Full textThe aim of this LlD (Doctorate of Laws) is to determine, how competent authorities have adapted the rights of intellectual ownership to requirements of the development of generic medicine with regard to its health and economic stake. The study of the implementation of patent law shows that, although the efforts of the legislator, the measures infringing this right and regulating its implementation have not managed to prevent the strategies of innovative laboratories aiming to limit or forbid the access to market of generic medicines. On the other hand, as far as the study of brand law is concerned, it could be noted that for nearly ten years, the neutralisation of the right to benefit generic medicine, was justified owing to the inability of generic laboratories to compete the promotional potency of the innovative laboratories, and to withdraw the benefit of this right. However, nowadays, the market of generic medicine is growing. Consequently, some new types of generic laboratories have means to promote their own brand. In the interest of the development of the generic medicine, this LlD subsequently offers, the re-establishment of brand common law

Full textIn this work, we study the properties satisfied by the probability measures invariant by the geodesic flow {∅t}t∈R on non compact manifolds M with pinched negative sectional curvature. First, we restrict our study to hyperbolic manifolds. In this case, ∅t is topologically mixing in restriction to its non-wandering set. Moreover, if M is convex cocompact, there exists a symbolic representation of the geodesic flow which allows us to prove that the set of ∅t-invariant, weakly-mixing probability measures is a dense Gδ−set in the set M1 of probability measures invariant by the geodesic flow. The question of the topological mixing of the geodesic flow is still open when the curvature of M is non constant. So the methods used on hyperbolic manifolds do not apply on manifolds with variable curvature. To generalize the previous result, we use thermodynamics tools developed recently by F.Paulin, M.Pollicott et B.Schapira. More precisely, the proof of our result relies on our capacity of constructing, for all periodic orbits Op a sequence of mixing and finite Gibbs measures converging to the Dirac measure supported on Op. We will show that such a construction is possible when M is geometrically finite. If it is not, there are no examples of geometrically infinite manifolds with a finite Gibbs measure. We conjecture that it is always possible to construct a finite Gibbs measure on a pinched negatively curved manifold. To support this conjecture, we prove a finiteness criterion for Gibbs measures

Full textTo fulfil the rheological requirements of cementitious materials, mix designer engineers use various polymers. Theses admixtures either stay in the suspending fluid modifying its viscosity or adsorb at the surface of cement particles modifying their surface properties and their interactions. In this work, we propose a general physical frame allowing for the description of the consequences of the addition of one or various polymers on the rheology of cement paste. We identify two main parameters affecting the rheology of cement paste, which can be modified by chemical admixtures. These parameters are the inter-particle distance and the viscosity of the suspending fluid. Our solution viscosity and hydrodynamic radii measurements in synthetic cement pore solution suggest that the volume fraction of polymers is the main parameter enhancing the viscosity of the suspending fluid. By means of rheological and adsorption measurements, we study the effects of polymers on the inter-particle distance and the rheological behavior of the suspension. Finally, we study the competitive adsorption between polymers at the surface of cement particles. We propose a technique based on dynamic light scattering measurements allowing for the measurement of the respective adsorption of two polymers at the surface of cement particles. We then study the competitive adsorption between a super-plasticizer and sulfate ions, retarder or viscosity enhancing admixtures

Full textI examine the relations between the properties of long-term geological faults and the properties of the large earthquakes these faults produce. I have gathered available seismological information on large historical earthquakes worldwide and mapped in detail, on satellite images, both the long-term fault and the rupture traces. The combined analysis of the data shows that: i) long-term faults have a number of generic properties (arrangement of overall fault networks, lateral segmentation of fault traces, form of cumulative slip distribution, etc); ii) large earthquakes also have generic properties (similarity of envelope shape of coseismic slip-length profiles, of decrease in rupture width along rupture length, of number of broken segments, of stress drop on broken segments, of relative distance between hypocenter and zone of maximum slip, etc); iii) the structural maturity of the faults is the tectonic property most impacting the behavior of large earthquakes. The maturity likely acts in reducing both the static friction and the geometric complexity of the fault plane. It partly governs the location of the earthquake initiation, the location and amplitude of the maximum coseismic slip, the direction of the coseismic slip decrease, the rupture propagation efficiency and speed, the number of major fault segments that are broken, and hence the rupture length and its overall stress drop. To understand the physics of earthquakes, it thus seems necessary to analyze jointly the tectonic properties of the broken faults and the seismological properties of the earthquakes
