Abstract:
After 1760, constitutional debates occurred in French Canada on issues ranging from the contestation of royal authority to the consolidation of constitutional rights or colonial autonomy. In this regard, our main source of information is the bilingual Quebec Gazette, which reported on legal developments in France, England, and the American colonies. Contrary to what is generally assumed, these discussions predated the American Revolution. The Chapter also examines the assimilation of British constitutional principles by the educated members of the Francophone elite. Many of them were eager to obtain an Assembly in which Catholics could sit. They believed that the Capitulation of 1760 protected property and seigneurial rights, as well as inheritance and matrimonial laws. In the end, the request for an Assembly was shelved in order to obtain religious equality. Meanwhile, British officials declared that Canadians had no appetite for an Assembly, creating a lasting and misleading impression.

Abstract:
This book explores the scope of copyright user rights through the lens of property, copyright, and contract law. It proposes a taxonomy and hierarchy of copyright user rights that makes a distinction between user property, user rights, and user privileges. The book looks at user rights from an international law and multijurisdictional perspective (including the European Union, United States, Canada, United Kingdom, France, and Australia) with a particular focus on Canada, given the significant amount of jurisprudence of the Supreme Court of Canada on copyright user rights. Unlike other works that look at copyright user rights through concepts of public law and policy, this book explores user rights through concepts of private law (personal property, goods, services, sales, licences) and copyright law (exceptions to copyright infringement such as fair dealing and fair use, the first sale or exhaustion doctrine, and the impact of technological protection measures on how users experience copyright works). The book develops a pluralistic theory of copyright user rights that recognizes their diversity and myriad ways users experience copyright works, while emphasizing the importance and role of copyright users within copyright law. The book calls for the re-evaluation of the dichotomy between tangibility and intangibility and for greater cohesion between copyright law and traditional concepts of private law.

Abstract:
This chapter examines how the Coutume de Paris (customary law of Paris) influenced nineteenth-century domestic affairs, especially inheritance practices, in a large swath of northern France, as well as in French colonies such as Missouri. Beginning in the 1720s, the Coutume was regularly cited in Illinois Country legal documents, with Charles-Joseph Labuxière, acting as the strict custodian of French law and legal traditions in St. Louis. French Canadians who settled early at Cahokia and Kaskaskia adhered loosely to many provisions of traditional French customary law, but it took a while for the Coutume to be fully institutionalized in the Illinois Country. This chapter analyzes the human dimensions of the Coutume as it was implemented in St. Louis by presenting case histories about marriages and marriage contracts, buying and selling property, and making arrangements for old age and death. These case histories illuminate how the law helped guide village families in the management of their mortal affairs.

Abstract:
Modernity arrived in Japan, as elsewhere, through new forms of ownership. In A Fictional Commons, Michael K. Bourdaghs explores how the literary and theoretical works of Natsume Sōseki (1867–1916), widely celebrated as Japan's greatest modern novelist, exploited the contradictions and ambiguities that haunted this new system. Many of his works feature narratives about inheritance, thievery, and the struggle to obtain or preserve material wealth while also imagining alternative ways of owning and sharing. For Sōseki, literature was a means for thinking through—and beyond—private property. Bourdaghs puts Sōseki into dialogue with thinkers from his own era (including William James and Mizuno Rentarō, author of Japan’s first copyright law) and discusses how his work anticipates such theorists as Karatani Kōjin and Franco Moretti. As Bourdaghs shows, Sōseki both appropriated and rejected concepts of ownership and subjectivity in ways that theorized literature as a critical response to the emergence of global capitalism.
