Il processo penale canonico ha sempre costituito l’extrema ratio cui ricorrere solo quando fossero esaurite tutte le altre vie per ottenere la riparazione dello scandalo, il ristabilimento della giustizia, l’emendamento del reo (cfr. c. 1341). Le cause penali necessitano della presenza del promotore di giustizia in quanto con esse si vuole perseguire le finalità della giustizia e della tutela del bene pubblico. Per irrogare o dichiarare la pena il Codice di Diritto Canonico del 1983 prevede una doppia procedura penale: giudiziaria (che si concluderà con una sentenza) o amministrativa (stragiudiziale – che si concluderà con un decreto). Nel processo penale giudiziario il Promotore di giustizia svolge il compito di parte attrice o titolare dell’azione criminale contro l’imputato. Giovanni Paolo II nel discorso alla Rota Romana ha sottolineato che «l’istituzionalizzazione di quello strumento di giustizia che è il processo rappresenta una progressiva conquista di civiltà e di rispetto della dignità dell’uomo» (Cfr. Giovanni Paolo II, Discorso alla Rota Romana, (18 gennaio 1990), in L’Osservatore Romano, 19 gennaio 1990, p. 5). Si evince molto chiaramente dal can. 1342, § 1 la preferenza del legislatore per la via giudiziale. Infatti, il processo penale giudiziario offre maggiori garanzie di giustizia, in quanto assicura e garantisce in modo conforme il diritto alla difesa, permette al giudice di consolidare una maggiore certezza morale sull’esistenza dei fatti mediante l’acquisizione giudiziale delle prove, delle circostanze e dell’imputabilità, valutando tutte le circostanze del delitto, determina la condizione dell’imputato, precisa il grado del danno causato dal delitto, applica con equità la pena giusta alla luce degli elementi emersi durante il giudizio. Rimangono tuttavia casi in cui il legislatore indica la via giudiziale come la più adatta, che certamente offre maggiori certezze e garanzie ai fini dell’accertamento della verità, della giustizia e soprattutto della salvaguardia dei diritti dei fedeli. Innanzitutto essa è obbligatoria per irrogare o dichiarare le pene più gravi, come quelle espiatorie perpetue (can. 1336). «Per decreto non si possono infliggere o dichiarare pene perpetue; né quelle pene che la legge o il precetto che le costituisce vieta di applicare per decreto» (can. 1342, § 2). Il promotore di giustizia assume le vesti di parte attrice o titolare dell’azione criminale (actio criminalis) contro l’imputato. Egli è la persona pubblica costituita per tutelare il bene pubblico, che deriva dall’osservanza della legge, al di là delle considerazioni soggettive can. 1362, § 1; 1720, 3°; 1726. Nel processo penale, a protezione dei diritti del fedele il legislatore vieta espressamente di imporre all’imputato il giuramento e l’accusato non è tenuto a confessare il delitto (can. 1728, § 2). In questo modo si garantisce al reo la scelta della linea difensiva più opportuna senza costrizione a riconoscere i fatti che siano a sé sfavorevoli. Il processo penale giudiziario prevede e garantisce al reo un diritto fondamentale di appello dopo l’emanazione della sentenza di condanna (can. 1727, § 1). Inoltre garantisce il diritto di appello al promotore di giustizia nelle cause in cui la loro presenza è richiesta (cfr. cann. 1727, § 2, 1628). Il termine per proporre l’appello è di 15 giorni e va proposto avanti al giudice a quo, che ha emesso la sentenza. Può essere fatto a voce, ed in tal caso il notaio lo deve mettere per scritto avanti allo stesso appellante (can. 1630, § 2). Il can. 1353 disciplina che «l’appello o il ricorso contro le sentenze giudiziali o i decreti che infliggono o dichiarano una pena qualsiasi hanno effetto sospensivo». Il legislatore prevede nel Capitolo III: «de actione ad damna reparanda» un’azione contenziosa per la riparazione dei danni ingiustamente inferti dal delitto (cann. 1729–1731). Pur consentendo nell’ambito del processo penale giudiziario l’esercizio dell’azione per il risarcimento dei danni, il legislatore tiene sempre distinte le due azioni, quella criminale, tendente all’irrogazione o alla dichiarazione della pena, e quella contenziosa per la riparazione dei danni inferti dal delitto. La sentenza può essere eseguita dopo che sia passata in giudicato, ossia dopo una duplice sentenza conforme che non sempre si ha con la decisione di secondo grado.

Nel processo inquisitorio romano-canonico, una rigida applicazione delle regole del sistema di prova legale non avrebbe reso possibile la condanna di un imputato gravato da soli indizi e presunzioni, ponendo non pochi ostacoli all’amministrazione della giustizia criminale, orientata al principio dell’interesse pubblico alla persecuzione dei reati. Un’affermazione di Innocenzo IV contenuta nel commento al c. Quia verisimile (X 2.23.10) aprì la via alla condanna presuntiva: il giudice avrebbe potuto condannare l’imputato in assenza di piena prova, a patto di infliggere una pena ridotta. Nella sua formulazione originale la massima innocenziana non rappresentava più che una raccomandazione di prudenza. Fu l’elaborazione dottrinale a trasformarla, oltre le intenzioni del suo autore, in uno strumento capace di incidere sulla teorica rigidità del sistema di prova legale, ammettendo discrezionalità nel modulare la pena e nell’applicarla anche in situazioni di carenza di prova. In questo dibattito, che il presente studio intende analizzare nelle sue tappe fondamentali, il contributo dei decretalisti ha avuto un peso di primo piano: anche per tale via si manifesta il ruolo centrale assunto dalla scienza canonistica nella riflessione dottrinale sulla teoria della prova legale.

In questo articolo vengono analizzati i canoni 1341 e 1342 del CIC/1983. Lanalisi viene fatta alla luce dell’attuale interpretazione dottrinale in materia della giusta applicazione delle pene. Canoni sottoposti all’analisi riguardano le competenze e gli obblighi del Ordinario nella fase iniziale dell'applicazine delle pene ecclesiastiche. Si tratta del momento molto importante nel iter dell’applicazione delle pene, e cioè della possibilità e necessità di iniziare il processo penale canonico e scelta del modo di procedere: giudiziale o amministrativo. La prima parte dell’articolo l’autore ha dedicato alla problematica del delitto canonico, della possibilità e della necessità del processo penale canonico. Ordinario prima di avviare vero processo penale (o quello in via giudiziale oppure quello in via amministrativa) deve avere la notizia almeno probabile del delitto. Non basta la notizia di qualsiasi violazione, ma è necessario che il comportamento denunciato sia incluso tra i delitti previsti nel diritto canonico. Soltanto così si può passare all’avvio del primo passo del processo e cioè all’indagine previa. Terminata questa si deve rispondere alle domande se il processo canonico è possibile e se questo processo è anche necessario. Può darsi, che, a causa della prescrizione dell’azione criminale, il processo non sarà possibile anche se ci fossero certe prove del delitto. A quanto pare una eccezione troviamo al riguardo dei delitti riservati alia Congregazine per la Dottrina della Fede. Secondo la concessione data dal Sommo Pontefice nel 2002 i delicta graviores, anche se sono passati in prescrizione, possono essere ripresi sulla fonadata petizione dei vescovi interessati. Alla luce della disposizione del can. 1341 si può dire che applicazione delle pene in Ecclesia diventa extrema ratio, e cioè la via che si puo intraprendere soltanto, quando l’autorità ha fatto inutilmente rifferimento ad altri mezzi di carattere pastorale. Un’altro punto dell’articolo viene dedicato all’analisi delle disposizioni che bisogna tenere conto nel momento della scelta della via giudiziale o amministrativa per applicare le pene. Seguendo le disposizioni del can. 1342 si deve notare che la via giudiziale dell’applicazione delle pene ecclesiastiche è la via normale ed obbligatoria. Ordinario per principio è obbligato di scegliere questo modo di procedere, inoltre la via giudiziale è obbligatoria per l’applicazione delle pene espiatorie perpetue. Obbligo di scegliere la via giudiziale potrebbe risultare anche dalla legge o precetto che vietano l’applicazione delle pene tramite la via amministrativa. Invece la via amministrativa è possibile da scegliere soltanto sotto la condizione, e cioè soltanto nel caso se ci fossero le giuste cause che si opponessro alla via giudiziale. Fermo restando però divieto di scegliere la via amministrativa nel caso diapplicazione delle pene espiatorie perpetue, come pure del divieto previsto nella legge o nel precetto. Come si può vedere dall’analisi dei elementi specifici del processo giudiziale e quello amministrativo, sia l’uno che l’altro possiede i strumnenti neccessari per garantire, che la pena diventi veramente l’applicazione di quello che e veramente „iustum et bonum” in caso concreto. Bisogna notare però che il processo in via giudiziale (grazie alla sua struttura) offre più garanzie per salvaguardare i diritti delle persone e per arrivare alla verità oggetiva. Invece il processo in via amministrativa (grazie alla procedura meno complessa) diventa più breve, più spedito e quindi non sottoposto troppo facilmente alla diffusione, e quindi sembra meglio garantire la salvaguardia di buona fama della persona giudicata.

O gerenciamento de informações de riscos utilizando dados criminais apresenta desafios associados à Consciência Situacional (SAW), como a dinamicidade, heterogeneidade, variedade e o volume de dados. Tais desafios impõem dificuldades referentes à representação de informações de vítimas, criminosos, locais de eventos e à própria especificação das situações de crime. Representar de forma precisa as informações do domínio criminal vai contribuir para processos de análise quantitativa de dados, gerando assim melhores subsídios para a SAW de humanos e consequentemente uma tomada de decisão mais assertiva. Neste contexto, o estado-da-arte em modelos semânticos para representar riscos e crimes apresenta lacunas que restringem a quantificação de entidades e características relevantes das situações críticas. Portanto, este artigo apresenta um processo de quantificação de dados de ontologias para o domínio de gerenciamento de riscos sobre dados criminais, visando suportar a extração de dados específicos sobre crimes, para melhorar o apoio aos analistas criminais para a sua obtenção de SAW. Para tal, foram empregados a análise de tarefas dirigidas por objetivos, a análise de vocabulários e propriedades no contexto criminal e o desenvolvimento de uma nova ontologia para a representação de dados criminais. Resultados indicam que o processo desenvolvido é capaz de mensurar informações presentes na ontologia, tais como objetos furtados ou roubados por criminosos, o que pode contribuir para que um analista criminal adquira e mantenha seu nível de SAW sobre a incidência criminal de áreas urbanas brasileiras.

Em 1830 foi publicado o Código Criminal do Império, que seria o primeiro código genuinamente brasileiro. Ele trouxe, juntamente com o Código do Processo Criminal de 1832, regras para regular o julgamento de crimes no Brasil depois da Independência. A estrutura e a organização disposta nessas normas foram reformadas em 1841, com a Lei nº 261, que foi logo regulamentada em 1842. Tudo isso fazia parte de um contexto social vivido no Brasil da primeira metade do Oitocentos. Este artigo tem o objetivo de contribuir para o entendimento sobre a história da Justiça Criminal em Pernambuco, de 1831 a 1850, percurso temporal em que ocorreram diversas estruturações no Judiciário. Admite-se que, para que o estudo seja realizado, é imprescindível conhecer como era realizada a prestação jurisdicional, o que foi possibilitado pela análise de processos judiciais. Este texto traz, por meio da análise dos processos criminais dos crimes de estupro, rapto, calúnia e injúria, um fragmento de como era executada a Justiça no selecionado período, bem como quem eram os acusados, naquele contexto social.

Hapsburg age marks a new outset and at the same time a definitive sunset of a Lombard Court, called Supremo Consiglio di Giustizia di Mantova. His criminal sentences represent a privileged observatory for a deepened study based on criminal phenomenon, on criminal apparatus operation, and on justice administration in Mantova. Ius commune system was characterize by a variegated law source mosaic, and the plurality of law levels. This system must face lot of law blanks, that inevitably required subjectivity. This arbitrium permit the surfacing of crime circumstances profile, psychological and tangible elements that characterize the felony, influencing punishment. In many trials come to light subjective element of negligence and, as defence cause, legitimate self-defence. Others elements contribute to modify punishment, as aggravanting factor of locus commissi delicti, tempus commissi delicti, the relationship between guilty and victim, consuetudo delinquendi, atrocious crimes, that required a more cruel execution. By processual point of view it will be extensively analysed evidences subject, consequence of doctrine interpretative work and in practice, judge prerogative. Criminal emergency and the fear of the omnipresent thief, assassin, and robber, appears also in those particular instruments called specialia in procedendo, a real ordo iudiciarius waiver, to stem atrociores (incurable delinquent). Process could be delayed or even stopped by remissio of victim, or by the guilty claim of ius asyli. It’s fundamental the topic of grace, instrument hard to categorize, because of his ambiguity and evading that characterize his nature. Grace is the only way for the sentenced to avoid execution or to ask a sentence reduction or to change the punishment inflicted into other kind of penalty. The study of grace shows a double-face justice: merciless and compassionate togheter. A system trying to fix errors with the examples, with augmented bloody executions, but ready to give forgiveness those who redeem themselves.

This work examines an unpublished manuscript of eighteenth century that contains treatises and dissertations written by judges of Venetian mainland between XVII and XVIII century. The research focuses in particular on works of Giovanni Guidozzi, an important jurist at that time. The examination of all these sources allows to reconstruct the different stages of criminal procedure administered in the Terraferma’s penal courts in the modern age. Venice however has a strong influence in the administration of criminal justice: the relationship between the capital and its territorial state is complicated and the judges of the mainland, also called assessori, represent an important point of contact between these two worlds.

The dissertation analyses a new theme which has not yet been analysed in Lithuanian research and makes an attempt to reveal the theoretical foundations of the institute of reopening a criminal case.
The object of the dissertation is the nature of the institute of the reopening of criminal proceedings, the historical development of this institute, the purposes, features, the existing grounds for the reopening of a case, types, specialness of the types, procedure for the reopening of a criminal case, and the place of the reopening of a criminal case among other forms of control over court judgments. The research has been carried out along two directions.. The first has analysed the theoretical grounds of the institute of reopening a criminal case. The second has evaluated both the norms of the Code of Criminal Procedure which regulate the reopening of a criminal case and the resultant court practice, the analysis of which has determined some of the theoretical conclusions. The research has conformed the hypothesis that the appropriate conception of the reopening of a criminal case as an extraordinary form of control over court judgment and the facultative stage of criminal process enables to safeguard both the lawful expectations of the parties to the process and a fair trial. Disertacinio tyrimo objektas – baudžiamosios bylos atnaujinimo instituto teisinė prigimtis, istorinė raida, tikslai, požymiai, pagrindai, dėl kurių atnaujinama byla, rūšys, rūšių ypatumai, atnaujinimo procedūra bei baudžiamosios bylos atnaujinimo vieta kitų teismų sprendimų kontrolės formų sistemoje. Mokslinis tyrimas atliktas dviem kryptimis. Pirma, analizuoti baudžiamosios bylos atnaujinimo instituto teoriniai pagrindai. Antra, vertintos baudžiamosios bylos atnaujinimą reguliuojančios Baudžiamojo proceso kodekso nuostatos ir jų pagrindu besiklostanti teismų praktika, kurios analizė vėlgi leido atskleisti ir suformuoti kai kurias teorines išvadas. Previous issue date: 2014-03-19<br>This paper aims to verify which rhetoric strategies are used in legal discourses and how the characters' ethos is constituted in those discourses made along criminal cases. In the case analyzed, the father and the stepmother of a murdered child are the main suspects, and the sentences ended with the defendants conviction. In order to put in context the constitution process of the dissertation, historical and theoretical considerations about Classical Rhetoric and New Rhetoric were made, based on the studies of Aristotle, Chaim Perelman and Lucie Olbrechts-Tyteca, Michael Meyer, Olivier Reboul and Lineide do Lago Salvador Mosca. The studies of Luiz Antonio Ferreira were also used, referring to the principles of rhetoric analysis.The Constituição Federal da República Federativa do Brasil, in regard to magna laws, served as basis for the considerations of legal nature. The analysis is a result of the association of persuasion rhetoric techniques and the specificity of the construction of the ethos of the characters involved in a jury plenary, in order to point out how the discourses made in those scenarios were more or less persuasive and convincing. The selected piece shows the presence of several persuasive rhetoric strategies, as well as the way how the construction of the ethos of the characters is made in a discourse context. It can be seen the predominance of the epideictic genre and apodictic thinking, which start from probable or true premises and so, also bring speaker and audience close together. The characters involved in the analyzed discourses use passion movements to persuade the audience in order to obtain its adherence. Some rhetoric figures of presence and choice, like hyperbole and irony, are noticed in those discourses, what brings the speaker closer to the audience. The legal truth constitution, as shown in the analysis, starts from truthful premises and associates extrinsic and intrinsic evidence to conduct the audience. The rethoric context, surrounded by a universe of social values, is a major factor for the argumentative constitution and wields persuasive power. If the laws are vital for the promulgation of a sentence, the rhetoric path of all parts involved, done during the trial sessions, is key to the results obtained. It seems impossible to dissociate the logic conducting of the thinking without the potent association with the passion elements in the rhetoric constitution process of the act of judging, convicting or acquitting<br>Este trabalho objetiva verificar quais são as estratégias retóricas utilizadas nos
discursos jurídicos e como se dá, ao longo dos processos criminais, a
constituição do ethos dos sujeitos manifestados nesses discursos. Na amostra
escolhida, o pai e a madrasta de uma criança assassinada são os principais
suspeitos e a sentença culminou com a condenação dos réus. Para bem situar
o processo de constituição da dissertação, parte-se de considerações
históricas e teóricas a respeito da Retórica Clássica e da Nova Retórica, com
base nos estudos de Aristóteles, Chaim Perelman e Lucie Olbrechts-Tyteca,
Michael Meyer, Olivier Reboul e Lineide do Lago Salvador Mosca. Também
foram usados os estudos de Luiz Antonio Ferreira, no que tange aos princípios

no que diz respeito às leis magnas, serviu de base para as considerações de
natureza jurídica propriamente dita. A análise resulta da associação de
estratégias retóricas de persuasão e da especificidade da construção do ethos
dos sujeitos envolvidos em um Plenário do Júri, a fim de apontar como os
discursos elaborados nessas esferas foram menos ou mais persuasivos e
convincentes. O recorte selecionado evidencia a presença de muitas
estratégias retóricas persuasivas, bem como a forma como, no plano
discursivo, a construção dos ethos dos sujeitos é retoricamente delineada.
Observa-se, como produto analítico, a predominância do gênero epidítico e dos
raciocínios apodíticos, que partem das premissas prováveis ou verdadeiras e,
nesse sentido, também aproximam o orador e o auditório. Os sujeitos
envolvidos nos discursos analisados valem-se do movimentar das paixões
para persuadir o auditório em busca da adesão. Há, ainda, nos discursos
analisados, ocorrência de figuras retóricas de presença e de escolha, como
hipérbole e ironia, que aproximam orador e auditório. A constituição da verdade
jurídica, como demonstra a análise, parte de premissas verossímeis e associa
as provas extrínsecas às intrínsecas para a condução do auditório. O contexto
retórico, envolto num universo de valores sociais, é fator preponderante para a
constituição argumentativa e exerce forte poder persuasivo. Se as leis são
vitais para a promulgação de uma sentença, o encaminhamento retórico de
todas as partes envolvidas, criado durante as sessões de julgamento, é fator
exponencial para o resultado obtido. Parece ser impossível desvencilhar a
condução lógica do raciocínio sem a associação potente com os elementos
passionais no processo de constituição retórica do ato de julgar, condenar ou
absolver

This thesis focuses on the privacy interests of those subject to a criminal process. The thesis investigates the extent to which the privacy interests of those subject to such a process are recognised and afforded adequate protection in England and Wales. Over the last thirty years policing has become increasingly proactive and preventive. Advances in technology have given rise to new policing strategies, which emphasise the need to manage ‘risky’ groups and individuals through the collection and retention of disparate pieces of personal information. Whilst there is a significant body of criminological literature documenting this trend, and raising the possibility that these developments could pose a threat to the privacy interests of those subject to such preventive policing measures, criminological theorising alone cannot provide a defensible normative model for assessing the impact of such developments. Moreover, criminal procedure scholarship tends to focus on human rights insofar as they regulate adjudicatory policing measures geared towards the prosecution of suspected offenders. This procedural scholarship does not focus centrally on the wider functions of the police in maintaining order and protecting the public by gathering intelligence on ‘risky’ individuals and groups. This thesis aims to fill this gap in the literature through an assessment of how such policing activities set back privacy related rights. An interdisciplinary method is used, which draws on philosophical literature, European and domestic human rights and criminal procedure jurisprudence, and relevant policing and criminal justice scholarship. The first broad task for the thesis is to develop a normatively defensible model which can identify where privacy interests are set back as part of a criminal process, and articulate why it is important for those tasked with regulating such a process to recognise and appropriately protect these interests. This normative model is then used to assess English law’s response in different contexts to the police use of privacy interfering measures against those subject to the criminal process. It is noted that the European Court of Human Right’s Article 8 jurisprudence has (generally speaking) had a positive impact on English law in this area, but concerns are raised that domestic lawmakers consistently fail to strike a fair balance between the privacy interests of those subject to a criminal process and the legitimate crime prevention goals of the police.

No contexto de proteção dos direitos humanos, a prova penal como
motivo de revitimização de crianças é propósito de discussão pelas ciências
envolvidas, sobretudo o Direito, a Psicologia e o Serviço Social, conduzindo assim, à
análise da produção probatória e suas justificativas. A pesquisa, após revisitar a
bibliografia acerca da infância e o tratamento a ela dispensado, bem como o sistema
de provas do processo penal, estudou os processos judiciais em que crianças foram
vitimadas por crimes contra a dignidade sexual, transitados em julgado em 2ª
instância pelo Tribunal de Justiça do Estado do Tocantins. Utilizou-se as ferramentas
metodológicas quanti-qualitativas, sendo os dados obtidos por meio do levantamento
de informações processuais comparáveis e no viés qualitativo, por amostragem,
foram analisados os discursos desses processos e a relação entre os tipos de prova
com a fundamentação da decisão judicial. Apurou-se ainda o superficial arranjo
entre as ciências envolvidas, o que deprecia não só a qualidade da prova, como
também a proteção da criança. O resultado aponta para a afirmação de um percurso
processual que respeite os direitos humanos das vítimas na utilização de provas e
contribua para a efetividade das decisões judiciais como meio de responsabilização
dos autores de crimes contra crianças.<br>In the context of human rights protection, criminal victimization of
children as proof of motive is purpose of discussion involved the sciences, especially
the Law, Psychology and Social Work, thus leading to the analysis of evidentiary
production and their justifications. The research, after revisiting the literature on
childhood and the treatment she dispensed and the evidence system of criminal
procedure, studied the legal proceedings in which children were victims of crimes
against sexual dignity, by the courts in 2nd instance by State of Tocantins Court of
Justice. We used the methodological tools quantitative and qualitative, and the data
obtained from the survey of comparable procedural information and qualitative bias
by sampling the speeches of these processes and the relationship between the types
of proof on the grounds of the judgment were analyzed. It was also found the surface
arrangement between the involved sciences, which cheapens not only the quality of
the evidence, as well as child protection. The result points to the affirmation of a
procedural route that respects the human rights of victims in the use of evidence and
contribute to the effectiveness of judgments as a means of accountability of
perpetrators of crimes against children.

Previous issue date: 2011<br>A presente pesquisa tem por objetivo demonstrar a viabilidade da aplicação da tutela antecipada instituto legalmente previsto e utilizado na esfera processual civil também na esfera criminal. O trabalho foi desenvolvido baseado na análise da legislação brasileira bem como na consulta da doutrina nacional e estrangeira sobre o tema. Inicialmente a pesquisa segue linha genérica descrevendo o direito do acesso à justiça e caracterizando aspectos mais relevantes das ações autônomas de impugnação. Neste momento descreve-se a ação penal o habeas corpus e o mandado de segurança em matéria criminal em seguida estuda-se o fundamento da revisão criminal. Caracteriza-se a tutela antecipada neste primeiro momento em sua origem ou seja, no campo do processo civil e sua aplicabilidade nas ações rescisórias. Demonstra-se sua aplicabilidade em sede de revisão criminal utilizando-se a analogia como forma de integração desta lacuna existente no Código de Processo Penal.<br>Salvador

Previous issue date: 2018-05-11<br>A Emenda Constitucional n. 45, de 30 de dezembro de 2004, trouxe, entre outras tantas alterações do texto constitucional, a inserção de um §3º no artigo 102, que previu que o recorrente deveria demonstrar, nas razões de seu recurso extraordinário, a repercussão geral das questões constitucionais discutidas no caso, a fim de que o Supremo Tribunal Federal examine a sua admissão, somente podendo recusá-lo pela manifestação de dois terços de seus membros. Estava criado um filtro de acesso à jurisdição de nossa Corte Suprema, relativo ao controle difuso de constitucionalidade, sucintamente denominado de repercussão geral. Surgiram então, no estudo e na práxis das Ciências Jurídicas Criminais, questionamentos acerca da aplicabilidade de tal instituto ao recurso extraordinário do processo penal, dada a natureza pública, indisponível e fundamental dos direitos envolvidos nessa seara, em tese, possuidoras de relevância e transcendência em todos os casos. Ocorre que o Supremo Tribunal Federal, incumbido da definição dos limites semânticos da repercussão geral, logo no início da vigência do instituto, pontuou que o recurso extraordinário criminal também se submetia ao disposto no art. 102, §3º, da CF e ao seu regramento infraconstitucional. Isso fez surgir certas dúvidas, então, de quais viriam a ser as questões constitucionais em matéria penal e processual penal que possuiriam relevância e transcendência e, mais do que isso, as que eventualmente não possuiriam tais atributos. Como a definição desses critérios estava relegada, pelo legislador constitucional reformador e pelo legislador ordinário ao próprio STF, a jurisprudência do Tribunal passou a ser a principal fonte de onde se pode extrair o sentido da repercussão geral em matéria criminal e os parâmetros estabelecidos pela nossa Corte Suprema para a definição do que é ou não relevante e transcendente nessa seara do Direito e, com isso, ainda, confirmar ou infirmar a tese inicialmente decorrente da instituição do referido filtro recursal no sentido de que todas as questões criminais de cunho constitucional possuem, em si, inevitável repercussão geral.

O objeto primordial desta dissertação é conceituar a investigação criminal defensiva, sob a ótica da eficiência e do garantismo, e demonstrar a necessidade deste instituto nos ordenamentos jurídicos em que a investigação pública é tendencialmente acusatória. Para tanto, nos dois capítulos iniciais, esclarecem-se alguns aspectos gerais condizentes ao tema em análise, a saber: a definição de investigação criminal e suas principais características; a questão da parcialidade do Ministério Público e a investigação do crime por este órgão; e a definição de inquérito policial e sua disciplina legal no Brasil. Em seguida, aborda-se a relação da investigação defensiva com os princípios constitucionais da igualdade e da ampla defesa, que se encontram na base de um processo penal acusatório e asseguram às partes igual oportunidade de comprovarem os seus argumentos. Por conta disso, se um sistema jurídico prescreve a investigação do crime pelo próprio órgão acusatório, é de rigor que o imputado tenha direito equivalente, sob pena de se violar os mencionados direitos fundamentais. Ademais, a investigação defensiva, ao permitir a obtenção de elementos que serão contrapostos à investigação pública, amplia o campo cognitivo do Magistrado, o qual disporá de um maior número de dados materiais para fundamentar decisão acerca da viabilidade da acusação e da adoção de medidas cautelares. Após a análise constitucional da investigação defensiva, estuda-se o tratamento conferido pelo Direito estrangeiro a esta matéria, particularmente na Itália, onde o tema está em voga e é objeto de importantes e auspiciosos debates jurídicos. Ao final, a dissertação cuida da concretização da investigação defensiva, isto é, o modo como deve se desenvolver, as suas limitações, a utilização do seu resultado e a possibilidade de inserção no ordenamento jurídico pátrio.<br>The main subject of this dissertation is to create a concept of the criminal defense investigation, under the efficiency and the guarantism perspectives, and to demonstrate the need of such institute in the legal system in which the public investigation has an acusatory tendency. For this purpose, in the first two chapters, the dissertation clarifies certain general aspects regarding the subject under analysis, such as: the definition of criminal investigation and its main characteristics; the question of partiality of the Public Prosecutor\' s Office and the criminal investigation ran by this office; and the definition of criminal investigation and its legal regulation in Brazil. Following, the dissertation approachs the relation of defensive investigation with the constitutional principles of equality and of full defense, which are in the base of an accusatory criminal procedure and assure the parties equal opportunities to prove their arguments. For this reason, if a legal system provides for a criminal investigation to be conducted by the accusatory party itself, it is imperative that the accused has equivalent rights, otherwise the legal system will be violating the above mentioned fundamental rights. Furthermore, in allowing gathering elements which shall be confronted with the official investigation, the defense investigation expands the cognitive field of the Magistrate, who will have more material data to pronounce a decision regarding the accusation\'s viability and the adoption of cautionary measures. After the constitutional analysis of the defense investigation, the dissertation enters into the foreign law on this subject, particularly from Italy, where the matter is highly in evidence and is the subject of important and auspicious legal debates. In the end, the dissertation provides for the materialization of the defense investigation, i.e., the manner in which it shall be developed, its limitations, the use of its results and the possible insert in our national legal ordinance.

This thesis examines the concept of 'open justice' as it applies to the English criminal process. The conventional understanding of open justice requires merely that trial proceedings are open to the public and that those who attend are free to report to others what they have witnessed. This thesis seeks to demonstrate that the notion of open justice need not be so confined. The oversight of the criminal process provided by the courts, independent administrative bodies and the public, and the open manner in which such oversight is conducted, may be viewed as a more expansive conception of open justice. Such openness is argued to be required by the values of accountability, effective performance, rights protection, democracy and public confidence. It will be demonstrated that the openness flowing from the oversight of the English criminal process provided by the courts, independent administrative bodies and the public, has developed considerably in recent years. There may though be scope for the development of further openness. Where appropriate, proposals designed to achieve such enhanced openness will be advanced.

Introdução Para produção da cadeia de custódia se faz necessária a obtenção de provas e apuração de fatos. O trabalho pericial de corpo de delito de animais que sofreram maus tratos se circunscrita na produção dessas provas por meio de observação macroscópica e necropsia. Para tanto, há direitos fundamentais como a ampla defesa e o contraditório, como reza a Constituição Federal do Brasil de 1988 (CF/88), Art. 5, Inc. LV. Ao longo do processo judicial os vestígios são analisados para decisões judiciais contra maus tratos animais. As provas periciais são essenciais para o processo penal. A Lei de proteção animal garantida recorre a essa etapa. Provas são obrigatórias quando o delito deixa vestígios. A fase processual no qual o perito veterinário atua inicia-se no inquérito policial, logo após o conhecimento da prática da infração penal, isola-se o local até a chegada dos peritos criminais. Esse auxílio é indiscutível, a fim de obter sentenças justas. Esses procedimentos devem ser conduzidos por Médicos Veterinários, com notório saber científico no assunto, chamados peritos veterinários, seja criminal ou judicial, que auxiliam o poder judiciário e partes envolvidas. A valoração desses profissionais, assim como investimentos em institutos de medicina veterinária legal e a obrigatoriedade de inclusão da disciplina na formação veterinária são essenciais. Objetivo Pretende o trabalho discutir a importância do perito veterinário, criminal ou forense, para casos de maus tratos animais, no auxílio à justiça. Sua valoração, em que pese o papel do poder público judiciário, em fomentar institutos médico-legais e aumentar a demanda de contratação de mais profissionais na área. Da mesma, forma a necessidade da obrigatoriedade de implementar a disciplina de medicina veterinária legal na grade escolar de intuições superiores de ensino veterinário. Métodos O trabalho foi elaborado através leitura e pesquisa em livros didáticos, revistas veterinárias, doutrinas jurídicas brasileiras, código penal e código processo penal brasileiro. Além de revistas científicas veterinárias, legislação ambiental e de direito dos animais, relatos de casos, casos práticos, e processos judiciais por meio de buscas em websites e sites jurídicos. Resultados e conclusão O Juízo pode decidir sobre matéria de maus tratos animais mesmo contra laudos periciais emitidos por peritos veterinários, porém, verifica-se cada vez mais processos cimentados em laudos periciais veterinários. Necessária é a expansão de concursos, contratação de peritos veterinários, assim como fomento às instituições médicos veterinário legais e de ensino superior veterinário. O crescente aumento de cursos e especializações comprovam a necessidade desses profissionais que auxiliam os tribunais. O perito médico veterinário deve ser especializado na área forense. Peritos veterinários corroboram e auxiliam o judiciário a elucidar crimes de maus tratos. Destaca-se o trabalho do perito veterinário criminal e judicial na aplicabilidade de sansões, com base na legislação ambiental e proteção animal. Assim, a medicina veterinária legal e a perícia veterinária devem ser exaltadas. Devendo haver mais subsídios para institutos médicos legais e obrigatoriedade de incluir a disciplina nas faculdades de medicina veterinária. Confinement brought with it virtual classes, and that teaching channel that was once the exception, became the rule, but, what are the implications that this change produced for crime victims who seek access to justice? The main objective of this contribution is to exemplify, by sharing the results and experiences produced by the criminal clinic taught in virtual format of the Campus Puebla, how online clinical teaching, as well as a face-to-face legal clinic execution, achieves a differentiated learning in relation to the traditional methodology of teaching, that is, the development of disciplinary and transversal educational competences for criminal litigation through experiential learning. The penal clinic at the Tecnológico de Monterrey in Puebla City, Mexico, was established four years ago from the project "Voice of the Victims" in conjunction with the Arizona State University and sponsored by the Merida Initiative. The criminal clinic works with an external institution called "socio-trainer". By acquiring knowledge about the role of legal advisors to victims, and by taking an active part in the entire criminal process, students develop diverse transversal competences like professional responsibility, human sense, and professional ethics; In addition to that, this contribution aims to also showcase the online criminal clinic execution limitations and opportunities of development when compared to the face-to-face or in person clinic development. The methodology follows a format of assigning real criminal cases to students who assume the role of victim lawyers; They are guided by professors from the University and a lawyer from the Socio-trainer Institution. They are evaluated according to the procedural progress of the assigned cases, as well as activities and alternatives for access to justice such as: counseling for crime victims, preparation of briefs and guidelines for hearings. In the August-December 2020 semester, the clinic was executed online, and the methodology underwent an important transformation in its academic and practical aspects, as well as in the care and follow-up of assigned criminal cases. The process had negative implications due to the lack of constant interaction with the victims and the authorities, but this did not substantially affect the student's learning. The author examines the independence of an investigator as the driver of criminal proceedings, and does so in the context of the rights of a judge, a prosecutor and an investigator in charge of an investigation. The independence of the investigator is examined keeping in mind their rights and responsibilities, and the reflections begin with an overview of the investigator's historical rights and responsibilities, as well as the duty of the supervising prosecutor as the driver of criminal proceedings to oversee the actions of a particular investigator. The author analyses the recent amendments to the Criminal Procedure Law and focuses on finding more effective supervisory mechanisms of criminal proceedings, whilst keeping in mind the necessity for the driver of criminal proceedings to be independent in order to achieve the goals of this process. The assessment of this independence is done in relation to the simplified criminal proceedings. As a result of the questions examined within this article, the author suggests several options for improving the supervisory mechanisms of criminal proceedings in Latvia.

This article discusses the criminal procedure status of the victim on the basis of the current legislation. A number of proposals are put forward to improve the legislation to ensure the effectiveness of the victim’s participation in the criminal process. The article analyzes a number of specific legal shortcomings that reflect the procedural situation of the victim, and indicates ways to solve them. At the same time, proposals are put forward for more effective protection of the legitimate interests of the victim both during the preliminary investigation and during the trial. For example, in order to speed up the participation of the victim in the criminal process, it is proposed to include a rule that from the moment of initiation of a criminal case, the issue of recognizing the person as a victim must be resolved within 10 days. The article then discusses the victim’s right to compensation, the right to mandatory familiarization with the materials of the criminal case, and the shortcomings of the norms that reflect the legal status of the victim as a participant in the prosecution.

The concept of “Global Ethics” refers to the analysis and identification of ethical solutions to the challenges of the contemporary world. Among the current global problems we bring to the fore: illegal immigration as a component of human trafficking, but also other global issues interdependent with the two crimes above: violation of human rights and freedoms, poverty, resource scarcity, discrimination, illegal international business and trade, all of which, requesting from the authorities and beyond, legislative and ethical solutions. Legal migration is the widely accepted form globally, since it can be determined over time, but also controlled in terms of the number of people, fields and jobs. Illegal migration is the alternative used by people who cannot use the legal route to go abroad. A component of trafficking in human beings, illegal migration is a global scourge, hard to control, caused by organised criminal groups, but also by the increasing ingenuity of criminals. Although the phenomenon is manifesting itself worldwide, it is accentuated by the fact that there is a lack of appropriate legislation and an effective system of cooperation between government institutions and civil society.Trafficking in human beings must be related to the causes that led to its emergence: discrimination in the labour market revealed by high unemployment rates (women vs. men), poverty combined with low remuneration for work performed, corruption of authorities, poor border control, restriction of legal migration opportunities, internationalization of criminal groups correlated with high profits from human trafficking, poor information of people who want to emigrate about the real effects of the labour market. Knowing this phenomenon, but also of the causes that cause it to occur, determines the process of working for knowledge, resolution and fight against it. The present work is intended to be a source of information that makes available to those interested that information about illegal migration, as well as how state structures can and should be involved in the situation.

Sexual assault is a violent crime that traumatizes individual victims and endangers entire communities. Every victim of sexual assault deserves an opportunity for justice and access to the resources they need to recover from this trauma. In addition, many perpetrators of sexual assaults are serial offenders who also commit other violent crimes, including armed robberies, aggravated assaults, burglary, domestic violence, and homicides, against strangers and acquaintances. Criminal justice agencies have the power to create a strategic, sustainable plan for an improved response to sexual assault that aligns with current best practices and national recommendations. In this document, we define an “improved response” as an approach that supports effective investigation and prosecution of sexual assault cases, holds perpetrators accountable, and promotes healing and recovery for victims of sexual assault. This guide will help prosecutor and law enforcement agencies create a process with milestones, goals, and suggested actions, all designed to support a successful and sustainable approach for addressing sexual assault cases. Improving the criminal justice system’s response to sexual assault ultimately improves public safety and promotes trust between criminal justice agencies and the communities they serve.

Under the current legal paradigm, the rights to privacy and data protection provide natural persons with subjective rights to protect their private interests, such as related to human dignity, individual autonomy and personal freedom. In principle, when data processing is based on non-personal or aggregated data or when such data pro- cesses have an impact on societal, rather than individual interests, citizens cannot rely on these rights. Although this legal paradigm has worked well for decades, it is increasingly put under pressure because Big Data processes are typically based indis- criminate rather than targeted data collection, because the high volumes of data are processed on an aggregated rather than a personal level and because the policies and decisions based on the statistical correlations found through algorithmic analytics are mostly addressed at large groups or society as a whole rather than specific individuals. This means that large parts of the data-driven environment are currently left unregu- lated and that individuals are often unable to rely on their fundamental rights when addressing the more systemic effects of Big Data processes. This article will discuss how this tension might be relieved by turning to the notion ‘quality of life’, which has the potential of becoming the new standard for the European Court of Human Rights (ECtHR) when dealing with privacy related cases.

Arrested people across the United States often wait in jail for days, weeks, or even months before seeing a judge or meeting an attorney. In November 2021, the Deason Criminal Justice Reform Center published Ending Injustice: Solving the Initial Appearance Crisis, a comprehensive report about this ongoing crisis in pre-trial due process. That report described the devastating consequences of delayed and uncounseled initial appearances. Now, these Initial Appearance Report Cards offer a closer look at the laws governing post-arrest procedures in each U.S. state, the District of Columbia, Guam, Puerto Rico, and the U.S. Virgin Islands. While the Deason Center’s previous report provided an overview of the initial appearance crisis nationwide, the Initial Appearance Report Cards are a rigorous assessment of the laws in almost every jurisdiction in the country. These report cards reveal enormous gaps in the legal protections accorded to people accused of crimes, illuminating both the scope of the initial appearance crisis and our urgent need to solve it.
