Abstract:
This chapter explores some key provisions of the European Bank Recovery and Resolution Directive (BRRD) and how it relates to deposit protection provided by the European Directive on Deposit Guarantee Schemes (DGS). It explains the structure and roles of the agencies that comprise a financial system safety net and the pertinent features of the arrangements that have been widely adopted. In particular, the chapter considers the provisions of the Directive respecting which agency within the safety net should have responsibility for bank resolutions, the ‘bail-in’ provisions embodied within the Directive, and significant issues that have yet to be addressed fully. In doing so it examines how the EU Directive lines up with work undertaken by the Financial Stability Board (FSB) and the International Association of Deposit Insurers (IADI).

This chapter focuses on the functions of the Prudential Regulation Authority (PRA) and the Financial Conduct Authority (FCA) as statutory regulators of the financial services sector in the UK. It begins with a discussion of the constitutional provisions establishing the FCA and the PRA by virtue of the Financial Services and Markets Act 2000 (FSMA). It then considers the remit of the FCA and the PRA, along with their general functions and duties, statutory objectives, and regulatory principles with respect to financial services regulation. It also examines the boundary between FCA and PRA responsibilities, arrangements for the supervision of regulated firms and for enforcement, and the co-ordination between the FCA and the PRA in the exercise of their function. Finally, it describes the PRA's power of direction, directions relating to consolidated supervision, and central government and Parliamentary oversight of the regulators.

This chapter discusses the key concepts within the EU legal order: supremacy, direct effect, indirect effect, and state liability. The doctrine of supremacy dictates that EU law takes precedence over conflicting provisions of national law. If a provision of EU law is directly effective, it gives rise to rights upon which individuals can rely directly in the national court. If an EU measure is not directly effective, a claimant may be able to rely on it through the application of indirect effect, which requires national law to be interpreted in accordance with relevant EU law. State liability gives rise to a right to damages where an individual has suffered loss because a Member State has failed to implement a directive or has committed other breaches of EU law.

Abstract:
This chapter looks at the Money Laundering (ML) Regulations of 2007. These regulations implement both the Third Money Laundering Directive and the first implementing directive of the EC Commission. For the most part, the ML Regulations 2007 adopt the ‘copy-out’ or ‘direct incorporation’ method of transposing the Community measures into English law. This means that there is a verbatim transposition of the provisions of the directive into national law. This has an obvious advantage and difficulty. The advantage is that it ensures that all of the provisions of the directive are transposed into English law. The difficulty is that it can create uncertainty. That is to say, it removes from the domestic legislature the responsibility for interpreting Community concepts in an English law context and instead imposes that burden on individuals who have to decide how these measures are to be applied in practice. The chapter also looks at the Financial Action Task Force (FAFT) recommendations.

Abstract:
Social provision in Slovenia has pursued a gradual path of development towards a post-socialist model. The country faced a pronounced recession after the 2008 economic crisis, with a second recession in 2012. This was further exacerbated by political instability with a restructuring of left and right political coalitions. These pressures, coupled with an emphasis on austerity, led to structural reforms of the welfare system, which resulted in a step change in the reform process. This chapter considers future directions in welfare in Slovenia, using data from attitude surveys and analysing policy documents in order to examine current patterns of solidarity and division in support for different aspect of welfare state provision.

This book provides a comprehensive review of the implementation of the Antitrust Damages Directive across a selected number of EU States. It looks at generic EU law issues, such as Member State process and methodology for implementing this EU Directive. It also assesses, more specifically, the national debates and their consequences at the level of substantive choices adopted—in terms of implementation of the various Directive provisions, which may necessitate some change in national legal procedures and/or remedies in relation to claims involving an EU competition law infringement. The book achieves this through discussion of the general EU law issue regarding the national methods used for transposition of an EU Directive, examining the processes and general approaches to the implementation of EU law in the form of a Directive within the legal systems of the various Member States analysed. Processes may vary from involving considerable consultation with public stakeholders to an approach confined to executive or parliamentary decision-making. Additionally, the research assesses the way in which the Antitrust Damages Directive was actually transposed and why the particular approach was adopted within the Member State, considering, for instance, whether the Directive was simply adopted as it stands (literal incorporation of its text through ‘cut and paste’) and what this will mean in terms of national court interpretation and application of the Directive/national law measures implementing it.

This chapter examines the law of set-off in France and how the country's bankruptcy law may affect the effectiveness of set-off. In France, set-off has been reaffirmed by specific rules regarding the netting of derivative products or by the EU Directive on Financial Collateral Arrangements (Collateral Directive). Other laws with relevant provisions for set-off include the French Civil Code and the French Monetary and Financial Code. The chapter first provides an overview of set-off between solvent parties, focusing on legal set-off, contractual set-off, enhanced set-off of financial obligations, cash-pooling arrangements, and security interests. It then considers set-off against insolvent parties, taking into account issues relating to automatic stay, fraudulent transfers/suspect period, and set-off of financial obligations after opening of an insolvency procedure. It also discusses the key set-off provisions of the Collateral Directive before concluding with an analysis of the law applicable to set-off in a cross-border context.
