Full textAs regards child protection, speech of participation of the minor in his own protection is to consider this one like a subject of active right and not only like one object of protection. In this direction, the International Convention of the Children's rights affirmed the capacity of the child to be taken part in his own protection, guaranteed by its right to the expression. Consequently, the child to be protected is not simply any more perceived like a vulnerable human being requiring a State aid (passive subject of right), before the placement, during and after this one. The minor is recognized as a citizen in becoming ( active subject of right) to which a series of rights are conferred such as the right to take part in the decisions which relate to it according to its age and its degree of understanding, the right to freedom to think, of conscience and religion or the right to reach information diversified and aiming at promoting its wellness physics, mental and social. Accordingly, it is by the means of the exercise of its rights that the protected child can become the actor of his own protection

Full textThis research aimed to better understand the emotional difficulties (depression, anxiety, burnout, etc.) of Quebec’s child welfare clinicians and to explore the impact of these difficulties on their professional relationships (with the children and their families, colleagues and managers). By highlighting their subjective experience and experiential knowledge, the research allows to explain the emotional difficulties in a work context outside of the dominant psychiatric and psychological perspective. A sociological framework based on the concept of emotional labor as well as the clinical sociology theories of work was developed. This conceptual perspective shed’s light and articulates the contextual, organizational and individual factors that impact emotional difficulties experienced by clinicians in a child welfare setting. The research methodology is qualitative, based on semi-directed interviews at the CISSS and a CIUSSS from two different administrative geographic regions in the Québec province. The population sample is composed of thirty-one psychosocial clinicians (Professional Social Workers, Criminologists, Psychoeducators and Bachelor Professional Psychologists) working in child welfare organizations. The research results demonstrate that there are three (3) main protection factors at work (organizational mandate, work diversity, peers relations). Furthermore, the following factors were identified as impacting their emotional difficulties; three (3) contextual factors, nineteen (19) organizational factors and four (4) individual factors. From these categories two of them are structural as therefore external to individual control. As a result, targeting individual factors to explain clinicians emotional difficulties restricts the possibility of modifying their situation. Specifically, participants identified that the latest health care reform including the CISSS and CIUSSS service structure changes led to significant consequences that deeply affected their work organization and their clinical practice in the context of child welfare context. Also, the results show clinical functional impacts on their professional relationships. Negative impacts on their relationships with families and children were reported by all clinicians (decrease of intensity in service delivery, hurtful relationships with clients, lack of empathy and helpful relationship, decrease of work quality and objective and analytical abilities of clinicians). For 90% of the participants, emotional difficulties had negative impact on their relationships with their managers (anger, frustration, trustfulness, avoidance and lack of confidence) and 68% with their colleagues (isolation and withdrawal, negative emotional contamination, decrease in collaboration and lack of mutual aid). Overall, this research demonstrates the importance of protecting clinicians in a children protection mandate. Also, it shows that the emotional work that clinicians must produce, according to the requirements of the institutions involved (employer, academia and professional orders) is at the of all professional relationships in a child welfare context. This research allows in this regard to highlight the favorable conditions of emotional work, which can act as a protective filter in child welfare services. The research also allows, finally, to extend the typology of emotional work.

Full textThe Sápmi (traditional territory of the Sami of Sweden) and Eeyou Istchee (traditional territory of the Cree or Eenouch of north-eastern Canada) have been contested territories for several decades in the face of an hegemonic definition of “Nature” and its legitimized practices imposed by the Quebec (and Canadian) and Swedish states. In the late twentieth and early twenty-first centuries, these two “Norths” became open laboratories for the integration of Aboriginal peoples in the governance of their territories. The thesis argues that protection of Nature has allowed the creation of new arenas in which reconfigurations of power structures might take place, thus leaving more room for Sami and Cree values and territorialities. This thesis analyzes the reappropriation of the management of protected areas in these territories in order to understand the stakes and the compromises involved. Two case studies are at the heart of this research: the UNESCO World Heritage Site of Laponia (Sweden) and the Quebec National Park of Assinica (under creation). The context of development in which the involvement of indigenous peoples in protected areas management takes place greatly complicates the process. The two case studies allow us to investigate the accession to natural resource management structures – from which the indigenous groups were previously excluded – and to reflect on the possible new forms of governance that are emerging from this accession. It is a question of understanding the relations of dominations which take place in the decolonization of these spaces of protection of Nature, and their influences on the possible structural transformations which emerge

En tenant compte des conséquences dévastatrices de nature économique, sociale et psychologique de ces évènements, l'objectif du présent mémoire est d'évaluer si les mécanismes d'indemnisation actuellement en vigueur au Québec dans l'industrie des services financiers offrent une protection adéquate aux consommateurs. Le premier chapitre dresse le portrait du secteur financier d'aujourd'hui, alors que le deuxième chapitre examine les risques auxquels fait face l'investisseur de détail, les conséquences de ces risques de même que les mesures de protection mises en place par le législateur. Sur cette base, le troisième chapitre analyse certaines mesures de protection que sont les mécanismes d'indemnisation, afin de vérifier l'hypothèse de départ et de proposer, s'il y a lieu, des pistes de réflexion et de solution en vue de bonifier l'encadrement actuel.
