Massima Con la Risposta ad interpello n. 693 dell’8 ottobre 2021, l’Agenzia delle Entrate ribadisce che i beneficiari residenti di un trust estero opaco sono tenuti agli obblighi di monitoraggio fiscale e chiarisce altresì che gli stessi beneficiari non possono liberarsi da siffatti obblighi nemmeno con l’intervento di una società fiduciaria residente alla quale delegare la riscossione dei proventi e delle attività distribuite dal trust. Con riguardo a quest’ultimo aspetto, l’Ufficio precisa che l’esenzione dagli obblighi RW di cui all’articolo 4, comma 3, del D.L. 28 giugno 1990, n. 167 spetta solamente se l’intermediario residente applica sul flusso finanziario amministrato un’imposta sostitutiva o una ritenuta.

Abstract:
L'assetto attuale della tassazione dei redditi finanziari presenta consistenti profili di criticità, tra i quali assume un rilievo centrale la connotazione in senso proporzionale dell'imposizione sostitutiva prevista per tali proventi. Si tratta di una preferenza sistematica consolidata, che i più recenti interventi normativi in materia hanno ulteriormente esteso. Obiettivo del presente lavoro è verificare la tenuta sistematica di tale scelta, considerando se in una prospettiva di riforma vi sia spazio per una rivalutazione della progressività, da attuare con meccanismi impositivi tecnicamente adeguati al comparto reddituale in oggetto. Un ulteriore profilo di indagine concerne il principio di imposizione al lordo dei redditi di capitale: tale scelta è stata talvolta giustificata proprio in relazione al fatto che la maggior parte di essi sono tassati con forme di imposizione cedolare. Questa giustificazione, però, teoricamente prospettabile se la misura dell'imposizione sostituiva dei redditi di capitale fosse più bassa rispetto alle aliquote Irpef, attualmente non regge più ad una verifica empirica.

Abstract:
Allium-test je jednostavni biotest za određivanje ukupne toksičnosti i genotoksičnosti kojeg učenici uz pomoć nastavnika ili samostalno mogu provesti u školi te njime testirati učinak različitih otopina na modelni organizam Allium cepa L. (obični luk). Allium-test je dobar primjer projekta u nastavi jer se svojim opsegom može prilagoditi dobi učenika, a potiče njihovu kreativnost i samostalnost u provedbi i prezentiranju samog projekta. Sam projekt i rezultati istog potiču učenike na razvijanje svijesti o vodenom okolišu i učinku onečišćenja na svim njegovim razinama.

Odredbe članaka 167.-175. Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu o postupku ovrhe na zrakoplovu pokazatelj su kako bi se u praksi teško mogao provesti jedan jasan i učinkoviti prisilni postupak namirenja vjerovnikovih tražbina na zrakoplovu. Uzrok tomu su nepotpune, odnosno nepostojeće odredbe o: založnim tražbinama na zrakoplovu koje imaju prioritet u namirenju, nadležnosti i ovlasti ovršnog suda, podnošenju prijedloga za ovrhu i donošenju rješenja o ovrsi, troškovima provedbe ovrhe koje mora prethodno snositi ovrhovoditelj, privremenim mjerama na zrakoplovu te pojedinim ovršnim radnjama tijekom provedbe ovrhe na zrakoplovu. Čl. 175. Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu navodi da se u postupku ovrhe na zrakoplovu na odgovarajući način primjenjuju odredbe čl. 867.-988. Pomorskog zakonika o ovršnoj prodaji broda, odnosno odredbe o utvrđivanju vrijednosti broda (čl. 867.) i o daljnjim radnjama koje se odnose na ovrhu i osiguranje tražbina na brodu. Međutim, tako se samo djelomično ispunjavaju pravne praznine ovršnoga dijela Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu. Odredbe kojima se uređuju prethodne ovršne radnje u provedbi ovrhe na zrakoplovu, koje je potrebno provesti do utvrđivanja vrijednosti zrakoplova, nisu odgovarajuće utvrđene. Te su radnje ključne usmjeravanju daljnjega tijeka postupka ovrhe. Stoga je i namjera istraživanja usmjerena na analitički prikaz problematične regulacije takvih prethodnih radnji u provedbi ovrhe po odredbama Zakona o obveznim i stvarnopravnim odnosima u zračnom prometu. Prijedlozi de lege ferenda trebaju biti putokaz u dopuni postojećih odredbi o ovršnoj prodaji zrakoplova, pri čemu neka analogna rješenja Pomorskog zakonika o ovršnoj prodaji broda i poredbenog prava o ovršnoj prodaji zrakoplova trebaju biti pravni temelj.

Abstract In questo scritto si discute il ruolo dei diritti di proprietà e del rent-seeking nella gestione degli elefanti come specie in via di estinzione. In particolare, gli Autori si soffermano sul dibattito politico che si è prodotto all’interno della comunità ambientalista, divisa fra: 1) preservazionisti, che si oppongono a tutti i tipi di caccia e commercio dei prodotti derivati dagli elefanti, e 2) conservatoristi commerciali, che sono invece favorevoli alia caccia e al commercio dell’avorio e del pellame, cioè ai diritti di proprietà sugli elefanti, da riconoscere alle sole popolazioni africane.Quest’ultimo approccio si è mostrato più proficuo, sia ai fini dello sviluppo delle popolazioni africane che della salvaguardia della specie in pericolo. Il commercio dei prodotti derivati dall’elefante è una cospicua fonte di ricchezza per le popolazioni africane. Il riconoscimento dei diritti di proprietà sugli elefanti a favore di queste popolazioni ha garantito la possibilità di preservare una fonte di ricchezza legale, ridurre i fenomeni di bracconaggio e di commercio illegale e, in ultima analisi, di proteggere la specie in pericolo. L’interesse economico a ottenere vantaggiosi proventi dalla vendita dei prodotti derivati dagli elefanti ha infatti incentivato le popolazioni africane all’adozione di misure atte a proteggere il branco e a favorire al tempo stesso il suo accrescimento.La proibizione del commercio dell’avorio e del pellame di elefante ha prodotto invece solo retorica e ha creato seri problemi di sottosviluppo oltre che ambientali: non potendo ottenere alcun beneficio in termini di reddito direttamente appropriabile, le popolazioni non hanno alcun interesse ad investire sulla protezione degli elefanti. Il caso dei paesi dell’Africa Orientale e Centrale à un esempio probante dei notevoli costi sociali, in termini di declino della popolazione degli elefanti, derivanti da questo tipo di approccio.Ciò di cui si ha bisogno à quindi un approccio che bilanci l’interesse ambientale a salvaguardare la specie in pericolo e quello economico a preservare una fonte di ricchezza per le popolazioni africane.I diritti di proprietà si configurano come un primo e piccolo tassello ai fini della realizzazione di questo obiettivo.

ObjectivesIn critically ill patients requiring mechanical ventilation for at least 21 days, 1-year mortality can be estimated using the ProVent score, calculated from four variables (age, platelet count, vasopressor use and renal replacement therapy). We aimed to externally validate discrimination and calibration of the ProVent score and, if necessary, to update its underlying regression model.DesignRetrospective, observational, single-centre study.Setting11 intensive care units at one tertiary academic hospital.Patients780 critically ill adult patients receiving invasive mechanical ventilation for at least 21 days.Primary outcome measure1-year mortality after intensive care unit discharge.Results380 patients (49%) had died after 1 year. One-year mortality for ProVent scores from 0 to 5 were: 15%, 27%, 57%, 66%, 72% and 76%. Area under the receiver operating characteristic curve of the ProVent probability model was 0.76 (95% CI 0.72 to 0.79), calibration intercept was −0.43 (95% CI −0.59 to −0.27) and calibration slope was 0.76 (95% CI 0.62 to 0.89). Model recalibration and extension by inclusion of three additional predictors (total bilirubin concentration, enteral nutrition and surgical status) improved model discrimination and calibration. Decision curve analysis demonstrated that the original ProVent model had negative net benefit, which was avoided with the extended ProVent model.ConclusionsThe ProVent probability model had adequate discrimination but was miscalibrated in our patient cohort and, as such, could potentially be harmful. Use of the extended ProVent score developed by us could possibly alleviate this concern.

"Abstract: We present below two fragmentary texts carved in aere from Napoca, one known from the 19th century and the other novel, yielded by recent rescue excavations. The first inscription (Napoca-1) was carved on a bronze tablet discovered in Piaţa Muzeului no. 4. The document here might correspond to an imperial response (subscriptio), delivered by emperor Hadrian upon a request that might have been made for instance by the representatives of the town at Napoca. A second fragmentary inscription in bronze (Napoca-2) originating still from Napoca was discovered in the area of hill Feleac. The preserved words formis and ratio / procuratio are indicative of an administrative taxation type text. Keywords: bronze inscriptions, legal text, imperial rescript, Napoca Rezumat: Prezentăm aici două texte fragmentare incizate in aere din Napoca, unul cunoscut din secolul al XIX-lea şi altul nou, provenit din cercetări de salvare recente. Aceste documente poate fi un răspuns imperial (subscriptio) dat de împăratul Hadrian unei cereri făcute de reprezentanţii oraşului Napoca. Abstract:
321 Background: Sip-T is an FDA approved, autologous cellular immunotherapy for mCRPC, manufactured by activating peripheral blood mononuclear cells collected by apheresis and culturing them with PA2024 (PAP fused to human GM-CSF). Overall survival (OS) in mCRPC is positively correlated with key product parameters of sip-T: CD54 upregulation; CD54+ cell count; and total nucleated cell (TNC) count. Product parameters were amplified in men with earlier stage prostate cancer vs mCRPC, including increased T cell trafficking to the prostate (Fong L, JNCI 2014) and greater CD54 upregulation and larger immune responses (Antonarakis ES, Clin Can Res 2017). Methods: ProVENT (NCT03686683) will evaluate sip-T in men with Gleason grade 1/2 prostate adenocarcinoma receiving active surveillance (target, 450 men; randomized 2:1 to receiving sip-T or not). We evaluated apheresis and final key product parameters (CD54 upregulation; CD54+ cell count; and TNC count) for each infused product as well as cumulative values while also comparing with IMPACT (NCT00065442) study results. Results: This preliminary analysis describes data from the first 184 sip-T men in ProVENT. CD54 upregulation profiles were consistent between IMPACT and ProVent, peaking in week 2 products; however, values at each treatment week, and subsequently cumulative CD54 upregulation, were statistically significantly higher for ProVENT (P<0.001 per comparison; Table). The number of CD54+ cells was significantly greater at each treatment for both incoming apheresis as well as the final product, including cumulative values, in ProVENT compared to IMPACT (P<0.001 per comparison) as was TNC count (P<0.001 per comparison). Conclusions: This preliminary analysis of product parameters in ProVENT suggest sip-T potency is higher in pts undergoing active surveillance. Clinical trial information: NCT03686683. Abstract:
Penelitian ini bertujuan untuk mengetahui anatomi komparatif batang pada Gyrinops versteegii (Thymelaeaceae) di Pulau Sumbawa. Sampel batang pohon gaharu G. versteegii yang digunakan merupakan koleksi dari Laboratorium Pusat Kajian Gaharu FMIPA Universitas Mataram yang diambil dari Pulau Sumbawa. Pembuatan preparat menggunakan metode permanen dengan pengirisan menggunakan free hand section, dan metode maserasi. Data yang diamati meliputi jaringan korteks, xilem , empulur, dan keristal Ca-Oksalat. Hasil penelitian diketahui bahwa ditemukan empat provenan Gyrinops versteegii di Pulau Sumbawa yakni provenan Pantai, Hajumee, Kayuk pisak dan provenan baru (provenan Tartar). Komparasi anatomi antara batang G. versteegii provenan Pantai dengan provenan lainnya memiliki perbedaan pada tebal periderm, bentuk jaringan sklerenkim, tebal interxylary phloem, diameter parenkim korteks, jumlah barisan jaringan parenkim kayu, diameter trakeida, diameter sel empulur, bentuk Ca-oxalat. Provenan Hajumee dengan Tartar dan Kayuk pisak berbeda pada panjang trakea, diameter trakea, dan panjang trakeida, sedangkan provenan Tartar dan Kayuk pisak berbeda pada frekuensi trakea, panjang trakeid serabut, susunan jari-jari empulur, dan letak empulur.

Abstract:
Con l'avvento della globalizzazione, il fenomeno della criminalità organizzata ha intensificato la sua potenza, generando numerosi squilibri, in un Paese come l'Italia, già sconfortato dalla crisi economica. L'elaborato riporta un'excurssus storico sulle differenti disposizione che disciplinano la materia. Inizialmente è stato introdotto l'articolo 14 del Dl 537/1993; esso presentava però numerosi dubbi interpretativi e violazioni costituzionali, dettagliatamente analizzati nella composizione. Pertanto, dopo varie modifiche, si è provveduto alla radicale sostituzione della norma, mediante l'emanazione dell'articolo 8 del Dl 16/2012. Al termine è stato riportato qualche accenno relativo alla "Voluntary Disclosure", detta anche "Collaborazione Volontaria", tuttora in discussione alle Camere.

Abstract:
Il presente lavoro di ricerca ha l’obiettivo di ricostruire sistematicamente, in base al diritto attualmente vigente, la posizione giuridica di ciascuno di tali soggetti “terzi” rispetto alla confisca dei proventi dei reati economici. Una lesione alla sfera giuridica individuale può avvenire nei confronti di diversi soggetti, che non hanno partecipato alla commissione del reato, ma che al provento di esso o comunque al patrimonio o all’attività economica del reo risultano in qualche modo legati. Nel momento in cui il sequestro vincola e la confisca sottrae alcune utilità al destinatario diretto della misura, gli effetti negativi si estendono a coloro che hanno una pretesa sullo specifico bene oggetto di ablazione (proprietari o comproprietari, titolari o co-titolari di diritti reali e personali); a coloro che, risultando creditori del reo, hanno a cuore l’integrità del suo patrimonio, soprattutto nelle situazioni di crisi, in cui esso è incapiente; infine, nei casi in cui sono presi di mira beni strategici per un’impresa, ai c.d. stakeholder, vale a dire ai soggetti che per vari motivi orbitano attorno all’attività economica ed hanno interesse alla prosecuzione della stessa.
My research concern the protection of the third parties in relation of the confiscation of proceeds of crime. In particular, it’s possible to distinguish three categories of “thirds”: - the variegated category of subjects who have a specific pretense on the specific asset object of the confiscation (titular of right of property, to lease, etc.), against the interest of the State to remove the dangerous criminal product; - the subjects who have an interest to preserve the integrity of the assets of the criminal (creditors), against the claim of the Public Authorities to ablate the illicit proceeds; - - the diversified category of subjects who have a gain in the prosecution of the economic activity (the stakeholder: employees, supplies, creditors, small investors, etc.).

Abstract:
La disciplina dei proventi di natura illecita è una questione centrale, in particolar modo per il diritto tributario, tanto che è stata oggetto di dibattiti e di studio per molti decenni. L'obiettivo dell'elaborato è di fornire un quadro generale sullo scenario attuale riguardante i proventi illeciti, dopo aver dato alcune coordinate generali proprie della materia tributaria; lo snodo centrale però è l'indagine della loro relativa tassabilità, attraverso un excursus tra le varie posizioni, talvolta contrastanti, di dottrina e giurisprudenza, che si sono susseguite negli anni. L'introduzione dell'articolo 14, comma 4, della legge n.537/1993 ha colmato il vuoto normativo sulla questione. L'ultima parte del lavoro è, invece, dedicata agli aspetti procedimentali relativi all'accertamento dei redditi illeciti, tramite l'analisi delle principali metodologie di controllo a disposizione degli organismi di vigilanza, senza tralasciare la concreta possibilità che questi siano sottoposti a misure ablative, quali sequestro e confisca.

Abstract:
Le questioni relative alla tassazione dei proventi di natura illecita e l’indeducibilità dei costi da reato possono presentare un punto di vista innovativo per riconsiderare alcuni dei principi sanciti dalla Carta Costituzionale quali: il principio di capacità contributiva, il principio di uguaglianza, il principio di legalità e il principio di riserva di legge. Attraverso l’analisi di questi principi si è giunti alla determinazione della funzione impositiva e sanzionatoria dello Stato e alla demarcazione dei confini dei concetti di reddito, tributo e sanzione. La tassazione dei proventi di natura illecita, poi, rappresenta una questione molto discussa sia in dottrina che in giurisprudenza. Il legislatore, infatti, è più volte intervenuto, con norme non sempre del tutto coerenti o censurabili dal punto di vista costituzionale; fino ai due interventi con il comma 4 dell’art. 14 della Legge 24 dicembre 1993 n. 537 e il comma 34 bis dell’art. 36 del Decreto Legge n. 223 del 2006 con il quale il legislatore ha inteso ricondurre i proventi da reato all’interno della base imponibile anche per rispondere all’istanza costituzionale della redistribuzione ai fini sociali delle imposte. Anche la questione dell’indeducibilità dei costi da reato solleva delle perplessità analoghe, sia in merito agli eventuali profili di incostituzionalità delle norme, sia per il campo di applicazione delle stesse, sia per le considerazioni in merito alla natura sanzionatoria o meno delle norme. La discussione relativa a questi aspetti apre degli interessanti scenari in merito ai rapporti tra il processo tributario e il processo penale. In particolare l’introduzione dei concetti di autonomia del processo penale rispetto al processo tributario con il Decreto Legislativo n. 74 del 10 marzo 2000 e la codificazione del principio del “doppio binario” hanno dato la possibilità di fare in modo che i due processi potessero svolgersi parallelamente. In particolare il Decreto Legislativo 74/2000 ha introdotto agli articoli 19 e 20 i principi di autonomia e specialità che consentono di stabilire quale norma possa essere considerata speciale e quindi valere sulle altre: nei casi in cui a un fatto possano essere applicate sia una norma penale che una tributaria, il principio di specialità consente di determinare quale debba essere valutata come speciale rispetto all’altra. Abstract:
Denna studie syftar till att undersöka hur lärare i årskurs 6 upplever de nya nationella proven i årskurs 6.  Studien har genomförts genom intervjuer med lärare som är verksamma i årskurs 6 under hösten 2012 där lärarnas generella uppfattning om de nationella proven samt hur proven påverkar lärarnas arbete har varit det centrala i undersökningen. I studien ingick sex stycken lärare från tre olika län i Sverige. I studien framgår det att lärarna har en positiv inställning till de nationella proven men upplever att det är väldigt tidskrävande att genomföra dem. Lärarna anser även att proven är ett bra verktyg för att utvärdera deras egen undervisning, att ett gott resultat vid nationella proven innebär att man bedrivit en bra undervisning och att eleverna lärt sig det som de förväntas lära sig. Huruvida proven påverkar det dagliga arbetet i klassrummet så är lärarna inte helt överens, men att de påverkar deras arbete på ett eller annat sätt kan man tydligt se i studiens resultat. I analys och diskussion lyfts debatten om läraryrkets förändringar har lett till en intensifiering eller en professionalisering, i denna studie kan man se tendenser åt båda håll och något svar på den frågan ges inte. I studiens konstateras dock att lärarna har fått ett utökat ansvar och i och med ett ökat ansvar så skapas fler arbetsuppgifter vilket har medfört att lärarna i denna studie upplever att de inte hinner med sina arbetsuppgifter inom ramen för 45h/arbetsvecka.

Denna studie har till syfte att undersöka hur lärare upplever att arbetet inför det nationella provet i årskurs 3 påverkar undervisningen och elevernas prestationer. För att besvara syftet har följande forskningsfrågor ställts till studien: 1) Väljer lärare att förbereda elever inför det nationella provet i åk 3 eller inte?, 2) Hur upplever lärare att nationella provet påverkar deras undervisningsvanor samt elevernas kunskapsutveckling? och 3) Hur påverkas lärarnas upplevelser och arbete med det nationella provet i åk 3 utifrån deras arbetslivserfarenhet, ålder, skolans geografiska placering och skolans socioekonomiska område?För att besvara forskningsfrågorna har data samlats in genom en enkätmetod. Analysen behandlar webbaserade enkätsvar från 116 respondenter och enkäten innehåller 27 frågor. I analysen framträder det likartade svar som vi sedan har kategoriserats. I diskussionsavsnitt har vi diskuterat resultaten utifrån studiens bakgrund och tidigare forskning. Studiens resultat är samstämmiga med tidigare forskning. Lärare som väljer att förbereda sina elever inför det nationella provet menar att de främst gör det för elevernas skull. Det är spridning i svaren kring hur mycket nationella provet påverkar deras övriga undervisning. Detsamma gäller hur lärarna upplever ifall provet hjälper eleverna att prestera bättre inom vissa ämnen. Utifrån analysen framkommer det att lärarnas upplevelser och arbete inför det nationella provet i åk 3 inte påverkas av faktorer såsom arbetslivserfarenhet eller sociala miljö i vilket de verkar. Slutsatsen är att det finns många faktorer som avgör huruvida en lärare väljer att agera i en viss situation, i detta fall arbetet med nationella provet och det kan få konsekvenser för elevernas möjligheter att lyckas.

Syftet med detta examensarbete är att undersöka hur lärare uppfattar att kursen Matematik 1a påverkas av det obligatoriska nationella provet. Kursen har reviderats under senaste gymnasiereformen, men det nationella provet ser likadant ut som tidigare. En kvalitativ metod med öppen frågeställning används för att fånga lärares uppfattningar och svaren från intervjuerna analyseras utifrån ett sociokulturellt perspektiv. I analysen används forskning från hur lärare reagerat vid tidigare skolreformer samt hur lärare hanterade nationella provet innan Gy11.Resultatet visar att provets inte direkt påverkar enskilda elevernas betyg i någon högre grad i förhållande till lärarens uppfattning innan provtillfället. Indirekt påverkas dock eleven genom att hela kursen inriktas på att ge goda förutsättningar att lyckas i det nationella provet. De yrkesrelaterade momenten som syftar till att göra kursen mer begriplig och konkret ges enligt lärarna mindre utrymme än vad som anges i Gy11 eftersom dessa inte bedöms i nationella provet.

Syftet med det här arbetet var att få en djupare förståelse för vad de nationella proven har för betydelse för matematikundervisningen. Ett annat syfte var att undersöka vad lärare tyckte om de nationella proven och hur de påverkar undervisningen, bedömningen och betygssättningen i matematikämnet. I studien har fem verksamma lärare i årskurs 6 intervjuats angående sina åsikter och erfarenheter kring de nationella proven. Resultatet visade att lärarna är positivt inställda till proven men att bland annat rättningen är det jobbiga med proven. De nationella proven ha en stor påverkan på undervisningen enligt lärarna då de repeterar mycket inför proven. Lärarna anser att proven påverkar bedömning och betygssättning i matematiken men att det inte är det enda som de väger in när de sätter betyg.

Plasma gasification is an efficient and environmentally responsible form of thermal treatment of wastes. In the plasma gasification process, extremely high temperature gases are used to break down the molecular structure of complex carboncontaining materials — such as municipal solid waste (MSW), tires, hazardous waste and sewage sludge — and convert them into synthesis gas (syngas) containing hydrogen and carbon monoxide that can be used to generate power or other sustainable sources of energy. Gasification occurs in an oxygen starved environment so the waste is gasified, not incinerated.
