Massima Con la Risposta ad interpello n. 693 dell’8 ottobre 2021, l’Agenzia delle Entrate ribadisce che i beneficiari residenti di un trust estero opaco sono tenuti agli obblighi di monitoraggio fiscale e chiarisce altresì che gli stessi beneficiari non possono liberarsi da siffatti obblighi nemmeno con l’intervento di una società fiduciaria residente alla quale delegare la riscossione dei proventi e delle attività distribuite dal trust. Con riguardo a quest’ultimo aspetto, l’Ufficio precisa che l’esenzione dagli obblighi RW di cui all’articolo 4, comma 3, del D.L. 28 giugno 1990, n. 167 spetta solamente se l’intermediario residente applica sul flusso finanziario amministrato un’imposta sostitutiva o una ritenuta.

L'assetto attuale della tassazione dei redditi finanziari presenta consistenti profili di criticità, tra i quali assume un rilievo centrale la connotazione in senso proporzionale dell'imposizione sostitutiva prevista per tali proventi. Si tratta di una preferenza sistematica consolidata, che i più recenti interventi normativi in materia hanno ulteriormente esteso. Obiettivo del presente lavoro è verificare la tenuta sistematica di tale scelta, considerando se in una prospettiva di riforma vi sia spazio per una rivalutazione della progressività, da attuare con meccanismi impositivi tecnicamente adeguati al comparto reddituale in oggetto. Un ulteriore profilo di indagine concerne il principio di imposizione al lordo dei redditi di capitale: tale scelta è stata talvolta giustificata proprio in relazione al fatto che la maggior parte di essi sono tassati con forme di imposizione cedolare. Questa giustificazione, però, teoricamente prospettabile se la misura dell'imposizione sostituiva dei redditi di capitale fosse più bassa rispetto alle aliquote Irpef, attualmente non regge più ad una verifica empirica.

Allium-test je jednostavni biotest za određivanje ukupne toksičnosti i genotoksičnosti kojeg učenici uz pomoć nastavnika ili samostalno mogu provesti u školi te njime testirati učinak različitih otopina na modelni organizam Allium cepa L. (obični luk). Allium-test je dobar primjer projekta u nastavi jer se svojim opsegom može prilagoditi dobi učenika, a potiče njihovu kreativnost i samostalnost u provedbi i prezentiranju samog projekta. Sam projekt i rezultati istog potiču učenike na razvijanje svijesti o vodenom okolišu i učinku onečišćenja na svim njegovim razinama.

Odredbe članaka 167.-175. Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu o postupku ovrhe na zrakoplovu pokazatelj su kako bi se u praksi teško mogao provesti jedan jasan i učinkoviti prisilni postupak namirenja vjerovnikovih tražbina na zrakoplovu. Uzrok tomu su nepotpune, odnosno nepostojeće odredbe o: založnim tražbinama na zrakoplovu koje imaju prioritet u namirenju, nadležnosti i ovlasti ovršnog suda, podnošenju prijedloga za ovrhu i donošenju rješenja o ovrsi, troškovima provedbe ovrhe koje mora prethodno snositi ovrhovoditelj, privremenim mjerama na zrakoplovu te pojedinim ovršnim radnjama tijekom provedbe ovrhe na zrakoplovu. Čl. 175. Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu navodi da se u postupku ovrhe na zrakoplovu na odgovarajući način primjenjuju odredbe čl. 867.-988. Pomorskog zakonika o ovršnoj prodaji broda, odnosno odredbe o utvrđivanju vrijednosti broda (čl. 867.) i o daljnjim radnjama koje se odnose na ovrhu i osiguranje tražbina na brodu. Međutim, tako se samo djelomično ispunjavaju pravne praznine ovršnoga dijela Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu. Odredbe kojima se uređuju prethodne ovršne radnje u provedbi ovrhe na zrakoplovu, koje je potrebno provesti do utvrđivanja vrijednosti zrakoplova, nisu odgovarajuće utvrđene. Te su radnje ključne usmjeravanju daljnjega tijeka postupka ovrhe. Stoga je i namjera istraživanja usmjerena na analitički prikaz problematične regulacije takvih prethodnih radnji u provedbi ovrhe po odredbama Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu. Prijedlozi de lege ferenda trebaju biti putokaz u dopuni postojećih odredbi o ovršnoj prodaji zrakoplova, pri čemu neka analogna rješenja Pomorskog zakonika o ovršnoj prodaji broda i poredbenog prava o ovršnoj prodaji zrakoplova trebaju biti pravni temelj.

Abstract In questo scritto si discute il ruolo dei diritti di proprietà e del rent-seeking nella gestione degli elefanti come specie in via di estinzione. In particolare, gli Autori si soffermano sul dibattito politico che si è prodotto all’interno della comunità ambientalista, divisa fra: 1) preservazionisti, che si oppongono a tutti i tipi di caccia e commercio dei prodotti derivati dagli elefanti, e 2) conservatoristi commerciali, che sono invece favorevoli alia caccia e al commercio dell’avorio e del pellame, cioè ai diritti di proprietà sugli elefanti, da riconoscere alle sole popolazioni africane.Quest’ultimo approccio si è mostrato più proficuo, sia ai fini dello sviluppo delle popolazioni africane che della salvaguardia della specie in pericolo. Il commercio dei prodotti derivati dall’elefante è una cospicua fonte di ricchezza per le popolazioni africane. Il riconoscimento dei diritti di proprietà sugli elefanti a favore di queste popolazioni ha garantito la possibilità di preservare una fonte di ricchezza legale, ridurre i fenomeni di bracconaggio e di commercio illegale e, in ultima analisi, di proteggere la specie in pericolo. L’interesse economico a ottenere vantaggiosi proventi dalla vendita dei prodotti derivati dagli elefanti ha infatti incentivato le popolazioni africane all’adozione di misure atte a proteggere il branco e a favorire al tempo stesso il suo accrescimento.La proibizione del commercio dell’avorio e del pellame di elefante ha prodotto invece solo retorica e ha creato seri problemi di sottosviluppo oltre che ambientali: non potendo ottenere alcun beneficio in termini di reddito direttamente appropriabile, le popolazioni non hanno alcun interesse ad investire sulla protezione degli elefanti. Il caso dei paesi dell’Africa Orientale e Centrale à un esempio probante dei notevoli costi sociali, in termini di declino della popolazione degli elefanti, derivanti da questo tipo di approccio.Ciò di cui si ha bisogno à quindi un approccio che bilanci l’interesse ambientale a salvaguardare la specie in pericolo e quello economico a preservare una fonte di ricchezza per le popolazioni africane.I diritti di proprietà si configurano come un primo e piccolo tassello ai fini della realizzazione di questo obiettivo.

ObjectivesIn critically ill patients requiring mechanical ventilation for at least 21 days, 1-year mortality can be estimated using the ProVent score, calculated from four variables (age, platelet count, vasopressor use and renal replacement therapy). We aimed to externally validate discrimination and calibration of the ProVent score and, if necessary, to update its underlying regression model.DesignRetrospective, observational, single-centre study.Setting11 intensive care units at one tertiary academic hospital.Patients780 critically ill adult patients receiving invasive mechanical ventilation for at least 21 days.Primary outcome measure1-year mortality after intensive care unit discharge.Results380 patients (49%) had died after 1 year. One-year mortality for ProVent scores from 0 to 5 were: 15%, 27%, 57%, 66%, 72% and 76%. Area under the receiver operating characteristic curve of the ProVent probability model was 0.76 (95% CI 0.72 to 0.79), calibration intercept was −0.43 (95% CI −0.59 to −0.27) and calibration slope was 0.76 (95% CI 0.62 to 0.89). Model recalibration and extension by inclusion of three additional predictors (total bilirubin concentration, enteral nutrition and surgical status) improved model discrimination and calibration. Decision curve analysis demonstrated that the original ProVent model had negative net benefit, which was avoided with the extended ProVent model.ConclusionsThe ProVent probability model had adequate discrimination but was miscalibrated in our patient cohort and, as such, could potentially be harmful. Use of the extended ProVent score developed by us could possibly alleviate this concern.

"Abstract: We present below two fragmentary texts carved in aere from Napoca, one known from the 19th century and the other novel, yielded by recent rescue excavations. The first inscription (Napoca-1) was carved on a bronze tablet discovered in Piaţa Muzeului no. 4. The document here might correspond to an imperial response (subscriptio), delivered by emperor Hadrian upon a request that might have been made for instance by the representatives of the town at Napoca. A second fragmentary inscription in bronze (Napoca-2) originating still from Napoca was discovered in the area of hill Feleac. The preserved words formis and ratio / procuratio are indicative of an administrative taxation type text. Abstract:
321 Background: Sip-T is an FDA approved, autologous cellular immunotherapy for mCRPC, manufactured by activating peripheral blood mononuclear cells collected by apheresis and culturing them with PA2024 (PAP fused to human GM-CSF). Overall survival (OS) in mCRPC is positively correlated with key product parameters of sip-T: CD54 upregulation; CD54+ cell count; and total nucleated cell (TNC) count. Product parameters were amplified in men with earlier stage prostate cancer vs mCRPC, including increased T cell trafficking to the prostate (Fong L, JNCI 2014) and greater CD54 upregulation and larger immune responses (Antonarakis ES, Clin Can Res 2017). Methods: ProVENT (NCT03686683) will evaluate sip-T in men with Gleason grade 1/2 prostate adenocarcinoma receiving active surveillance (target, 450 men; randomized 2:1 to receiving sip-T or not). We evaluated apheresis and final key product parameters (CD54 upregulation; CD54+ cell count; and TNC count) for each infused product as well as cumulative values while also comparing with IMPACT (NCT00065442) study results. Results: This preliminary analysis describes data from the first 184 sip-T men in ProVENT. CD54 upregulation profiles were consistent between IMPACT and ProVent, peaking in week 2 products; however, values at each treatment week, and subsequently cumulative CD54 upregulation, were statistically significantly higher for ProVENT (P<0.001 per comparison; Table). The number of CD54+ cells was significantly greater at each treatment for both incoming apheresis as well as the final product, including cumulative values, in ProVENT compared to IMPACT (P<0.001 per comparison) as was TNC count (P<0.001 per comparison). Conclusions: This preliminary analysis of product parameters in ProVENT suggest sip-T potency is higher in pts undergoing active surveillance. Clinical trial information: NCT03686683. Penelitian ini bertujuan untuk mengetahui anatomi komparatif batang pada Gyrinops versteegii (Thymelaeaceae) di Pulau Sumbawa. Sampel batang pohon gaharu G. versteegii yang digunakan merupakan koleksi dari Laboratorium Pusat Kajian Gaharu FMIPA Universitas Mataram yang diambil dari Pulau Sumbawa. Pembuatan preparat menggunakan metode permanen dengan pengirisan menggunakan free hand section, dan metode maserasi. Data yang diamati meliputi jaringan korteks, xilem , empulur, dan keristal Ca-Oksalat. Hasil penelitian diketahui bahwa ditemukan empat provenan Gyrinops versteegii di Pulau Sumbawa yakni provenan Pantai, Hajumee, Kayuk pisak dan provenan baru (provenan Tartar). Komparasi anatomi antara batang G. versteegii provenan Pantai dengan provenan lainnya memiliki perbedaan pada tebal periderm, bentuk jaringan sklerenkim, tebal interxylary phloem, diameter parenkim korteks, jumlah barisan jaringan parenkim kayu, diameter trakeida, diameter sel empulur, bentuk Ca-oxalat. Provenan Hajumee dengan Tartar dan Kayuk pisak berbeda pada panjang trakea, diameter trakea, dan panjang trakeida, sedangkan provenan Tartar dan Kayuk pisak berbeda pada frekuensi trakea, panjang trakeid serabut, susunan jari-jari empulur, dan letak empulur.

Abstract:
Due to its initial dependence on testosterone, prostate cancer patients are initially treated with androgen deprivation therapy, a form of chemical castration. However, in many cases, the cancer develops resistance to this treatment. Sipuleucel-T (Provenge), is the first live cell vaccine approved for treating patients with advanced, hormonally refractive prostate cancer. However, it has shown limited survival benefit. Recently, it has been proposed that combining Provenge with androgen deprivation may result in a better treatment outcome. Here, we develop a nonlinear dynamical systems model with a view to predicting the therapeutic potential of such a combination. Our model accounts for the mechanism of action of Provenge and the immune system response elicited by androgen deprivation. We use data from mouse xenograft experiments to calibrate and validate our model. The validated model is then used to explain the limited clinical success of Provenge, and predict optimal scheduling that maximizes the anti-tumor potential of Provenge combined with androgen deprivation. In particular, we demonstrate that the two treatments should be given concurrently, rather than sequentially, as is current practice.

Wine exports from Provence have grown by over 30% in ten years. In response to the pandemic, the constituent appellations of this region1 have adapted to the closure of consumer frontiers. The expansion of local consumption through œnotourism in the locality of the viticultural terroir provides an element of resilience through which the industry can pursue its ambitions. In order to sustain performance, territorial promotion needs to coexist with geographical indications (GIs), and to permit the exploitation of expertise associated with the latter. While the wines of Provence are the only viticultural beverages which are permitted, under the terms of French and EU legislation, to be designated by the distinctive term « Provence »2, their constituent appellations fall within a broader administrative territory, under the name of the Provence-Alpes-Côtes d’Azur Region (PACA).

Abstract:
Background Among patients with acute respiratory failure requiring prolonged mechanical ventilation, tracheostomies are typically placed after approximately 7 to 10 days. Yet half of patients admitted to the intensive care unit receiving tracheostomy will die within a year, often within three months. Existing mortality prediction models for prolonged mechanical ventilation, such as the ProVent Score, have poor sensitivity and are not applied until after 14 days of mechanical ventilation. We developed a model to predict 3-month mortality in patients requiring more than 7 days of mechanical ventilation using deep learning techniques and compared this to existing mortality models. Methods Retrospective cohort study. Setting: The Medical Information Mart for Intensive Care III Database. Patients: All adults requiring ≥ 7 days of mechanical ventilation. Measurements: A neural network model for 3-month mortality was created using process-of-care variables, including demographic, physiologic and clinical data. The area under the receiver operator curve (AUROC) was compared to the ProVent model at predicting 3 and 12-month mortality. Shapley values were used to identify the variables with the greatest contributions to the model. Results There were 4,334 encounters divided into a development cohort (n = 3467) and a testing cohort (n = 867). The final deep learning model included 250 variables and had an AUROC of 0.74 for predicting 3-month mortality at day 7 of mechanical ventilation versus 0.59 for the ProVent model. Older age and elevated Simplified Acute Physiology Score II (SAPS II) Score on intensive care unit admission had the largest contribution to predicting mortality. Discussion We developed a deep learning prediction model for 3-month mortality among patients requiring ≥ 7 days of mechanical ventilation using a neural network approach utilizing readily available clinical variables. The model outperforms the ProVent model for predicting mortality among patients requiring ≥ 7 days of mechanical ventilation. This model requires external validation.

Abstract:
PURPOSE: Provenge (Dendreon Corp, Seattle, WA) is an immunotherapy product consisting of autologous dendritic cells loaded ex vivo with a recombinant fusion protein consisting of prostatic acid phosphatase (PAP) linked to granulocyte-macrophage colony-stimulating factor. Sequential phase I and phase II trials were performed to determine the safety and efficacy of Provenge and to assess its capacity to break immune tolerance to the normal tissue antigen PAP. PATIENTS AND METHODS: All patients had hormone-refractory prostate cancer. Dendritic-cell precursors were harvested by leukapheresis in weeks 0, 4, 8, and 24, loaded ex vivo with antigen for 2 days, and then infused intravenously over 30 minutes. Phase I patients received increasing doses of Provenge, and phase II patients received all the Provenge that could be prepared from a leukapheresis product. RESULTS: Patients tolerated treatment well. Fever, the most common adverse event, occurred after 15 infusions (14.7%). All patients developed immune responses to the recombinant fusion protein used to prepare Provenge, and 38% developed immune responses to PAP. Three patients had a more than 50% decline in prostate-specific antigen (PSA) level, and another three patients had 25% to 49% decreases in PSA. The time to disease progression correlated with development of an immune response to PAP and with the dose of dendritic cells received. CONCLUSION: Provenge is a novel immunotherapy agent that is safe and breaks tolerance to the tissue antigen PAP. Preliminary evidence for clinical efficacy warrants further exploration.

AbstractThe Pyrenean-Provence fold-thrust belt is characterized by a geological complexity arising from superimposed tectonic history and the propagation of the deformation through a heterogeneous mechanical substratum inherited from Paleozoic and Mesozoic times. The construction of a regional balanced cross section together with field data show that the thrust system of the southeastern Provence region is characterized by a mixed thick- and thin-skinned tectonic style related to the inversion of deep-seated late Paleozoic-Triassic extensional structures and the décollement of the Mesozoic-Cenozoic sedimentary cover above Triassic series. Earliest Cenomanian restoration state highlights the northward pinched-out of the Lower Cretaceous sedimentary series above the main long-wavelength Durance High uplift. Latest Santonian restoration state indicates a southward tilting of ~2° of the basin attributed to the initial growth of the Pyrenean-Provence prism controlling the external flexure of the foreland. Thrusts propagation in the northern part of the Pyrenean-Provence fold-thrust belt was recorded to be synchronous during latest Cretaceous to Eocene time and produced a ~7° southward basin tilting. This major tilting is attributed to the tectonic inversion and basement thrust stacking of the Cap Sicié-Sainte Baume units. Cross section balancing shows a total horizontal basement shortening of 40 km (~35 %) across the Pyrenean-Provence foreland. The main part of this shortening (~37 km) was accommodated by thick-skinned thrusts involving basement south of the Arc syncline. ~5 km of shortening were accommodated northward by the Arc syncline and eastern Sainte-Victoire thin-skin structures, resulting from slip transferred from the deep thick-skinned intercutaneous thrust wedge. Finally we interpret salt tectonic structures of the southeastern Provence as passive diapirism growth during Jurassic to late Cretaceous time, and then reactivated during Pyrenean-Provence compression. Late normal faulting related to hypothetical reactive diapirism during the Oligocene extension episode was predominantly localized above inherited salt structures and probably controlled by inherited basement faults.

Ce n’est qu’en 1990, que d’autres produits alimentaires ont pu accéder à ce précieux Graal, à cette reconnaissance d’un savoir-faire, d’un lien au terroir incontestable. Les huiles d’olive ont rapidement saisi l’intérêt de cette reconnaissance et dès 1994, la première appellation d’origine oléicole a vu le jour. Une naissance qui en a appelé d’autres, bénéficiant du et au dynamisme de la filière oléicole. En 2018, les huiles françaises comptent 8 appellations d’origine (Nyons, Vallée des Baux-de-Provence, Aix-en-Provence, Haute-Provence, Nice, Nîmes, Corse-Oliu di Corsica et Provence) dont les spécificités sont successivement exposées dans cet article. Après 24 ans d’existence, on peut se poser la question de ce succès et des retombées des appellations dans la filière et faire un premier bilan de ces deux décennies.

Objective.To quantify the effectiveness of nasal expiratory positive airway pressure (nasal EPAP) devices or Provent as treatment for obstructive sleep apnea (OSA).Methods.PubMed and six other databases were searched through November 15, 2015, without language limitations.Results.Eighteen studies (920 patients) were included. Pre- and post-nasal EPAP means ± standard deviations (M ± SD) for apnea-hypopnea index (AHI) in 345 patients decreased from27.32±22.24to12.78±16.89events/hr (relative reduction = 53.2%). Random effects modeling mean difference (MD) was −14.78 events/hr [95% CI −19.12, −10.45],pvalue < 0.00001. Oxygen desaturation index (ODI) in 247 patients decreased from21.2±19.3to12.4±14.1events/hr (relative reduction = 41.5%,pvalue < 0.00001). Lowest oxygen saturation (LSAT) M ± SD improved in 146 patients from83.2±6.8% to86.2±11.1%, MD 3 oxygen saturation points [95% CI 0.57, 5.63]. Epworth Sleepiness Scale (ESS) M ± SD improved (359 patients) from9.9±5.3to7.4±5.0, MD −2.5 [95% CI −3.2, −1.8],pvalue < 0.0001.Conclusion.Nasal EPAP (Provent) reduced AHI by 53.2%, ODI by 41.5% and improved LSAT by 3 oxygen saturation points. Generally, there were no clear characteristics (demographic factors, medical history, and/or physical exam finding) that predicted favorable response to these devices. However, limited evidence suggests that high nasal resistance could be associated with treatment failure. Additional studies are needed to identify demographic and polysomnographic characteristics that would predict therapeutic success with nasal EPAP (Provent).

Abstract:
In the long history of French translations of Vergilian Eclogues, the work of M. Pagnol (1895-1974) has a special place. The novelist, playwright and filmmaker (the first one of them elected to Académie Française) published his version of pastoral poems in 1958, two years after the highly artistic edition of P. Valéry. In a sociocultural approach, Pagnol’s translation is usually considered as a sophisticated tool of marketing used to remodel the image of the author. The popular and rich star of French theatre and cinema is not really accepted neither by academic literature nor by the movements of literary radicalism because of his regional features and his cheap sentimentalism. By translating Virgil in a quasi-academic way, by editing a text with a preface, commentary and notes, Pagnol would highlight his erudition and postulate a place for himself among the Classics. Nevertheless, his very funny and personal way to interpret Virgil, his cultural commentaries, and his ethical remarks based on the norms of modern urban society make the Latin poet accessible for a very wide audience. The current paper focuses on the aesthetic features of his work. Being born in Provence, passionate of the Mediterranean landscape and highly influenced by classical mythology, Pagnol appears to emphasize the Latin origins of his homeland, the cultural and ethnical continuity between the Antiquity and the 20th century, with a strong apparent wish to revive thousand-year-old traditions.

A eliminação da etapa de enraizamento in vitro na micropropagação de plantas é desejável do ponto de vista econômico, além de proporcionar a melhoria na qualidade do sistema radicial formado. Dois experimentos foram realizados com os objetivos de avaliar diferentes concentrações (0; 2,5; 5,0 e 10mM) de ácido indolbutírico (AIB) no enraizamento ex vitro de lavanda (L. angustifolia), cv. 'Provence Blue' e avaliar a capacidade de enraizamento ex vitro das cultivares 'Vera', 'Provence Blue', 'English' e 'Elegance Ice'. Após 30 dias, foi avaliado o número de microestacas enraizadas, comprimento das raízes principais, porcentagem de enraizamento e porcentagem de sobrevivência. A concentração de 5,0mM de AIB foi mais efetiva para o comprimento de raízes e porcentagem de enraizamento das microestacas de lavanda cv. 'Provence Blue', apesar de reduzir o número de raízes formadas. Entre as cultivares estudadas, a porcentagem de sobrevivência das plantas variou de 82% a 100%. As cultivares apresentaram diferenças no enraizamento ex vitro das microestacas, sendo as maiores médias de porcentagem de enraizamento registradas na 'Provence Blue' e 'Elegance Ice'. Conclui-se que a microestaquia pode ser uma técnica eficiente para a propagação de lavanda, pelo tratamento das microestacas com 5,0mM de AIB, por proporcionar alta porcentagem de enraizamento e sobrevivência das plantas.
