Abstract:
Mining is one of sources the country and religional incomes. That is why the presence of mining company truly help country and region /local development. Renegotiation is based on the acts number 4 year 2009 about mineral coal, of wich statement should be adjudted to the recent acts. The bill number 4 year 2009 stated the mining conservation based on utility, equality and nationality. The creation-contract negotiation has strong law foundation, even though its content clashes with the contarct which already been signed. Renegiatation does not deny the content of contract, but adption of current condiotion and the rules of certain country. It is imposible to keep the content compeletely the same after long years because that condition will be harmful for one side. Even worse that contract is full of political and foreign needs as the main consideration.

Abstract
This article aims to examine the legal aspects of the share divestment process carried out by foreign mining companies in Indonesia and related to the obligation of the share divestment process offered to Indonesian Participants by Foreign Mining Companies according to the applicable legislation. This method of writing is legal research with a statute approach. Based on the research, the divestment arrangements in Indonesia still intersect with the non-compliance of foreign mining companies and the uncertainty of regulations in the past, so that the divestment process of foreign mining companies such as PT Freeport Indonesia had problems with the Government. The problem during the divestment of PT Freeport Indonesia's shares due to the incompatibility of permits granted by the Government through the Ministry of Energy and Mineral Resources to PT Freeport Indonesia was feared to provide bad influences for foreign mining companies which would later also divest.
Keywords: divestment; share; law; mining

Abstract:

Indonesia is the world 's largest archipelago with 1,904,569 km2 of surface area. A very diverse landscape with a variety of abundance of flora and fauna is a special attraction for foreign tourists. Not only that, the natural wealth in Indonesia 's intestines is also very abundant, as are various minerals and richness from other mining materials. However, a abundance of skilled human capital, both in terms of science and technology mastered, do not complement the plentiful natural resources. This is one of the reasons superpowers should be providing cooperation. PT. PT. Freeport is an clear example of Indonesia 's collaboration in the mining sector with foreign parties. The first contract for Freeport-Indonesia was established in 1967. After the Foreign Investment Law was passed in 1967, Freeport became the first foreign mining firm to operate in Indonesia. But the existence of this partnership was regretted by many because it was perceived to be detrimental to the region. The reason is that so far nobody knows for sure how much gold and silver has been produced from the mining to date. The magnitude of the distribution of mining goods is also not quite good given that Indonesia owns land which is turned into gold fields. There are, in fact, many reports uncovering miserable stories of discrimination by indigenous people around the mining region. Justice is once again present as something that is not only wishful thinking, but also noble values that have to be realized for the collective good of the state goals set out in the Pancasila points and the preamble to the Constitution of 1945.

Keywords: Mining, PT. Abstract:
The mineral and coal mines have long been managed by foreign contracts between governments and foreigners. The position threatens the state's sovereignty over the wealth of natural resources. The study was to analyze the renege-management of Indonesia's Freeport mines in Papua. Socio-legal methods were used to analyze the renegotiation of Indonesia's Freeport management. The study found that according to the principle of state mastery over natural resources as a common property of Indonesian people's prosperity as in article 33 verses (3) constitution of 1945, the Indonesian government officially took over its 51-percent share of Freeport. It is part of an expression of national sovereignty over the management of its natural resources. With this position, Freeport's mining management is no longer based on a contract of work, but a Special Mining Business License which provides guarantees to business holders to have their licenses extended to provide certainty to mining business actors in conducting mining business in Indonesia.

Abstract:
This thesis examines how the Kamoro (also known as the Mimika) people of the south-west coast of Papua (former Irian Jaya), Indonesia have adapted to major political and economic changes over a long history of interactions with outsiders. More specifically, it is an ethnohistorical analysis of Kamoro strategies of engagement dating back to the seventeenth century, but focusing on the twentieth century. Taking ethnohistory to most generally refer to the investigation of the social and cultural distinctiveness of historical consciousness, this thesis examines how perceptions and activities of the past shape interpretations of the present. Though this thesis privileges Kamoro perspectives, it juxtaposes them against broader ethnohistorical analyses of the “outsiders” with whom they have interacted. For the Kamoro, amoko-kwere, narratives about the ancestral (and eternal) cultural heroes, underlie indigenous modes of historical consciousness which are ultimately grounded in forms of social reciprocity. One key characteristic of the amoko-kwere is the incorporation of foreign elements and their reformulation as products of indigenous agency. As a result of this reinterpretation expectations are raised concerning the exchange of foreign material wealth and abilities, both classified in the Kamoro language as kata. Foreign withholding of kata emerges as a dominant theme in amoko-kwere and is interpreted as theft, ultimately establishing relationships of negative reciprocity between the Kamoro and the powerful outsiders. These feelings are mirrored in contemporary Kamoro conceptions of their relationships with the Indonesian State and the massive PT Freeport Indonesia Mining Company who use a significant amount of Kamoro land for deposition of mining waste (tailings) and for the development of State and company infrastructure.
