Full textProcedural automation is certainly not a new topic of investigation for scholars working on administrative law. It has been studied by doctrine, and practiced by administrations, since the 1980s. Within this long-standing debate, the relevance of the present dissertation lies in the fact that the exponential development of technologies for automation (with the advent of Artificial Intelligence) has substantially expanded the areas where automated decision-making can be successfully implemented. Until ten or fifteen years ago the type of administrative activities in which officials could be replaced by a software were limited (and necessarily bound, considering that only deterministic algorithms were used). Nowadays, the large number of data in possession of the administrations, as well as the way in which they can be stored and above all analyzed, has led to the multiplication of the activities in which they can be used and the advantages that can be derived from them. In this work, an attempt is made to identify the correct systematic collocation of automated administrative decisions and of all the elements that constitute them, and to highlight the problems that recourse to such decisions can entail. In doing so, a unified treatment of these decisions is advocated, hence independently from the level of complexity of the technology used. The first part of the dissertation is dedicated to conceptualizing and to elaborating the normative and systematic framework of the matter. In the first place, it is necessary to identify and define the essential features of the digitalization of the Public Administration. The focus then shifts to the digitalization of the administrative procedure, which is a privileged place of investigation. In this respect, two are the main points of relevance. Firstly, one should identify those regulatory sources that allow (and in some cases limit) the recourse to automated decisions by the administration. Secondly, further investigation must also be conducted into the legal nature of the tools that allow automation, because this has important consequences in terms of the legitimacy of acts and the liability of officials. The second part of the dissertation focuses on the main legal problems posed by the introduction of automated public administrative decisions. A first hypothesis is that automation is not compatible with European principles and rules on public administration and with national sources on the administrative procedure. As will be extensively discussed, this preliminary hypothesis proves unwarranted. Instead, it is proposed that a more viable solution is to reconcile traditional procedural principles and legal tools (duty to give state reasons, participation) with decision-making automation. The final part of the work investigates the complex relationship between the transparency of the administrative activity and the intelligibility of automated decision-making. Here, a new analysis is proposed of both classical legal tools such as the right of access, and the way in which they are interpreted in those cases by case law, and of new instruments of protection provided ad hoc by the Legislator. The research takes a comparative view between the Italian and French systems. The comparative perspective is required by the scope of the investigation. The automated administrative decisions and their legal status remains rather unexplored. The intervention of the Legislator and the pronouncements of the jurisprudence on the subject have just begun to acknowledge the problem. For this reason, limiting oneself to the Italian experience would probably not have been sufficient for a complete understanding of the issue. In addition, as will be seen in the course of the work, the intervention of the European Union in the field of the digitalization of the Public Administration and algorithmic decisions is quite pervasive. Here, the comparison of the role that the EU had in two different Member States seems rather significant. The choice of France, however, is not accidental. First of all, the French Legislator has proved very sensitive to the need for intervention with regards to the new IT tools. It follows, that the study of new legislative instruments developed in this context is of paramount importance. In addition, the multiple affinities between the Italian and the French legal systems have eased the comparison of the performance of classical legal tools of administrative law, such as participation and the right of access (in the face of automation).

Full textThis work analyzes the role of the legislator and of the public administration respectively in outlining and implementing public policies aimed at the promotion of economic development models distinguished by a high rate of environmental sustainability. For this purpose, the work is split into four chapters. The first chapter takes into consideration the main elements of the general theory making up the keys to understanding the topic being dealt with. This first research phase is centred, on the one hand, on the (historical-evolutionary) analysis of the environment concept in the light of prevalent legal interpretation and, on the other, on the formation of the concept of sustainable development, especially in an environmental perspective. In the central part of the work, consisting of the second and the third chapter, the analysis involves three areas of investigation of great importance for the systematic contextualization of public policies in the sector: the system of relations existing between the numerous entities (international, national and local) involved in finding solutions to the systemic environmental crisis; the identification and definition of the substantial principles regulating the environment protection system and directing policy choices in the sector; the main, currently applicable protection instruments (juridical and economic). The fourth and last chapter takes into consideration the policies relating to the authorization procedures for the building and running of energy production plants fuelled by renewable sources, analyzed as a specific case which can be taken as a paradigm of the role played by the legislator and the public administration in the sector of sustainable development policies. The analysis conducted shows a high rate of complexity of the institutional and organizational system, to which must be added evident limits of efficiency as regards the administrative system of authorizations introduced by the national legislator.

This paper will examine both the accordance of the Italian law to the European directives, in particular to the public procurement rules required to assure the fair and competitive development of the enterprises’ economic activity in the market place, both the special nature of the public administration’s action in its contractual relationships with the economic subjects, always double connected to public and civil law, and therefore involving questions about jurisdictional division and claim for damages.

Full textL’oggetto della ricerca ha carattere trasversale e, conseguentemente, l’attenzione non è stata focalizzata su di uno specifico istituto ma, più in generale, sul ruolo svolto dalla pubblica amministrazione nei vari momenti in cui lo svolgimento della funzione si intreccia con la tutela di interessi privatistici o di interessi generali quale è certamente la tutela della concorrenza nei mercati. Molto sinteticamente si può dire che il lavoro è stato suddiviso in tre macro aree. Nel primo capitolo mi sono soffermato sulla posizione dell’amministrazione e, in generale del soggetto pubblico, nell’economia di mercato, nella duplice veste di operatore che svolge un ruolo attivo attraverso lo strumento societario e di soggetto investito di una funzione di garanzia degli equilibri di mercato (focalizzando qui l’attenzione sulla funzione delle autorità garanti). Nel secondo capitolo ci si è concentrati sul ruolo della p.a. quale soggetto tenuto a garantire l’erogazione di servizi di interesse economico generale e, conseguentemente, l’analisi ha avuto ad oggetto la disciplina pro concorrenziale di stampo comunitario e le sue diverse declinazioni nell’ordinamento interno. Particolare rilievo è stato assegnato alla disciplina dei servizi pubblici locali dove è molto accentuata la tensione tra apertura al mercato, da un lato, e salvaguardia degli interessi pubblici sottesi ai servizi da erogare, dall’altro. Nel terzo capitolo l’analisi si è spostata sul ruolo dell’amministrazione quale operatore di mercato la cui attività contrattuale si caratterizza per numerosi profili di specialità rispetto alla disciplina normalmente applicabile ai rapporti tra privati. Sono stati svolti, quindi, alcuni approfondimenti in tema di responsabilità precontrattuale, sorte del contratto ad esito dell’annullamento del provvedimento prodromico di aggiudicazione e in relazione ad alcune vicende della contrattualistica pubblica che possono rappresentare un pericolo per le esigenze di tutela della concorrenza e di parità delle chances competitive dei vari soggetti privati interessati ad essere controparti negoziali della p.a.

Full textThe thesis examines the rules governing local public services from the angle of view of competition. The first paragraph is devoted to a comprehensive examination of national discipline in the field of local public services. The second focuses on the question of the difficult balancing cit., and raises a reflection on the modalities and approach the legislator should take to "put the hand" on matter. Following is a reflection and comparison between the European and national notions of service of general interest and local public service and the analysis of competition in the market, for the market and self-production in the current context. The second chapter deals with independent administrative authorities, their nature still controversial, their lack of predictability in the constitutional charter and the problematic profiles pertaining to the exercise of their implied powers, procedural safeguards and protection for those affected by the decisions and Their role in the implementation and protection of competition. The last chapter deals with the administrative court syndicate on anti-competitive public administration acts. The conclusions reflect on the need for the legislator to address coherently, homogeneously and prudently the pro-competitive reform approach in the complex field of local public services.

Full textL'indagine oggetto di questo lavoro concerne le garanzie processuali di cui gode l'individuo nell'ambito del processo amministrativo italiano, e, più specificamente le garanzie ricavabili dalla Convenzione europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali e dal di-ritto dell'Unione europea. La CEDU ed il diritto dell'Unione Europea (quest'ultimo soprattutto attraverso la Carta dei diritti fondamentali) predispongono infatti una serie di garanzie processuali il cui rispetto contraddistingue quello che viene comunemente indicato come "giusto processo". Il processo amministrativo presenta però alcune peculiarità che pongono, nell'applicazione di tali garanzie, non poche questioni. Infatti, la Pubblica amministrazione (parte necessaria di tale giudizio), già nella fase procedimentale (e dunque ben prima dell'instaurazione di un eventuale contenzioso), è vincolata al rispetto di determinati principi, posti dalla legge, dalla Costituzione, dalla CEDU e dal diritto dell'Unione, nell'ottica di realizzare una sorta di "giusto procedimento amministrativo"; l'agire amministrativo dovrebbe dunque essere già di per sé "legittimo". Inoltre, mentre il ricorrente persegue un proprio (legittimo) interesse individuale, leso dal provvedimento impugnato o comunque dall'illegittimo comportamento posto in essere dalla Pubblica amministrazione, il fine perseguito da quest'ultima è quello dell'interesse della collettività. Il processo amministrativo presenta dunque un profilo di asimmetria fra le posizioni delle parti in causa, originato tanto dalla presunzione di legittimità dell'azione amministrativa, quanto dall'interesse pubblico ad essa sotteso, tale per cui, nell'ordinamento italiano, così come nella maggioranza degli Stati europei, esso è sempre stato distinto dal processo civile. Il problema del bilanciamento fra valori, fondamentale criterio di valutazione tanto della Corte costituzionale, quanto della Corte EDU e della Corte di giustizia, si pone dunque in tale ambito in maniera assolutamente peculiare: fino a che punto tutelare i diritti processuali dei singoli, nel momento in cui la tutela in questione va inevitabilmente a collidere con l'interesse pubblico tutelato dalla Pubblica Amministrazione, il quale a sua volta si sostanzia nella difesa di altri valori fondamentali, tutelati anch'essi dalla Costituzione, dalla CEDU e dal diritto dell'Unione? Nel corso di questo lavoro si analizza quindi il modo attraverso il quale la Corte europea dei diritti dell'uomo e la Corte di giustizia affrontano tale difficile bilanciamento, concentrandosi in particolare sulla giurisprudenza relativa al diritto processuale amministrativo italiano. Inoltre, una particolare attenzione viene posta al modo in cui i giudici italiani, costituzionale, di legittimità e di merito, si pongono nei confronti della giurisprudenza di tali corti, riscontrando l'esistenza fra le giurisdizioni proprie dei vari livelli di un rapporto dialettico, nell'ambito del quale si alternano momenti di dialogo e di rottura. L'obbiettivo è quindi quello di rinvenire, all'esito di tale analisi, una nozione europea di giusto processo amministrativo e di analizzare in quale maniera essa si cali in concreto nell'ordinamento italiano. In tal senso, non si può certo trascurare l'oggettivo sforzo compiuto dal legislatore che, attraverso la riforma dell'art. 111 della Costituzione e l'entrata in vigore del Codice del processo amministrativo (c.p.a.), ha mostrato di voler recepire nel nostro sistema processuale i principi del giusto processo così delineati, (anche) attraverso un allineamento del livello di tutela garantito nel processo civile e nel processo amministrativo. Tuttavia, nonostante tale impegno, continuano a permanere nell'ordinamento italiano situazioni di evidente vantaggio in favore della Pubblica Amministrazione. Il lavoro si articola in tre capitoli. Nel primo, dopo una panoramica sugli obblighi di carattere universale idonei ad incidere sul processo amministrativo in Europa, si cerca di determinare quali garanzie presenti nella CEDU e nel diritto dell'Unione europea (e, particolarmente, nella Carta dei diritti) siano applicabili al processo amministrativo. Nel secondo, l'oggetto dell'indagine si concentra sulle modalità attraverso le quali l'ordinamento italiano si adatta alle garanzie processuali della CEDU e dell'Unione, nonchè sulle possibili intersezioni (tanto in ottica di conflitto quanto di integrazione) fra tali garanzie oppure fra di esse e la Costituzione, senza prescindere da un approfondimento sul coordinamento processuale della giurisprudenza della Corte di giustizia, della Corte EDU e della Corte costituzionale. Nel terzo capitolo, infine, dopo una breve presentazione del sistema italiano di riparto di giurisdizione, l'indagine si focalizza sulla maniera in cui le giurisdizioni interne, internazionali e dell'Unione abbiano effettuato il delicato bilanciamento che è oggetto di questo lavoro, presentando alcune questioni problematiche che si pongono in concreto nell'applicazione del principio del giusto processo nel sistema processuale amministrativo italiano. Per fare questo, si indicano alcune possibili soluzioni rispetto a determinate questioni interpretative ancora irrisolte nel nostro diritto nazionale, oppure rispetto a situazioni di palese incompatibilità dell'ordinamento italiano col principio del giusto processo, attraverso un'interpretazione delle norme interne orientata alla tutela dei diritti umani. All'esito di tale percorso, così delineati gli elementi in campo, sarà per il lettore possibile comprendere se il processo di allargamento dei diritti degli individui nel processo amministrativo sia arrivato ad uno stabile punto di mediazione fra opposti interessi, oppure debba piuttosto continuare, andando a toccare gli ambiti dove ancora alla Pubblica Amministrazione è riservata una situazione di privilegio, legata alle sue indubbie peculiarità.
