Abstract:
This chapter describes a number of international projects in various areas: oil and gas; mining projects; conventional power; renewable energy; nuclear power projects; and the infrastructure of public and private partnerships. Oil and gas projects span a broad range of activities from upstream ‘exploration and production’ projects to downstream LNG and petrochemicals projects. The second part of the chapter begins with a brief overview of the current American, UK, French, Japanese, Korean, and Saudi Arabian power markets focusing on current electricity generation mix policies in these markets and the current and future place of conventional power therein. The text then looks at renewable energy projects. These share many of the characteristics of conventional power projects. However, there are certain crucial differences which will impact upon the contractual structure and risk allocation employed in the development of these projects. Nuclear power projects are perhaps the most challenging power/infrastructure projects to develop and finance. The chapter finally provides a discussion of the applicability of project finance principles and disciplines to a unique and challenging segment of the power/infrastructure sector.

Abstract Private international law has long been understood as a doctrinal and technical body of law, without interesting theoretical foundations or implications. By systematically exploring the rich array of philosophical topics that are part of the fabric of private international law, Philosophical Foundations of Private International Law fills a significant and long-standing void in the legal and philosophical literature. The contributions to this volume are testimony to the significant potential for interaction between philosophy and private international law. Some aim to expand and rethink classical jurisprudential theories by focusing on law beyond the state and on the recognition of foreign law and judgments in domestic courts. Others bring legal and moral theories to bear on traditional debates in private international law, such as legal pluralism, transnational justice, the interpretation of foreign legal policies, and the boundaries of the legal system. Several engage with the history of both private international law and legal and political philosophy. They point to missed opportunities when philosophers ignored law’s transnational dimensions, or when private international law scholars failed to position their theories within broader philosophical schools of thought. Some seek to complete past attempts to articulate the philosophical dimensions of private international law that were never carried through. Thought-provoking and topical, this volume displays the varied themes cutting through the disciplines of private international law and philosophy.

Investment treaties are some of the most controversial but least understood instruments of global economic governance. Public interest in investment treaty arbitration is growing, and some developed and developing countries are beginning to revisit their investment treaty policies. This book synthesizes and advances the growing literature on the investment treaty regime by integrating legal, economic, and political perspectives. Based on an analysis of the substantive and procedural rights conferred by investment treaties, the book asks four basic questions. What are the costs and benefits of investment treaties for investors, states, and other stakeholders? Why did developed and developing countries sign the treaties? Why should private arbitrators be allowed to review public regulations passed by states? And what is the relationship between the investment treaty regime and the broader regime complex that governs international investment?
