This paper proposes an address authentication method based on a user’s location history. Address authentication refers to actual residence verification, which can be used in various fields such as personnel qualification, online identification, and public inquiry. In other words, accurate address authentication methods can reduce social cost for actual residence verification. For address authentication, existing studies discover the user’s regular locations, called location of interest (LOI), from the location history by using clustering algorithms. They authenticate an address if the address is contained in one of the LOIs. However, unnecessary LOIs, which are unrelated to the address may lead to false authentications of illegitimate addresses, that is, other users’ addresses or feigned addresses. The proposed method tries to reduce the authentication error rate by eliminating unnecessary LOIs with the distinguishing properties of the addresses. In other words, only few LOIs that satisfy the properties (long duration, high density, and consistency) are kept and utilized for address authentication. Experimental results show that the proposed method decreases the authentication error rate compared with previous approaches using time-based clustering and density-based clustering.

The article is focused on the analysis of the legal category of police officers’ presumption of innocence. Accordingly, the purpose of the research is to provide comprehensive characteristics of police officers’ presumption of innocence, taking into account international practice of its formation and development. To achieve this purpose, the author has formulated the following tasks: 1) study of the historical aspect of the origin and formation of police officers’ presumption of innocence, including within the qualification immunity of police officers; 2) analysis of the practice of applying qualification immunity in the United States of America; 3) objective reveal of the content and essence of police officers’ presumption of innocence; 4) outlining the possibilities of introducing the police officers’ presumption of innocence into the legislation of Ukraine.
The expediency of introducing police officers’ qualification immunity (police officers’ presumption of innocence) is based on a number of arguments, in particular: police officers need qualification immunity to perform their professional duties: they perform important tasks that may require immediate decisions in stressful situations, but lack of qualification immunity may lead that police officers do not dare to act when it is most needed; lack of qualification immunity can lead to unjustified police trials, when judges and jurors can review decisions, may lead to significant budget expenditures; police officers do not have absolute immunity and can be prosecuted for violating clearly established constitutional rights, despite the perspective of the availability of qualification immunity; police officers should not be forced to apply “abstract law”, i.e. those provisions that are not explicitly provided in the current legislation, but follow from its provisions, to specific circumstances, we cannot expect from police officers to be scholars in law sphere and use legal arguments during the arrest; police officers should be able to act professionally without worrying about prosecution.

La question à savoir si la Loi sur l’aménagement et l’urbanisme est une loi de centralisation ou de décentralisation divise la doctrine. À l’heure où l’Union des municipalités du Québec profite de la première grande révision de cette loi pour réclamer une disposition proclamant que c’est une loi de décentralisation, l’étude qui suit entend répondre à cette question. Pour ce faire, l’auteur expose d’abord les raisons d’être de la décentralisation (démocratie, libéralisme et diversité identitaire) et définit certains concepts (centralisation, décentralisation et semi-décentralisation). Il se penche ensuite sur le contenu de cette loi et sur les réponses apportées par la doctrine. À la lumière des raisons d’être de la décentralisation et d’évolutions dans la doctrine française et la jurisprudence québécoise, l’auteur suggère qu’une qualification de cette loi jamais envisagée par la doctrine, soit celle de « semi-décentralisation », conviendrait davantage. En conclusion, il expose des modifications législatives qui pourraient faire évoluer cette loi sur l’axe centralisation-décentralisation.

Based on the analysis of scientists’ scientific views, the meaning of the concept of “qualification” has been revealed. It has been found that the qualification is a complex characteristic of the employee, which includes the presence of the appropriate level of education, as well as professional skills, abilities, skills, experience in performing certain processes and actions, which together characterize them as an experienced subject of a certain type of work. In fact, qualifications are a factor that determines whether a person can perform a job, such as serving in the police.
Emphasis is placed on the fact that the initial professional training provides an initial level of qualification, which allows to work quite efficiently and comfortably in the bodies and units of the National Police of Ukraine, but the personnel prospects of such employees are truncated.
An analysis of the current legislation, which determines the legal basis for training and retraining of employees of the National Police of Ukraine has been carried out. The peculiarities of training and advanced training of police officers at higher education institution have been revealed.
It has been established that the training of a police officer is an additional element of his/her professional training, which takes place in parallel with his/her main service activity and is aimed at its improvement. As part of in-service training, skills and abilities are developed, as well as the knowledge of a police officer is supplemented in order to ensure that he/she performs his/her duties even more efficiently and effectively. In addition, professional development affects the career of a police officer, as the results of such training are properly designed and recorded in the personal file. It has been stated that the qualification of the employee is inextricably linked with the process of their professional training, acquisition of new skills, abilities, as well as the acquisition of special knowledge. The study of the legal framework has showed that the wider the level of education a police officer has, the higher his/her value to the bodies and units of the National Police of Ukraine. Taken together, these factors allow them to compete with other police officers in terms of professional prospects and opportunities to hold senior positions.

Introduction L'objectif de l'étude était d'effectuer un sondage auprès de parents canadiens sur leurs attitudes et leurs croyances au sujet de la législation du port du casque chez les cyclistes et de comparer les réponses des parents vivant dans une province ayant légiféré dans ce domaine et celles de ceux vivant dans une province n'ayant pas légiféré. Méthodologie Un sondage national a été réalisé auprès de 1 002 parents d'enfants âgés de moins de 18 ans. Des tests du chi-carré ont été utilisés pour comparer les réponses des parents dans les différentes provinces. Résultats Les réponses des parents vivant dans une province ayant légiféré (n = 640) ou ne l'ayant pas fait (n = 362) s'établissent respectivement comme suit : sont préoccupés par les accidents de vélo (63 % et 68 %, non significatif [NS]); croient que le port du casque de vélo est une mesure efficace (98 % et 98 %, NS); l'enfant porte toujours un casque de vélo (74 % et 69 %, NS); sont favorables à une loi visant les enfants (95 % et 83 %, p $lt; 0,001); sont favorables à une loi visant les cyclistes de tous âges (85 % et 75 %, p $lt; 0,001); sont favorables à l'application de la loi par les services de police (83 % et 76 %, p = 0,003); croient que la loi réduit la durée d'utilisation de la bicyclette par leur enfant (5 % et 8 %, NS). Conclusion Les parents sont largement favorables à la législation du port du casque chez les cyclistes au Canada. Ils croient que le casque de vélo est une mesure efficace et que la loi n'a pas pour effet de réduire la durée d'utilisation de la bicyclette par leur enfant. Ils sont également largement favorables à une loi visant les cyclistes de tous âges et à l'application de la loi par les services de police.

Le projet de loi bioéthique témoigne d’un changement de paradigme de la filiation. En effet, le projet de loi prévoit la levée de l’anonymat du donneur à la majorité de l’enfant issu du don. Toutefois, le législateur ne prévoit aucun régime juridique particulier qualifiant la relation qui unie le donneur et l’enfant issu du don. Il procède dès lors à une qualification négative pour une situation qui entraine pourtant des conséquences juridiques importantes. On s’interroge alors sur la nature de ce lien et sur les potentielles conséquences induites par la levée de l’anonymat, conséquences à la fois juridiques et sociales. Cet article permettra alors de dissocier la notion de filiation et l’émergence progressive du droit d’accéder à ses origines.

This article analyses the decisions on public policy contained in the Kluwer Arbitration database. The database includes more than 1,000 cases. Objections based on public policy have been raised in 44% of recognition and enforcement proceedings and in 38% of setting aside proceedings. The success rate of these objections was low, 19% and 21%, respectively. This article discusses the decisions in which these objections were successful, distinguishing between the three International Law Association categories: (i)‘violation of fundamental principles, procedural public policy, or substantive public policy’; (ii) ‘loi de police’; and (iii) ‘violation of international obligations’ (though there were no successful objections in this category). En ce sens — que nos développements justifieront, nous l'espérons — la qualification a toujours été négociée, ne serait-ce que par la signature d'accords de classification. Si développement il y a, il a été très progressif: l'accord interprofessionnel sur la formation continue date de 1970 (faut-il rappeler que l'intérêt de certaines entreprises pour la formation est bien antérieur ?), la préoccupation pour l'amélioration des conditions de travail s'est affirmée au début des années 70 et a abouti à un accord interprofessionnel en 1975. L'usage à des fins de conversion des institutions de formation s'est progressivement développé. La loi de 1971 sur la formation professionnelle et les accords qui l'ont prolongée ont confirmé le rôle des comités d'entreprise dans l'examen des plans de formation professionnelle. En principe, les parties à un contrat de distribution peuvent choisir librement la loi applicable à leur contrat. Mais, à défaut de choix par les parties, la loi applicable est désignée par les systèmes de conflit de lois nationaux. Pour déterminer la loi applicable aux relations fournisseur et distributeur, l’auteur analyse et compare les règles de droit international privé de différents pays et celles de conventions internationales. Il dégage une nette tendance à l’application de la loi du pays où est situé l’établissement professionnel du distributeur. Il soulève la question de l’impact que peuvent avoir certaines lois de police sur les relations entre les parties. Quant à la loi applicable au pouvoir de représentation, il aborde l’épineux problème du mandat et de la protection des tiers qui traitent avec le distributeur, face aux limites posées par le fournisseur au pouvoir de représentation du distributeur. Sur ce point, il constate que les droits internes divergent sensiblement et il expose la règle de conflit retenue par une convention internationale. L’auteur termine en étudiant les perspectives d’harmonisation du droit matériel en matière de distribution par le biais de conventions internationales.

This article presents preliminary findings from a longitudinal study contributing to the current debate about police education and professionalising the police in England and Wales. The findings in this article are taken from a survey administered in 2016 to third-year students enrolled in a policing degree. Surveys were distributed to police officer students in the last year of their degree programme asking for their perceptions of the degree, their organisation's support for their learning and how they felt that learning was utilised in their workplace. Supplementary to the survey, interviews were conducted with the students after their graduation in 2018. The research findings suggest that students perceived the benefits of obtaining a degree-level qualification as fundamentally important to their professional development and personal decision-making at work. Early support initially received for study leave purposes, rarely extended beyond this practical provision. The extent to which police organisations valued the learning from the degree was perceived to be lacking. Senior-ranked students were more likely to be able to use and promote their newly acquired skills and knowledge in the workplace compared with lower-ranked students. Such findings may inform scholars’ and practitioners’ continued evaluation of police education reforms in England and Wales.

Underlining the application of forensic science methods in police investigations is investigators’ perceptions of the methods. The premise is that a positive perception indicates a willingness to apply forensic science in criminal investigations, regardless of prior forensic training. This study compared common sociodemographic markers with regard to perceptions of forensic science application in criminal investigations among investigating police officers in Nigeria, controlling for forensic training. The six sociodemographic markers were: gender, age, marital status, highest educational qualification, rank, and years in service. The survey used a self-administered questionnaire for data collection. Based on a total population of 3771 investigating police officers, a sample size of 347 was determined using Krejcie and Morgan’s formula ( Krejcie RV and Morgan DW (1970) Determining sample size for research activities. Educational and Psychological Measurement 30(3): 607–610). A potential 20% dropout rate was added giving a sample size of 416. No difference was found across the sociodemographic markers with regards to the perception of forensic science utilization in criminal investigations ( p > .05), except for the highest educational qualification ( p = .008) and rank ( p = .042) of the respondents. The perception score was higher in the primary school category than in the secondary school and diploma certificate categories. Comparison between the categories secondary certificate and degree/HND certificate indicated a statistically significant lower perception score in the secondary certificate category. The perception score was lower in the diploma category than in the degree/HND certificate and postgraduate categories. For police rank, pairwise comparison showed that the officer category had a higher perception score than the constable category. There was also a statistically significant higher perception of forensic science among inspectors than among constables. It is recommended that educational qualification and rank should be considered when deploying police personnel to the criminal investigation department.

The subject of the study is the analysis of the state of professional training of police officers, first employed, in a specific educational organization of the Ministry of Internal Affairs of Russia in the North-Western region. The purpose of the work is to evaluate the results of the survey of police officers upon arrival and surveys upon completion of training (training), entrance control, as well as to conduct a statistical analysis of the results of qualification examinations (final attestations) upon completion of training (training). The conducted research has shown that it is necessary to make significant changes to the vocational training (training) programs, content, forms, means, methods and technologies of training (training) in order to prepare a police officer for the effective performance of professional tasks. The duration of the existing training (training) of police officers, who were first recruited, is on average from 3-4 to 5-6 months. Such a short period of time objectively affects the state of vocational training (professional training) of police officers in a specific educational organization of the North-Western region. The actual state and reliability of the results of qualification examinations (final attestations) police officers upon completion of the existing professional training in the educational organization of the Ministry of Internal Affairs of Russia was confirmed in the study by the use of methods of mathematical processing of results (methods of primary statistics): arithmetic mean, sample averages, error of representativeness of the sample average and coefficient of variation.

Le maire aurait dû être un acteur essentiel dans la lutte contre la Covid-19 au regard de ses compétences en matière sanitaire entrant dans le cadre de ses pouvoirs de police administrative. L’histoire, déjà, le justifiait. La loi des 16-24 août 1790 confiait aux maires des attributions de police en matière sanitaire, texte qui fut le fondement de l’article L. 2212 du CGCT habilitant le maire à prendre toute mesure pour assurer la salubrité publique. D’autres textes furent pris dans ce sens. Cependant, aujourd’hui, c’est l’État qui a renforcé ses pouvoirs en matière de police sanitaire. En fin de compte, les maires sont restés cantonnés à une fonction de complément au rôle de l’État, sous le contrôle du juge administratif.

Abstract This article explores perceptions of individuals involved in an early attempt to professionalize detective work in Kent, UK. In 2000, Kent Police developed a Strategic Policing Doctrine incorporating a learning and development strategy. These ideas resulted in a partnership between Kent Police and Canterbury Christ Church University producing the Advanced Detective Training (ADT) programme including a university qualification, the BSc (Hons) in Applied Criminal Investigation delivered between 2001 and 2006. This research, conducted in 2016, used semi-structured interviews with 27 participants including: trainers, academic staff, students, and the Chief Constable. The research revealed that there were challenges in the selection of candidates, use of the term ‘advanced’ in the programme title and the abstraction of ADT trainees. A very high proportion of ADT officers valued the ‘training’ part of the programme with the majority valuing the ‘academic input’. This research provides a useful analysis of previous attempts to develop detective professionalization and accredited learning relevant for programme designers responding to the introduction of the Police Education Qualification Framework and direct entry and fast track detective training.

L’auteure désire susciter la réflexion du juriste sur un aspect particulier de la nouvelle loi fédérale traitant des infractions imputées aux adolescents. Il s’agit d’une question qui, bien qu’elle revête une grande importance, a été presque complètement passée sous silence : la qualification d’une infraction, selon qu’elle est sans violence ou avec violence. C’est que le législateur a choisi de mettre de côté la définition de ces expressions, tout en décidant de continuer de s’y référer. Or, il en découle d’importantes répercussions pour les adolescents sur deux plans. D’abord, selon qu’il est déterminé que l’infraction imputée aux adolescents est comprise au sens de l’un ou l’autre de ces vocables, il est présumé que la prise de mesures extrajudiciaires sera suffisante pour faire répondre les adolescents de leurs actes délictueux ou, a contrario, qu’elle sera insuffisante. Ensuite, le tribunal pour adolescents est autorisé à imposer une peine comportant le placement sous garde de l’adolescent qui a notamment été reconnu coupable d’une infraction commise avec violence. Ainsi, la qualification de l’infraction comporte des enjeux de taille, car elle ouvre (ou non) la porte aux mesures extrajudiciaires plutôt que de recourir au tribunal et elle autorise (ou non) le placement sous garde. Inévitablement, la nouvelle loi amènera avec elle son lot d’incertitudes pour la prochaine décennie. Il reste à espérer que ce ne seront pas les adolescents qui en feront les frais.

Attention is drawn to the fact that the assessment of the legitimacy of the actions of police officers is important not only for qualifying their actions, but also for the behavior of persons against whom these coercive measures were applied, regarding the presence in their actions of signs of a crime under Article 318 of the Criminal Code of the Russian Federation. It is concluded that such law enforcement errors lead to the fact that employees of the internal affairs bodies use firearms only in the most extreme cases, often only when there is an immediate threat to the life and health of the employees themselves. This situation is explained by the unwillingness of the policeman to be accused of illegal use of weapons. The relevance of the issue follows from the data of sociological surveys: it is emphasized that in the criminal law assessment of the use of physical force, special means and firearms by police officers, their compliance with the provisions of the Federal Law of February 7, 2011 no. 3-FZ “On the Police”. The problem of the practical application of the Federal Law of February 7, 2011 no. 3-FZ “On the Police” and the Criminal Code of the Russian Federation is those cases where the provisions of the Federal Law of February 7, 2011 no. 3-FZ “On the Police” restrict the rights of police officers to use physical force, special means and firearms, while it is necessary and recognized as lawful based on the provisions of the Criminal Code of the Russian Federation.

Une récente proposition législative de la province de Québec sur la sécurité privée –Loi sur la sécurité privée– nous a servi de point de départ pour répondre à deux objectifs, soit tenter de définir l’objet « sécurité privée » et comprendre les liens qu’entretient cette sécurité privée avec l’État et la police. Une analyse de la littérature grise accompagnant cette loi (mémoires déposés à l’Assemblée nationale du Québec et consultations particulières de la Commission des institutions) nous a permis de décrire les divers morcellements de la sécurité privée, ainsi que la difficulté à la circonscrire clairement, les frontières l’entourant étant larges et poreuses. En outre, notre analyse a mis en lumière certaines spécificités de l’État dans la gouvernance de la sécurité – soit sa capacité à légiférer et à légitimer – qui continuent à peser sur l’industrie. Enfin, il est observé que l’industrie de la sécurité privée ne tente pas tant de se substituer à la police que de se construire une place à part, qui lui soit propre et, si est possible, libre de toute contrainte.

Abstract: Article 7(2) of the 1980 Rome Convention provided that nothing in the Convention shall restrict the application of the rules of the law of the forum in a situation where they are mandatory irrespective of the law otherwise applicable to the contract. The Rome Convention however did not define these 'overriding mandatory provisions'. The absence of a definition gave rise to a controversy between French and German courts. According to the latter, overriding mandatory provisions only protect public interests in a strict sense. However, French courts may consider a provision that exclusively protects the interests of the weaker party as an overriding mandatory provision. The definition of 'overriding mandatory provisions' provided in Article 9(1) Rome I fails to bring any real legal certainty. Since the controversy between the French and German courts essentially relates to the systematic relationship between overriding mandatory provisions and connecting factors protecting a weaker party in the Rome I Regulation, an intervention by the European Court of Justice will be necessary. Dans ce cadre, la chambre criminelle de la juridiction suprême a rendu une douzaine d’arrêts touchant la vente de l’écorce de quinquina et le commerce de la quinine. Cette jurisprudence a renforcé la monopole des pharmaciens contre les épiciers, les droguistes et les herboristes, clarifié le droit relatif à la contrefaçon de marques de fabrique et contribué à distinguer les médicaments des boissons, ainsi que de nombreux produits d’hygiène.

While explaining the reasons for unethical behaviour among police personnel, with emphasis on training and education, the role of emotions is often neglected. This study clarifies the role of emotions in reducing unethical work behaviour by examining the influence of emotional intelligence and self-regulation on attitude towards unethical work behaviour among a sample of the Nigerian police personnel. The study adopts an ex-post facto research design to collect data from two hundred and t:.’tittv-five police personnel at Ogun State Police Headquarters, Eleweran, Abeokuta. A questionnaire consisting of four sections, for measuring emotional intelligence, self-regulation, attitude towards unethical work behaviour and demographic variables, was the instrument of data collection. Two hypotheses were tested using the stepwise multiple regression analysis and 2×2 analysis of variance (ANOVA). The results revealed that emotional intelligence, self-regulation, age, educational qualification and gender were significant predictors of attitude towards unethical work behaviour (R2: 0.66; I; (5, 219):5.66; p < .001) accounting for sixty-six percent of the variance in attitude towards unethical work behaviour. The independent predictions also showed that emotional intelligence (B:-.44; t: -5.9; p< 0.001), self-regulation (B:-.27′ t: -2.3; p<0.001), age (B=’.16′ r:-2.2; p<0.01), educational qualification B:-.15; t:-2.2; p<0.01) and gender (B: t:-2.1; p<0.01) contributed significantly to variance in attitude towards unethical work behaviour. Lastly, there was a significant influence of emotional intelligence and self-regulation on attitude towards unethical work behaviour (F [1, 221]:18.40; p<.001). These findings have implications for personality assessment of police recruits in order to reduce unethical work behaviour.

Thus, in the article, on the basis of generalization, the practice of qualification requirements for persons of law enforcement specialists is considered. It is considered how, since the reform of the new police of Ukraine, the requirements for law enforcement officers have increased. (2) In order to realize the civil servant career development strategy, Indonesian National Police must first compile types of structural and functional positions specifically intended for civil servants to clarify the position of career paths for civil servants in Indonesian National Police by applying 3 (three) other aspects according to Mondy's theory (2005) which includes educational qualifications, competencies and optimal performance to ensure that the management of civil servants resources in Indonesian National Police is carried out properly. Based on the analysis and synthesis of the experience of investigators from the National Police, the Security Service of Ukraine, as well as prosecutors on the de-occupied territories of Ukraine, four basic problematic subject areas with the corresponding typical situations of the law on criminal liability application have been identified: criminal legal qualification of artillery shelling, mining, causing death to a person, and other actions of physically detained representatives of the aggressor state. For each zone and situation, the main approaches to the qualification of documented criminal offenses and other events used in law enforcement practice have been identified. A critical analysis of these approaches has been carried out, shortcomings are identified, and ways to eliminate them are proposed.

En ce qui a trait à leur exécution, ils ne bénéficient ni de la force obligatoire des conventions ni de leur effet relatif lorsque, au-delà du couple, des enfants sont touchés. AbstractThe Norwegian Police University College is required to regularly evaluate and ensure the quality of the education in order to maintain its accreditation as an institution of higher education. A central aspect of this quality control is to make sure that the education is relevant for the field of practice and the policing profession. The Police University College has therefore on three occasions since 2006 sent out a survey to police officers three years after graduation and asked them to evaluate the relevance of the education in general, and more specifically to evaluate their own qualifications in different areas of competence. A similar questionnaire was sent to the supervisors of the post-graduates to get a broader comparative perspective.
The overarching aim of this article is to find out to what degree newly educated police officers and their leaders perceive the police education to provide a sufficient preparation for the police profession. To shed light on this question we will present and analyse data from the “quality surveys” mentioned above, but mainly from the 2015 survey. Overall, the findings presented in the article suggest thatboth the newly educated police officers and their leaders generally perceive the education to provide a sufficient preparation for the police profession. However, the leaders tend to give a better score than the newly educated police officers both overall and on specific qualification. Moreover, when looking into specific areas of competences we find that both groups tend to give the lowest scores on physical and operational qualifications such as use of firearms. A discussion of possible causes and implications of the findings is included in the article.

The need to introduce into the system of primary professional training the training of service skills using drones is substantiated. On the basis of the study of the content of the training program for unmanned aircraft systems of the first class according to the basic qualification level of the first level, it is proposed to introduce the general professional educational unit “formation of skills and skills of controlling an UAV” into the training program of the primary professional training of police officers in the specified specialty.

C’est d’abord et avant tout en invoquant l’insécurité provoquée par le phénomène des groupes de motards que les policiers vont, dès 1947, mener à l’égard de ces groupes une offensive qui se poursuit encore partout en Amérique du Nord. Or, depuis très peu de temps, des éléments nouveaux au dossier permettent de mettre à l’épreuve cette réputation. L’article montre à quel point la réputation construite par les services de police à l’égard des motards semble de moins en moins résister à l’épreuve de ces faits. Pourtant les policiers continuent à s’acharner contre les motards. Est-ce à cause du degré de marginalité affiché par eux ? Ou cet antagonisme pourrait-il être l’expression d’un conflit culturel larvé entre deux clans qui se ressemblent nettement plus qu’il n’y paraît au premier abord ?

La notion de no-fault qu'on a commencé à utiliser pour l'assurance automobile aux États-Unis dans les années soixante, est devenue courante dans les discussions portant sur les accidents de la circulation en Europe dans les années soixante-dix. Le sens de l'expression « assurance pour responsabilité sans faute » restait cependant à être clarifié. Une qualification qui paraissait admise voulait qu'une véritable assurance sans faute signifie l'abandon de la responsabilité civile individuelle. Lorsqu'une nouvelle loi sur les dommages résultant des accidents de la circulation a été adoptée en Suède en 1975, la responsabilité civile du conducteur n'a pas été abolie. Néanmoins, une lecture de la loi a permis d'y découvrir un régime de no-fault. En bref, la loi a pour objet de faire glisser l'assurance automobile obligatoire vers un régime de responsabilité stricte pour l'assureur, pendant que la responsabilité civile du conducteur envers les tiers est maintenue. Mais comme la responsabilité civile du conducteur n'est jamais recherchée, en pratique, le poids de l'indemnisation est dirigé du côté de l'assurance. Avec ce système, un conducteur qui a, par exemple, percuté un arbre peut recevoir une réparation intégrale du préjudice qui en résulte. Sa propre faute ne le prive pas du droit à la réparation. A titre exceptionnel, une faute grave ou intentionnelle ou encore une conduite en état d'ébriété peut avoir pour effet de modifier le niveau d'indemnisation. Les règles de la responsabilité civile ont également été appliquées en ce qui concerne l'évaluation des indemnités. Les liens avec le droit de la responsabilité civile entraînent des problèmes mais, dans l'ensemble, le système suédois d'indemnisation fonctionne bien dans ce domaine.

C’est l’œuvre de Balzac qui signe véritablement l’entrée de la justice en littérature, laquelle fournit la matière d’une multitude d’intrigues. Nostalgique d’une société organique dont il réfère la perte à l’événement révolutionnaire, Balzac conçoit la justice rapportée à ce moment, synonyme pour lui de bascule d’une société de droit à un ordre de fait que symbolise le contrat, garant d’un nouveau pacte social dont La Comédie humaine passe au scalpel tous les dysfonctionnements. Dès lors, la justice dit-elle le droit ? Pas sûr, à lire les avertissements que professe le duc de Chaulieu dans Les Mémoires de deux jeunes mariées : « Il n’y aura plus que des lois pénales ou fiscales, la bourse ou la vie ». Et l’on peut d’autant plus en douter à voir Vautrin devenir chef de la police ce que le précédent de Vidocq ne peut suffire à expliquer : au-delà du cas particulier, ce sont bien des mutations structurelles que désignent Balzac, celles qui accompagnent l’entrée dans la société civile.

The main aspects of changes in the organization of the police in the early 1920s have been revealed. At that time there was a complex, controversial, but quite consistent formation process of the police in Ukraine as a law enforcement agency. Significant changes in the organization of the police have been noted. The functions of the police and criminal investigation were separated, which, as time proved, was a mistake. In 1923, there were changes in the structure of the police, closely related to the administrative reform in the republic. County and parish police departments were replaced by circute and district police departments. The expansion of circutes and districts had led to a corresponding expansion and strengthening of local police departments, which was positive. The number of police in 1921–1923 decreased by 20 times, which had led to negative consequences. The qualification of many police officers was low, they lacked basic literacy. In the early 1920s, the issue of further development and structure of the police, centralization and decentralization of its bodies was not sufficiently resolved. The issue of the relationship between the police and other public and private bodies was also not settled. Training in the police was not organized, the use of technical means in its activities lagged behind. However, in 1923 a number of important legal acts regulating the organization and activities of the police were adopted. These are, first of all, the Rules of Service and the Police Disciplinary Statute. In the first of the named documents, it was stated that persons who joined the police and investigation service are considered civil servants. This was of significant importance for raising the social status of police officers. According to their official status and type of activity, police and detective workers were divided into the following categories: a) regular staff, which was subdivided into command staff of the police, detectives and police officers; b) political staff; c) administrative staff; d) clerical staff; and e) non-staff personnel. The Police Disciplinary Statute was a new type of departmental legal act. It was the first to define the concept of police discipline. Incentive for integrity and strict liability for violation of official duties by police officers were foreseen. Serious violations, which were qualified as criminal offences, entailed judicial responsibility for the police officer.

Contrairement à ce qui se produit dans la théorie classique, la recherche de l’intention commune des contractants ne guide pas le processus d’interprétation de la Convention d’indemnisation directe pour le règlement des sinistres automobiles ainsi que la police d’assurance automobile standard. Créatures particulières, ces actes juridiques sont plutôt interprétés à la lumière de la loi, de la jurisprudence et de la règle contra proferentem, ce qui laisse ainsi entrevoir que la détermination de l’intention commune est davantage une question de droit qu’une question de fait. L’étude de l’interprétation de ces deux actes juridiques pourrait bien jeter les bases d’une théorie interprétative du contrat non mutuel (réglementé, standardisé, légal ou imposé).
