Abstract:
In response to the prospect of service contracting and the privatization initiatives in the City of Indianapolis, a unique partnership has evolved between labor and management that encourages both cooperation and competition between city departments and their represented employees with outside private contractors. A conceptual model was utilized to analyze the Indianapolis partnership with respect to five developmental stages of collaboration. Empirical data were collected from a questionnaire given to all employees within the Department of Public Works. These data were assessed using multivariate regression and logit analyses, and combined with insights drawn from interviews with labor and management. The results from the multivariate regression indicated that 88% of the variation in the perceived success of the Indianapolis partnership could be explained by the five stages of the conceptual model. Moreover, the regression results, when coupled with the results of the logit analyses, identified a number of critical antecedents for successful service contracting in the form of labor-management partnerships.

Abstract:
Water supply system management for providing proper services to the community is a challenge for the Government of Indonesia. The Indonesian government through the Public-Private Partnerships (PPPs) scheme involves the role of the private sector for decent, quality, and cost-effective water supply system infrastructure. This study aims to describe problems faced by the Regional water supply system PPP project initiated by business entities (unsolicited) in Indonesia. Also, describes the application of Critical Success Factors as a problem-solving strategy in the implementation of the water supply system PPP project. To express this, This research uses a case study qualitative method involving Government Contracting Agency (GCA) informants from the Ministry of X. Data were collected through semi-structured interviews and documentation studies. It was found that in this case, the water supply PPP project has gone through the stages of PPP agreement signing which still faced problems in land provision, the certainty of raw water sources, inflation, tariff setting, and downstream infrastructure development. GCA seeks to resolve the problem with intensive coordination between related parties, financial and non-financial compensation, alternative sources of raw water, and support from the GCA Budget for downstream development.

Abstract:
This study aims to shed light on the increasing importance of the public-private partnership in the Saudi Arabia Kingdom, and the growing of available opportunities to attract private investments for many sectors such as aviation, water and port management, as well as clarifying challenges and obstacles of this type of contracting, and requirements for the successful partnership between public and private sectors in order to clarify and crystallize requirements and foundations of the real partnership between them in setting economic policies in order to advance the Saudi economy and achieve the desired economic development in the Kingdom’s Vision 2030. The study concluded that the partnership between public and private sectors, if it has the right structure, can be developed successfully, that’s what has been proved by the actual progress made by the Kingdom by opening new sectors and reforming laws and regulations, which led to an increase interest in partnership projects between the public sector and the private one. Thus, it will contribute to an increase number of partnership projects in the coming years with international, regional and local partners.

Abstract:
AbstractFocusing on the problem of pharmaceutical R&D for drugs and vaccines against neglected diseases in developing countries, this article argues that the effectiveness of global health partnerships potentially lies in their capacity to address the problem of dual market failures: on a first level they may tackle the poverty induced lack of effective demand for health products which impedes the creation of market-financed innovative products. On a second level, they may help overcoming hold-up problems and underinvestment induced by the complexity of neglected diseases R&D. Yet, organizing transactions within a partnership is not a panacea against these problems: a crucial determinant of success is properownership structures. They need to respond to (i) the degree to which the respective parties value the partnership outcome, (ii) the relative importance of the investment of the parties, and (iii) the nature of the partnership outcome. The argument developed in the analysis is built on an integrated framework combining insights from incomplete contracting theory and public goods economics. It is supported by a preliminary statistical analysis of 17 GHPs.

Abstract:
Much research has been carried out to discover partnership critical success factors that influence public-private partnership success. Since most public-private partnership projects are long-term in nature and include contractual arrangements, there is still a lot to learn about contract governance’s role in public-private partnership performance. Therefore, this study examines the effect of contract governance on the relationship between partnership critical success factors and partnership performance in Malaysia. Stakeholder Theory serves as the underpinning theory for this study. This study employed a quantitative method based on the positivist paradigm to distribute questionnaires. The information was collected from 261 contracting parties’ officials in Malaysian public-private partnership projects regulated by the Malaysian Public-Private Partnership Unit, and a stratified random sampling method was employed. The structural equation model analysis found that eight out of ten hypotheses were supported. According to this study, it has been established that contract governance has a direct favorable influence on partnership performance. However, it is also found that contract governance does not moderate the relationship between partnership critical success factors and partnership performance. Due to time constraints and the emergence of the COVID-19 pandemic, this study was from a cross-sectional viewpoint and adopted a quantitative methodology. The findings of this study are important in the contract governance and partnership performance literature, providing policymakers and concessionaires with new information on the impact of contract governance on public-private partnership project performance. Managers of public-private partnership projects should also be able to enhance their projects’ performance by understanding how contract governance influences the performance of their projects.

Abstract:
Public-Private Partnership (PPP) is a commonly used arrangement to develop public infrastructures. Traditional PPP focuses primarily on the public sector as contracting agency and private sector as project company. This research explores a major gap observed in such setup, namely the lack of attention on the people sector who is the end-users or groups impacted by these public infrastructures. Based on literature review, qualitative analysis involving executive interviews, and quantitative analysis involving survey of operational staffs, this study recommends a new Public-Private-People Partnership strategic stakeholder institutional framework along with its components of critical success factors for both policy and operational regulating frameworks to enhance PPP practice, both in Thailand and beyond.

Abstract:
The neo-liberal restructuring of state assets and facilities, which has taken place internationally over the past three decades, as well as in South Africa, has been a matter of great controversy. Privatisation, in particular, has been a polarising issue, especially when applied to fields like healthcare. Supporters of privatisation view it as cutting costs, mobilising funding, expertise and innovation, resulting in improved delivery, and opening possibilities for a spread of ownership. Critics claim the process involves retrenchments, declining services for the (poorer) majority of people, and a focus on the elites as citizens become transformed into customers, and with any economic empowerment going to the already prosperous. This thesis examines these issues by looking at the privatisation of hospitals in South Africa, with a case study of the Netcare-Settlers Public Private Partnership (PPP) (also known as the Settlers Private Hospital) in Grahamstown, South Africa. Netcare is South Africa’s largest private hospital company, and also has substantial operations in the United Kingdom. The thesis sets out the context: a highly inequitable healthcare system in the country, the rise of privatisation in the apartheid and post-apartheid eras, and healthcare privatisation. In terms of the Netcare-Settlers PPP, the thesis examines how the PPP was structured and developed, focusing on the impact of the PPP on non-clinical operations. The thesis argues that the results of the PPP are mixed, that it has greatly improved areas like facilities, maintenance, cleaning and catering, performed less well in increasing the doctor/ patient ratio or in attracting specialists, and is associated with the widespread and problematic use of outsourcing of service workers like cleaners and security. Overall, the PPP has improved healthcare, with some effective sharing of resources between the public and private parts of the hospital, but also relies on a pool of relatively low waged, under-unionised, labour. In terms of the general debate over privatisation, the Netcare-Settlers PPP shows that both supporters and critics have some valid points, and that privatisation in practice is not an either/ or, black/ white, good/ bad proposition, but something more complex. The success and failure of PPPs depend on the details of the contracts, and these can be used to maximise the performance of both the public and private partners. Better contracts may help avoid the uneven results seen at institutions like the Netcare-Settlers PPP.

Moussa, Edie A. "Contracting Out in a Complex Network: An Effectiveness Analysis of EPC Program I." Diss., Virginia Tech, 2011. http://hdl.handle.net/10919/77973.

Abstract:
While government contracting out its work continues to proliferate and studies about this phenomenon have increased during the past two decades, still little is known about how effective government sponsored networks are at managing broad and complex networks of primarily non-governmental entities. This dissertation reports the results of one such investigation, which examined a U.S. federal agency's contracting experiences in evidence-based health care. The Agency for Healthcare Research and Quality (AHRQ) is a unit of the U.S. Department of Health and Human Services (HHS). Among other tasks, AHRQ supports the development and dissemination of evidence about current best practices in health services delivery through its Evidence-based Practice Center (EPC) programs that contract out its work and operate in broad and complex network. The purpose of this study was to examine the extent to which AHRQ's EPC Program I was effective in supporting the translation of evidence reports and disseminating the products to the public by contracting with public and non-profit entities to do the work. This dissertation also sought to examine the extent to which the evidence reports and derivative products were publicly accessible by operationalizing the objectives articulated in AHRQ's authorizing legislation in a manner consistent with theories of representative democracy and exploring Program I's effectiveness using William T. Gormley's ideas (1989; Gormley & Balla 2003) of bureaucratic control. The results from this dissertation suggest that a decentralized network was related to overall higher translation and dissemination network effectiveness. Specifically, the findings from this study suggest that a decentralized network was related to overall higher translation and dissemination network effectiveness. Also, weak ties among the network actors when transferring complex knowledge was associated with higher translation and dissemination network effectiveness on the whole. The findings from this dissertation also contribute to network theory by extending Gormley's bureaucratic control typology (1989; Gormley & Balla 2003) to the network level, and also to the type of control that was available to the Agency over the network. Finally, the results contribute to better understanding of the dynamics that can be associated with the effectiveness of similar programs.

Abstract:
With the globalisation of the increasingly competitive maritime freight transport market, commercial seaports have become more and more increasingly economically sensitive areas. While governments have always taken a major interest in their ports, this interest has grown both for governments and for port economic operators such as stevedores, shippers, carriers and shipowners, precisely because of the development of international trade, which favours transport by sea, which is highly adapted to change. The collaboration between the State and these essential actors in the port area, who are generally legal entities under private law, raises questions about the legal framework of the partnership that is best suited to the economic, financial and port activities development stakes of each party. With a view to improving the efficiency of the management and operation of the Major Seaports and the Autonomous Port of Lomé, the french and togolese States have carried out successive reforms and adopted port policies in order to turn these ports into hubs of the global trade of goods. In France, the most important port reform to date is law no. 2008-660 of 4 july 2008 on port reform. In Togo, we can cite decree no. 91-027 of 2nd october 1991 transforming the Autonomous Port of Lomé into a State-owned company, or law no. 2021-034 of 31st december 2021 on public-private partnership contracts.Through these port reforms and policies, France and Togo have aimed to improve the performance, attractiveness and, by extension, the competitiveness of their commercial seaports on a regional and international scale. However, the results achieved have always been insufficient and have never lived up to expectations. Indeed, analysis shows that the level of competitiveness of the Major Seaports and the Autonomous Port of Lomé remains well below expectations. The reports of the french Court of audit, in this case that of 2017 entitled ‘ʻAssessment of the reform of the major seaports : uneven implementation, modest effects, insufficient attractivenessʼʼ is illustrative. The same is true of the historical report of Togo's Court of audit in february 2015 entitled ʻʻFinal observations report on the management control of the Autonomous Port of Lomé (PAL) : financial year 2008, 2009, 2010''.This situation raises questions about the efficiency of the legal, political and strategic arsenal relating to the management and operation of these ports. This thesis therefore sets out to make a legal diagnosis of the underlying causes of the lack of competitiveness of the Major Seaports and the Autonomous Port of Lomé, marked by the very active interventionism of the State in port affairs.Keyword : Seaports ; public companies ; governance ; public domain ; public contracting ; public-private partnership ; environment

Chung, Demi. "Contractual Approach to Optimising Risk Sharing: A Quantitative Study of the Multidimensional Nature of Risk in Private Provision of Road Infrastructure." Thesis, The University of Sydney, 2012. http://hdl.handle.net/2123/8842.

Full text
Abstract:
Public-Private-Partnerships (PPPs) are a public procurement policy that argues in support of greater value for money through optimal risk-sharing, by aligning incentives among parties who are profoundly different in terms of interests, objectives and risk preferences. The subject of interest in this thesis is tollroads that are procured under the PPP method, which traditionally involves the transfer of demand risk to the private sector. Designing contracts to share risk in light of incentive problems is the central premise of contract theory, yet the risk-sharing implications have rarely been adequately tested using micro data at the decision-maker level. In addition, empirical contract studies tend to ignore the risk preferences of contracting parties or assume that the stereotypical risk-averse agent and risk-neutral principal are present in all contractual relationships. This thesis addresses these shortcomings by presenting the methodology and empirical findings of an online survey within which a stated choice experiment was designed to capture the risk perceptions of contracting parties to a number of hypothetical PPP tollroad concessions. Information from 101 participants drawing on their project experience over 32 countries was collected within an advanced computer-aided personal survey instrument, to condition model estimates on observing the manner in which respondents processed the information presented to them to test the impact of contractual conditions and external institutional variables on their risk preferences, and hence their choice behaviour. While the findings of this thesis support the concept that risk-sharing in PPPs is in line with contract theory’s incentive alignment proposition, they refute the common belief in contract theory with respect to stereotypical economic actors. Moreover, the results demonstrate the powerful incentive effect of property rights to ex post surplus. There are a number of significant implications as to the design of contracts and reform of public policy if PPPs are to gain popularity and to attain value for money. To induce appropriate ex post performance efficiency, ex ante property rights need to be complemented with equitable risk-sharing among contracting parties. Uptake of the policy by the market can be enhanced by modifications to the identified institutional variables and contractual conditions. Finally, the thesis appeals to the theories of decision making to further pursue the influence of human cognition, particularly bounded rationality, on our decision choices.

Through this PhD thesis, our initial objective was to understand the control exercised by the government on their private partners in the Public-Private Partnerships. This was necessitated by the differences in objectives of the partner institutions and their different characteristics. This is why it has been the question for us to understand how the authorities through the institutional and contractual arrangements exercised this role of control over the private partner. On the basis of such an approach, it was subscribed to qualitative methods including case study to understand the control on the PPP.On the institutionalization, axis such as the inclusion of all the stakeholders, the differences in objectives, the roles and responsibilities, the lack of hierarchy were alternately analyzed. This allowing to make them prerequisites to PPPs.With respect to contracting, we had to look at the control models which were based on the need to correct the system and on those which create the conditions of accountability. To conclude this point, it will appear that contracts should be based on elements of performance. Finally, on the treatment of the differences between partners, the differences in goals, values and characteristics, the opportunism of partners especially the private ones, the need for an alliance and cooperation, the pragmatism of partners have been highlighted. In other words in the PPP, it is necessary to manage such differences

Abstract:
Nonprofits, including cultural organizations, are increasingly relying upon fees for service as part of their operating budgets. Arts organizations have taken an increasingly prominent role in arts education starting with federal budget cuts in the 1960s and 1970s. There is a lack of data on the effects of partnering with schools on nonprofit arts organizations as well as the effects of government contracting on nonprofits. This study consists of an email/internet survey to determine how contracting with schools to provide arts activities affects nonprofit arts agency independence, vendorism, bureaucratization, costs, and artistic quality. The survey was pilot tested with 22 leaders of arts organizations. The survey was emailed to a random sample of 680 leaders of American nonprofit arts organizations identified as art museums; ballet; dance; music; music groups, bands and ensembles; opera; singing choral; symphony orchestras; theaters; and visual arts organizations. Responses were gathered from 280 respondents for a 41% response rate. The researcher analyzed the data using frequencies, cross tabulations, logistic regression, and linear regression. This study reveals limited negative effects on arts organizations of partnering with schools. The major findings of this study support Lester Salamon's (1995) theory that bureaucratization is among the most likely effects of government contracting on nonprofits, and a study of nonprofits by Patricia Hughes and William Luksetich (2004) indicating that greater reliance on private funding does not divert funding fiom program service delivery. Organizations that partner with schools have greater odds of being affected by rules and regulations compared to those that do not partner with schools, but these rules seem to fall within acceptable limits for arts organizations of the types studied.Earning higher levels of income from school partnerships does not make arts organizations less likely to advocate for arts education, change artistic direction or offer significantly different programs, or impose unreimbursed costs. This study does not support Bruno Frey's (2003) Crowding Theory of the effect of external rewards on creativity. More collaborative types of school activity had no effect on organizational creativity in this study. However, enhanced artistic growth appears to be an important positive effect of school partnerships.

Abstract:
The hybrid nature of Public Owned Enterprises (POEs) presents opportunities, difficulties, and challenges. This paper focuses on the implementation of transparency, anti-corruption and accountability in POE in Spain. Spain is one of the European countries with lower importance of public owned enterprises. However, the privatisation process has been intense in Spain and it is accompanied by a parallel process of development of public enterprises at the regional and local levels. The analysis shows the need to improve the compliance of anti-corruption, transparency, and accountability measures by public enterprises in Spain. The mere existence of laws on this field is not enough to prevent corruption. The main risks and problems identified concern the political influence, the lack of professional management, the contracting procedures, and the confusion between the public and private sphere.

Abstract:
As part of the African Data Initiative, this poster focusses on the procurement menu of R- Instat, a tailored product of R-Instat designed specifically to analyse datasets on public procurement. The menu, initially tailored around an online-available dataset of World Bank funded public procurement tenders awarded across 171 countries, implements a new, objective methodology for measuring corruption risks. By specifying recognised procurement variables in their dataset, such as number of bidders, users can allow R-Instat to suggest appropriate analyses of their data. Experience using this data in a hands-on workshop for mathematical science MSc students in Tanzania demonstrated the educational value of this tool. The menu has also been used to teach Public Procurement Management Masters students in Italy about corruption risks methodology using European procurement datasets. There is a growing movement towards more data becoming open, with initiatives such as the Open Contracting Partnership. Open data has exciting consequences for training statisticians and public procurement students. However, being able to fully take advantage of the open data movement requires tools that enable users to easily carry out appropriate analyses. Trainings using R-Instat have shown this has the potential to fill this gap. Future development of the procurement menu to support more varied datasets could make it easier for trainers to incorporate more real- world data into courses.

Abstract:
The WHO World Health Organization encourages PPP and believes that it is inevitable in healthcare because it represents significant opportunities. The WHO strategy is the promotion and protection of public health, which is presented in this way as well. Achieving the goals and economic launch of the PPP project requires a lot of resources and knowledge. The focus should be on the development of a methodology related to the preparation of a PPP project. PPP - partnership in healthcare is a strategy to increase efficiency. We will present the advantages and disadvantages of public-private partnerships in healthcare in the Republic of Serbia, in the Republic of Croatia, PPPPartnerships of Canada and healthcare in the UK-as well as development, legal regulation and institutional support.

Abstract:
Because of the complexities associated with the water pricing and public-private partnership issue and their relevance to water management of the future, the Third World Water Centre for Water Management, the Inter-American Development Bank and the Agencia Nacional de Aguas of Brazil sponsored two focused workshops on water pricing in Brasilia, held on June 3rd-5th, 2002 and on public-private partnership in the water sector in Mexico City, held on September 25th-27th, 2003. The main objective of both the workshops were to assess the experiences from North and South America on the issues concerned in an objective and critical manner. Papers for each of the two workshops were specially commissioned. Following the discussions at the two workshops, the authors revised their papers, and this publication includes the selected and revised papers.
