Abstract:

There are always painful tradeoffs in environmental problems. In the current period, the tradeoff. has to be made between consuming environmental goods and "dirty" goods. Since many pollutants accumulate in nature and cause long time problems, the current period's decision also has important impacts on future generations. This yields another tradeoff. between control of the pollution flow and cleanup of the pollution stock in the future. For a local government, tradeoffs between strict environmental policies and local economic prosperity are also concerns.

This thesis analyzes the tradeoffs made by households, firms and government under different policy regimes. Chapter 2 considers assigning tradable permits to households that are suffering from pollution generated by firms. The households can sell a limited number of permits to polluters according to personal preferences for environmental goods and "dirty" goods. It is shown that, the market transaction between households and polluters can achieve the efficient pollution level. Chapter 3 considers a case in which the stock pollution is reversible with capital investment. In a natural resource extraction model with externalities of heavy metal pollution in the surrounding farmland, the firms tradeoff. between controlling the pollution flow and abating the pollution stock, as well as the firms extraction decisions are analyzed. Chapter 4 derives the optimal environmental bond required by a local government as a financial assurance for inducing firms to do pollution abatement. A local government needs to make tradeoffs between charging a large amount of bond and encouraging local economic prosperity. For a local government, the optimal bond amount does not necessarily cover the worst-case scenario. This thesis contributes to environmental policy design by considering the interests of different parties.

Abstract:
An authorisation system determines who is authorised to do what i.e. it assigns privileges to users and provides a decision on whether someone is allowed to perform a requested action on a resource. A traditional authorisation decision system, which is simply called authorisation system or system in the rest of the thesis, provides the decision based on a policy which is usually written by the system administrator. Such a traditional authorisation system is not sufficient to protect privacy of personal data, since users (the data subjects) are usually given a take it or leave it choice to accept the controlling organisation’s policy. Privacy is the ability of the owners or subjects of personal data to control the flow of data about themselves, according to their own preferences. This thesis describes the design of an authorisation system that will provide privacy for personal data by including sticky authorisation policies from the issuers and data subjects, to supplement the authorisation policy of the controlling organisation. As personal data moves from controlling system to controlling system, the sticky policies travel with the data. A number of data protection laws and regulations have been formulated to protect the privacy of individuals. The rights and prohibitions provided by the law need to be enforced by the authorisation system. Hence, the designed authorisation system also includes the authorisation rules from the legislation. This thesis describes the conversion of rules from the EU Data Protection Directive into machine executable rules. Due to the nature of the legislative rules, not all of them could be converted into deterministic machine executable rules, as in several cases human intervention or human judgement is required. This is catered for by allowing the machine rules to be configurable. Since the system includes independent policies from various authorities (law, issuer, data subject and controller) conflicts may arise among the decisions provided by them. Consequently, this thesis describes a dynamic, automated conflict resolution mechanism. Different conflict resolution algorithms are chosen based on the request contexts. As the EU Data Protection Directive allows processing of personal data based on contracts, we designed and implemented a component, Contract Validation Service (ConVS) that can validate an XML based digital contract to allow processing of personal data based on a contract. The authorisation system has been implemented as a web service and the performance of the system is measured, by first deploying it in a single computer and then in a cloud server. Finally the validity of the design and implementation are tested against a number of use cases based on scenarios involving accessing medical data in a health service provider’s system and accessing personal data such as CVs and degree certificates in an employment service provider’s system. The machine computed authorisation decisions are compared to the theoretical decisions to ensure that the system returns the correct decisions.

Competitive markets respond automatically to change. Corrective forces are delivered by the pricing mechanism, where price changes indicate new allocations in the consumption of economic resources. Those market participants that are unable to respond adequately to change fail, resulting in a restructuring of the marketplace. Such failures are necessary in order to prevent a misallocation of scarce resources. Public policies, by attempting to suppress or eliminate the dynamic corrective processes of competitive markets, may lead to significant distortions in the marketplace. Using the collapse of the American Savings and Loan Industry as a case study, this paper analyses the distortions that may arise in the provision of financial services as a consequence of misguided public policy. While it is recognised that there may be scope for some public sector involvement in the financial sector of an economy, the overriding theme is that the goal of financial stability would best be served by actively promoting the corrective forces of private, competitive markets.

As applications of Radio Frequency Identification (RFID) become more profuse, the technology itself is stirring up some controversy. Due to its potential for amassing large amounts of information about both people and things, and the possibility of using the information for marketing, tracking, or even spying, numerous consumer groups are spearheading efforts to ensure that RFID does not breach their privacy rights. While there are some privacy laws regulating specific aspects of commerce, there are no laws which currently apply to the collection and use of information as it pertains to RFID. This lack of formal regulation allows companies to legally engage in practices which may encroach on consumers' privacy. However, RFID has the potential to optimize supply chain practices as well as provide other benefits to both consumers and businesses. As RFID use becomes more widespread, regulatory strategies should be considered to protect consumers' right to privacy while obtaining the benefits of using the technology. This thesis explores consumer and industry opinion of RFID through a customized survey. Results of the survey found that consumer and industry opinion are similar in many aspects, especially in the concern for protecting privacy and the desire for a regulatory mechanism to enforce those privacy rights. This thesis addresses the question of whether market-based solutions, self-regulation, or government regulation is the best option for addressing consumers' legitimate concerns of privacy while allowing businesses to reap the benefits of using the technology.
(cont.) The regulatory options are compared and then discussed based on the needs of consumers and industry members as determined by the survey. Finally, four recommendations are suggested to provide guidance for ensuring a positive acceptance of RFID while acknowledging the privacy rights of consumers.

Abstract:

The purpose of this thesis was to present a policy analysis of the Trafficking Victims Protection Act (TVPA) of 2000. Specifically, this analysis examined the impact the TVPA had on the victims of sex trafficking. This project utilized David Gil’s (1992) analytic framework to evaluate the strengths and limitations of this policy. This analysis found that there have been some improvements in the prosecution of traffickers as a result of the passage of the TVPA. However, the analysis also suggests that there remain many issues and unintended consequences for victims of sex trafficking. For example, the requirement of the TVPA to involve the victim in the prosecution of their trafficker makes it difficult for some victims to come forward. Also, the return of victims of sex trafficking to their home country against their will continues to be a problem that the TVPA did not solve. The recommendations for social work practice, policy, and research are discussed.

Abstract:
The dissertation examines US democracy protection policy carried out in three post-Soviet countries that had been just moved away from autocratic rule: Russia in 1991-1996; Georgia in 2003-2008; and Ukraine in 2004-2009. It aims to answer the question whether US policy increased or decreased the likelihood of democratic consolidation in new democracies. Based on theoretical insights from the disciplines of both comparative politics and international relations, two novel research instruments are developed: the ‘two scales’ model and the concept of pragmatic democracy protection policy. By employing these two research instruments, it is revealed that US national security interests have had a distorting impact on US democracy protection policy towards Russia, Georgia and Ukraine. Due to its interest in the cooperation with leaders in power, the US did not apply the principal of democratic conditionality in bilateral relations with the three post-Soviet countries and did not deter the non-democratic behaviour of their governments. Such US policy decreased the likelihood of democratic consolidation. Furthermore, US security interests corrupted US-funded democracy assistance programmes in two out of three cases (in Russia and Georgia). Instead of enabling the opposition and civil society in new democracies, these programmes increased the asymmetry of political playing field and limited the capability of civil society to control the government. Gruzijoje ir 2004–2009 m. Ukrainoje. Siekiama atsakyti į klausimą, ar JAV politika didino, ar mažino šių naujųjų demokratijų konsolidavimo tikimybę. Sujungiant dviejų disciplinų – lyginamosios politikos ir tarptautinių santykių – teorines įžvalgas, darbe konstruojami du nauji tyrimo įrankiai: „dvejų svarstyklių“ modelis ir pragmatinės demokratijos gynimo politikos koncepcija. Abstract:
This PhD project by publication begins to explore how Scottish adult support and protection (ASP) policy and practice carves out its role and remit. It examines the ways that concepts like “abuse”, “vulnerability” and “protection” have been constructed, both by individual practitioners and at a policy level. The submission comprises five papers published in peer-reviewed journals and this contextualising document, which knits together the work and draws out overall conclusions and implications. The papers themselves report on a literature review, a further analysis of case study research into ASP practice and a critical policy comparison. The case study research was conducted immediately prior to legislative changes in Scotland with respect to ASP, and the policy comparison was conducted subsequently to these changes. Overall, the findings highlight the ways that a social constructionist approach can usefully deepen our understandings of ASP. That is, they show how understanding concepts like “protection”, “vulnerability” and “abuse” to be actively constructed in unique and complex contexts can promote criticality in policy-making, practice and research.

Abstract:
Consumer protection policy measures can enable consumer behaviour shifts in favour of more sustainable choices. Whilst government is responsible for developing consumer protection policy in a particular country, business is central in the implementation of such policy. In South Africa, there is disassociation in consumer protection policy and environmental policy where consumer protection policy is the responsibility of the Department of Trade and Industry, whilst sustainability is located under the Department of Environmental Affairs. As a result, South African consumer protection policy does not holistically incorporate sustainability. A six-step qualitative research process was adopted to develop a framework to implement sustainability into consumer protection policies. First, a theoretical framework for incorporating sustainability into consumer protection policy was developed to structure the qualitative research. Four dimensions for incorporating sustainability into consumer protection were then identified. Qualitative data was collected using an open-ended questionnaire and also content analysis of existing data. Two sets of experts further reviewed and critiqued the proposed framework. The results of the qualitative enquiry, in particular, showed that for all the countries examined, some at least had sustainability consideration elements in their policies, but this was evident to a lesser extent in African countries, particularly those with less-developed economies. On the other hand, policy mechanisms that promoted sustainability were more evident in the policies and laws of developed countries. In the case of most African countries, basic needs were foregrounded as the primary concerns of consumers, ahead of sustainability concerns. Further, poverty limited consumer choices, particularly if more sustainably produced and eco-efficient goods came at a higher price. The research also underscored the importance and centrality of consumer education and stakeholder engagement for achieving sustainability policy intentions. It further confirmed that the basic needs of poor consumers in South Africa, and the impact of poverty on sustainability policy intentions must underpin the proposed framework. Factors that created an enabling environment for the implementation of the framework were identified as policy harmonisation within government policy domains, joined-up government, good corporate governance and shared value that considered the needs of future generations and consumer education. These factors would create an enabling environment for policy implementation. Consumer policy could play a key role in the choices that consumers make and, if well-designed and implemented, could direct consumer spending in support of the goal of sustainability and sustainable consumption. The proposed framework provides a foundation on which to futher refine and develop consumer protection policy that incorporates the well-being of consumers and social justice. Using consumer spending to drive sustainability requires a deliberate intention on the part of policy makers to move away from the more conventional framing of consumer policy, which has tended to focus on the economic interests of consumers, such as price, quality, choice and redress. However, modern business is shifting towards a more holistic conceptualisation of sustainability, as a value that needs to be deliberately and consciously built into the design and essence of a business. Doing so is not only good corporate citizenship, but offers a competitive advantage, which could drive product demand and attract consumers.

Abstract:
Competition policy is meant to ensure a level-playing in the market, but its ultimate goal is to enhance consumer interests. The telecommunications sector is one of the two sectors that have set up a competition policy in Hong Kong. This paper examines the current competition policy framework in the telecommunications sector by analyzing the level of consumer protection using the Structure-Conduct-Performance Paradigm. It examines in detail the consumer related complaint cases received by the Office of the Telecommunications Authority in four markets: fixed line telephone services, mobile phone services, International Direct Dialing services, and Internet services. Regression analysis results reveal that more competition in a market has a positive and significant effect on the frequency of complaints about misleading or deceptive conduct on the part of operators in the period from 1999 to 2006. Also, smaller and newer operators tend to receive more complaints. From the lessons we have drawn from the telecommunications sector, a more comprehensive policy coped with consumer protection regulation is needed in order to better promote consumer interests in Hong Kong.

Abstract:
Varieties of Capitalism theory predicts that the skill specificity of workers determines their demand for social protection. In this thesis, I test this assumption using a measure of occupational mobility between pre- and post-unemployment, which I apply to European workers in different skill groups as defined by Fleckenstein et al., (2011). Using this measure as an indicator of the portability of workers' skills, I then evaluate whether the lower marketability of human capital investments is associated with greater demand for unemployment protection. The findings demonstrate that whilst this relationship is apparent in certain countries, notably Coordinated Market Economies such as Germany, the assumptions do not apply across institutional settings. Consequently, skill specificity cannot explain variation in attitudes towards unemployment protection policies between countries.

Abstract:
According to the Swedish Forestry Act, environmental protection is required within forest operations regardless of forest ownership. This thesis examines the extent to which regulations issued by the National Board of Forestry are implemented in clearcuttings. Different factors contributing to the outcome of environmental protection are analyzed both from a top-down and a bottom-up perspec­tive. Empirically, the study combines field investigation of clearcuts, interviews with implementing actors, and evaluation of written prescriptions and advice on environ­mental protection. The Swedish forest-environmental legislation and implementation process is also compared to that of the U.S. and, especially, to the state of Cali­fornia . Conflicting goals within the Forestry Act and vague environmental guidelines leave the implementing agency officers with great discretion. Steering attempts by the Forestry Agency are in terms of friendly advice and information. No breaches of the regulations were taken to court during 1980-1986 although this is formally possible. There is an average compliance of approximately fifty per cent of the required environmental measures. Aesthetic values are taken into account to a greater extent than pure floristic and faunistic ones. Economic considerations and harvest technology contribute to a low degree of environmental protection. Forest machines are inadequately suited for protecting single, environmentally valuable trees and they frequently cause deep tracks. Inadequate environmental knowledge and insufficient pre-harvest environmental planning also affect environ­mental performance negatively. Generally, economic considerations contribute to the low priority to environ­mental protection given by the implementing actors compared to timber production. Economic inducements counteract environmental protection. It is generally rare that environmentalists and other public interests affected by forest operations are consulted. Environmentalists however influence indirectly through political pressure to legislate, participation in the consultation process before legislation is enacted, and mass-media attention.

Le partage d'informations dans les systèmes de réseaux sociaux (SRS) suscite des inquiétudes concernant de possibles abus impactant la vie privée. La possibilité pour les utilisateurs de contrôler les informations qu'ils partagent avec le fournisseur de SRS et avec les autres utilisateurs peut être améliorée par la décentralisation des données personnelles et par une gestion appropriée des conflits entre politiques. Prenant son inspiration dans l'approche de décentralisation, la première contribution de cette thèse est la proposition de propriétés relevant de la conception du SRS et impactant la vie privée lorsqu'elles sont considérées par rapport à une gradation de la décentralisation. Ces propriétés ont été organises dans une grille d'analyse multicritères conçue pour analyser et comparer les SRS. L'application de la théorie des treillis à cette grille permet d'évaluer, de classifier et de visualiser différents SRS dans une hiérarchie partielle. Alors que la décentralisation résoudre des problèmes impliquant le fournisseur de SRS, les politiques de vie privée jouent un rôle majeur dans la protection contre les accès non autorisés par d'autres utilisateurs. La seconde contribution de cette thèse consiste en l'introduction du concept d'équité dans le contexte de la gestion des conflits entre politiques. Un algorithme conçu pour maintenir l'équité entre les utilisateurs de SRS est introduit pour résoudre les conflits pouvant survenir entre les politiques de plusieurs utilisateurs, évitant que certains puissent gagner un avantage sur d'autres. L'évaluation montre que l'approche introduite dans cette thèse conduit à de meilleurs résultats que les stratégies classiques de résolution de conflits, réduisant ainsi les iniquités existantes en termes d'application des politiques
In Social Network Systems (SNSs), the sharing of information leads to many privacy concerns about potential abuses of personal information. Users’ control over information shared with the SNS provider and with other users could be improved in SNSs through the decentralization of personal data, and the proper management of policy conflicts. Inspired by the decentralization approach, the firrst contribution of this thesis is the proposal of SNS design properties relevant to privacy when considered along a gradation of decentralization. These properties are organized in a multi-criteria analysis grid, designed to analyze and compare SNSs. The application of a lattice structure on this grid allows to evaluate, classify and visualize different SNSs within a partial hierarchy. While decentralization solves issues involving the SNS provider, privacy policies play a leading role in the protection of unauthorized data access from other users. The second contribution of this thesis consists in the introduction of the concept of equity in the context of policy conflict management. An algorithm to maintain equity between users in SNSs is introduced to solve conflicts that may arise between the privacy policies of several users, avoiding that some users take advantage over others. The evaluation shows that the equity approach introduced in this thesis leads to better results than classical conflict resolution strategies, reducing existing inequities in terms of policy enforcement

Information and the related assets form critical business assets for most organizations. Organizations depend on their information assets to survive and to remain competitive. However, the organization’s information assets are faced with a number of internal and external threats, aimed at compromising the confidentiality, integrity and/or availability (CIA) of information assets. These threats can be of physical, technical, or operational nature. For an organization to successfully conduct its business operations, information assets should always be protected from these threats. The process of protecting information and its related assets, ensuring the CIA thereof, is referred to as information security. To be effective, information security should be viewed as critical to the overall success of the organization, and therefore be included as one of the organization’s Corporate Governance sub-functions, referred to as Information Security Governance. Information Security Governance is the strategic system for directing and controlling the organization’s information security initiatives. Directing is the process whereby management issues directives, giving a strategic direction for information security within an organization. Controlling is the process of ensuring that management directives are being adhered to within an organization. To be effective, Information Security Governance directing and controlling depend on the organization’s Information Security Policy Architecture. An Information Security Policy Architecture is a hierarchical representation of the various information security policies and related documentation that an organization has used. When directing, management directives should be issued in the form of an Information Security Policy Architecture, and controlling should ensure adherence to the Information Security Policy Architecture. However, this study noted that in both literature and organizational practices, Information Security Policy Architectures are not comprehensively addressed and adequately managed. Therefore, this study argues towards a more comprehensive Information Security Policy Architecture, and the proper management thereof.
