Mining is one of sources the country and religional incomes. That is why the presence of mining company truly help country and region /local development. Renegotiation is based on the acts number 4 year 2009 about mineral coal, of wich statement should be adjudted to the recent acts. The bill number 4 year 2009 stated the mining conservation based on utility, equality and nationality. The creation-contract negotiation has strong law foundation, even though its content clashes with the contarct which already been signed. Renegiatation does not deny the content of contract, but adption of current condiotion and the rules of certain country. It is imposible to keep the content compeletely the same after long years because that condition will be harmful for one side. Even worse that contract is full of political and foreign needs as the main consideration.

Abstract:
PT. Freeport Indonesia is one of the mining company that process the copper and gold ore. One type of ore processed in this company is Super Grade Ore (SGO). The characteristics of SGO are wet and smooth, which can result some problems in transportation. Therefore, it is necessary to do blending process using material from Kokonao stockpile which tends to be drier and rougher, but has the lower grade than Cut of Grade of company. Applying experimental method, this research aims to figure out effects of the addition of Kokonao material in the blending process with SGO on concentrate grade and metal recovery resulted. Overall, the levels of Cu and Au reduce when the Kokonao material added at each various composition, with the lowest Cu grade is 100% Kokonao (1,97%) and the highest Cu grade is 10% Kokonao (25,69%). Meanwhile, the lowest Au grade is 100% Kokonao portion (3,26 ppm) and the highest Au grade is 20% Kokonao (38,16 ppm). In addition, All various compositions result in Cu recovery that is higher than the company standard (>80%). The highest Cu recovery is resulted by 50% Kokonao composition (97,12%).

Abstract
This article aims to examine the legal aspects of the share divestment process carried out by foreign mining companies in Indonesia and related to the obligation of the share divestment process offered to Indonesian Participants by Foreign Mining Companies according to the applicable legislation. This method of writing is legal research with a statute approach. Based on the research, the divestment arrangements in Indonesia still intersect with the non-compliance of foreign mining companies and the uncertainty of regulations in the past, so that the divestment process of foreign mining companies such as PT Freeport Indonesia had problems with the Government. The problem during the divestment of PT Freeport Indonesia's shares due to the incompatibility of permits granted by the Government through the Ministry of Energy and Mineral Resources to PT Freeport Indonesia was feared to provide bad influences for foreign mining companies which would later also divest.
Keywords: divestment; share; law; mining

Indonesia is the world 's largest archipelago with 1,904,569 km2 of surface area. A very diverse landscape with a variety of abundance of flora and fauna is a special attraction for foreign tourists. Not only that, the natural wealth in Indonesia 's intestines is also very abundant, as are various minerals and richness from other mining materials. However, a abundance of skilled human capital, both in terms of science and technology mastered, do not complement the plentiful natural resources. This is one of the reasons superpowers should be providing cooperation. PT. PT. Freeport is an clear example of Indonesia 's collaboration in the mining sector with foreign parties. The first contract for Freeport-Indonesia was established in 1967. After the Foreign Investment Law was passed in 1967, Freeport became the first foreign mining firm to operate in Indonesia. But the existence of this partnership was regretted by many because it was perceived to be detrimental to the region. The reason is that so far nobody knows for sure how much gold and silver has been produced from the mining to date. The magnitude of the distribution of mining goods is also not quite good given that Indonesia owns land which is turned into gold fields. There are, in fact, many reports uncovering miserable stories of discrimination by indigenous people around the mining region. Justice is once again present as something that is not only wishful thinking, but also noble values that have to be realized for the collective good of the state goals set out in the Pancasila points and the preamble to the Constitution of 1945.

Keywords: Mining, PT. Abstract:
The mineral and coal mines have long been managed by foreign contracts between governments and foreigners. The position threatens the state's sovereignty over the wealth of natural resources. The study was to analyze the renege-management of Indonesia's Freeport mines in Papua. Socio-legal methods were used to analyze the renegotiation of Indonesia's Freeport management. The study found that according to the principle of state mastery over natural resources as a common property of Indonesian people's prosperity as in article 33 verses (3) constitution of 1945, the Indonesian government officially took over its 51-percent share of Freeport. It is part of an expression of national sovereignty over the management of its natural resources. With this position, Freeport's mining management is no longer based on a contract of work, but a Special Mining Business License which provides guarantees to business holders to have their licenses extended to provide certainty to mining business actors in conducting mining business in Indonesia.

Abstract:
The stability of a slope in mining activities is highly influenced by geology, especially thenature of rocks and geological structures. Slope stability analysis will be faced with severalproblems in the uncertainty of rock properties and rock mass. Slope stability analysis usingprobabilistic methods offers a more systematic way of treating conditions of uncertainty andprovides other alternatives to the value factor approach to security regarding information onthe probability of a slope failure.Grasberg Open Mine rock type classification based ongeotechnical parameters or Geotechnical Rock Code (GTRCK) classifies rocks based onrock type, rock mechanical properties, hydrothermal alteration type, clay content and RockQuality Designation (RQD) to 46 types of GTRCK. The GTRCK type which has a low rockmass strength value is a change in intrusive rock minerals and a low RQD value such as alot of clay material is exposed in the Northeast and Southwest of the Grasberg Open PitMine. The overall slope probabilistic modeling of the Grasberg mine uses a cross section of220o (northwest) with the effect of a 0.02g seismic factor which is the maximum criterionaccording to the probability of slope failure received with the average FK 1.13 and PK 0%.

Abstract:
PT Freeport Indonesia (PT FI) has a Contract of Work (KK) to undertake mining materials in Grasberg and Ertsberg mining areas which has begun in 1967 and will end in 2021. Since the promulgation of Law No. 4 of 2009 on Mineral and Coal Mining (UU Minerba), regulation on mineral and coal undertaking has been in accordance with Pancasila (State Ideology) and the 1945 Constitution, however, because UU Minerba can only be effective for legal actions after its promulgation therefore items related to KK before the existence of that law cannot be regulated. On the other hand, the existence of KK of PT FI is considered to be in violation with Pancasila namely The Fifth Principle “Social Justice for The Whole People of Indonesia”, and Article 33 (3) of 1945 Constitution concerning the substance of land, water, and natural wealth ‘shall be controlled by the State’ and ‘for maximum use for people’s welfare’. This article shall discuss on whether KK of PT FI has been in accordance with Pancasila and the1945 Constitution? And what should Government do in order KK of PT FI can be regulated within the frame of Pancasila and the 1945 Constitution? The method used in this writing is juridical normative. Based on the writer’s analysis, KK of PT FI is violating Pancasila and the 1945 Constitution. The effort to adjust it to Pancasila and the 1945 Constitution shall be conducted through renegotiation of KK of PT FI based on “hardship” principle in UNIDROIT Principles of International Commercial Contracts and principle of natural resources for national interest and people’s welfare in the Resolution of General Assembly Resolution 1803 (XVII) of 14 December 1962, “Permanent Sovereignty Over Natural Resources.

Abstract:
The forests of Papua are large enough to support a diverse range of flora and fauna and other natural resources such as mining materials. PT-Freeport Indonesia, one of the world's largest mining companies, has an ex-mining area (tailing) managed as a reclamation area. Regular biotic and abiotic factor interactions will aid in the success of reclamation efforts. Soil organisms, which act as decomposers, are biotic factors that contribute to soil fertility and bioindicator. Collembola is a soil microorganism that is very important in marginal soils and can help soil fertility naturally. This study aims to assess the differences between the Collembola communities in the tailings and plantation areas. The method employs a literature review, which refers to a literature review, and it uses secondary data from the PT-Freeport Indonesia Biodiversity and Reclamation Sub Division. Collembola population and diversity are classified as low in the tailings area, presumably due to limiting factors for the sub-alpine and alpine ecosystem types, making it longer. Unlike in the tailing area, the Collembola population and diversity are classified as moderate to high in the plantation area because of litter availability as a source of nutrients for Collembola activities.

This research to see the ratio of financial performance of Inalum before and after the acquisition of Freeport Indonesian through the EVA approach for the 2013-2020 period. Financial reports as material for analysis obtained from the website of Inalum and SGX with the type of data, quantitative and secondary data. The data analysis technique used is to assess financial performance using a comparative analysis of the EVA approach from 5 years before and 3 years after the acquisition with the data analysis instrument used NOPAT, WACC, and IC. From the results, financial performance is not good because the company has a negative EVA every year. This shows that the profits have not been able to cover the cost of capital. After the acquisition, the EVA value generated by the negative company is greater than the before the acquisition, so the company's financial performance before is better than after the acquisition.

Abstract:
The article analyzes the development of gold production in Indonesia in the last 2-3 years, which is subject to serious fluctuations and largely depends on production volumes at the largest Grazberg deposit, in Papua, operated by PT. Freeport Indonesia, which actually accounts for at least half of all gold produced in the country. The article points out the gross error of official Indonesian statistics in assessing the annual production of gold in the country, which is associated with double counting of the same gold produced by large companies and transferred for subsequent refining to the refinery of the state company Antam. At the same time, a significant amount of gold produced in illegal mines is also indicated, but not taken into account by the official statistics of Indonesia.

Abstract:
Freeport Indonesia's mission is to be committed to being creative in processing the transformation of natural resources to provide prosperity and contribute to aspects of sustainable development through various mining practices by prioritizing the welfare and peace of employees and communities, human resource development, social and environmental responsibility, as well as safety and welfare in the operating area. The paper aims at identifying the Education Diplomacy of PT. Freeport Indonesia with AMINEF in improving gender equality in Papua and to analyze the barriers faced by women especially Papuan Women in taking part of the AMINEF scholarship specifically the Community College Initiative Program. The method used in this research is descriptive qualitative, by selecting interview techniques and literature study in data collection, as well as using the theory of Education Diplomacy, Multinational Corporation, and Gender Equality as theoretical framework on the whole process of implementing the AMINEF program in facing obstacles in achieving gender equality in Papua. The result of the research reveals that there has been no gender equality policy among three actors: the government, Freeport, and AMINEF which leads to low capability of developing Papuan people. Freeport itself merely concentrates on its production without paying attention on gender equality.

Abstract:
To increased the production, the Deep Ore Zone (DOZ) mining department has a concept of implementing a staggered crew. Staggered crew is a crew formed specifically to support production activities. To assess the performance of the application of the staggered crew, an evaluation of the factors that influence production activities is carried out. Factors that subject to evaluation are working time, number of operators and production capability. The results of evaluating work time (optimum efficiency) for crew I, II, and III showed as follow 29%, 30%, and 28% respectedly. Very low efficiency is due to time constraints in operation, which are affected by delay time, idle time and maintenance time. Average productive work time (work) is 3.26 hours/day, delay time is 3.26 hours/day, idle time is 4.03 hours/day and maintenance time is 0.53 hours/day. Idle time is the highest time of these four parameters. The results also showed that there were differences in the number of distribution operators, namely crew I numbered 16 people, crew II numbered 12 people and crew III numbered 15 people. But the number of operators on each crew is still sufficient to support production activities. The average production is 62.14 tons/hour and 4,784.78 tons/day. So with a production of 62.14 tons/hour and working time of 11 hours/day, it takes a minimum of 8 dump truck operators to reach a value of 5,468.32 tons/day.

Abstract:
Ventilation is an attempt to drain clean air into the mine and remove dirty air out of the mine. The main components of a mine ventilation system are intake, working, and exhaust. Intake is a tunnel and wells system where air flows from the surface into the mine. The purpose of the ventilation system in an underground mine is to provide and drain clean air into the mine for breathing and comfort of mine workers. Based on the Ventilation Design Criteria used by PTFI, the minimum airflow level required for every mine worker is 0.033 m3 / s / worker. Based on PTFI Ventilation Design Criteria, the minimum level in diluting smoke of heavy equipment diesel engine is 5 m3 / min or 0.08 m3 / s / kW. PT Freeport Indonesia is currently developing new underground mines namely Grasberg Block Caving (GBC) and Deep Mill Level Zone (DMLZ) which will be mined using the block caving method.

Abstract:
AbstractCorporations often claim to be economic actors solely interested in capital accumulation. However, historical and anthropological scholarship has argued they have had outsized political roles, especially during high colonialism when transnational corporations such as the British East India Company and the Dutch East India Company shaped colonial entities. This article explores the case of American mining company Freeport-McMoRan, which runs the world’s largest gold and copper mine in West Papua, and its entanglement with contemporary imperial and colonial projects in the region. Through the study of the company’s decisive role in the transfer of West Papua from the Dutch to Indonesia during the decolonization period of the 1960s, and in the formation of the postcolonial Indonesian state characterized by its militaristic and capitalistic stances, this article argues that Freeport’s operation in West Papua has been central to shaping U.S. imperial policy in Southeast Asia. The company’s relationship with the U.S. government and its contract of work with the Indonesian government reproduce an older form of state-corporation partnership called a charter, which grants a corporate body privileges associated with exploration, trade, and colonization. Combining a historical study of the political role of corporations across time and an ethnographic study of Freeport’s operation, this article rethinks the anthropological and historical study of transnational corporations and their roles in the contemporary politics of colonialism.

Abstract:
The research is aimed at analyzing the ICSID (International Centre Settlement Investment Dispute) decision in solving a dispute between Churchill Mining PLC and the Government of the Republic of Indonesia. The case brought to the public attention, because mining license owned by PT. Ridlatama which acquired from Churchill Mining PLC had been revocated. Churchill Mining PLC holds 75% share of PT. Ridlatama and it suffered losses caused by the revocation of its mining license. Churchill Mining PLC filed the case to the local court but it failed. Churchill Mining PLC then sought ruling from International arbitration or ICSID. On December 6, 2016, ICSID issued a decision that clearly threw out Churchill Mining PLC claim. ICSID, the World Bank court, ordered the firm to pay a total of US$.9.446.528 in cost to the Government of the Republic of Indonesia. It is based on the evidences that the UK-Australia company did the fraud and had document forgery of coal mining permit in East Kutai, Indonesia. So the firm has violated the Bilateral Investment Treaties between Indonesia-UK and Indonesia-Australia.

Coal mining is one of the most developed industrial sectors in Indonesia. The quality of natural mineral resources spread across several islands makes Indonesia the 4th coal-producing country in the world. The main component in the coal mining industry activity is changing land and changing the landscape, which causes a high potential impact on the environment, social and community economy. Apart from having a direct effect on the ground, the mining industry is an activity that has a high risk of accidents that result in human injury to death. Therefore, occupational safety and health (K3) are important centres of attention in the mining industry. ISO 45001 and ISO 14001 are international standard certifications that become a component of a company in testing OHS control and environmental management, respectively. Qualitative methods are applied in this study to investigate what programs PT Adaro Energy Tbk, PT Toba Bara Sejahtera Tbk, and PT Indo Tambangraya Megah Tbk in implementing ISO 45001 and ISO 14001. Abstract:
In recent years, Corporate Social Responsibility (CSR) has attained increased significance in both business and in the associated academic literature. The very term, CSR, clearly indicates the focus is on social responsibility as a company’s obligation to be accountable to all its stakeholders in all its operations and activities. Nowadays the concept of empowerment has become the development paradigm. The Indonesian government is expected to coordinate and be responsible for a wide range of community development activities that allow the entire community to participate actively, while the company contributes to the community empowerment process as the implementation of social responsibility undertaken through its Corporate Social Responsibility (CSR). This study assessed the CSR activities undertaken by a mining company (PT Vale Indonesia). Over the past 50 years, PT Vale Indonesia (PTVI) has been operating under the Contract of Work (CoW) agreement with the Indonesia government to open-pit nickel mines and processing plant facilities near Sorowako, Indonesia. This study provided empirical evidence on PTVI's presence benefits the surrounding communities by implementing PTVI’s CSR program called Integrated Community Development Program (ICDP). The research purpose is to explore the concept of CSR practice that is viewed and applied by PTVI to create a win-win situation that contributes to community empowerment. The findings of this case study contribute significantly to give more profound knowledge of the role of ICDP to community empowerment and to extant an understanding of the company dealing with the challenges of CSR activities for community empowerment.

Abstract Mining business actors have an obligation to maintain the sustainability of the surrounding environment, both in the physical and the social environment. Coal mining extraction activities are closely related to the exploration and exploitation of natural resources. This activity is in contact with the interests of the surrounding community, in particular with the negative impact caused. Mining companies in Indonesia are bound by the Mineral and Coal Mining Act no. 4 of 2009 to carry out community development and empowerment. Under the law, the companies are required to implement Corporate Social Responsibility (CSR). Through the implementation of CSR is expected the company can provide a positive change for the survival of communities around the mining area. PT BARA is one of mining companies that had been implementing CSR since 1983. As a state-owned company PT. BARA has various binding regulations in the implementation of CSR. The regulation comes from the central government as well as the local government in which PT. BARA does its mining business. Every year PT BARA releases an enormous amount of CSR funds, but the surrounding community is still in a state of poverty. It turns out that the problem does not stop on poverty at all. The community becomes very dependent on the company's assistance. The purpose of the CSR program is to develop and empower the community has not been able to achieve the goal. This dependence is caused by various reasons such as CSR policies of companies as well as government and CSR implementation on society.

Issues regarding the establishment of a State-Owned Enterprise holding company in the mining sector as well as other sectors in the perspective of the Indonesian state administration will cause legal problems, including the constitutionality of the establishment of a SOES subsidiary, the legal entity status of a SOES subsidiary, the financial status and state assets in a SOES subsidiary, and state control over SOES subsidiaries. This normative legal research uses a statutory approach and then analyzed using qualitative data analysis methods. The position of SOES in the Indonesian economic system is as an implementer of the state's right to control important economic resources and control the lives of many people. The position of the subsidiary in the state-owned mining holding company remains as a State-Owned Enterprise and does not change to an ordinary limited liability company. State control over SOES subsidiaries in the structure of the SOES holding company in the mining sector can still be exercised through the ownership of Series A shares by the Government of the Republic of Indonesia as stated in Article 33 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. Abstract:
The machine maintenance strategy is very important in manufacturing, mining, and other industries so an appropriate maintenance strategy is needed based on industrial operating conditions. In this paper, a Proactive maintenance strategy is presented, in which this strategy requires the identification of vibrations, and the identification of vibrations is divided into two methods, there are the identification of vibrations in the time domain and the identification of vibrations based on the frequency domain. Identification in the time domain is usually done in analyzing gears because of so much noise in the frequency domain, while identification in the frequency domain is used to analyze vibrations in cases of unbalance, misalignment, bearing defects, cavitation, and damage to electric motors. This paper briefly presents the time domain and frequency domain differences and two case studies that happened on PT. Freeport Indonesia. The first case is the investigation of bearing damage to the conveyor using vibration signals in the frequency domain, while the second case is the investigation of gear damage using the time domain that occurs in the crusher.

Abstract:
Big Gossan (BG) mine is an open stope mine operated by PT Freeport Indonesia(PTFI). This mine started its development in 2006. Currently, the mine consists of 9 active levels, each level is designed with about 1 km footwall drift East-West. The production initiated in 2009, but the mine was temporarily shut down due to a company decision. Lately the mine has been re-activated since 2017 and will be pushed into its peak production in 2019, with 7000 tpd production rate. In order to meet with the production goal, 5 levels consisting of 34 at least production stopes are required on a yearly basis. The other strategy to meet the production goal is an improvement of stopes sequencing. Big Gossan Mine is ventilated by two parallel 1600kW exhaust Mixed-Flow fans. This paper presents the ventilation plan and design to support the improved stope sequence until peak production, include the analysis of ventilation design criteria, ventilation network modeling, infrastructure required, possibility of main fans upgrade and other ventilation open stope mine challenges.
