Abstract:
The recent threats to cultural heritage, including in Iraq, Mali, Nepal, Syria, and Yemen, has led to increased focus on the sources of international cultural heritage law. This volume reflects that this is not a discrete and contained body of law, but rather a diverse one whose components are drawn from—and often developed and contained within—public international law. These ‘intersections’ have formed in two ways: when public international law has been used to provide greater protection for cultural heritage; and when concern for cultural heritage protection or codification of rules within cultural heritage-centric instruments have helped fuel developments within other areas of public international law. In this volume, scholars and practitioners explore some of the primary points of intersection where international cultural heritage law and public international law converge. The contributions are organized according to five major ‘intersections’: (1) the Law of Armed Conflict and the Protection of Cultural Heritage; (2) Cultural Heritage-Based Offenses in International Criminal Law and in Laws for Combatting Transnational Organized Crime; (3) the United Nations System and the Protection of Cultural Heritage; (4) Special Legal Regimes for the World Cultural Heritage and Underwater Cultural Heritage; and (5) Intersections of International, National, and Community Interests in Cultural Heritage. The result is a diverse and cohesive collection that explores these intersections and examines how the regimes operate together and how the relationship between them largely facilitates, but also sometimes hinders, the development of international law governing the protection of cultural heritage.

Abstract:
Maritime archaeology has given rise to quite a few issues. The meaning of heritage for the society has undergone changes, and thus, ethical discussion has evolved, which is discussed in this article. Archaeological discourses include a historical review that is helpful in understanding how insights have developed. Archaeology is not uniform and archaeological heritage has been studied through different approaches and thinking. An item attributed heritage value in one part of the continent may not be regarded as the same in another part of the continent. For maritime archaeology, this national bias has been influential in several ways and it continues to be so. The principle that “heritage” is a public matter is quite central in the developing ethics of the archaeological profession. This article finally discusses the international development of a body of maritime law specifically concerning underwater cultural heritage.

Abstract:
This Handbook sets out and assesses the international legal framework governing the protection of cultural heritage. Cultural heritage is frequently not bounded by national territory and can only effectively be protected through international cooperation. This is a primary driving force of contemporary multilateral, regional, and bilateral initiatives, including legal measures. Accordingly, the Handbook is primarily focused on public international law, but it embraces also aspects of private international law and comparative law. It analyses the substance of cultural heritage protection and explores its links with other areas of public and private international law, as well as the ways in which cultural heritage law is contributing to the development of international law itself. The Handbook concludes with an examination of the implementation of cultural heritage law and of regional approaches. It reflects the diversity of developments in almost every field of international law which is leading to this specialist area of law and provides an overarching rationale for understanding and teaching cultural heritage law as a coherent body of law with key principles and practices. The book is designed in such a manner to enable a reader, whether it be a practitioner, policymaker, teacher or student, to pick and choose according their individual needs.

Abstract:
The management of a maritime cultural resource suggests control by a manager for appropriate treatment of the resource, with the objective of its protection and prevention. The advances in the technology have made underwater cultural heritage available not only to archaeologists and other scientists, but also to treasure salvors and the public. Underwater cultural heritage is protected to lesser or greater extents by various laws at the local, regional, state, national, and international levels. The United States has not ratified any of the conventions meant for the conservation of maritime heritage but has asserted sovereign rights in its territorial sea. The United States has nearly 1,800 areas in the marine environment that are reserved by federal, state, territorial, tribal, or local laws or regulations with the aim of long lasting protection of these areas. The effective management of submerged cultural resources is still a challenge to many communities and nations.

Strecker, Amy. Landscape Protection and EU Law. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198826248.003.0007.

Abstract:
Chapter 7 provides a critical overview of landscape protection in EU law. It begins by briefly outlining the impact of EU agricultural policy on European landscapes. It then moves on to ascertain the extent to which the cultural heritage dimension to landscape protection is considered within EU policy, before analysing EU environmental law, particularly environmental impact assessment directives, which include consideration of cultural heritage and the landscape. While the ELC provides for public participation, EU law requires member states to legislate not only for public participation but also for access to justice and broader standing requirements in environmental matters. The implications of this for landscape protection are explored, and some concluding observations are drawn on the role of the EU in landscape governance more broadly.

Abstract:
This book explores the various avenues—institutional, substantive, and procedural—for the protection of landscape in international law. Since the inclusion of ‘cultural landscapes’ within the scope of the UNESCO World Heritage Convention in 1992, landscape has gained increasing importance at the international level. ‘Cultural landscapes’ were intended to give recognition to the intangible and associative values attached to certain landscapes, to sustainable agricultural practices, and to ‘people and communities’—essentially the human dimension of landscape. This shift came full circle with the adoption of the European Landscape Convention (ELC) in 2000. The European Landscape Convention conceives of landscape above all as a people’s landscape and accordingly, provides for the active participation of the public in the formulation of plans and polices. It not only focuses on outstanding landscapes, but also on the everyday and degraded landscapes where most people live and work. This brings ‘landscape’ back to its early etymological origins—when it corresponded to a close up, human perspective—and has a number of implications for human rights, democracy, and spatial justice. How does international law, which deals for the most part with universality, deal with something so region-specific and particular as landscape? What is the legal conception of landscape and what are the various roles played by international law in its protection? This book assesses the institutional framework for landscape protection, analyses the interplay between landscape and human rights, and links the etymology and theory of landscape with its articulation in law.
