apply in the execution of their duties. Due to the wise use-sustainable development link, two NEMA principles have been considered to form the basis of this study, i.e. sections 2(4)(l) and 2(4)(r). The first principle places an obligation upon the state to ensure that there is intergovernmental coordination and harmonisation of policies, legislation and action relating to the environment (read to include a wetland); and the second principle is to ensure that specific attention in the management and planning are had to wetlands. Ironically, factors that are identified as hindering wise use include, but are not limited to: conflicting and incomplete sectoral law, absence of monitoring procedures, the absence of legal measures for environmental management of water quantity and quality. Therefore, an analysis will be undertaken to determine the extent to which South Africa’s legislative framework regulating wetland conservation is fulfilling the requirements for the promotion of wise use, through these two principles. Focus was had to environmental and related legislation, policies and regulations that promote and/or constrain wetland conservation and wise use. This study identifies the flaws within the law; and proposes streamlining and, where apposite, amendments to the existing legislative framework regulating wetlands in order for South Africa to fulfil her obligations.

Le Pacte international relatif aux droits civils et politiques et les Conventions américaine et européenne des droits de l'homme autorisent des " restrictions ", des " immixtions " ou encore des " sanctions ", ou consacrent un droit " dans les conditions prévues par la loi ". Les organes internationaux de contrôle compétents confirment cette faculté laissée aux Etats d'entraver l'exercice effectif de certains droits de l'homme. Le fondement de ce pouvoir de restriction et les cas dans lesquels il est reconnu et admis permettent de démontrer son caractère protecteur pour les droits et libertés concernés. De conception unitaire, ce type d'ingérence répond à une définition autonome et implique un régime juridique tendant à s'uniformiser. Le contrôle international des conditions de licéité applicables est d'intensité variable, mais l'analyse des différents degrés de cet examen montre qu'il n'est jamais laissé carte blanche aux Etats, même quand une marge d'appréciation leur est accordée
The International Covenant on Civil and Political Rights and the American and European Conventions on Human Rights authorize " restrictions ", " limitations " or even " penalties ", or recognize a right " under the conditions as prescribed by law ". The competent international control bodies confirme this possibility for states to undermine the effective exercise of certain human rights. The search of the foundation of this power of restriction and the cases under which it is recognized and admitted allow us to demonstrate the protector aspect of this power for the concerned rights and freedoms. This kind of interference constitutes a unitary conception, meets with an autonomous definition and implies a legal regime tending to standardization. The intensity of the international control of the lawful requirements differs from one to another, but we are never facing a situation allowing to give States free hand (carte blanche), even when a margin of appreciation is recognized to them

L'Eurafrique, thème à la mode dans l'après 1945, est vue comme la nécessaire traduction de la complémentarité entre l'Europe et l'Afrique. Le projet comporte aussi bien une dimension politique, économique que stratégique. Aussi, en cette période de reconstruction de l'Europe, la France y voit l'occasion de faire partager à l'Europe son destin africain. Le marché commun qui naît à Rome en 1957 se voit ainsi doté d'une inclinaison africaine; le régime d'association et la convention d'application. Les Territoires associés, désormais EAMA après les indépendances se prononcent pour la poursuite de l'Association et, est, ainsi signée la Convention de Yaoundé en 1963. Les EAMA entendent élargir à toute l'Afrique le bénéfice de la coopération avec l'Europe économique. Dès lors, la Convention de Yaoundé de 1969 apparaît comme une transition. Et l'élargissement de l'Europe à Neuf (Danemark, Irlande et Grande-Bretagne) coïncide avec la Convention de Lomé en 1975 avec les pays ACP (Afrique, Caraïbes et Pacifique). Désormais, le partenariat remplace l'Association dans la relation Europe-Afrique. L'acte de solidarité de l'Europe à l'Afrique française est motivé par l'interdépendance économique. L'Afrique est ainsi vue comme source de matières premières nécessaires à l'Europe, tandis que cette dernière, par sa maîtrise de la technologie, des sciences et la détention du capital financier est considérée comme un partenaire essentiel et incontournable pour son développement économique, social et culturel.

As we move toward the end of the 20th century, we see the burgeoning of Sustainable Development rhetoric, which resulted in a paradigm shift from polarizing environmental protection and human’s utilization of natural resource, to realizing that human activity is an integral part of the very environment our past effort is trying to protect. This shift is especially interesting when set against the background of wetlands. Wetland is a vibrant, complex and dynamic ecosystem, having a myriad of ecological functions that mirrors ecological services which have been long utilized by the human society. It is then particularly interesting to ask, when we try to construct a regulatory regime for wetland conservation, would the values of this new paradigm be adequately reflected? What type of challenges might be posed to our existing ways of establishing environmental law? Through legal process analysis, this thesis examines separately the Ramsar Convention and Taiwan’s Wetland Conservation Act, an international regime and a domestic regime. This thesis argues that Taiwan’s Wetland Conservation Act has incorporated to a certain degree, the core the regulatory elements enshrined in the Ramsar Convention. However, this incorporation process is an incomplete one. Particularly, in the regulation forming stage and later on, the effectuating stage of the formed regulations. Taiwan’s Wetland Conservation Act has failed, in some aspects, to deliver and accommodate the regulatory concepts embedded in the Ramsar Convention due to the local context of its environmental movement which caused it to turn too quickly to legislation for regulatory solution, and its failure to monitor and absorb the growth and development of the managerial rhetoric which continue to abound in the international convention.

У роботі розглянуто теоретичні аспекти та методичні положення дослідження водно-болотних угідь, динаміка їх чисельності у світі та Україні. Встановлено відповідність водно-болотного угіддя рамсарським критеріям та встановлення типу ВБУ.
Qualification work is devoted to the analysis of wetlands within the Sumy region. The paper considers the theoretical aspects and methodological provisions of the study of wetlands, the dynamics of their numbers in the world and in Ukraine. The Seimske wetland is proposed as a promising land of international importance. The detailed description according to methodical recommendations is made. The compliance of the wetland with the Ramsar criteria and the establishment of the type of wetlands.

The Kiziltashsky limans are the largest water bodies of land-to-sea interface zone of the Krasnodar region Black Sea coast separated from the Black Sea by Anapa bay-bar. Their territory is included in the Perspective list of the Ramsar Convention as a unique wetland of international importance. Currently, the main type of recreational use of the liman water area is active rest. A diversity of natural conditions, a small degree of economic transformation of the landscape in combination with good transport access makes it possible to combine the active recreation forms with health-improving rest at the Anapa resort. In the presented paper the different proposals for economic use of the Kiziltashsky limans are analysed in terms of influence to geoecosystem.

According to the definition of the International Union for Conservation of Nature and Natural Resources (IUCN), wetlands on Earth are areas that are flooded or saturated with water, artificial or natural, permanently or temporarily flooded with standing, sitting or running water. These areas include areas where water is the predominant element, such as swamps, wetlands, peatlands, estuaries, sea branches and lagoons, lakes, rivers and artificial reservoirs with a depth of more than six meters. Considering the importance of these territories and with the deep conviction that the preservation of their flora and fauna can be ensured by combining long-term national policy with coordinated international action, the scientific community reacted to the encroachments and unreasonable attitude to them by concluding 02.02. 1971 of the Convention on wetlands of international importance, especially as waterfowl habitats, known to the general public as the Ramsar Convention. The main objectives of this document are to manage wetlands as sites of great economic, cultural, scientific and conservation value, to avoid damage and loss and to preserve them through prudent use, i.e. through their continuous development. The object of study in the present work is the biological diversity, in particular the avifauna of some of the internationally important wetlands in the border areas between Bulgaria, Greece, the Republic of North Macedonia and Albania in view of the opportunities they offer for the development of some forms of alternative types of tourism.

Abstract:
Palic and Ludas lakes are located in the northern part of Vojvodina, Serbia near the town of Subotica, just a few kilometers south of the Hungarian border. While Palic lake has a long history as a tourist attraction and a nice recreational setting, Ludas lake and the surrounding steppe plains are habitats of international importance and protected by the Ramsar convention on wetlands. The lakes are connected through the Palic-Ludas canal. Thus Ludas lake is fed partially from Palic lake, but also supplied by the Körös river. The majority of the catchment area of the Körös river is in Hungary, this way the water supply problems related to the lakes are transboundary. The lake system is also drained by the Körös, which finally enters the Tisza river. Water quality problems and water quantity decrease are both identified and are escalating threatening factors at the lake system in the past decades. Several studies have been carried out in the past about the possible reasons and solutions. The authors have studied the previously published results and have been participating in a cross-border cooperation project funded by the IPA, in frame of which a comprehensive survey and measurement program has been carried out in order to develop, among others, a rainfall-runoff model of the catchment for the investigation of water supply scenarios of the lake system in order to substantiate a monitoring network and program for the sustainable management of the lakes. In our article we introduce the area, the problem, the field surveying and measurement methodologies and results, the modeling process and the model itself, concluding transboundary responsibility for water supply to the lake system, with a possible complex connection to one of Hungary’s major water management issues.

Commercially available handheld chemical analyzers for forensic applications have been available for over a decade. Portable systems from multiple vendors can perform X-ray fluorescence (XRF) spectroscopy, Raman spectroscopy, Fourier transform infrared(FTIR) spectroscopy, and recently laser-induced breakdown spectroscopy (LIBS). Together, we have been exploring the development and potential applications of a multisensor system consisting of XRF, Raman, and LIBS for environmental characterization with a focus on soils from military ranges. Handheld sensors offer the potential to substantially increase sample throughput through the elimination of transport of samples back to the laboratory and labor-intensive sample preparation procedures. Further, these technologies have the capability for extremely rapid analysis, on the order of tens of seconds or less. We have compared and evaluated results from the analysis of several hundred soil samples using conventional laboratory bench top inductively coupled plasma atomic emission spectroscopy (ICP-AES) for metals evaluation and high-performance liquid chromatography (HPLC) and Raman spectroscopy for detection and characterization of energetic materials against handheld XRF, LIBS, and Raman analyzers. The soil samples contained antimony, copper, lead, tungsten, and zinc as well as energetic compounds such as 2,4,6-trinitrotoluene(TNT), hexahydro-1,3,5-triazine (RDX), nitroglycerine (NG), and dinitrotoluene isomers (DNT). Precision, accuracy, and sensitivity of the handheld field sensor technologies were compared against conventional laboratory instrumentation to determine their suitability for field characterization leading to decisional outcomes.

The detection limit of 2,4,6-trinitrotoluene (TNT) and ammonium nitrate (AN) in mixtures of Ottawa sand (OS) was studied using a Raman microscope applying conventional calibration curves, Pearson correlation coefficients, and two-sample t-tests. By constructing calibration curves, the conventionally defined detection limits were estimated to be 1.9 ± 0.4% by mass in OS and 1.9 ± 0.3% by mass in OS for TNT and AN. Both TNT and AN were detectable in concentrations as low as 1% by mass when Pearson correlation coefficients were used to compare averaged spectra to a library containing spectra from a range of soil types. AN was detectable in concentrations as low as 1% by mass when a test sample of spectra was compared to the same library using two-sample t-tests. TNT was not detectable at a concentration of 1% by mass when using two-sample t-tests.
