Full textEnglish ABSTRACT This paper purports to analyse the “legislative activity “as between” the Parliament and Government”, with the focus being placed on how Parliament and Goverment respectively exercise their legislative functions, as well as on the qualitative and quantitative impact which such functions respectively have nowadays. The analysis originates from form of government and sources of primary regulations, as determined under the Republican Constitution: in respect of the both of them, it has been claimed that a central role has been conferred upon the Parliament in its capacity as organ directly representative of the will of the common. Coherently with this argument, the Section of the Constitution disciplining the legislative process opens with a statement according to which “The legislative function is exercised by the two Chambers” (Article70), and proceeds disciplining the legislative powers of the Government – to be regarded as exceptional and derogatory in their nature – consistently with this fundamental premise. The exercise of the Government’s legislative powers, in the forms of legislative decrees (‘decreti legislativi’) and law decrees (‘decreti legge’), is conditional on the fulfilment of specific requirements and encounters substantial limits, the purposes of which is to preserve the exceptional and derogatory nature of the Government’ legislative powers. Further, an important role is conferred upon the Parliament, which intervenes both in the process of converting law decrees (‘decreti legge’) into laws and in the process of approving a law conferring upon the Government the power to issue legislative decrees (‘decreti legislativi’). The role of the Parliament is aimed at establishing, in the context of Government’s legislative activity, those mechanisms which have traditionally characterised the Parliament’s legislative activity, to be identified in the involvement of minorities and the transparency of institutional activities. The headings of the following two chapters outline the substantial changes which have been witnessed from the perspective the legislative activity and, coherently with it, from the perspective form of government. From the following analysis of the legislative activity it emerges that “the crisis of the law and of the Parliament” has been mirrored by a “strengthening of the Government” in the production of primary legislation, modifying the balance between the Parliament and Goverment as initially established under the Constitution. Whilst the central role of the ‘laws’ as sources of rules has been gradually eroded, legislative decrees and law decrees have increasingly earned importance. Each of the these three sources of rules have been analysed from the standpoint of certain tendencies and usages in which such changes have resulted, as well as from the perspective of the consequences originating from such changes in terms of form of government.

Full textArmed non-state actors (ANSAs) have recently emerged as relevant actors within the international scenario. In fact, they are often involved in armed conflicts and frequently control territories belonging to states. Nonetheless, a gap in the regulation of ANSAs by international law exists. International law, in fact, is traditionally produced by states to regulate themselves. The emergence of non-state actors, like ANSAs, creates an obstacle in the functioning of the traditional, state-centric international law. Another issue connected to the regulation of ANSAs regards their identification. In fact, ANSAs evolve rapidly and often present characteristics belonging to different subcategories of armed groups. This creates difficulties in their identification and the consequent possible involvement in lawmaking activities. However, international practice shows a more and more frequent involvement of ANSAs in processes of production of legal instruments, such as international agreements with state authorities and self-regulation instruments. Various theories have been submitted regarding the compatibility of this practice with international law. Taking into consideration the aim of international law of meeting the needs of the international community, the involvement of ANSAs in lawmaking activities appears theoretically justified. This is consistent with the development of international law in the regulation of ANSAs. To solve the difficulties regarding normative efficiency caused by the state-centric conception of international law, this state-centric approach has been abandoned and several provisions binding ANSAs have been adopted in several branches of international law. This practice has been theoretically justified as well. Considering the development of international practice and the theoretical approach based in the pursuit of the needs of the international community, it appears possible, both from a practical and theoretical perspective, to engage with ANSAs in activities of production of rules of international law.
