Full textThe feeling of power is a philosopheme used by Nietzsche between 1875 and 1888; though it has remained largely unknown, it is a full-fledged concept. It has been formulated before the concept of will to power and has not been superseded by it, contrary to what the – posthumous and falsified – publication of the eponym book based on scattered notes of the philosopher, as well as an important tradition of commentaries, might suggest. The present work is the first study dedicated entirely to the concept of feeling of power. By attending to the concept’s evolution, this study brings out its main issues without systematically bending it to the conceptual framework of the will to power. Consequently, it sheds new light on the will to power and on the connections between the two concepts. The feeling of power represents another approach, alternative and complementary to the will to power, to the phenomena of power and powerlessness in general. The notion of feeling applies what we call an affective and hermeneutical prism to power relationships: any power, whether personal or external to the individual, is felt and interpreted in a manner more or less accurate, and according to several modalities of which Nietzsche provided tacitly a typological description. Understood in this way, the feeling of power enables us to reevaluate the whole Nietzschean comprehension of the world conceived as balances of powers, alongside the key concepts of his philosophy

Full textThis is a study on the gesture of care, i.e. the fact of caring for other people and providing them with the help required. It focuses on a particular case : humanitarian action, the action conducted by organisations that intervene in emergency situations generated by conflicts or disasters. This sector of practices nourrishes and contextualises this philosophical reflection. The impulse of this work resides in the observation of a set of pitfalls of caring practices. These issues are generally perceived as abuses of power: it is either the care-reciever that is being abused (imposition of a particular form of care, lack of respect, etc.) or the care-provider (lack of recognition, manipulation, empathic distress, etc.). According to the dominant understanding, these pitfalls would find their origin in the asymetry of the caring relations. It would then be necessary to reduce, or even, to remove this asymetry. However, what would care be in the absence of this asymetry? What could the carer do if he/she was as vulnerable as the one being cared for? This thesis critiques a dominant conception of care that leads to a weakening of the carer. Not only does this understanding makes it impossible to properly respond to suffering, but it also leads to legitimising distress and vulnerability, and even, celebrating these states. Hence, this work seeks to denounce this empire of suffering and reveals its deeper roots. Furthermore, this thesis is not only a critique; it also makes a proposition, that of coming back to power of acting at the heart of the gesture of care. It shows that the source of this power resides in desire, a desire understood in a fundamental and intrinsic sense. It eventually proposes to place desire at the center of care. The vitalism and the normative and anti-dogmatic power of philosophers such as Spinoza, Nietzsche, Canguilhem and Deleuze are a source of inspiration throughout this work, as well as an empirical study conducted with humanitarian actors

Full textThe present study focused on responses of purchasing and supply chain professionals faced with certain ethical situations. Individual (personal demographics, religiosity, ethical ideologies), psychological (moral potency), issue contingent (moral intensity), and organizational (firm size, activity, code of ethics) variables are hypothesized to the four stages of ethical decision making (EDM) including perceived importance of ethical issue, recognition, judgment, and intention in a purchasing context. The current study majorly employed a quantitative experimental research design. Firstly, six purchasing scenarios representing six dimensions of moral intensity were constructed and validated through detailed discussions with purchasing experts. Moral intensity dimensions were manipulated through scenarios. Responses were collected from 364 purchasing professionals for all six scenarios by conducting a survey. Firstly, all categorical variables and manipulations were examined through ANOVA. Then overall model was then tested in a multivariate space by using SEM path analysis for all six scenarios. The variance analysis revealed significant findings for moral intensity, religiosity, ethical ideologies, and moral potency and are heterogeneous across personal and organizational demographics. Moreover, the SEM analysis largely confirmed that moral intensity and moral potency are the key antecedents to EDM stages either independently or in the nomological serially mediated framework of EDM (perceived importance, recognition, judgment, and intention). Finally, the present research concluded with future directions for researchers and implications for managers as well

Full textIn French administrative law, the organic criterion is an instrument of legal qualification dependent upon the presence of a public body in a legal relationship. Its origins date back to the 19th century in the subjectivation of the rights of public power of which the State is invested and the differentiation of the public and private bodies. Misconstrued with the criterion of public service at the beginning of the 20th century, the organic criterion gains its autonomy at the time of the "crisis" of the notion of public service which consecrates the dissociation of notions of public body and public service. This criterion, which bears witness to the institutional logic to which administrative law is associated, serves as the foundation for the construction of notions.However, the organic criterion has been the subject of strong opposition for many years. On the one hand, the "trivialization" movement which affects rights of public bodies reinforces the inadequacy of this criterion in determining the applicable law. On the other, as a result of contemporary changes to the French administrative model, the reference to this criterion has diminished. While the public body appeared in the past as the preferred mode for public action, the administration is encouraged nowadays to "outsource" its activities. Despite a phenomenon of "privatization" of administrative measures, the judge and the legislator maintain the application of special rules in absence of the organic criterion.While the administrative phenomenon now extends beyond public law, the definition of the organic criterion in administrative law remains firmly linked to the notion of public body. Several factors, however, call for a redefinition of this criterion. The functionalization of public action only partially conceals the relation between public and certain private bodies within the public sphere which nevertheless remain under close public control. It is on the basis of the notion of "public control" that a redefinition of this criterion can be undertaken in administrative law

Full textFrom the Civil Code in 1804 to the Ordonnance of Decembre 23rd, 1958, the legal protection of the child « in danger » has been revolutionized. As the Civil Code consideres the « paternal authority » (puissance paternelle) as an inviolable and sacred power of the father on his child, there is a complete absence of legal protection of the child, whether the child is a natural one or a legitimate one. The right of custody may not been taken away from the father who neglects his own child. Nonetheless, since the early 19th century, the judges had drawn the concept of « interest of the child » in order to protect him against his father's abuse of auhtority. However, because the « paternal authority » is strong, they cannot limit durably the effects of the father’s power. Then, at the end of the century, the State involves itself in the legal protection by entering at the father’s home. Indeed, the law of July 24th, 1889 instaures for the first time forfeiture parental rights when parents has commited a fault. According to this new principle, an harmful judicial policy of « all or nothing » paralyzes the child protection. Thus the infrequent legislative interventions in the 19th and 20th centuries, harming the paternal authority, are taken in the aim of protecting the interest of the State in stead of developping a real Right to the child. Consequently, the judges still work for the protection of the child by formulating pretorian theoricies. As a result of the judges’work, the interest of the child tends to be the criterion of judicial protection since the interwar years. It is not until the Ordonnance of December 1958 that intervention of the State is not based anymore on a parental fault but on the only interest of the child

Full textWe suggest in this thesis to examine the State’s modalities of action in terms of framing and control of the economic and financial sphere. This study leads us to study the concept of regulation through an epistemological, legal, economic and philosophical approach. De facto, the analysis of the functions of government proves to be essential insofar as we observe the evolution of the State’s regulatory praxis with regard to the economic doctrines and the legal and operational architecture of the institutions of regulation. The functions of securization of the economic sphere shed lights on the complex space between the regulator and the regulated entity. In this context, the study of ethical issues with the importance of the concept of contextualization in terms of the moralization of financial markets imply the confrontation of the regulatory praxis with key concepts as governmentality, categorization and performativity. Successively, guardian, regulator and strategist, the State is inserted, today in the digital age, in a fragmented and global world. Understanding the phenomenon of “co-regulation” and “inter-regulation” requires, first of all, putting into perspective the notion of responsibility and independence of actors and institutions. In this reflection, the apprehension of risk by public authorities underlines some limits both in risk models and in models of regulation
